11:00 pm
greg: when you're out there digging those remains very those pants. [laughter] >> i will not. greg: doctor, thank you terry, kat thanks for watching. brian: welcome to "watters world." i'm brian kilmeade filling in for jesse. jewel rudy giuliani said mueller's probe is a trap. it comes after questions mueller wants to ask trump. they were leaked to the "new york times" this week. we still don't know why. here is the president yesterday. president trump: nobody wants to me to speak to him.
11:01 pm
i would love to speak. because we have done nothing wrong. there was no collusion with the russians. there was no obstruction. i have find that we'll be treated fairly. everybody sees it now and it's a pure witch hunt. brian: stunning comments from a federal judge. this happened friday. he questioned the muler probe. he said they are not interested in manafort's potential bank fraud but are interested in ousting president trump. andrew mccarthy, welcome back. what is your reaction to that judge's comments friday? >> i'm relieved that finally someone is able who has the
11:02 pm
authority and status to push back at the special counsel investigation, someone is finally pushing back at what has been the flaw in this investigation from the beginning which is it's an unguide missile. what's supposed to happen in this country is you have a crime and you are assigned a prosecutor. they assigned a prosecutor and gave him limitless authority to find a crime. that's not supposed to happen in this country. we have someone the special counsel has to take notice of. the judge presiding over a case saying what on earth does this have to do with collusion with russia. he was not very satisfied with the answers he got from the special counsel. brian: the goal to take out paul manafort who was in eastern europe for two years then came
11:03 pm
back for two weeks to help trump. now he's look at an 18-count indictment. but what i also know is significant, the judge said can you show me the scope your mandate, please. they handled it to him redacted. how dare they hand a redacted agreement about what you can and can't do. that doesn't make any sense, does it? >> what they are saying is what's in the document is classified information, or at least some of it is. if it's not classified, it's highly sensitive. their position is they gave the judge what they think is relevant to the manafort investigation. just because around federal judge doesn't mean you get to stick your nose into anything you want to stick your noles into. the judge said he would be the judge what is relevant and what is not. they are saying that document is
11:04 pm
what cabins their investigation. brian: it's good to see somebody outside a news channel what many people like you have speculate, there is something wrong here. i brought this up with you earlier on radio. they hired another prosecutor. this guy also gave to hillary clinton. mueller has to know that that is one of the hits on him. you are a republican perhaps, but look who you are hiring. and he adds another. >> i think it's ridiculously overstaffed to begin with. to have 18 lawyers. i think you and i discussed earlier this week, i ran a big terrorism case in the 90s with three prosecutors. why you would need 18 prosecutors, i don't know. i think special counsel mueller
11:05 pm
has disserved himself by the tin ear he has with respect to the people he brought aboard. they are not allowed to inquiry when you are hiring government people about what their political attitudes are. these are not people who apply for a job with mueller. a case like this, you have to be aware of whether you are retaining people who are not only opposed to the president, some of them seem like they are quite hostile to the president. >> the president late this week said rudy giuliani is the perfect person. but we'll work with him to make sure he gets the facts straight regarding around michael cohen. but i want to get this. everyone is saying whether or not the president should sit down robert mueller. >> if i were the president's
11:06 pm
lawyer i would probably tell him not to sit down a special counsel. >> whether the president would want to sit down with mueller and fbi agents, my argument is never never never in caps should he do that. >> he of course should not testify unless he absolutely has to. brian were nixon wasn't asked to, and clinton avoided the subpoena. what do you do, andrew? >> i think you assert executive privilege. i would point out while mueller hasn't seemed to find collusion with russia. he has made a small cottage industry of making small statements cases against people po who volunteered to be interviewed by the fbi. i don't think mueller should be allowed to ask the president for an interview until he can satisfy a test that establishes
11:07 pm
he has a serious crime and trump is somehow complicit in it and trump is the repository of information that he can't get from the any other source. if you can't meet that simple test, you shouldn't get to have an interview with the president of the united states. brian: you ask rosenstein that and he should decide that. but he's anything but predictable. your insight is valuable because you don't have a new orleans this race. another huge story tuesday. finding a new c.i.a. director. with all the corruption uncovered on the fbi side. isn't it time to take politics out of our intel agencies? isn't that what president trump is trying to do? why is anyone opposing a lifelong par is in the the cia? i'm talking about gina haspel.
11:08 pm
she should be equally applaud on the left and right. joining us to discuss it is dr. jim mitchell. he's one of the people behind the enhanced interrogation program. they played a significant role in preventing follow-up attacks, in my opinion. whether her role in black sites rendition should be something that expels her from getting this job. what do you think? >> she should be able to explain her role. what she should have to answer shard questions, if that's the case. but i'm confident if she is given a fair hearing she'll be able to answer them a way that puts people at ease. what i can say because i know her, she adheres strictly to the rule of law.
11:09 pm
she is in no way likely to become a rogue director, some of the things we have seen other agencies do. brian: she could say yeah, everything i did was okay by justice. i did what i had to do by law to keep america safe. now, you don't wanted to do that, and i won't do that. should she say that or i had nothing to do with rendition and enhanced interrogation. which one would you do? >> i think she should be as open and honest as she can be given the current level of secrecy. there is nothing to be ashamed of about that program. it was established at the highest levels of government. it was judged legal by the justice department. approved by the president of the united states and the national security council. it was briefed to both houses of
11:10 pm
congress, some of them said is that all you are going do? and it was adheres to legally and lawfully. i don't think there is anything to be ashaismed of whatever her role was. brian: the cia released a memo. they want her. they absolve her from any inappropriate behavior in the videotape that was destroyed that showed khalid sheikh mohammed being waterboard. he says documents they are asking for don't exist. >> i'm not sure what documents they are asking for. if they are asking for those tapes, i think it's been clearly established those tapes were destroyed. otherwise, jose rodriguez who destroyed those tapes, he's been
11:11 pm
clear about flat he authorized the destruction of those tapes on his authority, and it was his decision alone. he ordered the person who was there to get rid of those. the only role that gina had in that whole thing was as his chief of staff he directed her to put together the cable telling them to do that. but it was done under his authority and released under his signature. brian: overseas experience, multiple asignments as station chief. this somebody appointed by a politician but is not a politician. the agency would revel in having
11:12 pm
somebody from the agency leading them. >> she has been described as the first woman in 70 years who worked herself up through the ranks. seven overseas assignments. with her assignment as deputy director of the cia. she is apolitical. and her focus about be on getting the cia to do what it is supposed to do. not build a bureaucracy in washington, but focus on intelligence and espionage. i think we need her and america will be safer for having her. brian: thanks so much for your time. rand paul stands in the way and perhaps john mccain. they will need every vote because mike pompeo got under 60 and he should have gotten 80. president trump trying to break through this week's media side
11:13 pm
shows. he tweeted this. there is no collusion. what there is is a negotiation with north korea over nuclear war, negotiations with china over trade deficits, negotiations on nafta and much, much more. witch hunt. those negotiations with north korea may win him a nobel peace prize. 1 state congressmen and women officially nominating him this week. obama received the peace prize in 2009 because of his vision for the world. kim jong-un may soon release its three american hostages. with all that winning, "watters world" hit the streets to see what the average person thinks we should do on north korea.
11:14 pm
jesse: what should we do about kim jong-un? >> the dictator of north korea? >> yes. >> i would give him a decent haircut. jesse: how would you deal with kim jong-un. >> i wouldn't deal with him to be honest [bleep] jesse: what should we do about kim jong-un. >> we should take kind people like yourself and myself and give him a hug. jesse: if we hug the dictator he'll kill us. >> if you buy me a flight to north korea i will be the first one happy to give him a hug. jesse: how do you think the president is handling the north korean crisis? >> is he taking care of it?
11:15 pm
[♪] >> he promised us he would take care of us. america first. he's crazy, i have no idea what he's doing. jesse: but you are wearing that. >> how should trump deal with kim jong-un? carefully. jesse: why is there a north and south korea to begin with? >> i don't know. >> why there is a southern and northern california? >> there is north and south. >> there is north and there is south. >> because they have like they disagree on things. they are divided because of different intentions. they have been divided for a very long time. >> these lines separate us. less lines, more hugs, more love. >> happy. happy. >> can i give you a hug?
11:16 pm

