that. >> you can count on me for that. >> thank you, walter, dr. drew. i'm greg gutfeld. i love'l you, america. fox news learning of a possible end date to robert mueller's russia investigation which just entered its second year as president trump calls for a new investigation into possible fbi infiltration during his 2016 campaign. i'm rick le leventhal. this is the fox report. rudy guliani telling fox news that robert mueller could wrap up his russia investigation by september 1st if mueller and his team are able to interview president trump by the middle of july. this coming as the president demands an official investigation into whether the fbi or doj surveilled his 2016 campaign for political purposes after reports that an fbi informant contacted members of his campaign.

allison barber joins us from the white house with this breaking news. did guliani say anything else about this inform plant? he said he spoke with president trump last night and this morning. he says he spoke about the situation with the fbi informant. guliani is telling us that he wants to conduct a confidential interview with this informant and he thinks that a president special council interview should be contingent him getting to talk with this informant. he said he needs to talk to the informant so he knows what information that informant told special council mueller. rick. >> rick: the president has plenty to say on this topic. >> reporter: some of this started last night when president trump tweeted and called on the department of justice to release documents related to this informant. he said that in order to find conclusive answers and information on what actually happened here, that those

documents needed to be reviewed and released. he is now saying that he's going to make an official demand tomorrow, tweeting i hereby demand and will do so officially tomorrow that the department of justice look into whether or not the fbi/doj infiltrated or surveilled the trump campaign for political purposes and if any such demands or requests were made by people within the obama administration. when reports surfaced about a secret fbi informant, the president suggested the informant was a spy and possibly there for political reasons. the new york times is reporting the fbi sent an informant to talk to two campaign advisor, but, quote, only after they received evidence that the pair had suspicious contacts linked to russia during the campaign. republicans on the house intelligence committee as well as some of the senate judiciary it committee are saying they have many questions they want answered in regard to this. the top democrat on the house intelligence committee is saying all of this and the

president'sal lee gas stations in -- president'sal lee gas ga n particular are ridiculous. >> i want to make sure the fbi and department of justice did not try to change the outcome of election. >> what they would like this information for is to be of service to the trump defense team and further any narrative they have. this is part of a string of meritless allegations from the very beginning. >> reporter: the doj released a statement moments ago. it says, quote, the department has asked the inspector general to expand the ongoing review of the fisa application process to include determining whether there was any impropriety or political motivation in how the fbi conducted its counter-intelligence investigation of persons suspected of involvement with the russian agents who interfered in the 2016 election. the deputy attorney

general issuing a statement saying, quote, if anyone did infiltrate or surveil participants in a president campaign for inappropriate purposes, we need to know about it and take appropriate access . we reached out to the white house. so far, we haven't heard back. >> rick: we need to know what that appropriate action will be. allison, thank you very much. for more on this, let's bring in jeff mason, white house correspondent for reuters. thanks for being with us on a busy news day. this is a pretty significant development, is it not, that that robert mueller telling rudy guliani he will finish this investigation by september 1s september 1st. >> absolutely. it's significant for both sides. it's significant for the investigation and it's certainly significant for president trump and the white house. it would be positive of course for president trump and the white house going into the midterm he'l elections in novemo have this behind them and as far

as the investigation itself, clearly according to guliani it's contingent on them getting access to the president and having an interview with him and that's something that they've been seeking. so there could be a win-win for both sides but certainly very interesting that they are willing to say we could get this all done by september if you give us time with the president. >> rick: it sounds like they will get time with the president based on what rudy guliani is saying, although he is on record cautioning against mr. trump speaking with mueller unless and until they know more about this mole that we've been talking about, suggesting that the president might be walking into a trap. what do you think about that? >> sure, guliani has certainly set conditions of his own for giving the investigators access to president trump. but i agree with you, that it's sort of a bit of a departure from the words that we've heard from him so far, suggesting now that it seems more likely that he will sit down or will give -- the president will sit down with

robert mueller's team. so the lawyers who are add a adg president trump have to weigh the pros and cons of doing that. perhaps one of the bigger pros that they see is the fact that that might be takee et to getting this finished by early fall. >> rick: the president complained this was a witch hunt. does the presence of a mole support his argument in. >> i think that that's an argument he would make if that is proven to be the case and that's something that obviously guliani addressed as well and president trump addressed on twitter earlier today, that's something they'll be hammering on for sure and that's also one of the conditions that the former mayor has set for giving access to the president. >> rick: the trump team knows who this guy is. we're not releasing his name. they know who he is. how concerned do you think they are about this? >> it's hard for me to gauge that. the fact that they want access to this alleged mole to find out

