11:00 pm
forms. we pray for the families tonight, those that lost loved ups with and are healing up in hospitals tonight. laura has a big show coming up. laura, take it away. have a good show. >> laura: law enforcement officials are set to provide updates on the latest about the deadly, horrific shooting in the capital gazette newspaper inta annapolis, maryland. they were not planning on giving further updates tonight. we expect to hear real news. let's go straight to fox news correspondent kristen fisher scene. the kristen? >> reporter: police expected to identify the victims. we don't know if they're going to identify the gunman but already tonight, the parent company of the capital gazette, the newspaper where this horrific shooting took place, the parent company, the baltimore sun, has identified the shooter.
11:01 pm
they say that his name is 38-year-old jared ramose. they say he had a long-running feud with the capital gazette in 2012, he filed a defamation lawsuit against the paper and a columnist over a story that had covered a criminal harassment case against him. he then lost that lawsuit three years later which brings us to today and at a press conference earlier tonight, police said that there had been threats made against the newspaper over social media. listen here. >> we know there were threats sent to thehe gazette through social media. >> by this person? >>ness his late 30's. >> the threats were sent by this person? >> no. the threats were sent over social media. we're trying to confirm what account that was. we're trying to confirm who actually sent them. to my knowledge, the threats were as early as today. >> reporter: that's all police said about the gunman at that
11:02 pm
previous press conference. they may say more in 15 minutes. they'll most certainly be talking a bit more about the victims. in terms of what the paper has said, they have already named one of the victimsth and the baltimore sun is reporting that one of the people killed here today was the capital gazette's own editor and i'm afraid i may butcherr his name. it's rob hiaasan. he's one of the five victims here. two people were injured. they were transported to the hospital with what are believed to be superficial injuries either from glass or from the gunshots but just a horrific day here, laura. started around 2:30. police responded to the scene within 60 seconds after the gunman walked through the fronts door with a shotgun and smoke grenades. he walked through the first floor of the newsroom. it had an open floor plan. no place for the employees to
11:03 pm
hide. he opened fire. police showed up on the scene. the shooter didn't fire at police. they were able to miraculously take him into custody without any shots being fired. they're now interviewing him and trying to get to the bottom of this.o he's not been cooperative but at least now, laura, it seems like a little bit more in terms of motive. >> thank you so much. thank you for that report. it's been a harrowing day. our prayers are with those who are grieving tonight and those who are still suffering in hospitals and for the -- we're so grateful for the bravery of the first responders. amazing in a fast response today and there are a lot of outstanding questions that will be answered. we'll get to them and that press conference that's coming up in just a matter of moments. and we've a lot of news to get to tonight but we start with something that's been raging across the country. we call it protest-palooza.
11:04 pm
that's the focus of tonight's "angle." now, lately it seems like protest mania is a new normal in america with few exceptions, you really think about it conservatives aren't really into protesting. the joke is because they're too busy doing that thing called "work" but for the most rabid on the left, protesting has become kind of a way of life. marches are grievance festivals, the rollicking affairs complete with live musical acts, food trucks and balloon tosses. since the election of donald trump, the left has been ramping it up into overdrive. this was l.a. just a few daysw after trump's surprise victory where protesters, you'll remember, shut down one of the city's busiest freeways, the 101 between downtown and hollywood. back on the east coast, protesters at trump tower -- remember this scene -- they shut down traffic in midtownmanman --
11:05 pm
midtown manhattan. who could forget the women's march the day after the inauguration? >> i am a naaasty woman. i'm not as nasty as a man who looks like he bathes in cheeto dust. >> she was ahead of the time on the nazi reference. participants are passionate. you have to hand it to them.: some are old. some are young and they're pretty organized. and sometimes celebrities attend or donate millions to their pet causes that spill out onto all the streets, because when they write a check, it means they care and come on, let's face it, it ain't bad p.r. either! and then violence at some anti-trump rallies has happened, too. remember at berkeley, antifa
11:06 pm
showed up and showed us what they're capable of. no debate. no debate allowed. no diversity allowed ever. this makes it impossible for the president to travel, certainly for places like california. they tried to do that during the campaign. sometimes his supporters were harassed. others were actually assaulted. now the occupy ice protesters want to again make it impossible for our immigration investigators to do their job. they managed to shut down one office of ice in portland, oregon, for more than a week. this is a democratic socialist of america group them blocked entry into the federal facility. kiddinapping children you
