tv The Five FOX News April 19, 2018 2:00pm-3:00pm PDT
2:00 pm
today. if you are the president of the united states and you are worried about them circling around you, the might have more trouble keeping the wiggins street. the fbi, principal players, number one and number two, being questioned. >> kimberly: i'm kimberly guilfoyle with juan williams, jesse watters, kennedy, and tyrus. it's 5:00 in new york city, and this is "the five" ." breaking news on the russian investigation. deputy attorney general rod rosenstein reportedly telling president trump last week that he is not a target of any partisan special counsel investigation or the investigation into his longtime lawyer michael cohen. the latest development sure to be seen as great news by the president who just railed against the investigation as a "hoax." >> there is no collusion.
2:01 pm
there was no collusion with russia other than by the democrats. this was a, really a hoax created largely by the democrats as a way of softening the blow of a loss. this is a hoax. as far as the investigation, nobody has ever been more transparent than i have. >> kimberly: moments ago former fbi director james comey weighed in on the news. >> i don't know what it means. it's a fairly standard part of any litigation, trying to decide whether a person you are encountering is a witness, subject, or target. a target of someone on whom the investigation, the grand jury has developed significant evidence, evidence of visit to charge for. witness has nothing to do with exposure. a subject is everybody in the middle. i don't know the context in which the deputy attorney general did that but that's the general framework. >> kimberly: another episode of shakespeare in the park starting james comey.
2:02 pm
jesse, he is a thoughtful guy. poetry in motion here. wants to weigh in on everything to sell a couple books. >> jesse: yeah, and he will sell books but i think it's time's up. people are already sick of james, but we are not going to be sick of him when he's on fox news. we will tune in to see bret baier tear him apart. the mueller investigations lasted almost two years. it's gone on longer than the 9/11 commission. they've had multiple people from team trump testified in front of the house and senate, some three or four times. they turn over over a million documents. they found no collusion. if there was a smoking gun of collusion, it would've leaked because everything else does. there are no crimes that we have seen so far, so i don't know what they are looking for. you know who hasn't even testified in front of mueller? brad parr scale, trump's campaign manager, head of the digital media strategy. he's never been brought into being interviewed.
2:03 pm
what is mueller doing? i guess they approved this radon cohen for campaign finance violation. that's a fine. bernie sanders paid 14 grand for taking money from australians. you don't rate somebody for a campaign finance violation. i think they are trying to flip and squeeze cohen because they think he might have something based on the dossier. he was the centerpiece of the dossier. they said it was prague reading with russians -- meeting with russians. his past forces is never been to prague. i don't have any idea what they are looking for. if you look at the collusion, hillary was the one who paid for fake news from russia she was the one that got it into the bloodstream of the intelligence community. it was her husband who took a half a billion dollars to speak in moscow, not trump's spouse. it was her foundation that took millions from the russians, not
2:04 pm
trump's foundation. the fbi did not go after the dnc server. they did not try to seize hillary's server. instead, they tried to seize trump's lawyers' computers. they respected hillary's attorney-client privilege but not trump. huge double standard. >> kimberly: jesse rests his case. kennedy. do you concur or supplement with an amicus brief? >> kennedy: here's a couple different things happening. either this is a way of having the president let down his guard so he agrees to talk with the special counsel and cooperate with the investigation so they can snare him in some sort of perjury trap. push the boundaries and figure out whether or not a sitting president can be charged for something. or the investigation is actually winding down and people will find it's been a big waste of time and money. i think if that truly happens, there will be so much
2:05 pm
frustration. it's worse for this situation we are in now with the fbi and doj. there is such an erosion of trust. if you have politicized bodies which are supposed to be objective going after people to bring them down because they aren't happy with the outcome of an election, what does that say about the state of government when you can't even trust an objective source? >> kimberly: i know. tyrus, welcome to the program. nice to see you. >> tyrus: hi. man, you know what? when i look at my life and every time i've been in trouble with the law which hasn't been a lot but when it has, they say you are not subject of the investigation. i am not talking anymore. may i go? that's how the president needs to treat it. i'm not the subject, cool. move on. focus on the other stuff. it's not me. whoever they are looking for, enjoy it but as far as i'm concerned it's done. >> kimberly: don't be lured
2:06 pm
