whenever it is, wherever it is. the president heard the news and tweeted this out...ev now fox's trace gallagher heard this news and said, i'm sticking around, i will help you with the show, brian. trace, tell us what is going on. this is more good news..t this is some good signs. >> this is good news, brian. history shows that anything coming out of north korea should be taken with a giant grain of salt. in this case, kim jong un is by sayingup the ante that he plans to stop nuclear testing and he plans to offer proof. north korean state-run media released the following statemens from kim, quoting, "from april 21st, north korea will stop nuclear tests and launches of intercontinental ballistic missiles. the north will shut down the nuclear test site in the

country's northern side to prove the vow to suspend nuclear test. a nuclear test center will be discarded and over to ensure the transparency of the nuclear test suspension." the statement makes no mention of north korea abandoning its existing missiles and nuclear weapons, so there is of course room for skepticism. remember, kim jong un has not tested a missile since november and at that time he was embroiled in this name-calling game of chicken with president trump. so for now, this appears to be a major concession by the north and a major victory for the president. it precedes what could be a historic summit next month or in early june between trump and kim. it also comes one day after north korea dropped its demand that u.s. troops leave the korean peninsula. and that came in the wake of that stunning revelation that secretary of state nominee mike pompeo actually visited north korea over an easter and met with kim jong un. experts say that sanctions have

had a crippling impact on the north and even kim jong un says that he wants to focus on his economy and focus on his people. we'll see. brian. >> brian: yeah, we've been down this road before but never quite like this. trace gallagher, thank you so much. keep in mind, north korea and south korea will have a summit week.ag they will talk about ending thep korean war. now to tonight's other big story. the jim comey memos. now we now know what is in those memos and the justice department's watchdog also know what is the memos and they want to investigate whether two of them have leaked classified information on the inside of them when he gave some of thosem memos to his good buddy at columbia just uptown here, who was at the justice department. fox news chief intelligence correspondent catherine herridge is trying to stay up with us. man, this book tour is getting quite interesting. isn't it? >> it is, brian. fox news confirms that comey is under investigation by the justice department's internal watchdogs.ey

the inspector general for leaking the memos, whether he mishandled classified information, as well as his communications outside the fbi including reporters. the memos show the relationship between the president and comey was difficult from the veryhi beginning. after comey briefed mr. trumps about the dossier's unverified claims, just three weeks before the inauguration. those who support the president say that he wanted the russia claims investigated. comey said that it would be good to find out but he hadn't done anything at hoped he would find a way to get out, we weren't investigating him. the president's saying that he crossed the line -- comey replied that he would always get honesty from me. trump paused and said, that's what he wants come on his loyalty, i replied and said, he will get that for me. of the 15 pages of memos, eight contained classified information, secret, highly confidential, which seems to be at odds with comey's congressional testimony after he was fired. >> my thinking was that if i

write it in such a way that i don't include anything that would trigger a classification, that will make it easier for uss to discuss within the fbi and the government, and to hold onto it in a way that makes it accessible to us. >> but in his very first memo in january of 2017, comey knew his conversations with the president were sensitive and not public information. "i'm not sure if the proper classification, so have chosen secret. please let me know if it should be higher or lower than that." tonight, we have a seriousr investigation by the inspector general at the justice department and another apparent conflict between the documents and comey's testimony, brian. t >> brian: you can't say this is political, president trump's doj, the inspector general t appointed by president obama. >> that is correct. >> brian: great job. you make it sound so simple but yet we know it is very complicated. meanwhile, straight ahead -- have a great weekend, catherine.

comey spoke about leaking the memos during the interview with george stephanopoulos, the interview that never ended. take a look. >> the president has tweeted innumerable times calling you a leaker. what is your response to president trump? >> it's true. i testified about it. that is so people know about it. i gave that unclassified memo to my friend and asked him to give it to a reporter. that is entirely appropriate. >> brian: really? in what world? "the wall street journal"'s editorial board kim strassel,, one of her latest, she talks about the questions that she wants james comey to answer. is it right for him to have leaked that memo? his reasoning is bizarre. he said he needed to get the information into the public sphere. what is it, 1778? >> hi, brian. no, it is not appropriate. this is a man who has nailed to the wall numerous people for having mishandleds classified information, for leaking. he talks in his memos about how he tells president trump he

