"outnumbered" starts right now. >> a suspected serial bomber is dead but the nightmare may not be over. that suspected serial bomber who killed two people as he terrorized the state capitol is gone. he's identified at mark anthony conditt. austin police said he blew himself up as a s.w.a.t team closed in on his vehicle. authorities are warning people to remain vigilant in case he left behind more package bombs. we're learning about who the suspect was. investigators are searching why he did this. stay here foxnews for a live

second heim. >> harris: i like the new look, the fashion with glasses, i know you're bringing it. >> thank you. >> harris: he's based in d.c. let's get to the news. the war between the white house and sanctuary citys is heating up. yesterday president trump host aid round table at the white house. attorney general jeff sessions and homeland security kristin neilsen were there. also present the mother of slain officer brandon mendoza killed by an illegal immigrant in a 2014 drunk driving incident. here's what came out of that meeting, at least some of it >> sanctuary cities in states like california put innocent americans at the mercy of hardened criminals, hardened murder, in many cases. >> my son, brandon mendoza was killed in 2014 by a repeat illegal alien criminal that was in the state of colorado and released back out on to our

streets. it's just -- it's a common thing. i'm horrified. this is a very real issue. lives at stake. lives are being taken each day. we must work together. >> sanctuary cities dangerous, and we're going to take care of the problem. >> new claims rankin feel border patrol is pushing back. the chief border control officer said agents are now refusing to turn over illegal immigrants to the state. an alien was from anybody washingt nicaragua. despite the the egregious violations the san diego sheriff's office could not provide assurances immigration authorities would be notified if and then that alien was released therefore the criminal alien remained in dhs custody and processed for prosecution end

with the issues than federal i.c.e. acts. >> it has no control over immigration. >> adrienne: correct in terms of state department, versus federal government they don't have the authority. some of the federal laws have been enforced to the level -- >> you don't get to choose what laws from the federal government -- i mean, straight constitutions. you don't get to say, hey, federal government, i don't like your lawyers on this, i'm going to change it. >> adrienne: if i'm president trump, i would have this fight. let's have it and quite frankly on some immigration policies, period. if you look at polling majority of americans on his side on a variety of these issues. democrats already lost a battle on immigration just recently as adrienne pointed out over daca and trying to hold the government hostage on that issue. they lost. the majority of americans disagreed with the democrat's

approach. that's why they ended up hedging. if i was president trump. let's have this debate, this conversation and keep fighting. >> harris: i want to ask you on the business side, sandra. because we get both. this can work out to be almost a free market response, right? >> sandra: we're already starting to see some, at least the one town in california resist this, right? we wonder if there's going to be a new wave of that. because we hear from people on the ground this that state saying, i know people who really don't like what's going on here and you wonder when that silence is going to come to an end and we will hear more from some residents from that state who don't feel safe under the sanctuary city laws. >> i can be tough on the president sometimes but i have to give him credit for being willing to compromise on the issue of immigration. he's willing to go over his base, to be quite frank, conservatives against granting

amnesty. this president has said, you know what? i want to fix this issue. but the democrats haven't shown any area of compromise on this issue. >> we've ben willing to compromise on border spending. one from the most aggressive stars said i will support border defending in order to provide a path to sit skinship for the dreamers. >> they should be contractible with what the president's bill did. >> harris: i want to go back to my notes, because i read this skwoet in san diego. an alien was a previously removed felon from nicaragua, registered sex offender. when you hear that, how can you say that -- okay. there's some laws that you don't like. you have to follow the federal law. it protects us. this guy's dangerous. >> adrienne: that's an example of a very dangerous person that should not be allowed in our country.

>> harris: you know there's not only one. >> adrienne: of course. absolutely. again i'm talking about mayors in some of these cities to believe it's better for their local law enforcement to decide how their city should be governed. >> can we agree that's not their choice legally to make. >> what did i make of the mayor of oakland warning that illegal immigrants that i.c.e. said was caught for crimes what do you make of that? >> adrienne: i think it's a problem for communities protecting some of these criminals in their communities. >> sandra: why do you think he did that? >> adrienne: i don't know enough to comment. progressive mayors in cities across the country defined as being sanctuary cities believed it's better for their local law enforcement to make decisions how to keep their committees safe. >> sandra: what about the i.c.e.

