less then fully welcome in colorado's business community but is visited and left a lot of unanswered questions. you to discuss is federal attorney emily compare neo. justice kennedy disappeared -- disagreed with the commissioner who compared the baker as religious beliefs to those who support slavery and nazi-ism. a very nw ruling. do you agree with the decision? >> i agree with the decision. it is a total victory for religious liberty being protected from an antagonistic state. your religious liberty is protected in the realm of the first amendment for sincerely held religious beliefs from a hostile state and the heart of this decision, the baker brought, the colorado commission on civil rights treated my sincerely held religious beliefs with hostility. justice anthony kennedy agreed and said there is no place for this, the commission act was

clearly appropriate and said, clear and impermissible hostility toward sincerely held religious beliefs. rob: as carly said, a very narrow link, this cannot be applied very broadly. here is some of the ruling from the supreme court, from the majority, these disputes must be resolved with tolerance, without undue disrespect to sincere religious beliefs and without subjecting gay persons to indignities when they seek services in an open market. this ruling doesn't really apply to this statement because they did say in the future we have to look this way but how do you do that? how do you satisfy both sides? >> reporter: you are right that the court did cite that and that is the beauty of justice kennedy's practical uage, she offered the same-sex marriage decision as well saying absolutely the lgbt community should not suffer or be subjected to indignities in the open market but neither should

sincerely held religious beliefs be subject to open hostility on the part of the state. the court did not provide guidance on how lower courts should balance the interests. you are right this is a narrow runly applied to the hostility suffered here on the part of the baker and not the larger question whether sincerely held religious beliefs can legally prevent a business from doing business with a member of the lgbt community. if this case were to arise again the outcome, we don't know what that would be, the larger question, the state cannot act with hostility in its assessment of the larger question. carly: the headline is there are so many unanswered questions and if this baker or somebody else where to refuse serv based on their religious beliefs they could get sued again. the same-sex couple responded to the court's ruling, the decision means our fight against discrimination and unfair

treatment will continue. they will continue their fight and you say both sides are celebrating this as a victory. why is that? >> reporter: the aclu released a statement elevating the saying the court did affirm there is no place for discrimination in the context of the lgbt community in the open market and they cited the fact this had to do with the hostility of the state against religious beliefs. both of these parties walked away feelinghey were vindicated even though the baker was the ultimate victor in this case so it will remain to be seen how the lower courts react and how supreme court reacts should the lower cases be granted tertiary before the court yet again. rob: it will be a pickle going forward how to deal with it. appreciate it. jack phillips, the baker this morning on "fox and friends" coming up in the 8:00 hour, stay

so kids that grew up in economically disadvantaged homes, majority of the kids in the schools are 4 times the economic disadvantage, these are kids are in most cases asian, most cases are immigrants themselves, parents of cabdrivers, have language barriers at home and study and work to compete and nail this test and go on to the best high schools not just in our city and country, but specifically the kids we have these schools for and the models on which we build 8 more schools like it. >> one person said the minority versus minority, most of these schools are primarily asian and now they want to replace the asian-american students with black and hispanic students. >> it is economic background and not just family background, not just cabdrivers and hard-working immigrants but the school the kids go to and there is so much research, this is not just me editorializing, so much research