wants to go after the leakers, make an example of them. and just because jim comey decided that he was entitled to take these documents, which arguably, by the way, are fbi property, they were in his possession, then decided that he alone is entitled to the public interest to leak everyone who leaks has some sort of motivation like this, and it doesn't justify what he did. >> brian: four memos out, two of them taking another look at. meanwhile, his deputy, andrew mccabe, clearly is in trouble. he told multiple lies. he is going to be skewered. we'll find out if the criminal referral will result in charges. looking at comey in particular, i have a real problem, for example, his pull aside in the oval office. very similar to the pull aside in trump tower. you have a new person in politics was used to running a major organization. if you know more about how it is done, how about this, instead oi jotting it down after you leave, "mr. president, i shouldn't really be one-on-one with you. let's get somebody else in the

room for your own -- just so you don't have a problem later." there are so many ways to avoid the problem. instead, we hear about the voice and he writess in longhand and we eventually get a best selling book. >> there does seem to be almost a sense of entrapment in these memos, as though he was urging the president to do things so he could run back outside and write down the bad things the president had done in his mind. by the way, the double standard, too, is glaringly evident. jim comey tells us that i has on this tour about the doubts he had about loretta lynch, the orders she gave him, do we have any conversations between him and her that were memorialized? absolutely not. there's a lot of other things that come out of this memo, too. we are finding as well that jim comey likes to talk about how he is a fact guy but again, only the facts that matter. once we are seeing the context of a lot of the statements that have been wafting around in the press for the last year, it

turns out there is a very different reading of this than the one that jim comey was giving us up until now. >> brian: it's unbelievable. if he had any brains in his head, one interview, get off the stage.e. the more he talks, the more news unfolds, the more he backs into itself into a corner. now his battle's with andrew mccabe, because they both can be telling the truth because both of their stories t diverge. i look forward to your next article and i'll talk to you soon. >> thank you. >> brian: meanwhile, the memo news sparked a twitter response from the president. i didn't even know he had a twitter account. jonathan turley is a lawyer. he knows the answer to that. professional of constitutional law at george washington university, over $70,000 a year, i looked at that. they don't offer much aid. >> it's a deal. >> brian: you are there so it makes it worth it. what do we learn now, jonathan, that we didn't know before this

book published that has you really intrigued? >> it confirms many things that some of us have been saying. for over a year, he's had many supporters saying things that'vi think are facially simply unsupportable. one of them is that these were some type of personal diary,e that they were his personal notes.th he continues to maintain that. and that is facially ridiculous. if you look at the memos, they are not to him, they are not memos to the file, they are memos to other fbi officials. he is actually stating in one of the memos how he wants to do the preliminary classification and giving it to these other officials for their input. these are not personal records. also, the fbi itself has said, this is fbi material. so you have someone who was fired as the director of the fbi, removing seven documents from the fbi, four of which were deemed to have classified information, and then giving them to a friend for the purpose of leaking them to the media.

that is a very serious set of f facts. it doesn't exactly speak to the ethical leadership model that comey has been a proponent of. >> brian: when president trump sits there as the businessman turned brand-new politician and says, what is going on with comey?smys what's going on with mccabe? i think there's a prize at the fbi, peter strzok, lisa page. yes, yes, yes, and yes. his instincts were right on this! >> i think that it wouldn't comes to comey, many of the criticisms have been borne out, as with mccabe.. not that the president hasn't made his own mistakes but he has been blessed by the critics that he has inherited. i think with regard to mccabe, a very strong argument for a charge, it is the very case that he and others brought against flynn. he was part of that investigation initially. his situation seems more serious.as with regards to comey, there are other problems with this.

