inspector general's report. the report refew -- reviews the doj's handle of the harmed investigation. comey defied authority on more than one occasion. and thei g is critizing comey for not consulting with loretta lynch. that's the reason president trump fired comey in may of 2017. usurping the attorney general's authority. the ig will criticize comey for ignoring the suggestions.

this may force comey's defenders to reconsider a man they once called a principal defender of the fbi and doj against the president. >> i have to reciprocate what an honor it's been to serve with the likeses of john brennan and jim comey. dedicated public servients and served this country long and well. >> i do say that director comey, he came through with great sincerity. he is not a political person. >> the president himself makes accusations that turnout not to be true. who is telling the truth and who is not? most people would side with james comey. >> laura: the report tells a different tale. it will undercut comey's preaching about leadership in his latest book. >> it's about my hope they can

be part of the conversation about our values. i can be useful by offering people a vision of what ethiccal leadership lookses like. it's to offer a framework for how leadership should be and must be. >> sean: well, the ig will rebuke lynch's mishandling of the hillary clinton email investigation meeting with bill clinton just a week before comey cleared hillary clinton in that email investigation. >> do you want to come on the plane and say hello? >> was a part going no, no, turn around? >> at first my thought was, i speak to people all the time. people in public life and not in public life. >> right, but his wife was under justification by the justice department. >> she said they made small talk and nothing about mr. clinton's wife and her email server.

>> sean: -->> laura: chad about the grandkids. the report will criticize the tarmac meeting and its aftermath. this miscarriage of justice has also stunk to me. now an account -- objective authority is bringing it to life. former whitewater counsel and scott bowman and jason. they should all know whether these sources leaking the report are reliable. gentlemen, you made the all-star description at the top of the show. we are all all-stars tonight. why not? this is wild now. first, why this leak, this particular piece of information

and why now? >> i remember the inspector general mr. horowitz telling me a long time ago. he said at the end of the process when the report is written, i have to give it to the tono romo. -- attorney general and the deputy attorney general. when that happens you will see leaks. only he has seen the final report. i don't think it will say they did a really good job. >> i don't think it's going to happen either. the democrats are going to be watching this as well. lawyers as well. what comey did with the fbi and lynch before that handcuffed the fbi and the doj. the question is -- that's one in one bucket. comey's truthfulness in regard to his book and interactions

with donald trump are in a different bucket. comey puts republicans and democrats in difficult situations. >> laura: why do you think comey did not tell loretta lynch about this july press conference? >> it's incredible. there is not one criminal prosecutor at the federal level that works at the fbi. they work at the dolenc. -- doj. he can to consult with the doj. why didn't lynch recuse herself. -- doj. he can to consult with the doj. why didn't lynch recuse herself? no need for comey to become the investigator. that's a bad mix. loretta lynch said i will accept the fbi's recommendation and the fbi took and it ran beyond that. >> laura: sal, your reaction to this leak.

he was insubordinate. maybe you have heard this word used to describe a high ranking government official other than someone in the military. you don't usually hear that. what is that? defying protocol? is this just disciplinary or serious? >> it's very serious. insuborderination is not a strong enough word. why didn't he go to loretta lynch. he makes it very clear in his book. he thought the department of justice was corrupted. he thought it would hurt the fbi. he thought their investigation in some sense was corrupt. for 5 reasons he mentioned. he said i didn't want the fbi to be corrupted by that. i want the people to know that the fbi did an investigation and made its own decision.

it was a horrendous thing for him to do and violated every protocol on the face of the earth. it wasn't his job. but that's why he did it. he said president obama's comments about hillary clinton's guilt or innocence were inappropriate and said that loretta lynch it was inappropriate for her to direct him to call it a matter and not an investigation. it was inappropriate that the department of justice attorneys did not insist on getting the emails from clinton's attorneys. he had to go to sally yates and say i will call for the appointment of a special if my agents don't get these emails. they got them a day later. here's the biggest thing -- the most inexcusable thing he he presided over an incomp pent

and corrupt investigation of mrs. clinton and nothing about it. a man that did not hesitate to call for the appointment of a special when he served in a republican administration. here in a case that screamed out for a special counsel, he sat silent. >> laura: jason, from the strzok and page texts trickling out. there is one that involves. strzok said comey is so good. page, i know brilliant public speaker. yes. shafchaffetz is so phoney. talk about disdain for the other

