that the deputy attorney general and an oval office meeting last week told president trump he is not a criminal target in either the michael cohen investigation or the special counsel probe involving robert mueller, of course. bloomberg or kick this off by reporting that during this meeting, rosenstein basically said the president is a subject of the mother probe, meaning his conduct is under investigation but there is not enough to i have it evidence to charge him. rosenstein was repeating this for the first time, since cohen's office and home had been raided. fox news is specifically herein, rosenstein told the president he is not a target of that cohen investigation. he's not rule out making the president a l target on a later date based on evidence that could emerge. they same could happen in the cohen investigation, which explains why the president has added to his legal team, you see him there, rudy giuliani, former new york city mayor, he's been sharply critical of the fbi for

going light on hillary clinton but attacking the president. fbi officials, like andrew mccabe, the former number two who was fired for leaking, , and the inspector general at the justice department, have sent a criminal referral to the u.s. attorney here in washington, saying that mccabe tried to cover all that up by lying to thee fbi's own investigators. mccabe says tonight he believes he will be vindicated, but it's worth noting that former justice department officials are telling us that the fact that the inspector general, whose nonpartisan at the justice department, sent this outcome of this criminal referral, it carries a lot of weight. that is whatat the president waited aa few moments ago, maye james comey and andrew mccabe are getting and dose of their on medicine. mark? >> mark: that is pretty amazing news. thanks for that. the executive assistant director of the fbi, not one of those who's under criminal referral, and competent as the president of judicial watch.

tom, this is pretty amazing. we basically got a situation where the director of the fbi, the principal business in the prosecution of the a deputy and possibly vice versa and comey's case. it's bizarre times. >> it is. remember, he is the number two at thehe fbi, was number two, ws the senior official charged with investigating hillary clinton over the email matter. targeting president trump. as p far as i'm concerned, his conduct that's been alleged by the inspector general, h and to know he's facing potential prosecution, has tainted both investigations. remember, andrew mccabe, ironically, it is the official who reportedly set up the ambush interview of those agents with general plan and general flynn was later charged with lying and admitted to lying to those agents. now mr. mccabe is charged,

could be charged with lying at least three times under oath to fbi officials and investigators. extraordinary development, doesn't look good for mr. mccabe, mr. comey, and frankly mr. so we nan, who was handed this investigation by mccabe and his team. >> mark: chris, you broached today that you are pretty embarrassed about the state of your old agency and what it has come to. i mean, this is -- the fbi is not the issue. nobody cares about russia, it's all gone away, it's actually the conduct of the highest figures but is not the issue story. >> mark: mark, it is not the fbi. this is what my op-ed was about. it was about not equating the fbi come with a men and women of the fbi with comey and mccabe, peter strzok, page, a very smaln aberration. comey was only director for a short time.

i hate to have the entire fbi painted without broadbrush and we know that this small inter-circle made up their own rules and do things their own way and broke the rules. very welll established rules. >> mark: just to go to that, we all know that it's a crime to lie to the fbi and michael flynn supposedly do that and he would have been looking at several years in jail if they decided to go and prosecute for that. now mccabe did it three times as often as michael flynn. do you think there is any serious chance he'll be going to jail? >> i think the referral by the inspector general is a very serious thing. it's ironic that thehe potential charge would be 18 usc, u.s. code 1,001, lying to the fbi, that is what flynn and papadopoulos and others have been charged with. it's ironic he's basing those very same charges times three.

>> mark: will still want to mccabe's old boss, jim comey, who's managed to make enemies on all sides, which is boating poorly for his book to wear. this was the scene outside a new york city barnes & noble, they were both pro and anti-trump supporters united on nothing except on how much they detest comey. and typically, james comey is healing this divided nation. what is your reaction to that, tom? >> the veil has been lifted. james comey is an anti-trump activist. he might as well be running the dnc, given his hatred for president trump. his deference to hillary clinton. he illegally leaked, mind you, that document about his alleged conversation with president trump, i really don't even think it happened the way he said, in order to get a special counsel appointed. breaking the rules to get a

special counsel to target president trump, that is mr. comey's legacy. and andrew mccabe is his legacy. peter strzok is his legacy. lisa page is his legacy. this is the culture of corruption that james comey quickly set up when he was appointed by barack obama to run from a leader leadership position in rome the fbi. >> mark: let me ask chris a c question about that. you have been very strong on this idea that basically, here we have, and county court terms, the policeman usurping the role of theol county attorney when he absolved hillary clinton for many prosecutable wrongdoing. he's not the prosecutor, he's the investigator. why didn't president obama actually fire him as fbi director for that? >> that is a good question. this system is set up to have a filter between the investigators and a prosecution. that's a very sound system.

that keeps the fbi out of politics, in this case, he thrustst them directly into politics, sort of a thumbs on the sale investigation, a noninvestigation with clinton, and then pushed the envelope investigation on the president. i'm in favor of an all out investigation, if you eat we no investigate, fully predicated chemicalhey added. i think that fits in with the whole agenda. i think the attorney general wasn't my clamp for clinton and that is what the former director comey cited as the recent nearby pastor. he didn't do that differently just for her. the system of rules come he should follow the rules. >> mark: that is a good point. equality before the law. i have good memories of that. as we reported, there is news that deputy attorney general rosenstein told president trump he is not a target of the cohen

investigation. but there are still questions surrounding both the cohen and mueller probes. a democratic strategist and president of new heights communications joins us. as we were talking about earlier, the fbi is actually the issue here. if i am being told by rosenstein that i wasn't the target of the investigation, i would laugh and say, no, you got that right, it's you guys who are the target now, it's about corruption at the department of justice and the fbi. no? >> no. i would say that this shows that rod rosenstein is no fool. he sees the long trail of people ahead of him who dared to go into the morass of potentially criminal activity that surrounds the president, whether you are mueller, whether you are comey before that, whether you are. behar and sally yates, who've gotten fired every single day