one is, why would he give this toem his friend? what we now know is that various fbi officials had the document. so this wasn't going to be destroyed. he knew it was going to go to investigators. it was already in the hands of investigators. but instead, giving it to congress, leaving it with the investigators, he chose to give it to a friend to leak to the media. why? it wasn't going to help the investigation, it was going to hurt it because he just toldld trump that these h documents exist. what is the answer it seems that is that it was to his advantage. >> brian: the president angrily, in that one-on-one sessions, after certain things, he assumes that he means he's guilty or democrats assume that he is guilty. actually, that might be a human reaction. they accuse you of cavorting with prostitutes. that could become international news, and the worse thing is that your wife could find out. he expressed that in the one-on-one meeting and that emerged. also, he says, pursue satellite

problems or anyone that worked with me, and he writes, "i assume that meant people that worked with him that may have colluded with russia."em that did not get out until thean memos were public. >> much of this is now going to be public and we will for the first time see a complete record. one of the more interesting aspects about comey's conduct with regard to these memos and his book is that he seems to have put the investigation into a secondary position.he writing a tell-all book while the investigation is ongoing and you are a principal witness, it's not helping the investigation any more than leaking those memos were. they helped comey. >> brian: jonathan turley, we have to cut you almost every day because your legal knowledge helps us keep up with the investigation like no other. thank you so much, sir. before comey was under investigation for leaking classified information, he was criticizing hillary clinton for doing the same thing.

>> although we did not find clear evidence that secretary clinton or her colleagues intended to violate laws governing the handling of classified information, there is evidence that they were extremely careless in their handling of very sensitive, highly classified information. >> brian: how ironic is this? a democratic strategist with a clinton campaign for a while. robin, what do you think about these revelations about how the inspector general has a problem with some of the classification and the use of james comey's memos? >> it is really hard to wrap my brain around this. honestly, comey's fall from grace has been stellar. this is somebody who was widely regarded on both sides of the aisle, until the 2016 election, and now, as a veteran army ranger who served in the ranger regiment, i was awarded a top secret security clearance. i know very well everything that goes into that, the responsibilities that carries., he seems to me too smart of a man to make a mistake like this. then again, so did hillary clinton.

not a man, excuse me. but i just can't understand how people like this get into these situations when they know full well the responsibility that having that level of clearance carries with it. honestly, i just -- i have trouble even processing this. it is hard to believe, honestly. i have to wonder if he's just trying to sell books or if this is made up, if this is part of this crazy deep state conspiracy theory stuff. i constantly hear thrown around that no one can really explain to me, we don't use that term on the democratic side.e. it's just all a lot to try to wrap my brain around, brian. >> brian: he never had a relationship with hillary clinton.in he talked about trying to meet her once and it didn't go so well, maybe he had a negative feeling about something.g. in the end, what he has to be transparent around with their relationship with loretta lynch. it would alleviate a lot of the mystery into why he acted the way he acted. just come out and say i couldn't

trust the justice department, that is why i did it. hillary clinton deserves the criticism for putting -- for having huma abedin put the emails on her laptop. that forced me to act. then it is game on. we can debate it. you can't get to the point where you debate it because he talked so curiously about his thinking, where he contradicts himself in the same answer. >> yes.nk that is the problem. americans just want to know the truth. we want to know what happened here and we are not getting straight answers. people are getting mad. i know the dnc just sued. really, it is so hard right now, there is so much conflicting information going on. honestly, i wish this investigation would just wrap up so that we would find out what is going on and get to the truth of the matter. put politics aside. we are all americans. none of this seems to be panning out to me and making sense. especially comey right now, i just can't understand. you know, he even said that he wouldn't have brought the

charges against clinton the week before the election because he thought she was going to win. so as a democrat, that blew my mind. >> brian: it makes no sense! then he said politics didn't enter, but politics entered. got to go. robin, you are wrestling with it outwardly with us, helping the show get better, the same way i do, too. i can't make sense of it. the one thing is pretty clear, the left and right agree, he's not making much sense. i don't know where his constituency is but he has sold almost a million books. robin, thank you so much.. >> thank you, sir. >> brian: meanwhile, the conservative legal watch group judicial watch just filed a new lawsuit, get this, involving jim comey and special counsel robert mueller. they want the communications with each other. are they out there? we'll find out. ♪ out. ♪

department told us, mueller has them, so you can't have them, ak big lie in the sense that they gave them to congress. we want to know what comey and mueller were up to you in that regard. we know that they colluded on the testimony that comey gave last year, that talked about the memos and was an anti-trump tirade. mr. mueller's investigation would not hear but for that illegal leak by mr. comey through his friend to "the new york times." a leak that is now under criminal investigation, one step away from being under criminal investigation. mr. comey has a lot to worry about, mr. mccabe has a lot to worry about, but mueller, he wouldn't have an investigation but for those two men. he is the one who'ss running ths investigation because everything is collapsing around him. the memos show there was no rush and collusion. trump did nothing wrong, the one who did something wrong wasn't comey and mueller is not targeting him.