11:07 pm
[bleep] nazis. does it not look like a "saturday night live" skit at some point? it looks ridiculous. dozens of people today in washington d.c. shut down a government meetingng in grand rapids, michigan, they did the same thing, protesting a contract that ice had to house detainees in a local jail. more in washington d.c. that also saw these protests where thousands of women urged for the abolishment of ice, immigration customs enforcement. they occupied the senate heart office building and joined themselves together with all of these liberal politicians. everyone looks like jiffy pop. they have the tin toil robes and the chantsha that don't rhyme. the capitol police arrested 600
11:08 pm
of the chanting throng. the d.c. ice protests were led by pro-palestinian activist, you've seen her before, linda sasour. important. is rallying is important, but it is not enough under a fascist administration. are you ready to sacrifice just a little bit? people want to tell us how to protest. when to protest. how to be civil. they have billions of dollars to build camps on military bases but have money to give clean water to the people that need it! [ cheering and applause ] >> laura: as islamic countries continue to subjectgate girls and it's curious that sarsour would lecture us on human rights in the united states. by the way, this is the same woman who in addition to her hate toward the jewish state in israel once tweeted out the
11:09 pm
following. i tried to delete a lot of these but they were captured. underwear bomber was cia all along. why did i already know that? shamos scaring the american people and oh, and this gem, i love this one. how many times do we have to tell white women we do not need to be saved by them? is their code language -- is there code language i needs to use to get through? here is a question for linda. is she really worried about kids at the border? or is her primary concern burnishing her own grand in this global human rights super hero wynn? is it part of a larger political agenda? probably all the above. she's arrested regularly, kind of like a hobby. she was arrested outside of speakerine's office back in march. outside trump tower last year. she wears it all as a badge of honor. they release them quickly any way. of course, she relishes all media coverage. now, you have to understand this
11:10 pm
, she wants your daughters, your wives, your sisters and our students to join her in what is ultimately a deeply anti-free market, anti-rule of law, anti-american founding mind-set. she and thousands like her are really, really good at projecting anger and outrage. you know, i was thinking about this today. to what end? what is the game plan here for making america better? for making it stronger? more economically prosperous? i guess freebies for everybody from the government. guaranteed wages. guaranteed college education. guaranteed universal preschool. guaranteed, i don't know, everything. open borders. more abortions. i mean, where does it all go? well i have a question is this message really getting through to younger generations of women? republicans better hope not. in the meantime, they better
11:11 pm
have a plan of their own to reach younger people looking to engage politically. they're looking for meaning. i don't mean a bunch of conservatives sitting around and reading position papers of think tank fellows or quoting the federalist papers as much as we allot love the federalist paper. i'm thinking of the kids that join the social media flash protests and check their news feeds on the phone throughout the day. those are the people we have to reach. of course, our country has had a long and proud history of civil disobedience and marches that galvanized civil change from civil rights march f in 1964 to the march for life that wery hae it every year in january. our first amendment right to seek government redress has has to be protect and defended. even if that message offends and shocks our conscious, we must protect the right to speak out, but at the same time, what we should never encourage are threats, implicit or explicit against our public officials as
11:12 pm
we saw from maxine waters last weekend. so maybe we should reconsider, just kind of elevate it a little bit what we're writing on those signs that we hold up to the cameras, what we're screaming in people's faces, how we speak to each other. it's all gotten s too nasty. and everyone seems really, really angry all the time. >> this is america. the american people have zero tolerance for you. we need to fight for justice in our country. that is not negotiable. keep pushing, because the american people is here. this is america, mr. president. zero tolerance for you. [ cheering and applause ] >> laura: we're going to join
11:13 pm
