9:00 am
>> jon: thanks for joining us today. >> julie: "outnumbered" starts now. >> we begin with a fox news alert on the ongoing talk with nuclear north korea. president trump reportedly repaired to tell kim jong-un that he must dismantle his nuclear arsenal before the united states would consider providing him any relief from crippling economic sanctions. this is "outnumbered." i'm harris faulkner. kennedy is here, republican strategist lisa booth and larry elder is in the how. you are outnumbered. how are you feeling? >> i'm feeling good.
9:01 am
i hope i don't bring bad karma. last time i was here there was a train derailment. remember that? >> yeah. >> praying that doesn't happen. >> glad you're here. major new developments in the run up to potential talks up to north korea. the "wall street journal" is reporting that president trump plans to urge the rogue regime to act quickly to dismantle their nuclear arsenal. this comes after an announcement the regime would suspend their nuclear weapons testing. the president expressing caution. he tweeted this over the weekend. >> retired four star general jack keane defending the president's approach. watch. >> anybody that has any knowledge of the kim dynasty has to be skeptical. any thought that i've seen in the media and by some other
9:02 am
people that the president is going go into into this and not be properly prepared for this is an absolute absurdity. >> president trump is slamming critics of his policy decisions on twitter as well. funny how all of the pundits that couldn't come close to making a deal on north korea are all over the place telling me how to make a deal. >> it's true. >> he has a good point. when he first started talking about north korea, they were shooting off missiles and very few people thought there would be any kind of home that kim jong-un would sit down with the south. now it's happening. they're talking about denuclearization. i'm very, very skeptical as is the president as should be the president. however things do change. the soviet union collapsed. years before that people talked about how enduring it would be. we a talked about apartheid in south after. i said how long will it last? he said through the lifetime of your kids.
9:03 am
it fell in my lifetime. things do happen. >> it's interesting. you and i talk about how resources and energy and money can change about any conversation. >> is that at play here? >> absolutely. without question. all of the talk of tariffs and the sanctions as well. the tough talk on tariffs has put pressure on north korea and the nations surrounding them. i also think -- i like what general jack keane has said. that has been the slam on the president. even former governor bill richard said on the couch here that he suspected the president wouldn't be prepared. the general said that's ridiculous. it's obvious he's preparing. i like the language, that they need to dismantle their program. i wonder what that means? to me it signals that we're not going to get hosed and we need to see something real as opposed to a pause or a stop or something verifiable. >> it's an excellent point. a senior administration official is telling the "wall street
9:04 am
journal," that's where that reporting is coming from. the u.s. will not be making substantial concessions like lifting sanctions, so on and so forth until they move in a huge way. >> we've seen that through three previous administrations. north korea comes to the table and think automatically they're somehow trustworthy. because they want it to work out so badly. they have wanted that so badly in the past. i think anything the president can do differently in that regard will lead the peninsula better off. of course, you know, we want a lot of things from these talks. we want denuclearization. we want oversight from international monitoring agencies. we want to see where they have been creating this material and making sure you can shut it down. i would like to see humanitarian agencies visit some of the labor camps and help free some of those people. not just the three americans that are still detained that mike pompeo talked to kim jong-un about.
