courage for their extraordinary note of valor. they were deployed in places like iraq, afghanistan sniffing out bombs and ieds. i'm dana perino. here's trace gallagher in for shep. >> president trump meeting with cops, congressmen and others on new york's long island talking about how to take on one of the most notorious gangs in america. the president also focused on another issue today. the russia investigation and reports of an informant talking to some of his campaign advisers. the president call it's it spygate. now james comey is responding. we're also monitoring new developments with major players including the president's former campaign chairman, paul manafort and his personal lawyer, michael cohen. and secretary of state mike pompeo opening up about moscow's election meddling, the north korean nuclear summit and what to do about iran.

that's ahead in this hour of "shepard smith reporting." i'm trace gallagher in for shepard smith. the president is calling the attack on his administration spygate. >> there's never big anything like this in the history of our country. >> trace: the president has been tweeting about it. james comey responded on twitter quoting "facts matter. the fbi's use of confidential human sources, the actual term, is tightly regulated and essential to protecting the country. attacks on the fbi and lying about its work will do lasting damage to our country. how will republicans explain this to their grandchildren." president trump hit back saying he did a great service to this

country by firing the former fbi director. earlier this week, president trump demanded the justice department investigate whether an informant spied on his campaign for political reasons. "the new york times" reported the fbi sent the informant to meet with trump campaign advisers because their suspicious contacts linked to moscow. rod rosenstein agreed to have the deputy general investigation. now justice officials are set to hold a briefing tomorrow about highly classified material on the fbi informant for house intelligence committee chairman republican devin nunes and house oversight chairman republican trey gowdy. democrats did not get an envied to the meeting. the white house says they didn't ask. now they are asking. the chief white house correspondent john roberts is live for us at the white house with more. john? >> good afternoon, trace. president trump has left on this

idea that there was an fbi informant that made contact and had meetings with three trump campaign officials in 2016. those officials are carter page as well as george papadopoulos and sam clovus, what was a conservative radio voice out of iowa. now attention turning toward this meeting at the department of justice tomorrow. that will involve as you pointed out the chairman of the intelligence committee, devin nunes and the chairman of the government oversight committee, trey gowdy and o'callahan. the department of justice will be there with chris wray, the director of the fbi and dan coats, who was the director of national intelligence. the president in a meeting monday in the oval office with rod rosenstein and christopher wray directed the department to work with nunes and gowdy to get them access to documents they had been looking for.

john kelly was also in the meeting and the day after called the doj to set all of this up. on his way out of town to go to the ms-13 roundtable, i asked the president about setting up that meeting. here's what he told me. >> i want them all to get together. everybody wants this solved. a lot of bad things have happened. we now call it spygate. you're calling it spygate. a lot of bad things have happened. i want them to get together, sit in a room and work it out among themselves. >> no democrats were invited to the meeting, which they have been making a big deal about. the senate minority leader, chuck schumer said it smacks of banana republic politics. listen to schumer. >> leader pelosi and i are sending a letter to attorney general rosenstein and director wray to request they reconsider holding the meeting at all.

if they move forward, to do so in a bipartisan fashion. with the gang of eight. if the meeting goes forward as planned right now, only partisan, only the worst actors on the house side in the room. no one should trust anything they say coming out of that meeting. it will be a sham. it will be a sham. >> schumer may be complaining about nothing. sources tell fox news the chairman, gowdy and nunes are not expecting to get much out of tomorrow's meeting. they don't expect the department of justice is going to produce the documents that they want in regards to the fisa application that launched the russia investigation against the trump campaign. they do not expect to get documents about the fbi informant and what he or she may have told the mueller investigation. so this could be a big bunch of nothing tomorrow, trace. >> trace: what more do we know about the judge that ruled that president trump can't block

anyone on twitter? >> yeah. this was a case that was bright by the columbia university institution and said that they were blocked from access to the real donald trump twitter feed because they had replied with tweets that were political in nature and critical of the president. the judge ruled this case requires to us consider whether a public official may consistent with the first amendment block a person from his twitter account, response to the political views that person expressed and whether the analysis differs because the president official differs because the person is the president of the united stat states. the judge ruled that the president cannot block people from his at real donald trump twitter feed. i would expect that extends to the at potus twitter feed. the ninth circuit said we hope

