adapt and overcome. you don't forget. >> trace: we'll show you a program taking american heros to new heights. that's ahead this hour on "shepard smith reporting." i'm trace gallagher in for shepard smith. first lady melania trump making a surprise visit to the southern border. meantime, president trump faces backlash over his zero tolerance policy and the separation of immigrant families. the first lady visiting a shelter for undocumented children in texas. more on that in a moment. the first, the president signed an executive order to keep immigrant families together. he says it's still up to congress to solve the problem. he's accusing democrats of blocking bills to fix the issue. >> the democrats are causing tremendous damage and destruction and lives by not doing something about this. they don't care about the

children, they don't care about the injury, they don't care about the problems. they don't care about anything. all they do is obstruct. >> democrats pushing back accusing president trump of using immigrant children as bargaining chips. >> he can still fix it on his own. he created this. let's be honest, the president has used these tiny hostages, used the zero tolerance as a way to bargain with congress and force he's way into a $25 billion wall. >> trace: the house was going to vote on two republican bills. the first was defeated. gop leaders delayed the vote till tomorrow. we'll get a live vote ahead. first to kevin corke who is live at the white house. kevin? >> good to be with you. right no the plan is to extend and olive to the democrats. come here, work with us.

we're prepared to collaborate with you, willing to compromise even if that's what it takes to get something done on immigration that will benefit the american people. >> we can have a lot of people come into our country through the merit system. congress has to get together, get their act together. democrats and republicans. they have to come up with a solution. i have ideas, they have ideas. we can put them together very easily. >> perhaps they could. the problem here, trace, is there's a sense on capitol hill and in particular this is a white house that has routed democrats on a number of issues. so they're not inclined to say work with a white house that has rolled over them on a number of issues. they say turn abt is fair play. >> trace: the president called out democrats today but also called out mexico again. >> yeah, this is sort of what we expect the president to do, which is to say mexico could do.

they could do more. the problem is, you have to keep this in mind. mexico has a mass migration that's what officials sayre all the time. the president doesn't seem to be listening to that. instead, he seems to be focused on this idea that the mexican government can do a lot more. >> mexico is doing nothing for us. nothing. they have the strongest immigration laws. they can do whatever they want. they can keep people out of mexico. they have a 2,000 mile journey up mexico. they walk through mexico like it's working through central part. it's ridiculous. >> mechanic co's foreign minister describing that policy of separating children from the adults that brought them here as cruel and inhumane and calling on the international community to not remain indifferent to the plight of those trying to make their way to the u.s.

>> trace: meantime, the national security adviser john bolt is headed to russia. >> you know, a very interesting turn about. to be fr we've been expecting this to maybe happen down the line, maybe you something you do in year two or three. they're trying to get him there next week. it's not a surprise to this extent. the president has said on a number of occasion it would be good in the u.s. and russia got along. here's what he said about that meeting upcoming between his national security adviser and russian officials. >> we're looking at the possibility and with other leaders throughout the world. we're looking at that possibility. >> looking at the possibility. i can tell you, trace, if the president wants it to happen, it will likely happen and right now the betting money is it will happen sometime this year. back to you.

>> trace: now more on the first lady's visit to texas and the president's executive order aimed at stopping the separation of immigrant families. we have team fox coverage on both sides of the border. first to steve harrigan who is n mccowan, texas. steve? >> a surprise visit by the first lady. she was on the ground here for two hours. she visited with 58 children at a shelter here on the south side of town. the children aged from 12 to 17. she had pointed questions for the staff and praised their work. here's what she had to say. >> we all know they're here without their families. i want to thank you for your hard work and your compassion and kindness and leading them in this difficult time. i would like to ask you how i

can help to be soothing to them, get them back to their families as quickly as possible? >> the big question is whether there's any change in policy of charging parents criminally for crossing this border gall the departmenf justice says there's no change of policy. the "washington post" says there in fact is a shift in policy. what we can tell you here on the ground in mccallen is, 17 points were in court today and the cases of all 17 dismissed immediately. back to you. >> trace: thanks, steve. as you can see, mccallen hit hard by flash flooding. another shelter housing teenage boys separated from their families, this is in tornillo which is near the border with new mexico. that's where jeff paul is live outside that facility.