into the mousetrap. >> tyrus: it's a great day. if you tell me i'm not a target, i don't have to talk to you anymore and we can move on. >> kimberly: no sour grapes? juan come he should let it go? >> juan: he has been told he was not a target before. >> kennedy: exactly. he was the was a subject, not . >> juan: the point is he's not a target. he can turn into a target. he doesn't have a whole lot of significance in that regard for this investigation. i was so fascinated listening to jesse. sometimes i listen to jesse and i think, jesse is the poet of trump-landia. you capture the president's voice. >> jesse: i am glad you are listening to me. a lot of times it doesn't seem like it. >> juan: i listen. you are my inside source, brother. i listen to you. >> jesse: i think you are listening but you are not hearing. >> juan: i hear. sometimes i think g, i wonder,
2:07 pm
let's say paul manafort is watching "the five." how about michael flynn? i bet he watches "the five." how about george papadopoulos? they wouldn't say that nothing has come of this investigation. they would say my god. i might be going to jail. >> jesse: he has a five page page -- >> tyrus: they have to hug it out. i've been watching this for years. you need to hug it out. >> kimberly: from "the washington post," former mayor rudy giuliani saying he is joining president trump's legal team in an effort to help negotiate and end to the mueller probe. that's just in from "the washington post." while the president isn't currently a target in the cohen investigation, he could have some reason to worry because according to "the wall street journal," one of mr. trump's longtime legal advisors just warned him cohen could turn on the president if he is charged. kennedy. >> kennedy: to juan's point,
2:08 pm
there been some procedural indictments. that goes to show you, if you cast a big enough net, you can grab some fish. in the end, what does that do for us? does it make the world a more just place? does it hold people accountable or does it show show that if you get enough warrants and you go through enough stuff, you can pretty much tag anyone with anything. >> kimberly: 100%. great point from a legal perspective. >> juan: i don't see it, kennedy. go back to what jesse was talking about in this most recent case where it's portraye portrayed, the feds knocked down michael cohen's door to get these documents. guess what, you know. several layers of governmental officials and judges, most of them republicans, had to approve of this. it was a legitimate execution of a warrant. so you have to keep that in mind. but getting back to cohen, today the big news on cohen is i'm sorry. i'm sorry, buzzfeed. i am sorry i've been threatening to sue you.
2:09 pm
sorry, fusion gps. not suing you either. we don't want any trouble with you, says cohen. >> jesse: he probably is looking at is bank account and realizing he can't for this lawsuit against buzzfeed because it's going to cost an arm and a leg and he's probably up to here in legal defense bills being raided it. it's more of a monetary issue, less of a factual issue. on the rosenstein thing, rosenstein was the one that did approve the raid. he is conflicted. he is the one who wrote the memo saying why cohen should be fired -- why comey should be fired. now an investigation into whether trump broke the law firing comey. you don't see that as a conflic conflict? >> juan: he is the deputy attorney general. that's his job. >> jesse: and broke the law. >> tyrus: everyone keeps talking about the advice he was given by his attorney. if i have ever had and advice
2:10 pm
from an attorney, it had great advice. have nothing to do with cohen's character. he is saying this is what you need to be aware of. juan, you and i are tight. if you get indicted, i'm not going to call you. no matter what, i'm not going to do it. doesn't mean there's anything there. he has his attorney. he's done things he's supposed to do as an attorney, not all that pretty. some of it ugly. that's his job. he took on the responsibility. the penalties for that. he's a fixer. i was a fixer for snoop. >> kimberly: giuliani akin to your situation? >> tyrus: giuliani is a great pit bull. i would want him on my side. >> kimberly: breaking news about giuliani. >> kennedy: it doesn't surprise me. this is probably a better place for him than being attorney general are having some other formal postnatal administration because he's very loyal to the president. he knows the law well. he's been the u.s. attorney. he knows how to combat a lot of
2:11 pm
the stuff from the inside out but is also a politician. and he's a fighter. he has remained loyal to the president even though he wasn't given one of the plum posts many thought he would be given. >> jesse: i think they were worried about him going through the nomination process because some of the things that might have come out. now he doesn't have to go through that process. i like how they have crouched it -- couched it. negotiating the winding down of the deal. how many months have we heard this is going to end? every month, winding down, winding down. hopefully this is an indication that perhaps they are negotiating a wind down of the investigation. >> juan: part of the story today is that trump can't get most of the top-notch conservative lawyers in america to come work for him. so he's talking -- >> jesse: how dare you besmirch jay sekulow? >> juan: jay sekulow was working for him. he has lots of ties to lots of people, beyond donald trump.