9:05 am
i'd love to see their release but at this point in time, we do have to do things differently. we cannot automatically lift sanctions on the hope that good things will shortly follow. in the past, they have not. >> what you're saying, enumerating the other things that could be on the table that is important and interesting too. lisa? >> to kennedy's point, that's why we're seeing this table setting of president trump. maybe it will be a good meeting. maybe it won't. maybe we'll cut a deal. unlike the obama administration that wanted to cut a deal with iran and just wanted it for legacy purposes. president trump is doing the opposite of that, which is important. i think that a big difference in dealing with north korea now than where we have seen with previous presidents is president trump's threats are viewed as credible. we know that north korea and kim jong-un was reaching out to republicans in washington d.c. trying to figure out who is this trump guy. i think president trump starting out of the gate as i said
9:06 am
before, shooting those tomahawk missiles, dropping the mother of all bombs in afghanistan and following up in syria with missiles sends a message to north korea that i'm not playing around. that is critical and important here heading into these negotiations. >> surrounding the north koreans with american aircraft carriers has a way to put, to use the expression, has a way of opening up your nostrils. >> is that what he said? >> that's what he said. >> look at what we did in the china see off the coast of vietnam with the carl vinson. that was about a month ago. got everybody's attention there. china thought that they would dinosaur stomp through the islands there and we were like wait a minute. we're going to pull in a battleship. it's not just with north korea. that whole alliance. >> that's a really important point. the element that china isn't -- they're not participating so
9:07 am
forth. it's a dialogue with north korea and south korea first and the president and kim jong-un. china is not a part of the discussion. that means that if there's a way of unifying that peninsula once again and actually ending the war that has been going on since 1953 and the united states is having a major say in that, china is really rightly so -- they are in time-out because they have appeased this regime nor so long and allowed them -- >> giving them energy. >> very true. >> definitely. >> all right. the senate foreign relations committee is set to vote on president trump's nominee for secretary of state, mike pompeo, later today. at this moment, it appears likely that the committee will deliver a historic snub to the man tapped to be the country's next top diplomat. mr. pompeo is already involved in the country's most delicate international relations earlier this month. he met secretly with kim jong-un. despite all that, all democrats
9:08 am
on the committee and republican senator rand paul say the plan to -- they plan to vote against pompeo. that would make ten votes for and 11 against. last week ranking democrat member on foreign relations senator bob menendez announced his opposition of pompeo saying "his past statements do not reflect our nation's values and are not acceptable for the top diplomat. the american people deserve better." tom cotton accused democrats of playing politics with a critical national security issue. >> the democrats, especially on the foreign relations committee are engaging in shameful behavior. 15 voted nor pompeo last year to be the director of the cia. most of them don't have a problem were mike pompeo. they're still struggling to get over the election of donald trump or they face election in 2018 and they're afraid of
9:09 am
scaring the coat pink crowd. it's shameful. >> the full senate will still vote on the nomination of pompeo and is expected to be confirmed no matter what the committee decides. is that the point? the snub is about the show of it? >> i think so. they still haven't gotten over the fact that donald trump won the election. even "the washington post" editorialized in favor of mike pompeo. you have a couple of democrats that will vote for him. joe manchin will vote for him. >> let me step in with breaking news. joe manchin says he will vote to confirm mike pompeo as secretary of state. it's like you knew that that was hanging in the air. >> you see what i have. it's incredible. >> so joe manchin, democrat west virginia has released the following statement on his decision to vote. >> and i didn't know this. >> after meeting with mike pompeo and discussing his foreign policy directives and
9:10 am
his career in public service,ly vote to confirm mike pompeo. that is joe manchin. >> larry set that up so well. >> like he knew we had that. >> goodness. i obviously didn't. >> i didn't know that. >> so there you go. so we know about manchin on that front. at the same time, president trump tweeting that obstructionists may vote against mike pompeo for secretary of state. the dems will not approve hundreds of good people including ambassador to germany. they're maxing out the time on approval prom says for all. never happened before. need more republicans. kennedy? >> of course both sides will stoke the passion as much as possible before the mid-terms and use every issue in every conceivable way in order to get voters excited about it. rex tillerson's time was not a blinding success. anybody that becomes our next chief diplomat deserves scrutiny. i'm sorry. i don't have a problem with rand
9:11 am
paul voting his opposition to mike pompeo. i think that's fine. that is coming from a place of principle. but some democrats that are just doing it for the sake of being hyper poe llitized doesn't help. >> that's the problem. scrutiny, yes. this political gamesmanship, no. this is political gamesmanship. you have dianne feinstein supported him for cia director but now going against him. you have heidi hide caeitkamp i first democratic to come out for him because she's running in a state that is for trump. this is all about politics.