the law enforcement presser in progress right now up in maryland. let's watch. >> we know through the investigation there are no further threats, no further threats to the capital gazette newspaper or to the area around 888 fesgate road. what i would like to tell you is that the anne arundel county police department with our partners around, annapolis city, the state, we work very well together. have the best interest and well-being of our victims in mind. we have warn line for the county, 410-768-5522. and i would urge any persons who witnessed anything that occurred this evening or walking by the address of 888 or was near the address who just needs someone to speak to, i would urge them
11:14 pm
to call that line. jen corbin will have additional staff ready. for this evening fr any influx of phone calls and i'm going to allow her to explain the warn line and the issues blind that -- behind that in a second. i want to end on this, we have a responsibility and an obligation to these victims. everyone in the anne arundel county police department and all of our allied agencies, all of our government officials, we are deeply saddened by what happened today. we're deeply saddened that we had to make those notifications and we're deeply saddened that a person had to take this into his own handsen and this is the result. so i'm going to bring jen corbin up and we're going to talk about the warn line real quick. >> will you tell the names real quick? >> i'll make sure you get them. >> thank you. >> hey, good evening. just to kind of explain what's happened. my staff has been here since
11:15 pm
this occurred. we have been involved in the reunification of the witnesses to their families along with notifying the families of the people who have lost their lives. for the warn line, basically what we're asking is anyone who spoke with us today or anybody who maybe did not make contact with us through investigations that they could reach out through that number. we have licensed clinicians on 24 hours a day. we'll come out and help you in any way possible. what i'm going to ask is we're not using that number to call for information on the investigation. that is not what this number is for. this number is for people who have witnessed and might need assistanced getting through the trauma piece of this. we are not askingt you to call and ask questions about which family members are where or us to give comments on the investigation. we're here to help. that number is for family and witnesses to call in. we'll be available all night long. out if people need
11:16 pm
it or discuss how people are doing by phone. thank you. >> ok, so again that's the information that we have. to hold true to what we said at the beginning of this, as soon as we get the information we'll get it out. that was the purpose of calling this press conference. the warn line number is 410-768- 5522. that's the number to call for anyone who needs assistance and needs to talk to someone for support. the first victim was wendi winters. w-e-n-d-i. winters. >> can we get ages? >> this is all i have at this point. second is rebecca smith, r-e-b-e-c-c-a. smith, common spelling. first name is robert and the
11:17 pm
11:18 pm
>> thank you. thank you. >> yep. yep. >> as information becomes available, we'll make sure we get it out..om we don't anticipate having more information until the morning. we thought itip was very importt to get the information out about the victims to you guys so their families could begin that healing process. our thoughts and prayers go out to to the victims and their families. >> >> laura: we'll continue to monitor this for more developments. other networks are publishing photos. we've not confirmed those yet. we're not going do that here on fox news. let's get back to the focus of "the angle." robert padiois a civil rights attorney as well as "new york times" number one selling author and hit documentary maker whose new film "the death of a nation" is out august 3rd. see a new sneak peak of it later on in this segment.
11:19 pm
denesh is with us. gentlemen, first very briefly, comments about this horrific shooting tonight. denesh, we've now learned of the victims. looks like this killer had some grievances and had filed a defamation action against the newspaper widely reported tonight. there's a twitter feed that looks like it could be the individual. we're not confirming that. your thoughts tonight? >> we're seeing a vendetta played out before the whole country to see. in the age of media, it's not entirely surprising, although very disturbing, to see people who have grievances look for this kinde of media stage in which to enact this ritual of death. i don't know if it's driven
11:20 pm
partly for the desire to get attention. it's a dementia in our country. i am happy we're distancing it from false political attribution that has doesn't seem to be relevantri in this particular case. >> laura: robert, again, a horrific tragedy for the country and for the community and for the media.. and, we'll learn more about this individual -- i don't even want to use his name -- um but we'll learn more about it as the days go on but, again, it's -- you just want to -- you just want to sit down and cry at some point. >> well, you know, i don't think it'sa a situation where we have to sit down and cry. it's a situation where we have to reevaluate where we are and who we are as americans. fundamentally speaking, this is another example on why we need to encourage the second amendment.d even with the police responding in 60 seconds, five people lost their lives. if individuals had the ability to protect themselves, then maybe this tragedy and many others wouldn't happen.