11:20 pm
>> i just love trump. he's my boy. you look at a video snoop loving trump. president trump: kanye west must have some power because you probably saw i doubled my african-american poll numbers. we went from 11 to 22 in one week. thank you, kanye. brian: kanye west-donald trump revolution continues. he said this about slavery. >> you hear about slavery for 400 years. that sounds like a choice. like it's 400 years.
11:21 pm
we are virtually in prison. slavery goes too direct to the idea of blacks. prison unites us in one race. brian: it set the internet on fire. the president reportedly agreeing to host a white house summit on race with him and other athletes and artists and some others in between. joining us, gianno caldwell, and wendy diseppo. wendy, what do you get out of this dialogue? what you like to see it continue at 1600 pennsylvania avenue? >> i think kanye's dialogue is very, very dangerous. to say slavery was a choice
11:22 pm
negates history. if you look at matt turner and harriet tugman who rebelled against slavery. if we are going to have a summit about race at 1600 pennsylvania avenue that will be a great thing. but i don't understand why when we come together issues affecting black and brown people, we bring together athletes and entertainers. why don't we bring together scholars. we are not minstrel shows. brian: if it's athletes and artists it's a virtual waste of time. your reaction to kanye's comments. >> i agree that slavery was not
11:23 pm
a choice. the 250 rebellions that took place including matt continuer and harriet tugman. and those that freed themselves across the country. what i can say in terms of this imprisonment con yes talked about, there are a lot of people mentally imprisoned. we live in a generation where people are quick to blame history as to why they are not succeeding. i think that's problematic on many levels. we live in a country where we can create our own opportunity and do well. but that won't prevent people like dr. wendy oseppo who sits on fox news channel, on air, the number one news channel in the

