the president, has he called him or is he planning to meet with him? he has hero of the southwest flight in the oval office today. you said something about james shaw jr. last week. but is the president himself going to reach out to him? will he come to the white house? >> my understanding is that there has been an outreach effort to bring him here to the white house. i will keep you updated on that as i have more information. >> second question, chaos, hush money, russia trolls, facebook, wikileaks, d.n.c. hacks, comey investigation on the eve of the election. do the issues give support to those who offer question about the president's le jet mass -- legitimacy? >> i'm not sure i follow the question but millions of americans voted for and continues to support the presidency. that makes it legitimate. >> about yesterday how does it
12:01 pm
affect the thinking about the iran nuclear deal? >> certainly the fact that the deal was made under false pretenses is problematic. but the president has been clear he thinks that the deal is one of the worst we have seen. we will keep you posted when he made a final decision on the front. >> when did the president first hear about this. was it in early march when he spoke to the prime minister benjamin netanyahu? >> i'm not aware of the exact date that the president was made aware but the white house and the president were made aware prior to israel announcement yesterday. >> was this coordinated yesterday with the white house? did netanyahu give you a heads up and say this is coming? >> this was something that the israelis did. however, they did give us a heads up it was going to take place prior to the announcement. >> reporter: back to the president's tweets this morning. he said there is no question on collusion. when you look at the specific questions about outreach by the campaign to russia, aren't the questions about collusion? >> once again, i am not going to get into a back and forth about the questions leaked or
12:02 pm
anything having to do with the special counsel. i refer you to the president's attorney. >> one more, does list factor in at all to whether or not the president will or will not speak to the special counsel? >> again, i'll refer you to the president's outside counsel. >> the president has said before several times he would like to sit down with the special counsel. where is he on that? do you think he has made up his mind on that? >> i will refer you to president's outside the biggest mistake is the fact that the united states ever entered into the iran deal in
12:03 pm
the first place. it's not a simple typo that was immediately corrected and identified individuals as soon as we know what happened. >> the white house never sent out a corrected statement. >> we responded to every journalist inquiry that we received, that we were aware of or to the best that we could, responded to each person that asked about that. >> the president yesterday talked about holding a meeting with kim jong un, and he said, there are some people that don't like the look of that. has the location of this meeting in the dmv been a subject of controversy internally? >> i'm not going to get into the deliberations on that at this point but the list has been narrowed as the president said. we expect to have an announcement on that soon. >> one more follow-up on iran. is that the iranian nuclear deal
12:04 pm
was made under false pretense, but as it is clear from an historical record, the u.s. made this deal with iran because they knew iran wasn't truthful about its military program. so are your suggesting that in 2014-15, we believed iran? >> i'm suggesting the deal should have never been made in the first place, and even though they had been known to be bad actors to some degree, the degree to which they were not being honest was not fully known at the time the iran deal was made. >> thank you. two questions, one is about the lawsuit filed today by california and 17 other states over there right to have fuel standards in cars. they are fighting the administration on this. i wanted to know what your response was, and also the broader question, this administration seems to be on the other side of the
12:05 pm
traditional revolving artifact. is there any apprehension internally about having such a heavy hand with the state? >> certainly the administration supports state rights in regard to the specific lawsuit, and we all reviewing that. >> the second question was about the nra meeting this week. many americans say this is a sensitive time to be digging into the nra, given the epidemic of gun violence that the president has talked about. what is the administration's response that the administration speak to the nra

we were notified prior to their announcement that was made yesterday. >> how was the timing on the release? >> they supported their announcements and support of their efforts. >> there are supporting those documents and the domestic debate here in the united states in order to see the deal and a different light? >> i think there was a desire to make sure people understood the truth and had all the information that was out there. thanks so much, guys. >> white house press secretary sarah sanders is wrapping up today's briefing. i'm shepard smith, and this is shepard smith reporting. and reporters are asking the press secretary about president trump's tweet, that
12:10 pm
the leak of muller's was disgraceful. >> i can't speak to anything regarding those questions. >> what about questions of specifically the white house and being involved? >> is actually specifically about the president and i'm referring you to the president's personal attorney. >> is the white house concerned, as many of the questions point to obstruction of justice? >> we have the white house tried not to be concerned with anything dealing with , and whett
12:11 pm