11:21 pm
i'm a member of the african-american gun owner association. the cornerstone of our set is for individuals to -- society is for individuals to protect themselves in situations like this. >> let's go back to the focus of "the angle" which we didn't get to finish but suffice it to say that the nation has been locked down, at least immigration enforcement, in some parts of the country has been locked down by these protest that are -- at least on the west coast some on the east coast -- by the democratic socialists of america, this after a candidate for congress unseeded the number four in democratic leadership in queens two nights ago. dinesh, your reaction to now the embrace of open borders, lawlessness and the abolishment of ice.d >> i find it incredible a major party in the united states is essentially embracing
11:22 pm
lawlessness, in this case, lawlessness on the border. almost as a matter of strategy. now, i'm a legal immigrant. i'm a nonwhite immigrant. i come from a country with a billion people. if we had open borders, probably half of them would like to come to the united states. they can't, why? they don't have a contiguous border. they can't just jump over a fence. it's a long way. the second is there are lines. i went in a line. i stood in the line. really what the illegals are demanding is preferential treatments on the millions of other people who have to play by the rules to get here.em the fact the democratic party is unwilling to draw a line between the illegal and the legal -- in the media, the term illegal and legal is deflated. illegals are lawbreakers. they're not immigrants.re >> laura: robert, the language today at this protest in washington where they took over the senate heart office building
11:23 pm
but they met outside of the senate office building first and linda sarsour, the palestinian activist a lot of people think she's anti-semitic, anti-israel, she got up and she talked and others talked about white plaintiff and so forth. we'll play a little snippet of this.pp >> let's get down to business. i'm going to bring up to the stage lisa who is going to start the direct action training for folks who are not with us yesterday. >> there's different kinds of fear. there's real fear but a lot of folks, particularly folks with white skin privilege have a lot of irrational fears. >> white skin people have a lot of irrational fears. it's all virtue signaling from college campus lingo. dinesh and i saw that in dartmouth in the 80's. it's been ramped up quite a bit. robert, your take on where this is all going. you heard the training manual
11:24 pm
being referenced in the speech there where you have the direct action training. they train people on how to get arrested. that's nothing new. the civil rights movement did that as well in the 60's but it seems a lot angrier and a lot more rabid. >> well, i don't think so much anger and rabid but we have more media now to concentrate on it. back then, we had three news network that has reported on things. now we have a a o 24-hour-a-days cycle that reports on things and not including the internet. i think what we have to do is not discount these protesters. not discount their needs and their grievances. one of the mistakes the democraticte party made was in 2008 and 2009 while the tea party was rising, you saw liberal commentators on the other networks making the same assumptions about them calling those people crazy and saying everything align those -- along those lines. 10 years later after losing elections, republicans control most facets of the united states government and state government. we can't ignore the people out
11:25 pm
there protesting. what we need to do is engage across party lines and have the president and the republican party lay out what their strategy is. >>he laura: what's that strategy? i didn't get to this on "the angle?" what's the strategy of linda sarsour that tweeted the most hateful, horrific things in her career? she doesn't have problems in tweeting that. she tweets them. everybody forgets about them. dinesh, you have this film out onn august 3rd that deals with a d lot of the hate in the past. it's like a historical foundation on l many ways on wht is happening today. your reaction? play a're going to little clip from your preview of your film that no one else has seen. but your reaction to her in particulare in her vitrail? >> well, look at the reason they keep using the terms like "racism" "fascism" "white privilege" and so on -- they can't fault trump for being anti-black.