country almoster night or myself who was born into poverty and whose mom was addicted to crack cocaine. we take this in our own hand. no one and nothing can stop you about yourself. brian were gianno is saying we are not saying the playing field was equal. but having said that. this is the playing field and let's blet's d let's be success. >> the policies that make us feel there are hurdles even though we are 150 years removed from slavery. dr. martin luther king said we have the notion in our country that individual will pull themselves up by their boot traps. but these individual do not have
11:25 pm
any boots. we have policies that make us feel certainty. brian: gianno, should this be televised? >> i think elements of it should be televised. i reached out to pastor gerald scott talking about the summit and my involvement with it personally. this is something i have been calling for for a long time. wendy and i said on television after charlottesville * where we called for a summit wendy had a good point. you need to bring all voices to the table. we spend a lot of time talk past each other versus with each other. though people don't like the president, and some rightfully so. and we get that. but at this particular point in our country we need to have a
11:26 pm
serious conversation on race. how can we move together and work together. i may not agree with everything he says web's the least open up a conversation where they haven't just shooting hum down. saying we may not agree with him, but we'll listen. brian: who do you want to bring with you. >> i want to bring where lamont hill to the." i want to make sure scholars about race and policies are at the table. brian require's a great idea as long as everyone says i will listen and not just talk. people will listen, and keep politic out of it. thanks so much. appreciate it. wendy has moved that conversation ford. let's move ahead. is calve closer than ever from

seceding from the united states of america? i am going to talk to the man who's leading the evident next. man: i got scar tissue there. same thing with any dent or dings on this truck. they all got a story about what happened to 'em. man 2: it was raining, there was only one way out. i could feel the barb wire was just digging into the paint. man: two bulls were fighting, (thud) bam hit the truck. try explaining that to your insurance company. woman: another ding, another scratch. it'll just be another chapter in the story. every scar tells a story, and you can tell a lot more stories when your truck is a chevy silverado. the most dependable, longest-lasting, full-size pickups on the road.

now back to "watters world." brian: california has made
11:32 pm
protecting illegal immigrants and legalizing pot its priorities. is it time for the golden state to secede and become its own country. the man who says yes joins us right now. he's the president and co-founder of yes, california. marcus, why do you want to leave us? >> we need money and our cultures are not intact. look at the war the federal government launched on california. you never had a california governor talk like that. now you have 30 lawsuits from california against the federal government. i agree with jeff sessions is saying. this is unsustainable. california is a donor state. we have to raise taxes on ourselves to subsidize 25-35
11:33 pm
american states that are already doing better than us. brian: in california in san diego and parts of orange county siding with the u.s. government on immigration policy. so not everybody is speaking like marcus. >> well, that's true. there are conservatives in california. i would point out the overwhelming majority of californians support the policies and we'll see that in the elections coming up. i know there is a lot of talk about people in california will revolt and push back. it's not going to happen. our policies will stay the way that they are. nobody is going to be rebuked and we'll continue on the path we are on through the elections and we'll be able to see who is right when that happens. brian: i look at refugees, the
11:34 pm
would-be immigrants sitting on the fence in san diego making a mockery of our barrier. you want all those people to come in. open the border and count them all as equal, right? >> we never said that at all. brian: they want to bolster the immigration laws, build up the bored and reinforce the wall. >> america has had 30 years to deal with immigration policy and it never did it. i see a lot of talk. but it's a little bit too little too late. people who are undocumented, 40% of them are visa overstays. that's when the federal government is not doing their job. brian rrp why do you think you are better off in your own country. who will protect your shores.
11:35 pm
when you have fires ravaging your state. what will you do when the federal government is not there to protect you and help put that out. >> i encourage people to look at national emergencies. i recall governor swai schwarzer being upset with the federal government. fire suppression has been cut. if we look at fires and natural disasters, we are not getting a we paid for. we are a donor state. we lose $30 billion to $100 billion each year. and we have to pay for fire support? we lost $32 billion. we have to beg for $200 million. it's a horrible deal. brian: he says california pays

11:45 pm
brian: guilfoyle. she has the intellect, the background. she can talk -- jesse: you want to go to the bar with someone with an intellect. brian: i get tired of talking about myself. so i would think that. jesse: i have had drinks with both of them. i am going to go with kimberly. gutfeld likes wine and he is a lot of fun, too. brian: gutfeld, better body. jesse: hardest worker at fox? jesse watters or brian kilmeade? you seem offended. you do the two hours in the morning, then a three-hour radio show doesn't necessarily make you a harder work.