branch of government showing their own oversight. i guess the lovebirds thought no one would see those texts. >> they don't like the expose our. they don't like somebody asking tough questions. what goes on in those texts is a conspiracy to withhold documents from congress. i should a subpoena for those materials and they were talking back and forth about how they are just not going to provide them. you can't do that. when you are working together, not only are they lovers, but they both work for the fbi. they are discussing how to withhold documents from congress. a battle we are still fighting this day. i think if a jury or jury saw that, it would be crystal clear the only reason they are holding

them back is because they didn't like chaffetz and gowdy asking them hard questions. >> laura: we have to get to the mccabe issue. he is requesting immunity for his testimony before the senate judiciary committee. we have a clip from "special report." everybody watch. >> did you know that andrew mccabe, your deputy sat on that revelation about the emails? >> i don't know that to be the case. new york and the fbi head-to-hequarters were aware o weeks before it was brought to me. i don't know if they could have moved faster and why the delay. >> see. the fact that the documents were delayed. that's a really problem. the real issue is: was it necessary for him in october of 2016 to announce or write a public document as to

whether they would open up the investigation or not? if they the documents that long, if there were copies that's an efficient review. you can go through documents quick to see if they were copies or not. we do it all the time. i am not so sure he announced that publicly to protect himself or the fbi. a month before the election, which the doj guidelines say you are not supposed to do anything to influence an election. he knew when he wrote that letter it would be some influence. despite the fact saying it was just copies later. >> laura: it's not surprising that mccabe wants immunity for any testimony on capitol hill. he is under criminal investigation. any lawyer would ask for immunity? >> absolutely. people in hell want ice water. he won't get immunity until

somebody in congress is incompetent. if he gets immunity it would put if grave doubt any prosecution of him. when congress gave immunity to pointdeckser and north it was overruled. anyone that gets imunized and then testifies. >> i don't know that i agree with. that i think they need to hear what he will testify about. the government -- the inspector general is recommending prosecution for mccabe lying. let's hear what he says and not do what the fbi and the department of justice did and hand out immunity. they handed out immunity and got

nothing for. it i think grassley should play with them a little bit. >> laura: i want to play something before we go. april of this year. comey on with george stephanopoulos. it asks about the chain of command and sending that letter right before the election. it's a full screen. i'm sorry. he was asked if asked you would you have sent the letter? [laughing]. i'm sorry. given what the ig said. he believes in the chain of mand. >> it's moot at this point. he sent the letter and didn't ask. >> laura: no! >> it was issue driven. depending on the issue, he believed in chain of command.

>> laura: do you remember how we were told time and again that it was president trump damaging the integrity of our cherished institutions? >> is the president threatening the long-standing independence of the justice department. >> his campaign to undermine the russian investigation and the fbi. >> the justice department is under a shelling from the white house. it's like london in 1941 there. >> an assault on the rule of law undermining the justice department and the fbi in ways that are shocking. >> laura: okay. well, now the shoe is squarely on the other foot. what we just learned in the past 48 hours. mccabe the former fbi director asked for congressional immunity for further testimony. the doj general report found that comey was insubordinate and criticized his handling of the

clinton email investigation and the report casts doubts on loretta lynch in that same investigation and her tarmac meeting with bill clinton. let's discuss this with a former secret serve agent and a president of judicial watch and jeff who served in the fbi and the cia. tom, it's something to hear that litany of sound bites with the grand exaggeration. it's like bombing london. come on! what we have seen in the general report, the little dribs, an fbi mishandled this investigation and didn't consult with superiors and defied protocol. >> president trump inherited a terribly corrupt leadership at the fbi and cleaned house by

firing comey. he did the right thing. they came to the same conclusion about the clinton email investigation. not the sham investigation itself, but he attacked hillary clinton to distract from the fact he was helping her. the ig tore him apart. >> laura: dan, the developments today. a lot of comments from people that were mentioned and democrats and republicans able to comment. perhaps it will be changed. your initial reaction of what we are hearing. >> well, it looks like james comey will be exposed for the phoney he was. he hid this investigation from congress for 8 months.