jeff? >> yeah, trace. more than a dozen mayors were here at the port of entry. they were trying to bring attention to the facilities. the white tents have children in them after being separated from their families. >> they need to get their act together. they need to develop fortitude and move forward to do things that they have talked about for over 40 years. >> that was el paso's mayor. he along with new york's mayor bill de blasio and eric garcitte and hoping to gain access. they're worried about the more than 2,000 kids. one mayor commented that kids are not poker chips and washington needs to their act together before this situation breaks up more families. trace? >> jeff paul live for it in

tornillo, texas. we mentioned the president critical of mexico today. let's go to mexico with william la jeunesse live with mo >> this is america's door step, the busiest port of entry in the country. people come from around the world to ask for asylum or upthe fence. as for the separation policy, the women we spoke with said absolutely not. if they knew that their children would be taken away from them if they crossed the border that they wouldn't do it. agents say given time it may have been a deterrent. it's a moot point now. but as for the zero tolerance policy, everybody gets prosecuted. they know it's going to be a black mark on their record and spends time in jail but they'll take the risk to get to america. that brings up the point about shelter space. that could be a problem if the u.s. is trying to hold all of those individuals in shelters

and bed capacity is being reached. back to you. >> trace: yeah, it's notable the "wall street journal" saying the issue here, the backlog in the courts for immigration, 700,000 strock. william la jeunesse life on the other side of the border in tijuana. analysts say the battle over thousands of kids already separated from their parents could drag on for months and years. so what does it mean for those families and for republicans heading into the mid-terms? we'll look at where all of this goes from here next.

look, this is a bad situation of creation by the white house. the white house now is trying to backtrack away from it so that it's the politics of it don't impinge upon what it hopes to accomplish in the mid-terms. seems to be getting more confusing and worse as time goes on only because the white house because the white house has not articulated how they will reunite the kids with their parents. seems to be confused and uncertain. >> trace: really, a.b. a good point. you're talking about the facilities all over the united states. we went to one in texas and one in the northeast. how do you catalog the kids and make sure the parents get back to them in a shortened amount of time? >> i can tell you unlike when we grew up, every time our bags were at the airport, somebody

has a bar code and they scan it tell us. maybe it won't be back for a few days but they know where our bags are. costco and all the stores know where the cans of food and crates of stores are. so there's no excuse in 2018 for the fact that these kids can't be accounted for. that's the problem here. no matter what the political solution or the legislative solution becomes, the story hangs even though there was a policy change with an executive order and not challenged by the courts. there's 2,342 children that can be accounted for or a number of them cannot be accounted for is really a tragedy. so i just find it stunning their record hindered from having to account them. >> trace: a.b. and john, stand by. we have breaking news coming into fox news channel. we're now learning that the

pentagon has just approved some 20,000 beds to house these families that apparently will be held together now. the zero tolerance policy is still in effect. 20,000 beds for immigrant children. back to you, john bussey. you talk about 2,300 kids they have right now and having a difficult time. they know where all of the kids are, still having a difficult time getting the families back together. what do you make of 20,000 beds for immigrant children? >> the pentagon steps forward again. probably the best logistics people coming forward. this is chaotic. suddenly military bases have to be homes for families with kids because the administration's policy created this. they can only house them for up to 20 days. the court case that limits that. you cut put in jail parents with

kids for longer than 20 days. what happens after that? a.b. is right. from a political standpoint, the story is the 2,300 kids. whether or not the u.s. is prepared for these kids not getting reunited with their parents and parents complaining to u.s. embassies for months, perhaps years, where are my children. >> here's how bad the optics are getting. even though the zero tolerance policy is in effect and we have reporters saying the immigration hearings are going fast and the judges are saying you're dismissed, so they're dismissing cases as much as we think zero tolerance policy is still in effect largely there's somebody telling people get these kisses in and get them out. >> i think it's important to distinguish between this firestorm over the separation of families and the fact that most americans still actually do not support sanctioning illegal entry into this country what

they're saying in this backlash is keep them together. deport them together or detain them together. keep them together and don't separate them. that doesn't mean catch and release is fine with most americans, everybody gets to come over the border. that's not what this is about. the administration has to figure out where they can find political support and coalitions between republicans and democrats to deal with how to house families together once they get here what will happen with the flores ruling and see if that can be overturned by a new law from congress so there's no question where the kids are and families will be separate add again. that doesn't mean they can have a zero tolerance in terms of illegal crossings. >> trace: 20 seconds. to you, john bussey. legally they can only hold them for so long. it comes to a point that they have to go back to obama era rules where you say look, give