11:26 pm
he's not. they're trying to get him on this immigration issue as well as on the security issue as being some kind of a racist. now, the important thing to realize, laura is that the vast, vast majority of legal immigrants who come to this country are nonwhite. most of us today come from asia from africa, from south america and so the line that trump is drawing is not a racial line at all. it's a line between the legal and the illegal. the comparison to fascism is a third because hitler was not concerned with illegal immigrants. the jews were citizens of germany. they'd been in germany for a long time. hitler was drawing an internal line between if you will what he considered to be first-class citizens, the nordic germans and wanted to make jews second-class citizens or worse. >> laura: that comparison is embarrassing. the comparison is insulting. it's so ridiculous on so many levels. it's infuriating. but i want to play a clip. this is a preview from your film "the death of a nation" coming out august 3rd.
11:27 pm
no one's seen this yet. let's watch. >> lincoln was elected to unite a country and stop slavery. democrats smeared him, went to war against him. now, their target is trump. >> donald trump wins the presidency. >> so help me god. >> they say he's killing america. >> there will be a vote to impeach. >> they say he's a racist. >> this was a white lash. >> and a farbish. who are the -- fascists. who are the real racists? >> laura: where can we watch the entire trailer? >> go to my website, dinesh didsouza.com. we have the full-length trailer it comes out in the first full week of august. >> laura: robert, as we close
11:28 pm
this segment out, do you feel that the protesters throw out nazi, racist, concentration camp, internment camp, fascists two glibly and regularly so all the criticism, maybe some of it is merited of conservatives kind of just melts away? it becomes white noise at some point? and i don't mean that racially. i'm talking about white noise. >> well, ido think a big chunk f it is the hypobolelic nature of america's local discourse has grown to a point that xed itself out. during the obamacare debate we talked about death panel, fascism and new form of slavery because obama wanted to give people health care. let's stop down the rhetoric and tape on both sides. if you get to the root of things, 90% of people agree on most issues. 55% on each end of the political spectrum are driving the debate. we haveo to get to the point where we can all talk and find solutions. >> laura: nice point. i like that ending. thanks so much to both of you. moments away, tempers explode over a russia investigation that
11:29 pm
11:30 pm
11:31 pm
hesitate to vet their frustrations with his handling of the probe. >> you wrote the memo saying comey should be fired.te you signed the fisa extension for carter page. question to you, seems like you should be recused from this much more so than jeff sessions because you were involved making decisions on both prongs of this investigation. why haven't you done that? >> congressman, i can assure you if it were appropriate for me to recuse, i would have been more than happy. >> if you have evidenceng of any wrongdoing o of any member of te trump campaign, present it to the damn grand jury. if you have evidence that this president acted inappropriately, present it to the american people. whatever you got, finish it the hell up, because this country is being torn apart. i >> i think the best thing we can do is finish it appropriately and reach a conclusion. i certainly agree with you, sir, people shouldn't jump to conclusions without seeing the evidence. >> did you read the fisa application before you signed it? giant going to comment about any
11:32 pm
fisa application. >> why are you keeping information from congress? >> congressman, i'm not keeping any information from congress that is appropriate. >> your statement i'm previously conceal information from you -- >> you're the boss mr. rosenstein. >> that's correct. my job is to make sure we respond to your concerns. we have, sir. so i appreciate your concerns. >> again, i think the house of representatives isns going to sy otherwise. >> your use of this to attack me personally. >> i think you're wrong. >> you have seven dies get your act together. i don't know why you won't give us what we're asking for. >> sir, i certainly hope your colleagues aren't under that impression. that's not accurate, sir. >> it is accurate! we have caught you hiding information. >> mr. chairman, can we. allow the witness to answer? >> laura: anyone else get nervous during that exchange? i was very uncomfortable. joining me now for analysis, great panel, of course. fox news contributor, andy mccarthy. former whitewater deputy independent council, sal wisenberg and former international spokesperson john. great to see all of you. sal, let's start with you.
