that's what that case is about. it's sort of a legal battle right now, mueller's team wanted a delay based on some sort of technicalities over whether the summons had been actually obtained by the folks -- rob: i guess the russians helped to deliver the summons, right? >> the russian government looks at it. russian government is not going to do us any favors as they haven't done favors in a long time and will not assist with that unless absolutely required. the manafort case, you know, if you look at both of these in a sense, it's what special prosecutors do, it's what mueller and his team in a sense are doing what we always see special investigations do, they range all over the place. at a certain a point they

collect mass in terms of resources and time they've invested, budget they put into it that they are all over the place looking something essentially to justify their existence. rob: right, in this case, paul manafort who, you know, a lot of people on the left thought behind the grand collusion theory that they have, that he was communicating with the russians, trying the swing the election this way and they find bank fraud case from what, 13 years ago now and this judge, one judge who was actually a reagan point' says you can't use this to try and make a case here, this is too old, right? >> you have a reagan-appointee judge making those comments and really in unprecedented fashion and publicly talking about, you know, what mueller's team is doing here and the reason why they are going after manafort which, again, has really nothing to do with the collusion issue. the judge making the comments

primary races in four key states, republicans in indiana, west virginia, ohio and north carolina will pick their candidates for congress tomorrow and the stakes are pretty high in some of the cases, what should with look out for, here the break it down for us, scott, thanks so much for coming on this morning. we start in west virginia where we have an interesting race and we have a very vulnerable seat that's held by joe manchin. >> joe manchin has been elected for 36 years, donald trump won the state by 42 points. this is -- rob: shocker. >> this is what makes him vulnerable. the question is there's three republicans in the primary, jenkins, morris and blankenship, jenkins, clearly toss-up race, very competitive, manchin will have hands full.