breaking news. the pentagon has been asked to supply 20,000 beds for immigrant children. we don't know if this means for children and their families because clearly the order says keep families together or where this will happen. it's likely to happen on military bases in 2014 when the military housed thousands of unaccompanied minors. we're finding the details. the headline here is the pentagon will give 20,000 beds for immigrant children. don't know if that includes families. we'll keep you posted. in to fox news, the first lady's spokeswoman is responding after we got a look at the jacket that melania trump wore in texas. the back of it says, i really don't care, do you? she changed into another code before meeting with the kids. the first lady's spokesman said it's a jacket. there was no hidden message. the media isn't going to choose

to focus on her wardrobe. they did. two immigration bills were up for a vote in the house today. one of them rejected. the other postponed. where do things stand right now. let's get to mike emanuel. he's live for us on capitol hill. mike? >> trace, good afternoon to you. the house republican leadership compromise bill has been postponed till tomorrow to see if they can take more take more time to rally support. the first proposal from conservative bob goodlatte failed when 41 republicans and all democrats voted no. it did not provide a path to citizenship for the dreamers and a leading democrat said it just wasn't fair. >> here's what this bill will do. it will quash any opportunity for mom and dad to bring in extended family members, citizen mom and dad to bring in their

family members. it ends legal immigration, what we have called family reunification. >> that's just in all the pressure to the house republican leadership bill that would provide a path to citizenship for dreamers and is based on president trump's four pillars. many republicans are pessimistic. >> they have an uphill baitle because you are dealing with this issue of trying to be conservative enough to keep conservatives on and keep moderates on. when you play that game, you won't get there because you're getting no democrat votes here. >> next hour a briefing will be held for house republican members to ask any questions they have about the bill they're going to vote on tomorrow, trace. >> hey, mike, what about the president once again calling for changing the filibuster rules in the senate? >> that's right. huge frustration for president trump and huge frustration for house republicans that pass lots and lots of bills that don't go anywhere in the u.s. senate.

some senators note the filibuster does provide some profession. >> if god forbid they won the senate in november and they could pass whatever they want with 51 votes. we would have a very porous open borders immigration policy. so the 60 vote threshold protects republicans more times than democrats. i understand his frustration. we share it, too. >> i would wait to withhold judgment and see if the house can pass a bill. >> yeah, there's nothing for the senate to take up. >> immigration less than five months before an election is a heavy take. >> trace: give me a quick run down, if you can briefly. what is the timeline here? we're getting e-mails about what is happening on immigration. one bill is out, one delayed for questioning? >> a lot of lawmakers were asking leadership on the floor earlier in the day, what is in

breaking news. pentagon has been asked to provide 20,000 beds for immigrant children. it's unclear where the beds would be and if they are for children and their parents. let's get live to lucas tom hinson with more. lucas? >> that's right. defense officials says the pentagon has received notice from health and human services and requested to house up to 20,000 migrant children. it's not clear if that includes the parents. the three bases in texas they're looking at fort bliss, dias air fort base andoodfellow air force base. also a base in arkansas under consideration, this is not without precedence, trace. the obama administration housed up to 7,000 migrants on three bases in 2014 as well. this comes today as we learned the pentagon has dispatched up to 21 lawyers to the southern border to help with this large case load of migrant children.

the pentagon says they will approve and support, to house the children through the end of the year, trace. >> trace: lucas tomlinson. we toured one of the shelters that the obama administration used in 2014. some of those young people were there for weeks and weeks. lucas, thank you. the house defeating one immigration bill and delaying the vote on another. chad pergram is live for us on capitol hill. chad what is the latest? >> in just a couple minutes here, house republicans will meet and discuss the bill that they pulled off the floor. this is the so-called compromise bill which provides direct funding for the wall. keep in mind, they were trying to get votes on two bills. the conservative bill that went down earlier today and a voted on the compromise bell. president trump came to capitol hill earlier in the week as did

