rob: new questions of constitutionality surrounding the mueller probe stemming from the appointments clause. jillian: here to actually what that is and whether it has been violated, judge andrew napolitano. explain this so everyone can understand. judge napolitano: clause of the constitution that says officers of the united states, federal judges have to be appointed by the president and confirmed by the senate. some supporters of donald trump, even academics, that robert mueller is an officer of the united states because of the independence he has had because he wasn't appointed by the president and wasn't confirmed by the senate his office is

illegitimate and his behavior is unconstitutional. jillian: is a true? judge napolitano: no. that flies in the face of the supreme court opinion that says he is an inferior officer of the united states, an officer of the united states has no boss. an inferior officer has a bosc, his boss is rod rosenstein. because he is an inferior officer he doesn't have to be appointed by the president or confirmed by the senate. this is a very late in the day argument because this ruling describe to you as 30 years old, that is how well-settled the law is so those who are saying his office is illegitimate are following the dissent of the case, the dissent was written by my late beloved dear friend justice scalia. the majority rules. rob: arguments like this don't make republicans look good because it makes it appear democrats would argue they are trying to obstruct the investigation, makes it look like the trump campaign has something to hide if they are trying to get something like this -- judge napolitano: i agree with
