development as we go. on and on. stick a big monday morning for you "happening now" it's right now. >> fox news alert now as the supreme court rules on a controversial case. the justices setting aside the ruling against the colorado baker who would not make a wedding cake for a same-sex couple. but the high court did not decide on the larger issue about whether a business can refuse to serve and customers. the ruling turning on what the court ruled as an antireligious bias when the colorado civil rights commission ruled against the baker jack phillips. the justices voting 7-2 that the commission violated his first amendment rights. in just about 30 minutes, shannon bream will join us to break down what this means. >> jon: another fox news alert as key preparations are underway for next week's planned summit

pour himself a glass of water. looks like things still on trac track. three top military lders were removed from office and replaced with younger officers that could be an indication that kim jong is looking to elimin anyential opposition to his outreach to the united states. one of those military leaders that was removed was the chief of the general staff, form a close advisor to kim's father kim jong il. the other two removed with a defense chief and the head of the army's political bureau. if after meeting on friday with a vice chairman of north korea, the president deed that the summit is back on. it's actually a week from today because today is already tuesday, or just about to be tuesday in singapore. so next monday will actually be when the meeting happens. but the president is say he is also holding an advanced a new package of sanctions that were ready to go on north korea but in singapore over the weekend, secretary of defense sa the u.s. is not going to

the president's defense team sent a message to special counsel mueller over the weekend. to tell us more about that. >> this whole issue of pardons and came up after fox news and "new york times" obtained a 20 page letter that had been written by the president outside legal counsel back on the 29th of january. in that 20 page letter to mueller was the following statement. he, the president could if he wishedo terminahe inquiry or even exercise has power to pardon if he so desired. it became a big topic of discussion over the weekend particularly on the sunday shows prompting the president to tweet this morning "as has been stated by numerous legal scholars, i have the absolute right to pardon myself, but why would i do that when i have done nothing wrong? "in the meantime, the never ending witch hunt led by 13 very angry and conflicted democrats continues into the midterms." the president is being met with some contrary legal opinions over whether he could in fact

pardon himself but either way, if he can or if he can't, rudy giuliani is saying yesterday yesterday morning saying the president pardoning himself would be a horrible idea. listen here. the prent of the united states pardoning himself would just be unthinkable and it would lead to probably immediate impeachment. the house and senate would be under tremendous pressure. president trump has no need to do that. he didn't do anything wrong. >> the president again voicing his displeasure with the mueller investigation, the fact that a special counsel was appointed at all but saying he is going with what the president tweeted this morning, the appointment of the special counsel was totally uncotional. despite that, we play the game because i, unlike the democrats, have done nothing wrong. they continue to make the argument to the special counsel robert mueller that the president cannot be subpoenaed.

if they are also still negotiating interview, though rudy giuliani said yesterday he is leaning against that idea. but a week before, said he might be leaning toward it. so i think they are vacillating back and forth ashe winds b here in washington. >> rick: we know you will be on those vacillation's. shows. this seems to be the president trying to lay the groundwork before his supporters that if he were to do something ke that, that's someing they could support. usually, you wouldn't tweet something about the need to pardon and if you weren't at least thinking about the possibility. he says at this point, he would not needed if he hasn't done me wrong in his words, but it's an interesting way that the president and his team is trying to lay the groundwork for a potential pardon if necessary. >> melissa: both he and rudy giuliani staying some incendiary things about this. it seems like they're the ones i want to keep it alive and keep it going through the midterm. they must feel like the controversy and talking about it witch hunt helps their side. >> i think so. i think the context is important here. we are in a relatively dark period with the mueller investigation. we haven't seen a lot of public actions from his team.

so there are certain things a president and his team don't know that mueller knows. so it could be an attempt to try to set the parameters of the debate and allow yourself to be able to use different options if you need them in the future. it >> melissa: by dark, you mean quiet, not foreboding. >> right, we haven't seen a lot of public activities. we haven't seen any additional public actions from mueller and his team. you talk about the timing as well, it's very interesting. this is the 500th day of the administration, the president tweeted earlier about some of his accomplishments was an interesting choice to be leaning in on some of these columns. >> melissa: it makes you feel like he wants to keep the theme of i'm doing great things but they're still chasing me down and trying to take me out alive and maybe republicans feel like that helps them into the midterm, had a vote for republicans or democrats are going to impeach him no matter what, going to try to get him no

matter what so you have to get out and vote for republicans. if you think that could be part of it? >> i do. i think that is something we are probably going to see more from the president in these rallies that we are going to see appearing this summer, this idea that there's a reason that this investigation is trying to discredit him. i think they've decided to go on offense to try to discredit the mueller investigation, try to raise questions about the legitimacy of a special counsel from the get-go. but also any findings that they might have should be viewed with a lot of skepticism. >> melissa: ken thomas, thank you for your time today. >> rick: this fox news alert from scottsdale, arizona, where police may be closing in on a suspect in the shooting deaths of four people. this act is identifying the latest victim is 72-year-old counselor and life coach marcia levine and authorities releasing that sketch of a possible suspect who may now be cornered. jonathan hunt is live with this