kirstjen nielsen and jeff sessions and they couldn't close the deal. if you had the votes, trace, they would vote. the fact that they're not voting today and possibly delaying the vote till tomorrow tells you a lot. here's another interesting tidbit. that will got 193 yays. they thought it would get 170. did provide real money for the wall. the bill they have tomorrow does. what the bill did do is not provide a pathway to citizenship for those in the daca population. the bill tomorrow does. in other words, there's a lot of republicans in the house of representatives, in you interpret the outcome of that vote and where they are that think that maybe voting against the pathway to citizenship, no amnesty is more important than voting for border wall, trace. >> trace: yeah, it's important to note, chad, during his cabinet meeting, the president

said the worse this looks, the more democrats think it will benefit them. there has to be reaction from democrats about the president saying, you know, near thriving by these pictures and these optics that are coming out of these various shelters around the country. >> nancy pelosi was asked about that, about the compromise bill. she said it's a compromise with the devil. at in point have republicans tried to court the vote for democrats. chuck schumer said they have to deal with this via executive order. it's not an issue that has been created by democrats. here's the other thing. think about how long it's been since there's been a bill that passed through the house of representatives. there was an immigration bill in 2005 a big immigration bill in 1986. a border security bill in 2006. nothing through the house of representatives. you have to do in a bipartisan fashion. when the senate moved the bill a couple years ago, it was done in

bipartisan fashion that bill got nearly 70 votes and a wide array of democrats and republicans. nothing has been done on this issue so far has been done in a bipartisan way. >> yeah, newt gingrich said earlier today, the house should pass something, anything that would be attractive and dared the senate to kill it. >> yeah. we might not even have a vote on that bill tomorrow because maybe the recalibration is, all right, we can't pass something here. maybe we should pass a more narrow bill that deals with child separation or scrap this bill. the reason they had to call off the vote today is because the members don't know what is in the bill. that's why paul ryan and mark meadows got into it. there might be that daring. they might have this conference meeting here in a few minutes and say why don't we just scrap this, put another bill on the floor and dare the democrats to vote against it? that is an issue that would play probably more prominently in the

united states senate especially where you have a lot of red state democrats that would have trouble with immigration issues on the ballot this fall. think about joe manchin, border state senators like john tester in montana. >> trace: yeah. you look at thcope here, the legalities of the president's executive order. maybe 20 days to hold these people. they have to move them in, move them out. how long are we looking at for some type of legitimate legislation off of the hill? >> john cornyn indicated he thought they would do something this week. he said that tuesday. here's is late in the afternoon thursday. the senate is just about done for the week. the senate is not in session tomorrow. there's other members that have introduced various approaches. ted cruz of texas and mark meadows. but those bills are not in the cue. maybe what the republicans decide to do if the bill they have been pushing to course the moderates, the one that the

president advocated for, the one that kirstjen nielsen wanted, maybe they have to put the genie back in the bottle and go back to square one and do somethg else. there's next week. they probably don't want to go home before the fourth of july recess, they're in session one more week without addressing this in some fashion, trace. >> those would be bad optics as well. >> trace: come up, you could be paying for more stuff you buy online. we'll explain why. in a few minutes we'll tell you about a facility built or about to be built for those that fought our our country to play and recuperate and rehabilitate. we'll hear from some of those veterans on how it's changing their lives. watch. >> that's what i tell these young kids when i talk to them. getting in here is not the end of the world. it's the beginning of your life really. because you have to adapt to it.

>> trace: well, it could soon be more expensive to shop online. that's thanks to a ruling from the supreme court. hillary vaughn is here with more on that. good news, right? >> this is a big win for brick an motor stores like target, sears and walmart who have been struggling to keep up with online retailers. here's why. up until today when the supreme court overruled this law, they found that states could not collect sales tax from online-only stores. overstock, amazon. the president is cheering this reversal because he says it will give governors and states more tax revenue. >> we had a victory just a few moments ago on the internet sales tax. a lot of states and cities will be benefitting from what's going on. it's a big, big victory for the governors in this room. i know they wanted to see that

happen. i don't think it was a surprising victory. it was the right thing to do. >> the government accountability office says states should collect about $8 billion to $13 billion more in the internet sales tax and will make shoppers pay more for what they buy online. sales tax are up to 10%. you'll pay 10% more for what you. have companies like target and sears are cheering the change. >> some executives are now. >> yes. s.c. and overstock lashing out against this. i want to point out a statement from sears. they say it's time to correct a system that has been given an n unfair competitive of retailers while hurting those that create jobs and invest in local communities. also retailers like overstock.com lashing out saying this lessens the potential