what he said about the president suggests that they don't know what he may have said or shared, so that perhaps is something they're really concerned about. perhaps it's not. but it's clearly something they see as a bit of a bargaining chip. >> rick: we saw the president's tweet calling for an investigation of the fbi and doj. rudy guliani said there should be a criminal investigation for james comey for perjury, in part related to what the mole said and when james comey said the investigation started but apparently with this mole talking to someone before that date, it suggests that perhaps the investigation was started far before that. >> well, it plays into certainly president trump's long now sort of documented skepticism about thfbi in general. he's been critical of the fbi since coming into office and before for the way it handled

the investigation into hillary clinton and her e-mails and this for the president, i think for the people who support him, is further evidence that they haven't treated him fairly. that said, the counter argument to that is that the -- whoever this gentleman is, the alleged mole didn't do anything he wasn't supposed to do and that the fbi has been conducting the investigation in the way that it is -- has a mandate to do. >> rick: this interview would be critical, not just for the investigation but for the white house and we know that they're preparing for a lot of other things including the summit with north korea and say they're trying to prep for a meeting with robert mueller would be a distraction. is that part of the reason they're looking for an independence day time line for the sit-down? >> that's right. president trump is juggling a lot of things right now, one of which you mentioned, is this potential summit with kim jong un in early june. if that doesn't get canceled.

but assuming it does go ahead, there's a lot of preparation that's required to go to that. that will be a historic meeting the north korean leader and the president, if he does have a sit-down with robert mueller's team would absolutely need to prepare for that. there's a lot of things that he would have to go through with his counsel and so that makes sense really that guliani has said this was something that would happen maybe around july 4th to make sure that it's after that summit and gives the appropriate time and enough time for the president and his advice re -- advisors to prepar. >> rick: one of the arguments we've heard is this could be a breach of the campaign's private communications, that's what rudy guliani is suggesting. >> and again, if that's indeed what happened, i'm sure those are questions that they will ask and i can't address that myself, not having any intel into what happened there but i'm sure that's something that the president's team will be pushing for information about. >> rick: i'm wondering if there is buzz down there about something else that was -- that

surfaced today. some republican leaders are demanding records from the justice department about the mole and other aspects of the investigation and representative devin nunes threatened to hold jeff sessions in contempt of congress if he doesn't pony up that information. >> yeah, what i think is interesting about that, and president trump has also weighed in and supported that request, that just shows, again, the increased tension between now both the administration or the white house, president trump, and his attorney general and some members of congress. >> rick: some people may forget that bob mueller is actually a republican and rod rosenstein his appointment came from this president. does that matter at this point? >> i think it does matter. i think it matters because of the context. the president frequently when describing this investigation as a witch hunt criticizes the makeup of the mueller team as saying that they're biased to democrats. it's very important i think for people to remember that mueller is in fact a republican and that rosenstein was appointed under

>> rick: family members of the suspect accused in friday's deadly rampage at a texas high school say they're as shocked and confused as anyone else after the a attack left 10 people dead, reigniting the debate over guns and school safety. dan patrick says students and teachers are still vulnerable. >> schools that are not hard targets, we've done a good job since 9/11 of protecting government buildings and airports and private buildings, but we have not done anything to harden the target at our schools and we still have this gun debate, george, of whether or not teachers should be armed or not. students and the parents i talked to friday in the hospital of a wounded student said if one teacher in particular they think, a marine that was next door to the shooting, had the ability to carry a gun he may have been able to stop that. >> rick: casey siegal is reporting from santa fe texas tonight. the first funerals began today,

i understand. >> reporter: yes, rick, they have. out of the 10 people who were murdered on this high school campus on friday morning, one was a foreign exchange student from pakistan and she was just 20 days shy of finishing up her school year here in texas and planned on returning home to her country and her family. an honor student with hopes of one day becoming a diplomat and today the mayor of houston, other dignitaries, friends, perfect strangers coming together for a memorial service. she made strong friendships during the time she called texas home. >> she was so loyal to her faith and her country and she only had good things to say about everybody and she loved her family and couldn't wait to see them and she loved them and she