officer, who said every single day the mayor of oakland puts out warns like that. putting his officers at risk, their lives at risk? what about their lives? >> sandra: again, i am speaking to what the mayors have said in these city. i'm not an expert about immigration. >> she warns of an incoming raid. >> adrienne: let's talk about what this country would look like if mobsters got a heads-up? you want to talk about people who have gotten raided in the history of america and agents who were in danger if those information points got out. we would be completely different. >> i think it's obstruction. >> harris: what do you think? >> i think it's obstruction. you know how i felt about jeff sessions. i don't think he's been hard enough. he's been a weak attorney general. this is an opportunity for him to say, look, you put my guys at

harm's way and we're going to open up an investigation. what did you know? did you use your official channels? how do but that information and put my agents at risk. let's be clear. they were targeting criminals. not just getting teachers. they were going after criminals. there was no reason for them to let the public know. >> sandra: that's the case the trump administration has made. a lot of these policies, these state policies in california are presenting, doj presenting federal law enforcement agencies from getting he's criminals and presenting them from doing their job. that's part of the argument that the trump administration is making. >> harris: we were talking about, sandra, more people that come up in a market per market situation, it's very different in arizona than california. martha mccallie, congresswoman is the first to tell you, it's a different operation.

if those citizens speak up and say we don't want it to operate like this. we want it to operate like arizona. that makes a difference. >> you wonder how big of are an issue this will be come mid term elections. >> i think democrats will run for this as they did when they tried to shut down the government. the progressive wing of the democratic party is pushing the party on this issue. i lot of people feel pressured to go along with this because they don't want a primary challenge. to be fair we've seen this about when it comes to the negotiation of amnesty but the democrats have to make a decision. when you have a president witting to meet them halfway saying give me border security and pay fort wall and i'll grant amnesty even after i told my base i wasn't going to do it. >> adrienne: we agree with that approach. >> harris: wow. you have an opportunity. the spending bill is not going to sign itself.

>> adrienne: and there's a snowstorm, right? that helps. >> harris: wow. the list of republican law makers calling for a second special counsel is growing now. they say it is necessary if they want to get to the bottom of alleged abuse of bias inside the fbi. the debate ahead. and democrats and members of the media hitting president trump for congratulating russian president putin on winning re-elections but president obama did something similar. is it different for this president? if so, why, or are his critics playing a game of gotcha? we hope we got what right back. stay close.

of what this looked like to investigators. they have been following the trail for a few days now. this is part of the puzzle they were piecing together. surveillance video of the suspected bomber. as this makes news and we get more information we'll bring it to you live. fox new as later. president trump's cite is bouncing after he congratulated russian president vladimir putin on his re-election. but he only said what his predecessors and counterparts also said. despite that, immediately after the president's remarks a cnn reporter tweeting this. both trump and kim jong-un have now congratulated putin on his election win. and cia director john brennan saying the president's behavior suggest he's scared of putin. >> the fact that he has had this fawning attitude toward mr. putin has not said anything negative about him. it continues to say to me he does have something to fear.

the russians have had long experience with mr. trump and may have things that they could expose. >> lisa: here's what the president's critics are not including. president obama called putin to congratulate him on his re-election. and as press secretary sarah sanders noted yesterday. several u.s. allies did the same this year. >> the president once again has maintained that it's important for us to have a lie log with russia so we can focus on some areas of shared interest. at the same time, we're going to continue to be tough on them. the president joined other countries in these call, both germany and france reached out, as well as president obama in 2012. >> israeli prim minister benjamin netanyahu called to congratulate putin. and now "the washington post"

saying the president are ignored a written warning pr the national security team meaning, quote, do not congratulate the russian leader. i saw you out of the corner of my eye everything a reaction to john brennan talk about this president fawning over vladimir putin. >> lawrence: later on he said he believed the russian government and putin had dirt on trump. i don't understand how this is helpful for a former cia chief to do something like this. you wonder why no one trusts the intelligence community now. the leadership in the intelligence community because they do stuff like this. you know, trump campaigned on this america first policy and putin -- why would he all of a sudden be in bed with the russians? it just don't make sense. they have no evidence of it. this is why the president has been so resistant of talking about this publicly, because i

think they are trying to p suggest that the russians are responsible for his residency. that seems to be the narrative. >> harris: is this criticism unfair, adrienne considering president obama called puten in 2012? >> adrienne: it's customary for them to call when they win re-election, that's not unusual. what bothers me, since obama called him we've seen a massive attack on our democracy by the rugss. that we know is crew. for him to say congratulations, and whatever terminology he used and not follow up with. hey, quit hacking into our election process, that's where i have a problem. >> harris: can i have a quick follow-up on the obama response, as the former president would talk about russia, he didn't see it as a global threat the way we recognize them to be in terms of our election. what you're saying, he learned a lesson but then didn't act on it. we knew we had problems with the