in our west coast newsroom. jonathan? >> good morning, major development's ongoing right now in scottsdale. just a little over an hour ago, we got word that police have surrounded the extended stay america hotel in scottsdale, alive look at that situation right now. if a lot of police were on scene and they are on now multiple local media reports coming in that the men that they had cornered in that hotel the police themselves said was a suspect in three of these four recent murders is now himself dead. we have not confirmed that news, and if indeed he is dead, it is not clear whether it was of some sort of self-inflicted gunshot wound or whether it was a result of police action. either way, the first killing in this bizarre case came last thursday. the victim was stephen pitt. he was a well-known forensic

psychiatrist who worked on the jonbenet ramsey investigation in colorado and on the phoenix serial killer case in 2,006. he was gunned down outside his office in scottsdale. the next day, to paralegals, valerius sharp and laura anderson were shot dead at a law office not far from the first murder scene. police said at the time that three murders were related although they wouldn't say how. then yesterday, another murder victim discovered that counselor and life coach marshall levine. he was shot to death in an office building. indication from cops whether this fourth murder is definitely linked to the other three. police issued a sketch of a suspect as you say and said they need the public's health and the breaking news, they have ounded hotel where they have told us the suspect is located in scottsdale. >> rick: quick work by authorities. please keep us posted on this one. >> melissa: iran's foreign

between that regime or the united states of america. to the going to pout a little bit and be upset but when it's all done, i think we're going to look back, they will have made the right decision and i think the role will be a much safer place as a result of this. >> rick: iran says that the u.s. withdraw from this fact is it legal and discredits international law. what say you? >> this is iran talking about internatl law. this is iran that steps up terrorist groups, that goes after our friends in israel, backs a regime that kills innocent people including 50,000 children in bashar al-assad. so in terms of international law, i'm not sure iran is the expert on that. in the united states has every right to make a decision on our foreign policy. the president made a decision that this iran nuclear deal was not in our best interest and congress never ratified this because the prior president, mr. obama did not want to give it to congress because he knew it would fail so it is not a binding deal and president trump made a decision in the best interest of the united states.

>> rick: he talked about this extensively during the campaign, a promise of his that he wou kill this deal, it was a bad deal from day one and that he would spike it in and he did. i'm wondering if you think that this might have a negative effect as far as accelerating iran's nuclear program? how close are they? >> they are close but i don't think it will. the difference between this and north korea, there is a military option in north korea but it's kind of unthinkable. in iran, there is a military option. they don't have the ability to unleash hell on their neighbors. we hope to never use it. i'm not saying that but what i am saying is iran knows that they cannot sprint to a nuclear deal. if whae have to do is look at iran's behavior in the region prior to the steel and post this deal. prior to this deal, they didn't really have a major presence in syria, we didn't see all the things in yemen going on after this deal, they had all his wealth that they've been able to use to try to create a hegemony in the middle east.

it's actually united our allies but destabilized a lot of the region. so what we want to do is take these arrows come up with them back in the quiver, and negotiate a broader deal that's not just nukes but also iran's behavior in the region. >> rick: the president's tough ics with north korea and the big question here is will it work with iran? >> i don't know if iran will ever say it worked. they're never going to come out and say you're tough tactics are working but the real view will be able to come back to the table eventually? it will take some time and do they sprint to nuclear weapons? i do not think you will see the regime sprint to a nuclear weapon because they know even if the president doesn't say it that we have a military option as well as israel has a military option to prevent them from ever getting there in the first place. we when we appreciate your time this morning. >> any time, you bet. >> melissa: facebook already under intense scrutiny now disputing reports of more questionable practices. by the companies as it's done nothing wrong in sharing users information. if and for democrats, the road

>> rick: a fox ns t from arona where that suspect and form writers has been found dea dead. scottsdale s.w.a.t. team surrounded a motel this morning and say when they moved in, the unidentified man shot himself. he was wanted in the murders of multiple people, including a forensic psychiatrist who worked on the jonbenet ramsey case. we are waiting on another update from scottsdale and we will bring you more information when we get it. >> melissa: fox news alert on a major supreme court ruling involving religion and civil rights. in favor of a colorado baker who would not make a wedding cake for a same-sex couple. fox news at night anchor shannon bream is live from our bureau with more details. >> i finally got a chance to read through most of this opinion now and as we talked about early on, justice kennedy really honed in on his first commission that heard this case and some of the remarks that

were made by commissioners there. for him, it was a convincing factor that they were openly hostile to this cakeaks religion. a par oat they said. a freedom of religion has been used to justify all kinds of discrimination through history whether it be slavery, the holocaust, he went on to say this, it is to be one of the most despicable pieces of rhetoric that peoplese their religion to justify their actions. to hurt other people. justice kennedy said when you're looking at this commission and making this decision, not only did i commissioners say that there were other commissioners who never spoke up, they never had any objection to those claims and throughout the proceedings, that side of the argument never disavowed those statements and for him, that was very concerning. he said you're not only disparaging this man's religion but your questioning whether he is even serious about it. he says the sentiment is inappropriate. this is justice kennedy. for a commission charged with a solemn responsibility of fair and neutral enforcement of colorado's antidiscrimination law.