9:12 am
>> now it's 51 votes. right? so even if rand paul decide to go no, they can do it. they can move forward. that's huge news. >> the event there's a tie, you have vice president pence to break the tie. the quarrel that the president has and slow walking nominees is a legitimate one. this is over 100 people, very critical positions and in my opinion, trump is legitimate about being angry about his nominees being held up. >> and the tweet between mike pompeo and kim jong-un happened as mike pompeo is being nominated for secretary of state. it all right paints mike pompeo as the secretary of state, acting in that position. so i think it's smart. i assume it was intentional and sort of gives mike pompeo a nice
9:13 am
little lead-up to hopefully being confirm secretary of state. >> yeah. you wonder if it makes those against him look ridiculous or it doesn't really matter. they're going to stand up and say no matter what. kellyanne conway accusing one journalist of being a double standard after she asked about a recent tweet. you have to see how it went down. and pressure mounting on james comey. the justice department inspector general is investigating whether or not he may have broken the law by releasing classified information. mr. comey denies that. we'll debate it. >> i think all throughout this process he's been wrong.
9:14 am
9:15 am
9:17 am
let's fix that. let's give this guy gig- really? and these kids, and these guys, him, ah. oh hello. that lady, these houses! yes, yes and yes. and don't forget about them. uh huh, sure. still yes! xfinity delivers gig speed to more homes than anyone. now you can get it, too. welcome to the party. >> welcome back. pressure growing on james comey from congress, the president and the inspector general of the justice department. mr. comey continues promoting his tell-all book. last week the justice department released memos in which mr. comey detailed private conversations with the president. three republican chairman say the memos show his political bias and president trump tweeting, james comey's memos are classified. i did not declassify them. they belong to our government.
9:18 am
he broke the law. additionally he totally made many of the things he said i said and he's a proven liar and leaker. where are memos on clinton, lynch and others? comey said he didn't release any classified material. mike horowitz is looking to him giving his memos to a friend. >> personal diary of so many in the media portrayed it as. as we see the memos, it re-affirms what we said ahead of time. this is fbi material covered by fbi regulations. you can't take them and leak them to the media. >> that's one of the reasons why andrew mccabe was fired. he was fired for doing the same thing that james comey has admitted doing. so what do the memos say to you? >> i'm inclined to agree with
9:19 am
professor turley. he and dershowitz have been right from the beginning. i know this book has not helped comey. a number of agents that used to praise him have said that they feel it's political, they were cheap. since we have an ongoing investigation could compromise that. if i were president trump and i know he watches fox, let it play out. i don't believe that ultimately mueller will find anything at all. if it does, it goes to congress. he won't be impeached. the unlikely event that democrats are stupid enough to peach him, it goes to the senate. there's never been a senate that voted to impeach -- to throw out a president of his own party. won't happen now and it won't happen to andrew johnson and didn't happen with clinton and won't happen now. so trump is not going to be thrown out of office. what they're trying to do is
9:20 am
throw salt in the ears of his agenda. that's what they will continue to do. do your job, mr. president. get the economy going at 4 percent plus and the democrats will not take control of the house in the fall and he will be reelected in 2020. >> drop that mic. >> booya! >> i think it's in fact -- if this does go down the road to impeachment, that will help the president. i don't think the president should talk to special counsel at this point. but i think it doesn't hurt him. what happens to james comey though? andrew mccabe was fired. he's been referred for criminal prosecution. what happens to james comey? >> i bet nothing. probably he has covered himself in one way or the other. nothing comes of this other than the fact when you look at the memos with the become, they contradict each other. when he talks about the memos, he was comfortable, everything was fine. they have a relationship. then he talks about being
9:21 am
nauseous, this horrible situation. he looks cheap and like he's out there trying to make money and he's out there, you know, trying to be in the spotlight, which is not a good look for an fbi director. but i don't know. harris, that's about it. >> yeah. it's interesting. as you were talking, i thought it's less about the become that's been damaging and more about the tour. he has, you know, given texture to some things that people might not have noticed or not have noticed as much. then you get an apology and retraction from him. i wish i hadn't put the things i said about the president's appearance. that's uncomfortable -- >> he's so wishy washy. so many maybes and possible and i don't know and i guess so. he's like hillary clinton in that he won't stop. my question is, where are the other memos? the president brings up a good point here. if he wasn't political, show us some of the conversations you had with democrats. what was your recollection of the conversation he had with loretta lynch after the tarmac --
9:22 am
>> that's something that gowdy, nunes and goodlatte have raised as well. where were the memos with loretta lynch who you now had an exchange of words with with comey telling him to call the investigation a matter as opposed to an investigation. he had issues with that. loretta lynch said he did not. he's really exposed himself and damaged himself. what if we have found out, now he's being probed for his handling of classified information. we know that he showed the dossier, in salacious information to president trump. never told him it was funded by democrats. and then that meeting was leaked. so you look at all these things that have happened and you look at the memos that have been put out there. we know the memos show that there wasn't obstruction of justice. if anything, president trump was telling him that he wants to get to the bottom of this russia stuff, that he wanted it to be investigated. so comey has damaged himself in this and also damaged the investigation as well. >> i wonder about the people at the fbi.