looking at the potential of being fired, just again for daring to say that trump may have been part of this criminal activity asru well. if i will rod rosenstein, i would tell him, you know what, sir, you are not a target. >> mark: you think this is a crafty move by rosenstein to get himself off the hook and avoid being fired and then three months' time, he can supply the articles of impeachment and trump's finished? best the master plan? >> i think it's possible. 1 of 2 things. either yes, he's just appeasing him and saying that he's not a target because he doesn't want to get fired anti-can live another day. or trickle, it's possible he's not currently a target of the investigation. that doesn't say that he couldn't be tomorrow or he's not a target in the mueller investigation but he might be in the cohen raid. there's a lot going on. his big dumb ox.

when he might be a target in 15 years' time when mueller is wrapping this up. i think it's a serious thing. james comey is going on the late-night comedy shows, doing jokes about what the prostitutes were up to in trumps hotel room. at the same time, michael flynn has had his life ruined and his savings exhausted, and he is kaput, he's finished, he's over. he pleaded guilty to some phony baloney, stupid, halfway to process crime shouldn't really exist. it is of the democrats position, is it your position, that it should be a crime to lie to the fbi, that the fbi, like mccabe, should be able to lie to us as often as they wants? >> absolutely not. no, i do think that it could be a crime to lie to the fbi. as always been curious to me as

far as,o what exactly was andrew mccabe's wrongdoing here initially? what was his original sin? they said that he was leaking stuff to the press. again, i had a p.r. firm, i worked with the press every day for the last 20 years. leaking to the press could also mean giving truthful information to the press. it's very odd to me. >> mark: if you have a p.r. firm like you, but if you are supposed to be an impeccable, nonpartisan government bureaucrat, that's different from being a hot shot cracker jack p.r. firm. >> it doesn't have to be. that's the thing. there were was not necessarily any kind of wrongdoing on his behalf. the understanding was>> that he thought the article was going to come out in a journal that is going to make them look bad -- >> mark: let's break that down down. the wrongdoing may not be the leaking, but then he lied undera oath about the leaking. let's talk about the leaking.

>> mark: fox news has obtained a series of memos that former fbi director james comey drafted about his interactions with president trump before and after the inauguration. fox business networks ed lorenz has read the memos and he joins us tonight. >> here they are, this is the redacted version of these memos. the unredacted version wear hearing, we make it possibly tomorrow, but in these redacted

versions, a couple of things jumped out at the moment. you can see that six conversations are aligned that james comey had with resident donald trump, some on the phone, some in person. everybody talks about the pledge that the president had asked before to follow, to pledge loyalty to him. in the memo two times, the president has been outlined as a saying he would like a pledge of loyalty from comey. one of those times, comey responded saying you will get that. another thing that jumps out here is we are talking about the russia investigation into meddling. james comey documented that president donald trump asked him not to -- to get out the information that the president was not a target of that investigation. as we go through here, very sensitive conversations between the two. i can tell you that in february of this year, a judge ordered

that these memos not be released. they were assigned to it several committee members today, they've been requested of both the house and senate judiciary oversight and intelligence committee got these along with house speaker paul ryan and minority leader nancy pelosi. a few things jumping out. one that there was that pledge of loyalty according to comey, but in one of those instances, comey said you will get that back to the president. the other thing that's in here, james comey's rep tells a president a number of times that andrew mccabe is an honorable man heard the president questioning mccabe's motives on several occasions and meetings, phone calls, and meetings with us before, but again, reiterating each time that was brought up that mccabe is an honorable man heard also telling the president of the fbi is impartial and doesn't want their feelings get involved in their investigations. >> mark: thoughts directly related to not just the mccabe referral, but also seems to be

at odds with what comey told george stephanopoulos on the big abc interview where he said he didn't give loyalty, he talked about honesty instead. in this version, he pledged his loyalty. >> maybe it's an oversight, but written in these documents, it doesn't say in james comey's own words that he did say you will get that on at least one occasion when he talked to the president. >> mark: fox news producer child program is joining us. he's on the phone. chad, the lurid meeting is the one where comey met with trump to reveal the existence of this dossier and the more salacious elements of it. did we learn anything more about that in these memos? >> what we have here is part of this memo that was sent to

capitol hill is where comey told the president that the russians "allegedly had tapes involving him and in moscow around 2013." comey says trump said there were no, there were never any. he said the hotels he stayed in were liars comey also said it was a house full of protitutes," they were women who falsely accused him of grabbing him, touching him, he says there was a stripper, doesn't say who it might be, it i will leave it at that, the pre he was defending himself. we are still going through this. i have to say that we heard of elements regarding this from sources on capitol hill, probably in the spring of last year. again, the veracity of that is unclear. that is something that has been rattling around in intelligence circles for quite some time. >> mark: let me just ask you this, chad. thesk whole issue is that theres

no evidence of this, it's a story that comes from this dossier, the dossier comes from a foreign national, british subject who got it from supposed russian t sources. does anything comey says add any credibility to this allegation? >> well, there's one thing here that comey says in the memo. he indicates to the president that he was not saying that this was true. for exact verbiage, only that i wanted himim to know that the reports were in my hands. he said it was important we not give him the material, they were keeping a close hold. this is something, if you read between the lines of what comey is saying here, he says this is what is inflammatory stuff, quote unquote, someone in comey's position, then the fbi