just so everybody is clear on this, there is a protocol for quarterly briefings to congress about sensitive investigations. they asked him, every 3 months, this is not difficult for anybody to understand. he hides it for 8 months. mr. comey, why did you hide the investigation from congress for 8 months? you will never believe this. because it was sensitive. after acknowledging they briefed congress every 3 months because of sensitive investigations. i am talking about the investigation of donald trump. comey is being exposed. horrible leadership. i hope this ig report gets the truth out there. >> laura: your former experience with the fbi and the cia. the rank-and-file agents in the fbi they don't make a ton of money and work really hard and put their lives in danger every

day. what do they think? i try to put myself in their shoes. what are they thinking when they see the circus around this hillary clinton email investigation and the collusion between russia and trump that seems nonexistent. dates not matching up. what is going through their minds? >> you know they have to be disappointed. comey, i don't believe he ever was an fbi agent. he was an attorney. he hasn't come up through the ranks. contrast to at the cia haskell who came up through the ranks. one of the under lying things is where are the whistle blowers here? one of the reasons why there are not rank-and-file whistle plowers coming forward. there is a pay system in the

fbi. they don't get the best base pay. a system rewards them with 25% of their base pay. it came law enforcement availability pay. the fbi agents have to certify that additional time has been worked. 50 hour weeks or more. sometimes these corners are cut. a great look out there called "fraud fighters," written by a former fbi agent and talks about fraud and the supervisors certify this time was worked. >> laura: you are saying they are not whistle blowers because they are afraid they will get docked pay? >> well, they had to sign extra non-disclosure agreements. they put the fear of god into

them forcing them to sign these agreements. the most important thing about the ig leak is undermines the comey investigation. >> laura: he should have been gone day 1. that's one of the few things trump could have done differently. >> this was the most significant anti-corruption act by a president in recent memory. [overlapping talking]. >> laura: dan, why is rob rosenstein still supervising mueller when he is going to be a witness? he is a witness having signed a fisa warrant that did not reveal that hillary clinton paid for that field dossier. lindsey graham was all over this and said i will recuse myself.

he should not be exercising mueller. >> laura, not only that. not only did rosenstein sign a fisa warrant. he is a material witness in the firing of jim comey which the democrats allege was the greatest sin of the trump presidency. rosenstein is implicated in spy gate and how he is still acting as the department ig is one of the great mysteries. >> laura: i worked with the transportation department and the education department and in the white house. the under-secretary positions are so important. you have bad people you for big

trouble. jeff, react to paul ryan today in his weekly press conference jumped on the gaudy spy wagon. let's watch. >> [inaudible]. >> [muffled audio. >> i don't like to comment, let me say it this way. i think his initial assessments are accurate but have more diging to do. >> laura: that's an understatement. a lot of documents are missing. no spy. what is your reaction to that? >> well, my reaction is this has always been 2 different

aproaches. when the democrats apparatus was penetrated by people outside of this country the fbi warned them together. that's not the way they handled the republican side of the coin. they decided to go ahead and call it entrapment. they didn't go into them as american citizens and say, listen, we have foreign entits trying to penetrate this and corrupt the process. they handled the republicans differently than the democrats. no excuse for that. >> laura: thanks so much. the eagles trying to deal can being the first super bowl champs ever disinvited to the white house. melania trump is back! seen and unseen next. but this t. did someone say "bold?" mitch mcconnell boldly cancelled most of the august recess. he wants congress to work. confirmed long stalled nominations. i spoke to him about those issues in in exclusive interview a short while ago. thanks for joining us. >> good to see you. >> laura: the big august recess, tell me about this. chuck schumer is fine with as long as they spend time on health care votes. >> well, we will be confirming the president's nominees. we had to file closure to speed the process up 101 times during president trump's administration to speed up the confirmation of his appointments. that happened only 24 times over

the last 6 presidents. they made it more difficult to confirm judges as well. even though we win them all, they are taking time. i will give them plenty of time. >> laura: chuck schumer said democrats have a good chance of taking the senate. your reaction to that? >> well, i think it will be competitive. if you look at the history of off year elections 2 years into any president. bill clinton lost the house and senate. obama lost the house and almost lost the senate. it will be a knock down, drag out fight. we are optimistic we will still have the majority and confirm the president's appointments. if we lose the senate, on appointments to the cabinet and all of that, i think the american people need to understand the conquences for

this administration if we lose the senate. >> laura: optimistic about the economy in the future? >> yes, the economy is roaring. lowest unemployment in decades. jobs are created. much attributeed to the tax cuts bill pass the last december. it's a great time to be an american looking for work. >> laura: why would people vote against their own pocketbooks? >> that's our argument and they hope they share our view. this is not an environment crying out for change. >> laura: republican donors said unless congress passes the daca amnesty, they won't give a penny. any possibility of immigration reform getting passed in the house and then the senate? >> i don't know about in the house. i went to immigration early this year. wide open for amendments.