it was troublesome enough to him in six of his other justices that seven of them signed onto this. justice ginsburg wrote the dissent. the justice and said we don't think these are enough to overthrow the decision from below. they wouldn't have done it but seven dead. elissa: where does it go from here? >> what they are telling us is saying the lower commission got it all wrong. he doesn't mean another one of these cases isn't going to come along and i think the court contemplates that, the fact that this isn't a stled decision and this particular case, they felt the commission below had enough of an animus against religion that they were never fair to the baker. that was in these cases with photographers, florists, i would imagine that there were others that were bubbled through the system. i have to think with the current makeup of the court and the possibility that justice kennedy may retire in president trump make it to appoint another person to the supreme court, we have no clue that he will, but given the current makeup of the court, i think lgbt advocates are going to be hesitant to try to fight another one of these all the way up to scotus because

what it is saying is this baker wins and the couple who challenged him lose this case primarily of the inappropriate comments by the commission that heard the original case. if >> melissa: is interesting in how you explain it makes it not settled law so i understand what you're saying. doesn't seem likely but it's very interesting. thank you. >> rick: former president bill clinton taking a broad swipe at president trump. clinton saying republicans in congress are circling the wagons to protect mr. trump and insulate him from the fallout in the russian investigation. >> i think they have tried by and large to cover this investigation based on the facts. i think if the roles were reversed, this is me just talking but based on my experience, if there were a democratic president, most people i know it washington believe in impeachment hearings would have.

>> rick: left to die just so let's bring in beverly hallberg, president of district media group and host of other words podcast adjunct fellow at the consulate of fox news contributor, looking to you both. so beverly, president clinton seem like he was ready for this question. does his answer surprise you? >> it does in this sense. i don't think the president should be lecturing any of us on bad behavior. especially in relation to russia. let's not forget his wife, former secretary of state hillary clinton, there are some instances of her as secretary of state that are questionable. also during her campaign questions about who financed the russian dossier against president trump and i found it was most astonishing about him calling out bad behavior is that he even said that in reference to monica lewinsky, he has never apologized to her in the past two decades. and never planes too. so we're talking about bad behavior, i think that while an

apology can't erase what's been done, it does go a long way in showing wrong and also helping the public move forward. i this interview cially for the clintons and those who are in the democratic party doing nothing to help the party, i think democrats just want them to retire quietly. >> rick: i'm wondering if you think also the impeachment talk might be premature because there is so far zero evidence of collusion on the part of president trump. as we know, robert mueller has already charged 19 people with various crimes, none of which is collusion, which is not a crime in and of itself. but three trump campaign officials have been charged and he has accepted five guilty plea is already. ere is no evidence that we have seen to date that would seem to connect to the president to that for candidate donald trump to that so far. but mueller's iestigation is not over. i think the point that clinton

was making is that there is a double standard here. and that if the house of representatives were in opposition party hands, impeachment proceedings would have already begun. i think that's the point he was trying to make badly because as bevey yst happen to agree with this, perhaps bill clinton is not the best spokesman for that argument. >> rick: maybe there are sour grapes involved. clinton was impeached by the house, but his wife lost. maybe he was looking forward to being back in the white house. >> i think both of them still want to be in the spotlight. they won't go away. they were doing these backhanded compliments to president obama which further proves there is still bad blood. he talked about the media being very friendly to obama. i happen to agree with him. i think obama does have the favor of the media because he does have liberal policies, media tends to be liberal and also he's a great communicator. i think in some ways he out termed the ultimate charmer bill clinton in the way he spoke. so you find that on multiple

levels, democrats are looking at this and saying why are they still out there speaking whether hillary clinton on the international circuit or even bill clinton coming out here and making news with stories? >> rick: he was speaking because he was promoting a book, let's be clear on that. clinton also criticized trump's use of nicknames. little marco, lion ted, and cook it hillary. and he said my mother would've whipped me for five days in a row if i spent all my time badmouthing people like this and i wonder what his mother would've done based on his actual behavior in the white house. >> that's true and what i think twitter is burning up with now is not the impeachment statement by his refusal to publicly apologize again to monica lewinsky. he said, i heard the interview that he had never apologized to her directly. but that he had apologized to the nation forward putting his behavior and putting them through all that but in a me to recommend that is just not

enough. the long overdue a policy to the woman he harmed. is in order i think most democratic women even republican women think that now. there is a consensus, and he just refuses to admit that. so he is not the democrat the democrats want to hear from right now. >> rick: so he missed an opportunity is what you're saying. he also defended the press against president trump's accusations of fake news. >> i am with him there. >> rick: what do you think about that? >> even going back to the apology angle, i both he and his wife have trouble apologizing for anything which never helps them. him talking about the president calling other people names again i think that behavior look at different things that happen in his presidency but in the news in general, people can criticize president trump for calling out i think that he is unfairly targeted often in media, i agree with the president, former president bill clinton that president obama was treated