11:33 pm
you are annoyed by jim jordan's questioning which you found to be badger. i was watching on my radio studio and ich kind of winced because when you have to interrupt the witness, it makes your case not look that good. let him answer the question and then have a quick follow-up but i think he's worried about not having enough time. they have such limited amount of time that he probably got frustrated. was that a fatal mistake on the part of jordan? >> i don't think it's a fatal mistake. i just think he's -- he went to school at the teddy kennedy school of congressional cross-examination. you ask a hostile question and then you immediately interrupt the person that you're questioning.re my objection is not to the substance of what he asked. he's allowed to ask anything he wants. it is to the badgering, but the larger question here about this whole exercise of bashing rosenstein is something that andy has spoken to several times
11:34 pm
in his columns. andy mccarthy, and spoke to it a days ago. president trump a has the absole authority to order rod rosenstein to turn over anything and everything to the congress and if he did it and rosenstein didn't want to do it, he could resign. if he refused to do it the president could fire him. why hasn't he done that? >>th laura: let's ask andy that. andy, what's the delay? why hasn't president trump just said turn the documents over. it's transparency. why won'toe the president say to roansstein, enough with these continuing resolutions that they keep passing that are meaningless in congress? they passed a resolution compelling you to release a document. they're not going to release the documents. that was clear to me today. so why won't the president demand that they be finally released and get this show on the road? >> it's g a great question, lau>
11:35 pm
i appreciate sol bringing it up. the great irony i thought of the hearing was my friend jim jordan really laying into rod rosenstein saying j you're the boss. these people work for you, and the elephant in the room is that rosenstein works for trump. and precisely the point you make is true. trump can order this. so what we understand is that he's gotten advice -- i don't think it's particularly good advice, that because he's been under investigation for obstruction and because the critics of trump have conflated in the public mind the republican congress' pursuit of what went on with the agents who conducted these investigations and mueller's investigation that if trump acts to force disclosure and help congress here, he's effectively obstructing justice. now, i think that's nuts.
11:36 pm
i don't see a legal obstruction case. >> laura: i get it. >> i think that's where they're at. >> that's what they're worried about john, there's so many things in this hearing that were wild. was when he was asked --- rosenstein was asked, you know, what about this fisa warrant? he wouldn't answer the question about whether he read it. then he said, well, this -- struck didn't brief me. he went with the others. but he wouldn't answer the question about did you actually read this fisa warrant. he kept saying "well, you basically just don't understand." he also said, "i don't supervise --" you know "i have 100,000 employees." he said0, he wants to root out y corruption that's there. >> if he would have read thean warrant, he would have said "i read the warrant." he didn't read the warrant or glanced over it so long ago he didn't read the specifics which is why he's not commenting. this whole process is moving so
11:37 pm
incredibly slow. at this point, doj others that stop with the glacial performance and know the american people want to know what is going on. speed it up already. get the answers out there. >> he decided, sol, not to ask a question but to take his time to make sure he got quoted and the sound bite was used on most evening newscasts and cable and all over media, social media today, get this thing wrapped up what is taking so long! give us the documents. and then there was a moment when jordan was pressing another matter about peter struck. i want to play it and have sol's reaction. let's watch. >> why'd you tell peter struck nott to answer our questions yesterday? when i asked -- when i asked peter struck if he'd ever communicated with glen simpson, he gave us the answer he gave us dozens of times. "on advice of f.b.i. council, i can't answer that question." why couldn't he answer that question? >> i appreciate your sincere
11:38 pm
concerns. how i do know, sir? youiv interviewed mr. struck. i didn't. so i can't answer that. >> works for you. doesn't work for usct. >> laura: sol, um, i don't think rosenstein came off well today at all. i thought he came off as very defensive, very flip, but he played the victim card. "you're personally attacking me! you're mean to me in the media!" welcome to the big leagues, buddy. here deputy a.g. pretty hot right now. he kept saying, "well, there's all theseht people who work in e department of justice." this was a -- this is the biggest case, the russia case and the e-mail case for hillary, these two cases dubbed together because of this one agent. he had a b duty to find out what happened. >> well, keep in mind here, i think he did -- he did better than you think he did.ha but keep in mind two really important things. i'm glad you focused on this, because rosenstein made two points. not the one, and nobody at doj as opposed to
11:39 pm
f.b.i. which is in the doj, but no one in rosenstein's shop told peter struck what to say or not to say. and also, he made it very clear he had nothing to do with the redactions including this latest , outrageous redaction they didn't find out until the inspector general's report came out about the will stop him. he didn't have anything to do with that. when he found out and was told there were redactions, he brought in this u.s. attorney from chicago, but it brings up an interesting point. there appears for many years on and off, there's been a rogue element in f.b.i. leadership that obstructs these kinds of investigations and obviously, it's outrageous that that text message was not sent to the congress and the question is what is going to be done about it? because i think doj should do something about that? >> laura: andy any repercussions for what was done? redacting, don't worry, basically. i'll take care of it mean it's