knew about it or what he did know. here are just a few examples. what did you think and what did you know about the june 9, 2016, meeting in trump tower, and that it might be disclosed? what knowledge did you have any outreach by members or former members of your campaign to russia, offering potential assistance to the campaign? and it during the campaign, what knowledge or information did you have regarding russian hacking? use of social media, or other acts aimed at the campaign. if there are also questions about the firing of former fbi director james comey, and the attorney general, jeff sessions' recusal. robert mueller is looking into moscow's meddling in the 2016 presidential election. any possible collusion with president trump's campaign, and whether the president obstructed
12:12 pm
justice. president trump has repeatedly said there was no collusion, no obstruction, and he has not yet agreed to an interview with robert mueller. at least not as far as we know. john roberts has the story of the white house. >> shep, good afternoon to you. sarah sanders is refusing to answer questions about that this afternoon but we will get to that. if you look at the number of questions, numbering nearly 50, and if you factor into the equations the follow-ups, et cetera, that a prosecutor would want to go to after asking the initial question. there are hours and hours of questions there and this i am told was something that was developed in early march conversations between president trump's outside legal team and the special counsel's office. clearly the special counsel went into this wanting everything they could get. they fall into four broad categories about the firing of michael flynn, and what he was doing for he was fired, the firing of james comey, as well
12:13 pm
as jeff sessions recusing himself from the russian investigation. and then the meeting donald trump jr. had with the russian attorney in trump tower. some of the questions that we thought were pretty interesting, what is your knowledge the calls or efforts were made by people associated with you to reach out to general flynn or did flynn discuss immunity or possible pardon? what was the purpose of the dinner meeting with james comey? was loyalty discussed? regarding the decision to terminate, why was it made, who in your staff decided and what was done to make it public? what did you do regarding ag sessions recusal and what did dominic roll did you have in the communication regarding the release of don jr.'s emails regarding the same? you will remember that on air force one, the president and
12:14 pm
his team crafted an initial response to the revolution that donald trump jr. had that meeting. it was that initially in that statement that this was about the magnets ck act magna ski an of russian children. the president was not happy that these questions got out but there were plenty of people who believed that by getting this out there in the public, they are reinforcing in the case that there is no way that the president should sit down with muller. given the number and tone of questions this could differently be a perjury trap. >> remember the president's doctor, the one who licked that report on how healthy he was? his name is harold bernstein, and now he is telling an extra ordinary story. he says, the president's bodyguard, a lawyer and an
12:15 pm
unnamed third man raided his new york office last year and took all of president trump's medical files. just took them. dr. bernstein talked to nbc news. >> i feel . feel frightened and sad. i was completely surprised, the morning or two about the story about his hair ran. she said, don't you want to be in the white house? forget it, you are out. he said president trump's team ransacked his office, two days after the doctor told "new york times" that he prescribed president trump that hair growth medicine. the president's former doctor says he never received an authorization form, to put papers, allowing him --
12:16 pm
hipaa papers, allowing that to be released. >> don't forget that dr. bornstein said he had given a letter to dr. ronnie jackson who was then the president's personal physician, authorizing the transfer of the records to the white house medical unit. sarah huckabee sanders this afternoon, the briefing saying, there's nothing really to see here, it's standard operating procedure. >> as a standard operating procedure for the new president, the white house medical unit took possession of the president's medical records. >> it was characterized as a raid. is that what happened in your understanding? >> that is not my understanding. >> we did not get an opportunity to ask that, if in the past the records had been trust dominic transferred, the president's security detail went into get the records or if they were merely transferred from the white house to the doctor's
12:17 pm
office. some people are describing this as a raid but she said, as far as i know, there's only one person describing it that way. >> another big topic, the white house is changing its statement on iran. this was seen as very significant at the time because the white house seemed to be saying, the iranians have a clandestine nuclear weapons program right now. and then quietly, they changed it. >> and what a difference one letter can make. the official statement that came out last night said iran has a nuclear weapons program, but there is nothing to suggest that iran does have a nuclear weapons program. the nuclear atomic energy agency has certified that it does not, and the white house leader change the statement to, iran had, had, a clandestine nuclear
12:18 pm
weapons program. but in the realm of diplomacy that doesn't really change the underlying prep factor and that is that president trump believes that iran has been cheating on the joint company has a plan of action. the white house believes this iran nuclear deal was crafted under false pretenses. but all of us are reinforcing the idea that the president may not decide to grant another waiver of sanctions and pull out of the deal. >> let's turn to ken thomas, white house reporter for the associated press. the word has been all along, you don't want to sit down with muller. but the president might have been leading toward it. all of a sudden, the questions are released and there is a barrage of, don't do it. was that the goal of this week , or do we even know?
