rob: fox news alert, supreme court justice anthony kennedy announcing his retirement opening another seat on the high court donald trump will have the opportunity to fill. jillian: who will replace kennedy? to weigh in his legal affairs reporter for the washington times alex boyer. let's get to it. we are hearing a lot of names being thrown around in the mix. what do you think? >> one of the top names floated here is brett cavanagh, a circuit judge on the dc circuit and was appointed by george w. bush and worked on his administration so that is one of the front runners we have been

hearing as well as a name at third circuit that we heard prior to neil gorsuch being nominated so he is a repeat. we have several nominated by donald trump to appellate court and are now being considered for elevation. it will be interesting to see if the president pics one of his own goes to a bush appointee. rob: 25 names on the list behind us. the hoopla, the malay, the mayhem around this decision and this guy retiring has been incredible and schumer wanting to wait until after the midterms are over. why do you think he wants that? what is the point? >> reporter: the dnc is fundraising off of justice kennedy's retirement, they sent fundraising emails and they are

hoping it energizes their base as we signed 2016 energizing the republican base and it was upwards of 70% of evangelicals turned out for donald trump because of the supreme court vacancy but i believe republicans will fill the seat prior to the midterms. in 2010 a midterm the year alayna kagan was confirmed in may come in august, neil gorsuch was announced in january 31, 2017, and confirmed early april so 21/2 months. if donald trump comes out in july with a nominee that gives mitch mcconnell about 21/2 months before the october 1st start of the next term to put somebody on the bench and likely he could do it. jillian: donald trump what this person to be there 40 to 45 years. what type of character, do you think this person will have and also what issues should we keep

an eye out for? >> most of his appellate courts are in there 40s, likely to see a young supreme court nominee. barrett is a recent appellate court nominee. and donald trump floated around as potential replacement for justice kennedy. interesting to watch during her senate hearing for the circuit court placement because she was criticized for being too catholic. that is something to watch because pres. kennedy, to uphold roe v wade and we might see the president look to someone with more of a pro-life leaning that could be an issue we hear a lot about over the next several months as the debate between democrats and republicans heat up on who will do that. rob: am i concerned over how politically charged this is?

seems like the supreme court shouldn't be such a political place which we see what happens in the justice department when it gets criticized, we are seeing that now. should we worry about justices making decisions based on political bias? >> you hit on something important as the legal affairs reporter. interesting for me to see when judges get a certain case, not just the supreme court but a, court, who appointed them? it is interesting to watch. it tends to subject how they will vote on a certain case especially with politically charged issues and you are hitting on something justice kennedy 8 -- he was a swing vote often siding with the liberal justices on the court in the past and so interesting we don't know who lawyers will try to persuade the next term because it was always justice kennedy lawyers were trying to convince

campus and been spit on and i'm outraged the university has not taken time to hear my concerns. every time the video was recorded i'm attacked, members are attacked, we don't feel safe on campus but the university feels obligated to alert students ice is coming on campus and there is a paranoia, any alleged sighting from the university but they never respond to my request to provide protection, and procedures on what to do when facing threat on campus and cared more about free-speech and more pressing issues and trying to help lawmakers and a symptom of a greater problem that shows universities are no longer teaching students to be good citizens, to follow the law. they are showing they should resist and go against federal laws. jillian: you reached out to the university and they have a