11:40 pm
not going to be a problem. trump's not going to be a problem. and thattr doesn't go to the congress? >> of course. and, you know, this is the problem i think that rosenstein has. i think for example i wondered if he'd ever prepared a witness before, because a lot of times it seemed to me his answers were sensible but the smirk on his face was really off-putting, but on this particular, he says that he strongly supports the disciplining of agents who have committed misconduct. he endorsed i.g. horowitz' report. you have to put your money where your mouth is it's impossible to be credible and say at the same time "we're giving you all of this cooperation and when we find someone who withholds stuff we don't do anything to discipline them." >> laura: what i'm looking for from some of these officials, why isn't he angry about this? it's ball him.
11:41 pm
-- about him. you were mean to me. you were mean to me in the press. if this happened -- people burrowed into the system that hated trump and wanted to make sure that hillary didn't ultimately get prosecuted, and they were going to make sure by hell or high watter that trump wass going to be problems. why isn't this guy, rosenstein, angry? >> i don't know, because i'll tell you, in the f.b.i., i held a lot of leadership positions. no matter what somebody did underneath me, i'm the boss and responsible for it. you better believe i would have been angry after the fact when i confronted whoever did what. >> laura: the buck stops here? no. i guess not. >> they led struck out. he was led out and escorted out. >> laura: it's about time! >> he still works there, though. it's not like he's gone. he's sort of over there. >> laura: like what? he was moved to like human resourcesov after the lovebirds texas came out. >> we need human resources. >> laura: ok, guys.

correspondent for the washington examiner. we'll get to the issue of your associate being subpoenaed in a moment.. first the bloomberg story about the timingg of when this will be wrapped up. very curious. >> well, and two days ago, there was a story that said that the special counsel was now going to focus on russian collusion? really? what's he been doing for two years? we're almost at the half point in donald trump's first term and he's still under investigation with no charges of russian collusion by him or his family or his campaign brought because there is no evidence of such. this is an effort to undo what they couldn't do at the ballot box in 2016. it is a naked, partisan effort to remove the president. >> laura: byron, what do you make of the public souring on this investigation that the point? >> -- at this point? >> part of it is just the fact that it hasn't come out. there's no evidence to come out about collusion. part of it is the president's campaign against them.
11:46 pm
the rudy giuliani campaign has been actually quite effective. now, on the november thing, there's very specific justice department policy about issuing prosecutions that might affect an election. >> laura: last time. remember? that's what comey talked about. >> that's not done. there's no date specific set. it is late june now. the idea he would issue some sort of indictment in the fall before this election, no, i don't think that's going to -- >> laura: yeah, now they're talking about -- can't name a supreme court justice until the investigation wraps up. >> has tove be an odd-numbered year, apparently. can't be an election year. >> laura: roger, the news came out today your associate, one of your associates have been subpoenaed by robert mueller. he worked briefly for you during the 2016 election. thoughts? >> well, first of all, the witch-hunt continues. andrew miller who hasn't worked for me since 2013, three years

ago, did come help me at the republican national convention for a week. by the way, he's not a trump supporter. he's a registered libertarian and active supporter of governor gary johnson in 2016. he supported the johnson/weld ticket. this is a fishing expedition. if he didn't work for me other than at the convention -- >> laura: what did he do for you? >> -- sort of re-enforces my view this is some kind of effort to frame me for some extraneous offense to silence me or so get me to testify against the president. >> laura: what -- roger, what did that kid do? what did he do for you? why did you have a gary johnson guy work for you for a week? i'm not following that. >> well, when he f worked for me -- and it was three years ago -- he did scheduling. he traveled with me as a wing man. he did some i.t. work. but, again, he remains a good friend of mine, but i thought this was about russian collusion and the 2016 election. the story here is not so much

the subpoena, but the fact that he's going to seek through his lawyers to squash it on broad constitutional grounds as i understand it. it's a violation of his fourth amendment rights. this is an effort to take my associatesro and brow-beat them. >> laura: this>> is the most heavy-handed classic prosecutorial tactic, take people who are low on the totem pole, turn the screws on them and turn them so hard that they'll do anything to make it stop because they're afraid. they don't have money. i mean, roger spent hundreds of thousands of dollars to try to defend himself against lord knows what. someone on msnbc tonight apparently, byron, said that roger is the first person -- last person to be interviewed by mueller. >> and look for crimes that have nothing to do -- >> laura: with russia. >> -- with what you're actually investigating. i will say, though, this challenge that miller is going to make to mueller's appointment is another one.