2:12 pm
you get rudy giuliani, and he, in addition to being the former mayor of new york was a former prosecutor, very successful prosecutor. he has some insight there. he has been out of the game for a while. that's not to the president's advantage. you notice the president was calling a lot of his former lawyers. just last week the "wall street journal" reported one of the former lawyer said go ahead, fire some of these guys. get rid of rosenstein. don't be bashful. devon really don't talk to the investigators. i think he is reaching out to the old gang because he can't get the best of the current criminal lawyers. >> kimberly: i think that's a false statement. he listens to a variety of different opinions and rudy giuliani is very well respected. i would not say in any way he is out of the game and not going to give -- he still wields a tremendous amount of influence. he was an outstanding prosecuto prosecutor. i think he's going to be a very well recent, measured in addition to the president's team, especially at this
2:13 pm
juncture. bring in specialists at certain points in different phases. just because these people are saying that they are winding the investigation down, it doesn't mean, and they didn't get a smoking gun, that they are still not going to try to go after the president. >> kennedy: a former prosecutor and politician. knowing the law and politics is critical. so much of this, and a lot of the perception going into the midterms and 2020 hinges on this. and the outcome. that's why it's important to have someone who can do both things ably. >> juan: >> tyrus: trump is a loose cannon. getting a lawyer to tell the president want to do, he is going to refer to people who have told him what to do in the past. as a client, it's difficult. you will say something. tweet, say something wrong. attorneys don't want that headache. they can rein him in. where is giuliani, they know how to deal with him. more of that as opposed to why
2:14 pm
would you not want to be on the front end of a fight? >> kimberly: sometimes you go back to your roots. you go old school. >> tyrus: you have to. >> juan: that's why john dowd is no longer there. he won't listen to him. >> kimberly: should hillary clinton be worried that the doj's inspector general is now recommending criminal charges against andrew mccabe? we have the details next. i'll never find a safe used car. start at the new carfax.com show me minivans with no reported accidents. boom. love it. show me the carfax. start your used car search at the all-new carfax.com. i had a very minor fender bender tonight! in an unreasonably narrow fast food drive thru lane. but what a powerful life lesson. and don't worry i have everything handled. i already spoke to our allstate agent, and i know that we have accident forgiveness. which is so smart on your guy's part. like fact that they'll just... forgive you... four weeks without the car. okay, yup. good night. with accident forgiveness your rates won't go up just because of an accident. switching to allstate is worth it. you might or joints.hing for your heart... but do you take something for your brain. with an ingredient originally found in jellyfish, prevagen is the number one selling brain-health supplement in drug stores nationwide. prevagen. the name to remember.

>> jesse: they argue "those in positions of high authority should be treated to the same as every other american. comey brushed off the claims yesterday. >> i haven't read it. i don't know what to make of it. it seems they have been seeing that stuff since the clinton email investigation. a lot of it is being looked at by the inspector general, department of justice, which is a good thing. i don't have any other reaction. the accusations are not true.
2:19 pm
i guess i should have said that first. but that's okay. >> jesse: also calling on the attorney general to take action against hillary. speak with the evidence of mrs. clinton's guilt of espionage, failure to safeguard state secrets, that's the 22 or 23 top secret pieces of information that were on her pre server. failure to do that, the evidence of guilt is overwhelming. there is evidence of serious felonies on her part. she shouldn't be immune from prosecution because you ran for president and lost or because her last name is clinton. >> jesse: we don't know if the doj will move on that. we did learn today that the department's inspector general did recommend criminal charges for fired fbi official andrew mccabe. mccabe's team saying they are confident the u.s. attorney's office will decline to prosecute. kimberly, judge napolitano, lock her up.