>> brian: tom, you are wondering, it wasn't just that the columbia professor got the memos dropped off to him, you are wondering if comey gave them to robert mueller. >> did comey get the blessing to talk about them? we've also sued for the fbi and doj to figure out how it is that comey was allowed to use this material in his book. it was either private or classified or confidential and he shouldn't have been able to use it. and mueller certainly have to have been involved in blessing that operation. you know, donald trump has a lot of enemies, and it's mueller, comey, the deep state, the fbie and doj, and it's andrew mccabe. two of those people are facing jail time. the irony, quickly, brian, comey is in the same legal boat as hillary clinton right now. the mishandling of classified information is a significant legal liability for him and it was for her. you have to wonder whether he exonerated her because he was doing the same thing. >> brian: it was so quick, tom. it was, okay, i'm fired, i wrote

double russian investigation, don't you think that is the last thing the american people want see? when the democrats are saying, robert mueller should be left alone? this is a comprehensive investigation with a bottomlesss pit of funds to research? >> yeah, there is also something called statute of limitations they needed to file suit on before those expired. normally, you are right, they would wait until the criminal investigation with robert mueller but in this case, when you look through this series of torts and charges filed, i read the entire filing, there are statute of limitations, they need to file now. this is an appropriate time to do so. remember, a civil suit has a different standard for evidence, you just had tom fitton on. this is about the preponderance of evidence. really important for the dnc, the discovery phase, they can find out all kinds of great things they can use. >> brian: robert mueller is not doing much discovering. he's got 19 indictments, cutting

okay. so here's the very quick story.e it's not -- it is about my book but it's not about my book. it's about "the new york times" best seller list. it's not a best seller list. i don't say this with anger. i say it, though, with certitude. it doesn't tell what the best-selling books are. they admitted it in the 1980s when they were sued by the author of the "exorcist." they said it's editorial content, rather than just a list of best-selling books. generally, people have known that religious books and conservative books don't do as well, even when they are selling well. in my particular case with "the rational bible," it is number two last week on "the wall street journal," number two in "publishers weekly," number one on ingram, the biggest wholesaler in the country, and number two on bookscan, provides -- monitors 75-85% of the books sold.

it doesn't even appear in "the new york times" best seller list. b it's a real -- >> brian: it's bizarre. two conservative books that weit checked out, number 11, "the secret empires of peter schweizer," number 12, "killing the deep state." it's on there. when you have the numbers, i know about the book business, if you are in "publishers weekly," you are usually in that list. i find it hard to believe that you can't get bookscan and l others to give you numbers to go up to "the new york times" and, say, tell me who sold more. >> oh, we have the numbers. it is not a puzzle at all. it doesn't matter. they tell you they are like coca-cola. they have a secret formula and they don't want the world to know how they derive their numbers. they don't include amazon. on my book, the second best selling book of all books of all varieties when it opened up on april 2nd. even then it didn't appear in "the new york times" best seller list.

how is that a possible? i am only using it -- i'm not a victim, i'm not whining, i just want people to know what i have known and many conservatives and many, especially religiouskn writers know, it is not a c best seller list. people should understand that and then we can move on. >> brian: you are not moving on and you are fighting about it. you want people to know. it does bring extensive prestige to "the new york times" best seller list. you admit that? >> absolutely. that is why i am not -- they say i'm a hypocrite. first of all, i'm not a hypocrite. i wrote in my piece, i used that term, i am a "new york times" best-selling author, of course i will use it. it helps sell books. it doesn't make me a hypocrite. to the contrary, it makes me tohonest. >> brian: dennis is fighting the good fight for all of those who publish books and want too get on that list and want to make it a fair list. i know it's a great book. dennis, i had a chance to read it. grab it with two hands. it is quite heavy because you worked quite hard on it.