russians in our election back then yet phone calls like this are being made. how is it any different? >> adrienne: it's different because first of all we didn't see an attack b on american democracy when president obama -- >> harris: lisa's dying to get in here. >> sandra: i got to take a minute. someone should do a case study on selective outrage in the trump area. >> harris: how about memory. >> sandra: because that's literally all we've seen. president trump called him to congratulate him is a complete farce. and president obama did the same thing in 2012. if you're on facebook and not paying for the product you're the product. this whole predictive analytic thing. companies, campaigns can find out information -- >> harris: let me get to what i wanted to ask you specifically about, that is that "the washington post" is reporting his own national security team

told him not to congratulate the russian leader. there's this tweet foxnews independently confirms this. senior white house official said this. if this story is accurate that means someone leaked the president's briefing papers. leaking such information is a fireable offense and likely illegal. >> sandra: find the leaker. we should not accept illegal leaks of any classified information and we should be going hard after these leakers, because what did we see with theresa may and u.k. when they temporarily paused intel sharing between the two countries. this is dangerous for the country. >> lisa: if you look, the obama administration was some of the most firely when it called to going after leakers. they were following it all of the way to prosecution. why isn't the cure end white house doing it? >> lawrence: that's what general

>> harris: foxnews alert. the last little while. >> we know the name and what he looks like. the man suspected in a string of bombings that killed three people in texas in the past three weeks is identifieded as 23year-old mark anthony conditt. he died after he blew himself up as a s.w.a.t team approached his vehicle but not without leaving behind so much heartbreak. jonathan? >> reporter: it has been a night of drama. it continues to be a day of drama. right now in the austin suburb of pflugerville, there is a heavy police presence as investigators move in to search the home that mark anthony conditt shared there with, we understand, at least two roommates. investigators are also obviously talking to his family as they seek to understand what the motive was here. we have seen a blog written in

2012 by someone identifying themselves as mark conditt. that blog includes comments against gay marriage and abortion. whether that feeds into this case in any way, we do not know. but the governor, greg abbott, tells us that investigators are still going through mark conditt's online presence. listen here. >> de not destroy his digital footprint. my understanding, he went dark. he kind of closed down access to his accounts which made it difficult externally for us to tap into it but i think there's a treasure trove in his house as well as digital information that should shed light on who he is, what he was doing, why he was doing it. >> reporter: now his biggest mistake appears to have been going foo a federal express store to send some of these packages. that story in the sunset valley suburb of austin had something like a dozen surveillance

cameras mounted there and you can see from these pictures they caught him on those cameras. he was wearing a wig, he was wearing gloves but investigators got enough to identify him. once they had that positive identity. they had his vehicle description, they had his cell phone number. that brings us to last night and the spot i was standing right now. they traced his cell phone to this red roof in. they found the car there. conditt was sitting in that vehicle and then started to move away from the red roof inn. that's when a s.w.a.t team began to move in. they cornered him and as they moved towards his vehicle, conditt detonated an explosive device in the vehicle. that is what killed him. investigators say, though, while they have their man, they still have a lot of work to do. listen here. >> a long day ahead. we are concerned that there may be other pack annuals that are still out there.

we need the public to remain vigilant, especially today as we go through this investigation. we will be here as long as it takes with our partners to figure out exactly what happened, why it happened and how it happened. >> reporter: now, according to the associated press, harris, they are now reporting that investigators are evacuating the area around mark conditt's pflugerville home. that might indicate that they are weary of other unexploded packages being in that home. we're not sure of the reasons right now but that would be an obvious and logical reason why they would evacuate that area, harris? >> harris: the story goes on. they have to figure out as you aptly pointed out what was left behind to keep everybody safe. jonathan hunt, thank you. meanwhile growing call force a second special counsel as more and more republican law makers say an independents investigator

is necessary to probe allegations of bias and abuse at fbi. steve scalise and majority leader kevin mccarthy the latest to join those calls this after a letter was sent to attorney general jeff sessions suggesting he appoint a second special council. council lee zealanden was one of them quote saying he was appointed special counsel. accountability loaded to look into misconduct how and why clinton probe ended, tru trump-russia probe began and fisa abuse. speaker ryan has not began to echo those calls. should he, lawrence jones? >> lawrence: as i report. fbi reports to the attorney general. do your job. investigate what is happening in the fbi. this is what we pay you for.