was the most amazing person i ever met. >> reporter: her story just one of so many lives forever impacted by friday morning's attack as this community will carry out funeral after funeral after funeral in the coming days, burying kids and teachers instead of signing yearbooks and looking forward to their summer vacations. rick. >> rick: casey, we're getting new information tonight about the gunman's behavior during the rampage? >> reporter: chilling information, frankly, more students are starting to open up about the horrors that they witnessed and heard inside of that school during the attack which lasted a little more than 30 minutes. can you imagine? it was primarily contained to the school's art complex but multiple accounts now saying that the teen mocked and taunted his victims, yelling surprise, cheering at times. one girl described hiding in a

president trump's attorney rudy guliani telling fox news that robert mueller could be wrapping up the russia investigation by september 1st if his team is able to interview the president by mid-july. this comes as the president demands an official investigation into possible fbi infiltration of his 2016 campaign. let's bring in robert degrees d. thank you for being with us. how significant is this development? >> well, i mean, i think it's good to have at least some proposed end date. i would imagine just in dealing with any prosecutor there's no way that end date is as firm as guliani is making it sound. i'm sure there are a lot of caveat toss that that presuming there is no new information and presuming the president's interview goes expeditiously in july, maybe they could wrap it up by september 1.

>> rick: what's rudy guliani's motive to get this wrapped up by september. >> there's a political angle to all these cases. getting this wrapped up for the president's sake, taking this off the table, he's probably confident that there's not going to be any kind of collusion, in quotes, kind of charge and then he wants to take care of the obstruction of justice issue through an interview and be done with it. so i think he wants to at least provide an end date for the public and then provide an end date for his client to get it behind him. >> rick: you've represented a lot of clients in a lot of high profile cases. if president trump was your client, what would you advise him as he approaches this possible interview with bob mueller? >> you know, the client is entitled to do what he wants. presuming he ignored my advice not to testify at all or not to meet with him at all, which try to narrow the issue as much as possible and remind the president to talk only about what he personally knows. the president at least in public seems prone to sweeping statements, lots of always and

never and things like that, which make lawyers like me very, very nervous. and try to work with him a little bit to talk about what he knows, that if he doesn't know about anything, if he doesn't know what he doesn't know. he also doesn't know what may have gone on with other people on his staff and to draw that distinction so he doesn't make over-broad statements that get him into trouble. >> rick: your advice would be don't say anything, don't sit down with the prosecutor? >> i did not -- i don't see the benefit of doing it. the special council could still write the report without interviewing the president. they might draw adverse inferences. i think he can deal with that politically. i don't think there's an upside for it. i would not especially given his demeanor, i think he can be -- his skin can be gotten under fairly easy. i would not want to subject him to that type of interview unless it was very, very narrow and i had a long time to prep him very

well. in the first instance i would say he shouldn't be doing it. >> rick: as we've seen, robert, these kinds of investigations and these kinds of interviews can often veer drastically off topic. bob mueller could start by asking him about russia and could wind up asking him about any number of things potentially, right? >> yeah, he could ask about stormy daniels, about payments by cohen, he could ask about lots of different things. i think the president which is a good political skill has a way of cutting to the chase, cutting to the end game first but that's difficult in an interview situation with a prosecutor where you have precise questions, you have to give narrow answers to. >> rick: once he agreed to the interview, can he then not answer certain questions? >> it's a voluntary interview so obviously his lawyers and presuming that guliani will be by his side can interrupt or consult with him during the interview and presumably they worked out ground rules in advance that these are the topics generally we're going to

go over, this is the time limit and most interviews you're allowed to consult with your lawyer during the interview. that's the benefit of doing a voluntary interview versus going to a grand jury. he could consult with his lawyer during the interview. the question is would he. and i doubt he would. that's the problem if you represent him is he's going to answer the question as he sees and, again, i would be nervous about his penchant for overstatement sometimes where he gets the gist of something right but tends to be overstated a little bit. >> rick: as a former federal prosecutor it would seem that rudy guliani would be the right man for this job, to sit next to the president during this potential interview. >> whoever he has sitting next to him, i sure it would be guliani and others, are going to have to be pretty aggressive in terms of keeping things on track. it's a high risk strategy to bring him in at all. if they're going to do that, i