this ruling will bring it to an end. i reached out and so far nothing back from them. we'll let you know in we do. trace? >> trace: what about jared kushner getting his security clearance back? >> there was a big story when jared kushner's interim top secret security clearance was down graded to secret in the wake of the rob porter fiasco where he was granted a security clearance here at the white house or given interim security clearance despite the fact that he had faced allegations of spous spousal abuse. now jared kushner has his top security clearance. the fbi completed his file and submitted to the white house personnel security and he has that security clearance. his attorney in a statement a short time ago saying "as we

stated before, his application was properly submitted, reviewed by career officials and went through the normal process. having completed the processes, mr. kushner is looking forward to continue the work the president has asked him to do." it's significant, too, to consider that the fbi vetted him thoroughly and likely given him in this capacity and given all of the other stuff out there, regarding jared kushner and the russian investigation and the president and his connection to the president and his dealings with his former companies, this would have been vetted at a high level and the fbi didn't find anything that caused red flags for the white house office of personnel security to deny him a security clearance. so the implications of this may go beyond just the fact that he now has a top secret security clearance. we're likely to hear that from supporters of the president though. i have to tell you, folks here at the white house are zip-lipped about this. nobody ain't saying nothing

about this. trace? >> trace: john roberts live for us. thank you. let's bring in a.b. stoddard, columnist for real clear politics. i thought that that is significant. the white house is not talking but they're saying the only reason his clearance wasn't upgraded is because of the backlogs of the administration. like john roberts said, this had to be vetted at the highest levels and yet they gave it to him. >> yeah, it is significant. he has never had a full clearance. it's not as if he had one and it was revoked. it was always interim. never a complete clearance. that's because jared kushner failed to disclose a bunch of contacts with foreign officials. he had to amend it numerous times. that actually dragged out the process. the fact that he just sat with a special counsel we learned today for another seven hours in april

talking about all of his foreign contacts, stuff he did during the transition and since he's been -- and obviously during the campaign and since he's been employed in the white house as one of the president's top advisers makes it clear they have determined that none of those contacts and none of those discussions were relationships that prevents him from having a full clearance. that's great news for jared kushner. >> trace: you can bet in the hours and days ahead, there will be a lot of talking about this and boasting, this looks good for them. i want to move to the meeting tomorrow that nobody is happy about. you have trey gowdy and devin nunes saying we're not going to get the documents that we want. then you have the democrats saying we weren't invited to this thing. we weren't invited the reason why is because you didn't ask to be invited and now you have schumer saying this is a banana republic. what do you make of it? >> well, there's a lot of

questions about the president intervening in an investigation into himself and his associates and asking the justice department to come in and start revealing things that could include sources and methods. there's a question about that. that's why people are saying this is the kind of thing that dons banana republics. the idea of not having the democrats is foolish. makes it looks like they're using this intervention for political purposes to help the president and just to muddy up the narrative on this investigation. if they really have serious concerns, they will include as they always usually do these eight people, usually always included. the democratic and republican leaders of each chamber as well as the democratic and republican leaders of each intelligence committee. you have today republican senators cornyn, grassley and graham saying we'd like to come,

>> trace: president trump calling for tougher immigration laws on long island today. >> criminals have infiltrate our communities. >> trace: the president meeting with cops, gop congressmen, victims:gang violence and others. long island has been the site of several brutal murders linked to ms-13, a notorious gang that has roots in central america. the american civil liberties union accused the president of using policies that hurt all immigrants. bryan llenas is in new york where the president held the roundtable discussion. brian? >> the president made a point to say there's not much more they can do when it comes to fighting ms-13. he called our immigration laws broken. the ms-13 roundtable, this is the second time that he's been here to long island to discuss

ms-13. it's a progress report. there's police commissioners here that spoke about the arrests, the amount of ms-13 arrests have doubled under trump and the deportations of gang members have reached some 11,000. they talked about the need for more funding to continue to fight ms-13. also in attendance today, the department of homeland security secretary and the ice deputy director that talked about loop holes that allowed unaccompanied minors to fall in the happened of these gang members and talked about loop holes in our laws and say the government cannot bar gang members from entering this country, this is what trump had to say about central american countries. he called them out for not doing enough on stopping people from coming here. >> we're going to work out something where every time somebody comes in from a certain country, we're going to deduct a rather large amount of money for what we give them in aid, if we give them aid at all. >> trump talked about politics,

a lot of hoopla about him calling ms-13 gang members animals. he took a shot at house minority leader nancy pelosi that said that calling people animals is not a good thing. this is what he had to say. >> i called them animals the other day. i was met with rebuke. they said they're people. they're not people. they're animals. we have to be very, very tough. >> trace: among those in the roundtable, two teenage girls that were butchered here in long island, cut to pieces. gives you an idea how brutal this gang is. >> trace: we mentioned the aclu said the president was using this and hurting all immigrants. there were also protesters out there today. >> yeah, about 100 protesters. they and democrats are saying that the president believes all