the senate didn't want to pass any particular version of it. i can't see us going back to immigration this year unless there was some proposal the president is willing to sign. i don't think he is anything with anything i am seeing. short answer not on the agenda in the senate. >> laura: bob corker and others expressed their dismay over the president's tariffs. the president won on this robust economic national platform. good for the senate to take on the president on the issue of tariffs? >> i don't think so. i am not thrilled about the tariffs, but we won't be passing

something that the president can legally do. >> laura: the ig report that was delayed and is coming out has leaked parts of it saying that jim comey the former fbi director was insubordinate and defied authority in the way he handled his job. at the end he notified congress and cited loretta lynch. any thoughts on that given -- >> we are anxious to see what his recommendation will be. we heard he is a straight shooter. we know he is conducting this investigation. i have not heard about the leaks. we would like to see his report. i hope it comes out soon. >> laura: the deputy director of the fbi andrew mccabe's lawyers is asking for immunity before he

testifies before the senate committee headed by chuck grassley. your thoughts on that? >> that's certainly interesting. you could imply what you choose to implay from that sort of thing. you are a lawyer. i think it's an interesting request. >> laura: a lot of people said donald trump is calling the fbi into question. how dare he question the fbi. we love the fbi but this is the director of the fbi and the deputy director. >> i think all of these things will come out sooner or later. the ig report is something that will be interesting. >> laura: the big question for all of us court watchers is the supreme court. the decision coming out kennedy and the majority. the bakery case this week. if kennedy steps down and retires, when will the supreme

court hearings be held given the tight schedule we already have? >> the congress meets until december 31st this year. if we get a vacancy in the next month or two we will deal with it this year. >> laura: before the new court term begins? >> it will be held this year. if there is a vacancy in the next month or two, we have plenty of time to do the confirmation. >> laura: any sense that the president has narrowed down the candidates to 1 or 2 people? >> i can't imagine they are not being about this. i believe they are. if a vacancy occurs we get a nomination quickly and deal with. it's not just the supreme court. we have confirmed 21 circuit court judges in the first year and a half of the trump administration. breaking all records.

one 8th of the circuit judges have been confirmed in a year and a half. >> laura: 8 still waiting to get out of committee? >> they will all be done this year. >> laura: you hope to get them done through the august recess? >> this year. >> laura: this is the anniversary of d-day. have you spent time with veterans investigate washington. -- visiting washington. >> my dad was in world war ii in germany. he got there after d-day. it was the greatest generation. one fellow today was 100 years old. he was in the original north africa invasion and there with the germans surrendered. survived it all. >> laura: thank you very much for giving us time. in a minute how obama officials

look lawmakers in the eyes and lied about the iran deal.

a senate report shows that obama officials let iran gain access to the u.s. financial system despite testifying to congress that would never happen. joined by victor davis hanson. you wrote a whole column about this administration. before we get to the iran deal. i want to read something specific for viewers. you wrote we are slowly appreciating over the last year that lying under oath was an obama administration requisite for a high position. fbi comey lied. and:

wow! i love that column. number 1. number 2, the iran deal fit perfectly into your analysis does it not? >> yes, i think it does. it results from two things. they felt they were so moral and nobel that any means necessary was justified them to achieve them. they created an echo chamber of journalists. there was no independent audit on them. if you were charitable you would say they just misread human nature. more likely the iranians looked at that as weakness to be explo exploited. less charitable you would say they did anything to get a signature achievement before he went out of office and they had

some warped view that the irans and the shi'ite muslims deserved a second chance so there would be a new power in the middle east to battle the sunni monarchies. pulling away from israel. hezbollah and hamas and ha sad and iran. something we should tolerate. we saw the wages with that in yemen. >> laura: the iran deal giving access to iran. it was thwarted because 2 banks said no, we can't do this. it wasn't because the obama administration didn't want to give license to iran, but the bank said no. >> yes. >> laura: that is wild. >> wild or surreal. it was as if the obama

administration was advising the iranian government to circumvent u.s. law. the lefthand of the american government was at odds with the right-hand. it made no sense. that deal should have gone through the u.s. senate but there was no support even among democratic senators. only 40% of the american people thought it was a sane thing to do, and yet they pushed it. historians will argue why they did a silly thing. it shows that trump's suspicions there was not a good deal are ratified. >> laura: the same media is bashing trump first over his rocket man rhetoric. now over the way me stumbled into the negotiations with north korea. after the history with obama and what obama did?