would be pretty vocal about making sure i interjected my selfs a few times to keep things on track and keep the president on track as much as the questioner on track. >> rick: what about this call by the white house for an investigation into the fbi and the doj? >> well, it's funny, i saw a lot of kind of controversy about that online as i was waiting here. to me, other than he's president, it seems fairly routine. a lot of people under investigation complain the doj or fbi did something wrong while they're being investigated and the inspector general cysts for tha-- existsfor that region. i think i saw the doj agreed that they're going to ask michael horowitz, the inspector general, to expand his investigation to cover whether or not there was any misconduct with respect to this confidential informant or spy,

depending on one's point of view. to me, that's a fairly -- it's odd that the president made the request but it's not that the i.g. would look into something at doj. >> rick: if the president is watching and he often does, what would be your final thoughts to him about this particular matter, this possible interview with robert mueller? >> i would just say listen to your lawyers, your instincts are great on lots of things but this is something where you listen to the experienced people. if you have trust in rudy guliani, listen to him. and really take his lawyer's advice to heart, they have your best interest, mr. president. >> rick: thank you for your time tonight. >> thank you. >> rick: and the free legal advice for the president who may see the end of this russia investigation which he's been calling for by september 1st, if everything else goes according to plan. thank you again. >> thank you. >> rick: now to another top story this hour. steve mnuchin saying the u.s. will now hold off on china tariffs after president trump

and china's president reached a tentative agreement to close the u.s. trade deficit. the deal averting a potential trade war between the two countries with the world's biggest economies. mnuchin calling it meaningful progress. >> we agreed on a framework, which is important to understand. and the framework includes their agreement to substantially reduce the trade deficit by increasing their purchases of goods. we also discussed very important structural issues that they're going to make in their economy to make sure that we have a fair ability to compete there. and also, protections about technology. >> rick: garrett cheny has more on this from washington. >> reporter: rick, at least for now the trump administration is putting its trade war with china on hold. today the white house said that the two days of trade talks this week went so well, they decided not to impose tariffs on chinese products while the negligence ns play out. the trade deficit last year was

roughly $375 billion. in the first round of negotiations, both sides agreed to cut that by more than half. as the negotiations play out, the u.s. is pushing china for help with north korea ahead of president trump's summit with kim jong un. on fox news sunday, steve mnuchin said that issue will not influence the trade talks. >> i don't think we're going easy on the trade talks at all. we have a very good framework agreement that's not just about buying goods. it's about structural changes. it's about lowering tariffs. >> reporter: the white house is pushing back on suggestion that's it's looking to help zte in order to get concessions from china on trade. today the president's economic advisor larry kudlow said the two are separate issues and argued that any changes will not jeopardize u.s. security. >> let me just say with as much clarett a -- clarity as possibl, if any of the remedies are altered they will be very, very tough. the question is whether there are perhaps some small changes around the edges. i think president trump is doing

this because there's some very good feeling between him and china. >> reporter: in terms of where the trade talks go, they plan to look at areas the u.s. wants to see more trade in, such as energy and agriculture. >> rick: hillary clinton at yale law school speaking to graduates and alu alumni at the annual cls day. the event included awards for academic, artistic and athletic accomplishment as well as a celebration of undergrads. clinton urging unity in the face of heightened partisanship, while taking a few jacks at president trump. >> i still think that understanding what happens in such a weird and wild election in american history will help us defend our democracy in the future. whether you're right, left, center, republican, democrat, independent, vegetarian, whatever. [ laughter ] >> we all have a stake in that. so today as a person, i'm okay

but as an american i'm concerned. >> rick: another ivy league school looking to honor mrs. clinton. harvard will award her the radcliffe medal for her, quote, transformative impact on society. mrs. clinton will receive the award on friday as part of the school's graduation week activities. republicans taking aim at missouri senator claire mccaskill. she is seen and one of the most vulnerable democrats in the upcoming midterm he'l elections. the challenger could be facing his own problems for handling of a criminal case surrounding the state's republican governor. matt fin has more on the missouri election. >> it's a tough situation for the state. it's a sad situation for the state. >> reporter: republican state attorney general josh holly wants to show voters that despite political turmoil over scandals involving the republican governor, he is the best candidate to unseat veteran democratic senator claire mccaskill this fall.