>> trace: two area force pilots ejecting safely from a jet action it crashed to the ground in a training mission in mississippi. that's according to air force officials there. they say it happened this morning near columbus air force base, about 140 mile northeast of jackson. the pilots went to the hospital for medical evaluations. they were flying a t-38 c talon like this one. the air force uses that jet to

train fighter and bomber pilots. the nfl will not require players to stand for the national anthem during its next season. but throes that make that choice will not be allowed to stay on the field. commissioner roger goodell says that anybody doesn't want to state with wait in the locker room. the league is changing a rule requiring all players to be on the field during the anthem and will fine teams who players are on the field and that don't stand. players said it was their way of protesting police brutality. critics and president trump called them unpatriotic. the players association said they were not consulted about the change and will challenge it if necessary. developments in legal cases facing two men with ties to president trump. michael cohen and paul manafort. michael cohen is responding to a

report that his business partner has flipped and agreed to cooperate with federal prosecutors. laura ingle is live with more. laura? >> there appears to be a longstanding relationship with michael cohen and another man. "the new york times" records that friedman has agreed to cooperate with the federal prosecutors, which could be significant. the russian immigrant was arrested last year for skipping out on more than $5 million in taxes. he was facing decades in prison with this. instead he's pleading guilty to pay $50,000 and avoiding jail time entirely. his lawyer giving this statement to fox today. mr. friedman has a longstanding relationship with mr. cohen and considers him his friend. mr. friedman has accepted responsibility for his past actions. i have no comment on the details of my client's plea agreement or

what if any impact it may have on others. there's reports that friedman managed taxi cabs for cohen for years but cohen denies they were partners. he tweeted that i'm one of thousands of medallion owners that trust owners. gene friedman and i are not partners and have never been partners in this business or any other. #mediawrongagain. "the new york times" reporting that friedman contacted one of their reporters calling it shameful and michael is a dear friend and a passive client. that's it. when asked if he was cooperating with authorities, friedman would nod respond. >> trace: no response. and former campaign chair for trump, paul manafort was back in court. what happened there? >> this has to do with seizures of paul manafort's properties.

>> i'm lea gabrielle with a fox report. more on today's headlines. a suspected gunman is dead after a shootout and standoff with cops in panama city, florida. the sheriff says they're blessed they didn't lose more officers and citizens. the suspect's apartment was soaked in gasoline and he was wanted for a deadly shooting in a neighboring county. a tractor trailer packed with 80 undocumented immigrants. a local tv station reports many of them were dehydrated and some went to the hospital. investigators arrested the driver and a passenger. and heavy rain and hail slamming paris. this is what one of the city's subway stations looked like as flood water flows down the stairs from the street.

unambiguous. i could not have been clearer about the scope, the verification work, all of the elements that would be necessary for americans to understand that there would be real denuclearization. >> trace: the secretary of state met with the dictator in knot cree last month when he was still the cia director. pompeo said a meeting with trump and kim jong-un is still set to happen but it's ultimately up to kim if it does. yesterday the president said there was a substantial chance the summit would be cancelled. rich edson is live at the state department with more. rich? >> trace, secretary of state mike pompeo is just finished a meeting with a top chinese official here at the state department. spoke afterwards and he says the state department officials are still driving towards a june 12 meeting between president trump and kim jong-un. the secretary of state refuses to give any type of chances on whether it's going to happen.