2:20 pm
"fox & friends." who knows. gathering and transmitting information relating to national defense, not securing it. that is a 10-year stint. >> kimberly: he is not wrong about the law and the penalty. whether or not there's going to be the wherewithal and the intention, motivation to be able to follow through on the charges and pursue them. it's interesting because there's been so much we've been discussing and going through with this but that's something people thought was going to come back like the ghost of christmas past. let's take a look at this again. with a properly maintained, classified materials? was there a breach? if so, was it intentional? is it something she should be investigated, prosecuted for? now we see the decision with respect to mccabe and saying perhaps they're not going to pursue it. >> jesse: with respective mccabe, juan, if you're going to do things by the book, he lied four times, three times under oath.
2:21 pm
technically could be prosecuted for that. >> juan: that's what you are saying. >> jesse: how do you feel? a liar and a leaker? >> juan: i don't know if he is a liar and a leaker. >> jesse: well, he leaked. >> juan: the inspector general found him to have lied and believes he lied of something of substance. this is about a "wall street journal" article about a probe into the clinton foundation. it's interesting because mccabe was making the case that despite objections from higher-level justice department officials, the fbi should be allowed to pursue an investigation into the clinton foundation. that's what he was saying to the reporter. apparently comey, who ordered the investigation, and he are at odds. and the inspector general says that mccabe is the one who was lying. i don't know. but yes, referring to. let's see what happens. we don't know for sure that anybody is doing anything that favored hillary clinton
2:22 pm
versus -- to the contrary. mccabe is saying i want to investigate clinton. >> jesse: also to come out of that was that the person he had do the leaking was lisa page, the fbi agent. texting peter strzok and they were talking about, in andrew mccabe's office, an insurance policy to protect against a trump presidency. now she, as long as peter strzok are in the cross hairs of the criminal referral as well. >> kennedy: there are so many vectors here, and they all point to unholy hell. every time james comey opens his mouth, hillary clinton has to be pulling her hair out. he is illustrating these contradictions. the statements he's made under oath. for example, andrew mccabe, according to james comey, he's a a good person. good people lie. however, the president is a bad person and morally unfit because the president lied.
2:23 pm
james comey can't have it both ways, that's the least of his concerns. he's obviously not a man with stones. he is terrified to come out and make any straightforward statements. but he will sort of dance around an issue and he has thrown loretta lynch under the bus and said there is some classified information about loretta lynch that he can't talk about. but what he is implying is that it has to do with hillary clinton's campaign and the dnc. you have to wonder if they put pressure on loretta lynch to shut down the clinton foundation investigation which andrew mccabe didn't want to do. he felt he had to see why. he went to "the wall street journal" to clear his own name, panicked, lied about it to clear his name and here we are in a deeper quagmire. >> jesse: a deeper swamp. tyrus. >> tyrus: i am glad i am tall. this is an ugly, ugly time for the fbi.
2:24 pm
it's shameful. i don't want to hear the hillary clinton name anymore. i wanted to go into mitt romney romney-ville. i wanted to go away. the whole thing with her investigation, it was so sloppy and the story has become the fbi. and the lying and covering up. you almost have to have a special counseled into the whole thing because there's so many parts to it. i wanted to go away. i didn't want to see your investigated. i wanted to go away. every time i hear her name, i -- just move on. >> jesse: a deal. drop the trump stuff. we will drop the hillary stuff. we move on. >> juan: somebody else's president. who was that, jesse? >> jesse: donald j. trump. eight years. eight years, juan. >> juan: besmirched the cia,
2:25 pm
go after the fbi. >> jesse: they have besmirched themselves. >> tyrus: you didn't use to hear about the fbi all the time. they weren't the story. that's my problem with this whole thing. comey and them are of the story. it's shameful. it's not what the offices. >> juan: i think this is trump's team going after them to undercut the mueller investigation. >> kennedy: did trump's team write "higher loyalty?" either one of them would have fired comey. >> jesse: they were in captivity but now dozens of dangerous gang members are prowling the streets thanks to america's defiant sanctuary cities and states. the outrage coming up. hey! you know, progressive is america's number-one motorcycle insurer. yeah, she does purr! best bike i ever owned! no, you're never alone,

>> juan: welcome back. trump administration waging a war against jurisdictions that provide sanctuary to illegal immigrants. now they have released statistics to support that concern. more than 100 suspected members of ms-13 and other gangs were released in sanctuary cities last year, and that came despite request from the federal government that they be held. this is a breakdown by state. two-thirds of those released occurred in california. president trump set on twitter today: "california's dangerous policies release violent criminals back into our communities, putting all americans at risk." he thanked san diego county for backing the lawsuit against the state. >> kimberly: we seem to go back and forth on this. it's really got to be pretty accelerated and out-of-control in california. i remember the good old days when i was first lady in san francisco, seems like it was much more sane have the time. now you have such a big,
2:31 pm
aggressive push. your backlash from certain counties to say wait a second. we want to follow the law. we want to uphold the law, we want fairness, we are seeking justice, not injustice. we want to come to the -- we want people to come to the country legally. that's how it should be. when you see the law broken and people coming in come out revolving doors, it's not helping the immigrants and their families, children. people get separated. not helping the local law enforcement and ordinances in the border. it's fraught with complications and problems. this is an issue president trump is not going to give up on but it also seems the governor brown is digging in. lieutenant governor newsom is digging in. it's becoming a very large political issue for the upcoming gubernatorial election.
