to be one too. how could the fbi be so close but missed the warning signs? joining me special agent chad jenkins. thank you for joining us. >> absolutely. heather: you say the fbi did its job correctly, trying to recruit omar mateen on top of his father being recruited for 11 years. why do you think they took the appropriate action? >> if you look at the investigative techniques the fbi agent did in 2013 where there was an open investigation of omar mateen, he exhausted every investigative technique in his power under the fbi's dialogue, the rules that fbi agents have to stay within. he exhausted all those investigative techniques. they were not gleaning getting more criminal or terrorist information to keep the case

open so he had to close it. once the case is closed and he had the information it is smart to go ahead and target omar mateen as a potential source since you have all that information on the individual and always trying to that and recruit sources. what better want to recruit than one we just had of the subject to help us in the counterterrorism fight. heather: you have his father as an informant, information coming out for 11 years and then you have james comey in charge of the fbi coming out to say they determined he is not a threat because they talked to some sources. was the source omar mateen's father? >> great question. i do not know. that was one of the investigative techniques,

multiple chss. could it have been his father? yes but there were multiple chss reporting on the individual. in 2013 omar mateen said he was not a threat. we have saudi intelligence to look at when he did visit the kingdom of saudi arabia. they said there was nothing necessary in his travel activity overseas. we interviewed him twice during the 2013 investigation. heather: the other thing james comey said, they knew omar mateen was behind it, they believe he was a lone wolf. if you believe he is a lone wolf, why try to recruit him previous to nightclub.

at that time the director said lone wolf. now we have his trial and she is charged with aiding and abetting. i'm not a fan of loanable. i don't think there is any validity to the lone wolf theory in any terrorist attack. heather: what impact if any when the jury gets this case of noor salman, what will be the impact? >> doj had to release the information, the defense authority made a motion to get the case dismissed, the judge said no to that. this is a blip on the radar of this case. in a just society in which we seek justice, noor salman is on trial for aiding in the betting, this distraction trying to detract attention off of her and onto the father-in-law, the jury

legal for the census to do that, they have done it in the past and continuing on that. heather: 12 states oppose this census question. any ground at all? >> the constitution text is clear. it calls for account of all persons residing within the united states. of the founding fathers wanted it to be specifically illegal residents or citizens they would have said so. we have plenty of data from other places that gives an accurate count of citizens but the purpose of the census is to have account of the population. anything that undermines that goal should be considered unconstitutional. heather: one of the issues is there will be less people inclined to fill out the census if they are not a legal citizen. >> you are not obligated, some religious groups don't fill out

the census and it is not a deportation task force following them. important to know how many citizens versus noncitizens there are and with this information, better policy position, better legislation and it is good for the country. heather: one of those policies concern sarah huckabee sanders talked about when defending the action that it would protect voters with the voting rights act. >> census experts agree we have plenty of information through the american communities to enforce the voting rights act. that is not the issue here. having a full and accurate count of the entire population is important for everybody because it helps us figure out where we need to allocate dollars. we don't take a look at which communities have the most legal citizens, we look at the total number of the population when we

allocate where to build the newest roads and things like that. when we say we will look at who is legal and who is not and that is important actually hurts the entire community not just the ones that are considered legal citizens. heather: why do you disagree? >> that is not true. there is nothing that will make you be deported by saying i'm not legally in this country. >> what if this was a question with you are a lawful gun owner? people are protesting giving government information about themselves because we don't know how that information will be used. we don't have a national gun owner registry because people are worried how the government uses information. the point is very clear, the constitution requires a whole and complete count of the population. anything that undermines that goal -- >> just getting more information. >> anything male or female is