12:19 pm
>> is possibly a way for the white house to make the case if there is no collusion. the president sees upon these questions when they were put out, and his supporters said there was an indication that there hasn't been collusion. there could also be a way of putting out in the public record what the president might face if he were, in fact, questioned by muller. and it could influence his thinking. >> a way to get people around the president who didn't yet know the details of the questions? so that they could influence the president? is that what you are saying? >> either that, or just another way of making clear what is at stake for him as he sits down with muller. >> and no one is saying this is all the questions he might have, or that there are no follow-ups, or he might receive dominic refer to testimony might have received. this is just an outline. >> it gives you a sense of where
12:20 pm
the special prosecutor might be going, when and if, in fact, he gets a chance to sit down with the president. >> he says the leak is a disgrace but i'm not sure if he knows all about that leak. i'm curious if we have heard anything about how this affected the president, if it affected his thinking on this matter. >> he's been kind of all over the place. he indicated a few months ago that he did want to sit down and make his case, but in the meantime we have had some changing in the legal strategy and some legal advice that the president has been getting. keep in mind that rudy giuliani is now part of the team and he is interacting with a special prosecutor to get a sense of how they want to go. it's possible that this could be indicative of a change in thinking, or, a way to figure
12:21 pm
out what the best approach will be. >> ken thomas at the white hous white house. more on the leak special counsel questions coming. and i will speak with a federal prosecutor who says president trump will be a quote fool" to sit down with robert mueller. that's kind of what everyone is discussing today, isn't it? for a president who watches television. we will be right back. t what a l life lesson. and don't worry i have everything handled. i already spoke to our allstate agent, and i know that we have accident forgiveness. which is so smart on your guy's part. like fact that they'll just... forgive you... four weeks without the car. okay, yup. good night. with accident forgiveness your rates won't go up just because of an accident. switching to allstate is worth it. with expedia, you can book a flight,

12:25 pm
interview, he has not. "the new york times" posted a list of questions online last night and then fox obtained a substantially similar list. as we mentioned before, they aren't muller's questions word for word, but they are pretty much close, as it's been described to us. in other words, taken down and then recalled. many of them show that there is a lot a focus on whether president trump obstructed justice. one reads, what did you mean to a communicate during your may 10th meeting with the russia's concerning russians concerning pressure of off. you may remember after the president fired james comey, "the new york times" reported that the president met with russian officials in the oval office and set among other things that he got rid of that nut job, and that relieved the
12:26 pm
pressure on the president from the russia investigation. there was a time that the white house did not deny the comment but said that james comey had been influenced by politics and that put pressure on president trump's ability to negotiate with russia. let's bring in jeffrey kramer, a prosecuting attorney. that question specifically to and sent what he was trying to accomplish. >> it all comes down to intention when you are looking at obstructed obstruction of j. what did the resident mean by certain statements and actions, and if his intent was to thwart or obstruct the investigation, then you have a possible charge. >> you know, you have given us a lift of dominic list of the questions that you think might be most pertinent to talk about,
12:27 pm
and one of them is this one. what is your knowledge of calls that general flynn made with kinsley the russian? and the significance of that you say is what? >> that goes to the genesis of the obstruction. right now you have little snips that you have seen over the last few months and what they have been is now crystallized into these questions so it's all coming forth. if the president knew about tha that, that's a first step. he knew that phil and it, that's the second. in the third was a conversation with james comey that he should lay off of flynn. if all three parties parts wer, then you could see that. >> you mentioned the flynn investigation is a important
12:28 pm
follow-up? >> yes, that's an important bookend. the second book and is having the president asked the fbi director to back off of the investigation. that's what you need to make an obstruction charge. >> and then in questions of real estate obstruction, but interaction and can case and did you have with michael cohen, felix seiter, and others including foreign nationals regarding real estate developments in russia during the campaign? >> this one is a little more gray with respect to obstruction. where it does go is to color the motivation. felix seiter is an interesting character. he served a year in jail for stabbing an individual in the face with a martini glass. he pled guilty to a racketeering charge and was a corroborated witness with andrew weissmann. so this is financial ties
12:29 pm
linking cohen, which could be relevant, to provide bias or motivation to the president for going easy on russia. not a charge in and of itself but is it one of those outlying facts that could come into play? >> i have to go, but before i do, things don't leak in a bathroom. vacuum. >> it didn't come from muller's office, he came from the white house or his prior lawyers, perhaps. it is a warren dominic warning shot. >> a warning shot for the president? >> absolutely. >> and what did you say, because nothing good will come of it? >> nothing good will come of the president sitting down for hours with seasoned prosecutors who are armed with documents,, and
12:30 pm
sweet statements from witnesses. nothing will come of it. instead they are painting a bias argument. >> what if you are a president who says, i have done nothing wrong and i will be happy to talk with them because i didn't do anything? >> than the man should sit in that room and answer not only the questions that we have but the follow-up questions. it's the follow-up questions that are not scripted and that we have not seen that because the problems. >> thank you so much. some republicans on capitol hill have drafted the document calling for the impeachment of the deputy attorney general, rod rosenstein, the man who is overseeing the russian investigation. this afternoon, rosenstein responded. that's coming up.

the russia investigation of any attempt by the president to fire him. the senate judiciary committee approved the proposal last thursday. in that committee, it had a bipartisan support, republicans and democrats. but the senate majority leader mitch mcconnell would not allow a vote and house republicans had no interest, so nothing happened. but now some house republicans who are aligned with the president have drafted a document calling for the impeachment of the official overseeing the special counsel investigation. articles of impeachment against rod rosenstein. sources in the house freedom caucus today saying they documented the last resort, as they put it, to get rid of the deputy attorney general of the justice department continues what they call slow walking efforts for them to get information on the investigation. rosenstein reacted to the document today same threats were not going to get him to change the way he does his job. >> they can't even really resist leaking their own draft.