2:32 pm
>> juan: jesse come help me out of the audience understands what's at stake. the sanctuary cities legislation says basically if you have your average illegal immigrant in jail. they get out of jail. the city or state has no obligation to notify the feds. but if it's a violent criminal, they will you know. then of course if there is a detainer or warrant, they are obligated. >> jesse: in fits of felony they are holding among, gives the local discretion to contact the feds. there's other elements. if you pull over a guy for running a red light and he has tattoos all over his face, no i.d., can't speak english, you can't even ask him about his citizenship. they restrict ic access to prisons. you can't hold on the legal immigrant longer than you would otherwise while you wait for the feds. >> juan: what does the president wants? >> jesse: the president wants the sanctuary cities defunded. >> juan: that they would come even with someone who wasn't a criminal or a violent criminal, that they will hold them until the feds come get them.
2:33 pm
>> jesse: i think they would prioritize it. if that someone not here legally and it's a small thing, maybe shoplifting or something tiny. obviously the the feds are goio prioritize. if someone punches you in the face, steals a car, selling narcotics, something big. then the president wants i.c.e. to be able to go in there and get those guys and ship them out. >> juan: kennedy, with the numbers show coming from the president and white house today. 37 jurisdictions that have been engaging this kind kind of behavior. obviously california, two-thirds. washington state also involved. all over the country. what do you think? >> kennedy: if that's how the states want to play it, that's fine. if they want to operate independently, i don't have a problem with that. i happen to have a very high opinion of most immigrants who come to the country because most don't commit crimes and they work very hard. i hate to see them lumped in with members of ms-13. the problem is if you are
2:34 pm
letting bad people go and entering into society and hurting people, they get really good at not getting arrested and continuing to commit crimes. that's not okay. you end up having a disingenuous conversation about immigration and about crime. unfortunately immigrants get tired is being really bad people who want to hurt you and take your stuff. by and large, that's just not the case. i love california. it's a great state, and i hate to see it torn apart. i hate to see this state turned into "you are on our team or you're not." for us or against it. we have bad immigration policy from the top that is too confusing for states and counties. >> kimberly: very polarizing. make a great point. you see this injustice, so many hardworking men and women and children that grew up in this country, fantastic immigrant backgrounds like my family. they contribute to society and want to do with the right way.
2:35 pm
it's unfair to stigmatize it. the lawlessness cannot be ignored. you see people like ms-13 who i had to prosecute when i was a d.a. in san francisco, los angeles. the horrific crimes. they should not be allowed to come in and reenter again. >> juan: tyrus, i don't think he was talking about you with the tattoos. >> tyrus: i have tattoos but i was born in massachusetts, so i am good. i grew up in california. i don't see the upside of the argument. i try to look at things down the middle. if you are here illegally, you are already breaking the law. if you do something, you should be held. if you rob, steal, do things. if you are a normal american citizen and you had a warrant, they are going to hold you. it's only fair. the worst thing is, they are encouraging gang members to bring more guys over because the worst that will happen is you will do something and they will let you go. >> jesse: they know california california. >> tyrus: they know the law better than the people who are
