i would love to speak. because we have done nothing wrong. there was no collusion with the russians. there was no obstruction. i have find that we'll be treated fairly. everybody sees it now and it's a pure witch hunt. brian: stunning comments from a federal judge. this happened friday. he questioned the muler probe. he said they are not interested in manafort's potential bank fraud but are interested in ousting president trump. andrew mccarthy, welcome back. what is your reaction to that judge's comments friday? >> i'm relieved that finally

someone is able who has the authority and status to push back at the special counsel investigation, someone is finally pushing back at what has been the flaw in this investigation from the beginning which is it's an unguide missile. what's supposed to happen in this country is you have a crime and you are assigned a prosecutor. they assigned a prosecutor and gave him limitless authority to find a crime. that's not supposed to happen in this country. we have someone the special counsel has to take notice of. the judge presiding over a case saying what on earth does this have to do with collusion with russia. he was not very satisfied with the answers he got from the special counsel. brian: the goal to take out paul manafort who was in eastern europe for two years then came

back for two weeks to help trump. now he's look at an 18-count indictment. but what i also know is significant, the judge said can you show me the scope your mandate, please. they handled it to him redacted. how dare they hand a redacted agreement about what you can and can't do. that doesn't make any sense, does it? >> what they are saying is what's in the document is classified information, or at least some of it is. if it's not classified, it's highly sensitive. their position is they gave the judge what they think is relevant to the manafort investigation. just because around federal judge doesn't mean you get to stick your nose into anything you want to stick your noles into. the judge said he would be the judge what is relevant and what is not. they are saying that document is

what cabins their investigation. brian: it's good to see somebody outside a news channel what many people like you have speculate, there is something wrong here. i brought this up with you earlier on radio. they hired another prosecutor. this guy also gave to hillary clinton. mueller has to know that that is one of the hits on him. you are a republican perhaps, but look who you are hiring. and he adds another. >> i think it's ridiculously overstaffed to begin with. to have 18 lawyers. i think you and i discussed earlier this week, i ran a big terrorism case in the 90s with three prosecutors. why you would need 18 prosecutors, i don't know. i think special counsel mueller

has disserved himself by the tin ear he has with respect to the people he brought aboard. they are not allowed to inquiry when you are hiring government people about what their political attitudes are. these are not people who apply for a job with mueller. a case like this, you have to be aware of whether you are retaining people who are not only opposed to the president, some of them seem like they are quite hostile to the president. >> the president late this week said rudy giuliani is the perfect person. but we'll work with him to make sure he gets the facts straight regarding around michael cohen. but i want to get this. everyone is saying whether or not the president should sit down robert mueller. >> if i were the president's

lawyer i would probably tell him not to sit down a special counsel. >> whether the president would want to sit down with mueller and fbi agents, my argument is never never never in caps should he do that. >> he of course should not testify unless he absolutely has to. brian were nixon wasn't asked to, and clinton avoided the subpoena. what do you do, andrew? >> i think you assert executive privilege. i would point out while mueller hasn't seemed to find collusion with russia. he has made a small cottage industry of making small statements cases against people po who volunteered to be interviewed by the fbi. i don't think mueller should be allowed to ask the president for an interview until he can satisfy a test that establishes

he has a serious crime and trump is somehow complicit in it and trump is the repository of information that he can't get from the any other source. if you can't meet that simple test, you shouldn't get to have an interview with the president of the united states. brian: you ask rosenstein that and he should decide that. but he's anything but predictable. your insight is valuable because you don't have a new orleans this race. another huge story tuesday. finding a new c.i.a. director. with all the corruption uncovered on the fbi side. isn't it time to take politics out of our intel agencies? isn't that what president trump is trying to do? why is anyone opposing a lifelong par is in the the cia? i'm talking about gina haspel.

she should be equally applaud on the left and right. joining us to discuss it is dr. jim mitchell. he's one of the people behind the enhanced interrogation program. they played a significant role in preventing follow-up attacks, in my opinion. whether her role in black sites rendition should be something that expels her from getting this job. what do you think? >> she should be able to explain her role. what she should have to answer shard questions, if that's the case. but i'm confident if she is given a fair hearing she'll be able to answer them a way that puts people at ease. what i can say because i know her, she adheres strictly to the rule of law.

she is in no way likely to become a rogue director, some of the things we have seen other agencies do. brian: she could say yeah, everything i did was okay by justice. i did what i had to do by law to keep america safe. now, you don't wanted to do that, and i won't do that. should she say that or i had nothing to do with rendition and enhanced interrogation. which one would you do? >> i think she should be as open and honest as she can be given the current level of secrecy. there is nothing to be ashamed of about that program. it was established at the highest levels of government. it was judged legal by the justice department. approved by the president of the united states and the national security council. it was briefed to both houses of

congress, some of them said is that all you are going do? and it was adheres to legally and lawfully. i don't think there is anything to be ashaismed of whatever her role was. brian: the cia released a memo. they want her. they absolve her from any inappropriate behavior in the videotape that was destroyed that showed khalid sheikh mohammed being waterboard. he says documents they are asking for don't exist. >> i'm not sure what documents they are asking for. if they are asking for those tapes, i think it's been clearly established those tapes were destroyed. otherwise, jose rodriguez who destroyed those tapes, he's been

clear about flat he authorized the destruction of those tapes on his authority, and it was his decision alone. he ordered the person who was there to get rid of those. the only role that gina had in that whole thing was as his chief of staff he directed her to put together the cable telling them to do that. but it was done under his authority and released under his signature. brian: overseas experience, multiple asignments as station chief. this somebody appointed by a politician but is not a politician. the agency would revel in having

somebody from the agency leading them. >> she has been described as the first woman in 70 years who worked herself up through the ranks. seven overseas assignments. with her assignment as deputy director of the cia. she is apolitical. and her focus about be on getting the cia to do what it is supposed to do. not build a bureaucracy in washington, but focus on intelligence and espionage. i think we need her and america will be safer for having her. brian: thanks so much for your time. rand paul stands in the way and perhaps john mccain. they will need every vote because mike pompeo got under 60 and he should have gotten 80. president trump trying to break through this week's media side