yesterday the south korean government put it at 99.9%. the president put it at less. he testified in front of the house foreign affairs committee. he was asked whether north korea under any agreement would be allowed to maintain a civilian peaceful program. the secretary said it wouldn't be appropriate for north korea to have a capacity to enrich and whether that would be part of a final deal, he can't answer that right now. trace? >> trace: and rich, the secretary of state says the u.s. will fight russian election meddling, right? >> that's what he says. he says they're already working on it at the administration level and the administration will take appropriate counter measures to combat any type of russian interference. he did note the administration still has work to do. >> we have not been able to achieve deterrence, effective deterrence of the russians. but this administration has taken enormous efforts to push back against russia that haven't been done in a long time.

either here in the united states or from our partners that are more threatened by russia than we are in europe and elsewhere. >> trace: the top democrat says he worries this administration will give russia a pass because russia supported -- or president trump over hillary clinton in the 2016 election. to that, secretary of state pompeo says this administration is "light years ahead of the previous administration in countering and combatting russia." trace? >> trace: thanks, rich. let's bring in dr. rebecca grant. she's president of iris independent research. good of you to join us. i'm not sure if you heard rich edson there. the june 12th date as far as mike pompeo is concerned, that is -- he wants it to happen on june 12, but he's saying look, if the deal is bad, if the negotiations goes south, the president needs to be prepared to walk away.

>> yes. secretary pompeo told congress that we're not going to accept an ugly or a pointless deal. like you, they are driving for june 12. it's significant that they met with china. south korea says it's going to be on. we're not going to know for sure though until the u.s. south korea war games end here in a few days. i expect north carolikno north unless china tells them not to. >> trace: and mike pompeo said that china drove this to the goal line. that i were very instrumental in making this thing happen. then he's saying i hope china does help us get over the goal line indicating that maybe china is getting in kim jong-un's head a little bit and saying, you know, you can get more concessions if you play a little bit of hardball with this. is that your take on this? >> you're right. the key event came last year when charge told north korea

that if they attempted military action, china wouldn't help them. china has been supportive. now china is feeling their own way to see where north korea could end up. mike pompeo knows for than he can tell us. he spent time with kim jong-un. he has cards that he can't show. it's good for pompeo and for president trump to undersell expectations right now. that way when things go forward, it will look even better. you know, if it doesn't happen june 12, they're saying it will happen later. south korea has been very clear on that. i think china is continuing to support this drive. we see south korea saying that north korea is on track for denuclearization and that test site blowup may be step one. >> trace: quickly, dr. grant, you take, june 12, does it happen? >> yes, i think we'll see june 12. as trump says, if not june 12, a few days later. kim jong-un will be add that summit. china can't give north korea prosperity.

30 years. a move that could paralyze some of the world famous resorts. workers for the largest labor union voted to strike if they can't reach an agreement for new contracts. the a.p. reports the last strike was in 1984 and lasted two months and cost the city and workers tens of millions of dollars. the 77-year-old driver that was behind the wheel during last week's deadly school bus crash in new jersey had his license suspected 14 times. that's according to state records which also show he's gotten eight speeding tickets. investigators say they're trying to figure out whether the school bus driver was trying to make an illegal u turn. the crash killed a fifth grader and a teacher. more than 40 others were hurt. the motor vehicle commission said the driver's license was valid and he had no active points on it despite a history

of violations. it's unclear if he will face charges. a live look at lava flowing from kilauea volcano in hawaii where officials say they're taking steps at a power plants to stop toxic gas from leaking into the air. as you can see, lava creeps into the plant's property, destroyed a building there. officials say they're filling in wells with cold water to stop them from getting too hot. that should prevent them from leaking toxic gas. this video from the u.s. geological survey, lava shooting into the sky. scientists say it's hitting the oceans and causing explosions that look like fireworks. a man said a lava obama flew hundreds of yards and hit him in the leg. >> it was the most forceful impact i've ever had in any body, in my life. i've been hit by big waves and

out and get them out by air. trace? >> trace: and jeff, you've been there awhile how. how is the situation changed since you've got to hawaii? >> yeah, we got here. the focus was on the summit of the volcano, the big one that could happen what the rocks and things that could come from the summit. now the attention is on the fissures, the opening in the ground where the lava is spewing out. more than 20 have developed. several are active. in some spots, the fissures have come together and made a big lava pool. the lava flowing faster and wider streams. a few spots where the lava is entering the ocean and creating lays, steam full of tiny pieces of glass and acid. we asked first responders and geologists, is it getting worse. >> in some parts it is. if you're near the ocean or your house is the next in line to be