9:23 am
this guy was out there. he was in charge. larry what do you think about that? thousands of people doing their jobs well there. >> must be pretty demoralizing. when is somebody going to ask comey -- nobody has asked him, you exonerated hillary but by finding that she had no intent to violate the espionage acted. intent is not an element of the act. how did you find something that is required? >> or why did you find something that wasn't required. bret baier will talk to him april 26. >> he will bring it up. >> he found negligence to extreme carelessness -- >> intent is not a requirement of the statute. >> brett will get to the bottom of it. coming up, french president emanuel macron, why he believes he and president trump share a special bond ahead of the

official official state visit of the trump presidency and a madman shoots up a waffle house. what police are saying now. and were warning signs missed? more coming up. >> once he started shooting, i hit the ground and tried to keep an eye on him to make sure he wasn't going to come and try to shoot me.

it's true. i love you. a "new york times" article talking about their bromance. we don't know if president trump wrote it but it was given in the trump team to macron and i hope it's true. it's hilarious. >> it is. on a more serious note. the way that macron has described them as being people who their electorate didn't think would get hired by voters and calling them mavericks because of that even though they're not politically yolked on the bigger issued, at least the door is open. they can understand how they both got there. if you'll recall, macron's opponent was more trump-like in the run up to this in terms of the way that she was doing her politics. maybe not all of them. but it's interesting. he's spun this on a dime and he sees the connection, yeah, nobody thought he would be here. here we are. >> the broader point is that world leaders do not despise

9:46 am
brentwood police reports that they found the vehicle as he was driving it and engaged in a pursuit during rush hours. because of all of the vehicles on the road at that time and the fact that this vehicle had gps capability and could be tracked, the pursuit was discontinued by the brentwood police department and later that evening, the vehicle was recovered from ryan king's apartment complex. i would hasten to add that they had no idea who the man was. he wouldn't give any identification. there was no clue whatsoever of his name. but due to the gps tracking, the vehicle that bmw was recovered tuesday from that apartment complex. >> you said he had the fob. he had the fob from the dealership? >> i would defer to the brentwood police department on the specifics on the bmw dealership. >> but that car had nothing to do with this shoot something. >> that's correct.

he stole it tuesday. due to the gps capability it was recovered tuesday. >> did he jump out of the car and leave it there or was he arrested on site? >> when they recovered the car. >> no. the vehicle was recovered from his apartment complex due to the gps capability. there was no one in it. he was not arrested. the police department nor the dealership knew who he was. >> [question inaudible] >> the pickup truck. you're correct. >> there's no connection with the bmw and the dealership. there's no clue that he was planning something -- >> well that remains to be seen. >> something you're looking at. >> we don't know what his plan was. certainly he had a pickup truck. certainly he had possession of this bmw car. what his intention was remains to be seen.