paul mana fort tried to challenge it. they're doing it on two slightly different grounds. they're basically saying mueller's office is unconstitutional. they're not going to win with that. manafort has already lost in the courts this one will probably not work either. >> laura: roger, tonight, michael cohen put out a tweet saying "my family and i are owed an apology. after two years and 50 -- years of testimony about my entire statement must be quoted. i have nothing to do with russian collusion or meddling." any thoughts about that? >> michael cohen deserves his day in court as well. i read a dozen stories. he's going to plead to this. he's going to flip over that. we haven't seen anything yet. this story remains unwritten. i feel badly for michael cohen. >> laura: i do, too. >> because he's got millions of dollars worth of legal fees them seek to destroy him as well, yet he's not been charged with any crime. >> laura: and the public is turning on this. the public is turning against

11:54 pm
said they want tougher enforcement of our immigration laws. so this was a wrong policy but the underlying notion of the nation is that we got to have borders here while we're also good to daca recipients and treat families appropriately that means -- that explains why trump's ratings didn't go down in my poll. he went up to 47 despite this controversy, but i'll tell you, there may not be a blue wave but there's definitely a blue edge because while people may fear that the democrats are moving too far to the left, republicans have no leadership and no message and still have a pretty good edge here for thees democrs going into the midterms. >> laura: why do they have no leadership? donald trump is a leader. last night, he saidmo i we're gg to have a red wave. frank, you've been doing interesting polling on trade. he was in the big fox con deal today. thousands of jobs in wisconsin. they're worried about harley davidson. we have fox con. >> look at the unemployment records at lows. latinos and african-americans. more money are in their

tougher borders with compassion. and done the right way. >> laura: and frank, we talked about this before, but the democrats are looking for something in the trick bag to use against trump. they've tried everything. i mean, he's a demogogue. an authoritarian. he's hitler. he's nazi. he's fascist. they tried everything. his numbers were 47% in harvard harris yesterday. >> his numbers are higher than barack obama at this moment. i've got one for you also. i'm waiting to see who jumps on it. it's energy security. economics. if we actually turn our oil, our gasoline and using, um, um, natural gas, if we do that a kid of energy change which is easy to do, gas prices go down and the economy gets even stronger. >> laura: it's called money in the pocket. money in the pocket. people want money in the pocket. conservatives were motivated in 2016 on the supreme court. federal appellate court judgeships in the supreme court, people think it's geeky, not interested. my radio callers today were on fire about this -- about this retirement of kennedy and

schumer, etc., they're going to go to the mat. let's watch schumer today. >> our republican colleagues in the senate should follow the rule they set in 2016, not to consider a supreme court justice in an election year.ct >> we'll vote to confirm justice kennedy's successor this fall. >> he's making such a huge mistake. if they don't vote for it now, every republican across the country will vote to keep republicans in control of the senate. >> laura: they're motivated on guys.ssue, i want you both on radio. tomorrow or next day? we'll be right back.