you recuse yourself from the russian investigation. why are are you there? why are you there? i mean, we didn't -- the president didn't want a special counsel. he's the executive. he can say attorney general, if you refuse to do your job. let me appoint tray gotti who is a prosecutor that will go after this. >> harris: it's interesting. there are gop members. you can point to them even jason chef its chef fets /* /- chaff fets. i think they have an impact on attorney general jeff sessions. those were his colleagues for a number of years, so i think that has a big impact on sort of putting the pressure on him. what they are saying, the senators and also the members of leadership and other house members who want a second

counsel, they are concerned even with the independent -- the inspector general, rather, that there are certain witnesses that he cannot access that are not current employees of the doj or fbi. and they're concerned also, and i think rightfully so, with the bias that we've seen -- >> lawrence: they can't prosecute either. >> harris: and they were removed -- >> lawrence: you should be removed as fbi as agent. >> harris: where would you put them where their positions wouldn't follow them. is there a special room? >> lawrence: that's typical. we don't fire people in washington. >> harris: it's like checkers, i don't move anything, i just move thing as roundsed board. >> do you think jeff sessions will cave to that pressure?

>> adrienne: i don't know if he will cave. i hope he doesn't. there's no evidence that robert mueller's investigation did anything wrong. >> lawrence: do you agree there's corruption in the fbi? >> adrienne: i am the last person in the world given i worked on hillary clinton's campaign to go out and defend everything the fbi does but i think it's very important to protect the integrity of our government institutions. but i think in this case there's so much political bias by many republicans calling for a special counsel to look into this investigation. there's constant disparagement of robert mueller who was confirmed twice by all 100 senators when he was fbi director. >> lawrence: we're talking about people who conducted investigations who were sleeping together. sending text messages back talking about protecting the country. >> adrienne: plan planning parties. >> lawrence: a lot of corruption that no party should be okay

with. >> sandra: my understand the senator and calls, and members are congress is not about mueller. it's about the fbi, about the invest division into hillary clinton, and the abundant evidence, with lisa page, bruce orr and some of these other actors. >> harris: there is something about being able to get to the other witnesses. the i.g. can have access to them but cannot compel them to come forward. who have tiers for that role? like i can't wait to talk in this investigation. that's the problem. >> adrienne: again there have been plenty members of congress who called for a second session council. >> lawrence: do you agree? >> adrienne: no. i don't agree there should be a special council to the special council. >> harris: no, no, separately as lisa said. >> adrienne: separately as well. i want to also acknowledge the fact there have been calls. >> lawrence: how do you push back? >> adrienne: for you as a former

evacuate. fluger city hall is closed according to the pflugerville twitter account. residents have been evacuated from downtown pflugerville rest of the roadway and pecan. things are working quickly as this investigation continues in pflugerville, just outside of austin, the home of the bomber. we'll bring you more details as we get them. >> harris: now moving on to this. democrats stepping up always for president trump not to fire robert mueller with some pushing legislation to protect the special counsel. among them democratic senator chris kurns. >> anyone who thinks he isn't in eminent danger to be fired should pay attention. >> harris: they are assuring him

there's zero reason for a provision to protect him. >> i received consideration that there's no consideration for firing him. >> harris: and sarah sanders not hiding frustration when pressed about resent tweets calling out mueller, going after him. watch. >> the president has been very clear about the fact there was no collusion between his campaign and any other entity. however, to pretend like going through this absurd process for over a year would not bring frustration seems a little ridiculous. >> harris: i always think it's interesting when people say they think they though what the president can do. they don't. he can do what he wants and what's the risk? >> lawrence: it would be a political fallout. there's no reason for him to fire mueller. there's no evidence of collusion. the prosecution has not been into collusion.

it's been into financial crimes. there's no reason. also i would push back, too. because there's also been republicans that also say they are going to protect robert mueller. i don't think the president will act on this. he should be frustrated because now the special council is getting outside of the collusion investigation and going -- >> harris: family finances, so on and so forth. adrienne, talk about the process of wanting to protect somebody's job an capitol hill? is that necessary? >> adrienne: in terms of robert mueller's job? >> harris: for people on the hill to look to pass must-pass legislation with the spending bill? >> adrienne: well, look. i will say this. i think we all want to get this ominous bill through. i think we're tired of these short term spending solutions. we have to have a real budget in place. if this is holding up ultimately the bill, i think that's a problem. i understand some, i think chris coons means well here. he wants to do what he can to protect the special council robert mueller from being fired

and what he's doing is trying to get republicans on board on his bill so we can show this is not a part of an issue there's democrats and republicans coming together to protect robert mueller. >> harris: how frauth is this? the 2.7 percent increase in military pay. do you really tie robert mueller to the spending bill? >> lawrence: >> lisa: if you're president trump. you're frustrating. you're frustrated because you're told three separate times that you're not under investigation and all of a sudden now there's a special counsel probe after you fire him and leak classified information to get back at the president, not to mention the fact the only people that have been indicted regarding the election have been russians and also you see people that you were close to, whose lives have essentially been ruined for
