[laughs] 's pickup that sounds like fun. happy fourth come early. >> harris: president trump is already interviewing four potential picks for the supreme court as i mentioned. the white house spoke with them for 45 minutes yesterday. he is expected to meet soon with two more. the second woman he is said to be considering, and judge thomas hardeman. they will have the potential to be part of what some say are important decisions on issue like health care, gay marriage and abortion. democrats vowed to block any candidate to overturn

roe vs wade. they already spending millions of dollars on ads on a woman's right to choose. american voters agree 63-31 with roe vs wade. that same polling shows republicans disagree 58-30%. >> while the president is pro-life, he will not bring up roe vs wade in his meetings with potential nominees. she elaborated on that this morning and slammed democrats for being so critical. watch. >> secretary sanders: right now he is going to continue to stick with that list. the main thing the president is looking for our people that fit the qualifications that you would want in a supreme court justice. frankly, it has gotten really sad that their party has no message, no leadership, no solution. they want to fight our president who is trying to lead and is doing amazing things for our country.

>> harris: it so far does not sound like democrats aren't letting up. >> the president is looking at a list prepared by outside groups with the intention of changing the president of the court as it relates to women's rights and the right of choice. roe vs wade. we are talking about changing the direction of the supreme court for the next generation. >> harris: david, i know you're watching these things for your group, gopac, what are your thoughts? >> david: had americans wanted a supreme court that would make law or the mic rather than interpret law, they would have selected hillary clinton. president trump had a very clear during his campaign the men and women he would consider to go on to the supreme court. we would be the ultimate and political hypocrisy for democrats and republicans who had no problem voting for neil gorsuch, who shares the same judicial philosophy as the men and women who are being considered now for them to say that they are not going to vote for the president ultimately

nominates. >> harris: when you give up the litmus test, the president says there is not one. when i say potential litmus test, there are some democrats and republicans who see it that way. a moderate rate republican among them say that that is part of the discussion. if there is any movement against roe vs wade, she is out. >> david: understand that part of this, though, is we are in a time when we have to be stirred up just to be stirred up. when is the last time a supreme court nomination contest has been about someone's ideas? it is always about the nominees going in and talking about their philosophies and senators make these absurd questions to which these nominees never answer directly. they talk about their judicial philosophies. as we have seen an nominee after nominee, they ultimately win the vote. that is what is going to happen here. >> harris: you just spread out enough shade for everybody in the room.

[laughs] >> a terrific editorial in the newspaper today, talking about the scare tactics that democrats are using now that they have used every time in modern history that a republican has nominated somebody to the supreme court. in terms of the nominee will make abortion illegal. this is a critical vote. they have said it with justice kennedy, they said it in 1990 with david souter about clarence thomas in 1991. justice john roberts and sam in 2005. they claim that "the wall street journal" rights that he might overturn roe vs wade because his wife was a roman catholic. they do it to intimidate republicans, moderate republicans, like susan collins to try to get those republicans to vote with them. >> so critical about what you are saying can we talk about this on speed to anyone with one of my guest yesterday.

she does not think anyone would overturn roe vs wade. the whole talk against any potential candidates touching that issue rings hollow. >> jessica: i don't think so. susan collins was the hero of the democratic party when she voted against the g.o.p. health care will, bill. tax cuts on the individual mandate. democrats have a very shaky relationship with her. in terms of her showing respect, he wrote a whole book on it. we don't know what has happened. he read that list. but you did not address what happened. what would republicans think when they would not meet with them? scare tactics say, he will take all of your guns. your life will change under a supreme court with the mayor sitting there for justice scalia. both sides are guilty of this. it is rife with hypocrisy. we go with abortion, they go with guns.

and then -- >> harris: where does this leave the american people? let us throw up that recent poll that shows the edge majority of people motivated by politics. look at this. the supreme court mainly motivated by politics. we are not talking about using somebody for the supreme court. this is what people think about the supreme court. >> this is why you people so fired up about where we are and appeared you mentioned if hillary clinton had won, people would be up in arms for now. 45 minutes that these judges have spent in the white house over the past day or two, talk about the most 45 45 minutes of their professional career. they have made a clear that they want someone with the right demeanor. a constitutionalist, a conservative, i think the country needs to calm down and take a step back. >> harris: you know what the difference though, abby, conceivably is, alongside with

him on congress. hillary clinton would not have had that at this point. we do not know how this might change at the current midterms had she been in office, but there would have been enough actionable opposition, if you will, to her. and that has been the thing for democrats. they have no leverage. and say it again, elections have consequences. >> abby: that is why you have to go to the polls >> if you have donald trump nominee appointed to the supreme court that it will leave to abortion , that rallies the base. good luck to west virginia, the tenant democrats that are running in trump country. they are running for reelection and states that trump won. that will rally the base. >> harris: we have to move on. a new setback now for the trump administration immigration policy.

talking about a federal judge rule. the government must provide individual hearings to asylum victims or release them. the lawsuit is from a aclu. "this ruling means the trump administration cannot use indefinite detention as a punishment to deter asylum-seekers." no comment from homeland security officials. but when it comes to trump administration policies, a poll finds that voters approve of the supreme court's decision to uphold the president's travel ban affecting mostly muslim countries. 46% is appropriate meanwhile, president trump treated this this morning. ">> we all have that word that we cannot pronounce. >> harris: right? thank you. >> david: this is where we are in this debate and appeared democrats want to abolish i.c.e. this is particular interesting to me because last week i was in italy meeting with members of parliament and business meters along with this migration issue. you have seen amongst germany, the poster child, the left loves to talk about as being a policy that we should pursue. even germany is saying we have to know who is coming in to our country. a big problem that is ripping up the e.u., they are having big discussions about it, so why not here in the u.s.? >> harris: it is interesting

to, keeping the position and surviving politically, the camps along the border as they try to figure out who is in the country. >> jessica: in germany, by virtue of where they are located, there is a very different migration problems than we do. that is how western europe works. at a different set of circumstances. it was a steak to taken a million refugees at the start of it. but that does not mean that we need to be implement policies. there is backlash from both sides of the aisle about his coming on her now. this is a blow to president trump and jeff sessions. we will see what comes to it. hopefully we can have a humane solution for people who are fleeing countries. we also help these countries work out a better system for asylum seeking before they have to cross the border to come here. also, democrats do not want to abolish i.c.e., a few prominent

country illegally and the republicans did jack about it. >> we are in this position because of congress. >> harris: why do you think republicans get this heartless reputation that jessica is laying out? is there something different that they need to be doing, whether it is message or policy? >> absolutely. it is such an emotional issue. it is such an easy attack line to say republicans do not care. they are ripping children away from their parents. the trump administration should have seen this from a mile away. the obama administration considered for a moment separating families as well. because they were in a situation. >> harris: they must have been doing it because the pictures were taken from 2014. >> abby: if they went through with separating families, it would have been a disaster politically. president trump and their team did the same thing but they followed through with it. i think they need to be aware of how this is going to play. at the same time, they are also

saying we have got to vet people that come into the country. the majority of americans believe that we need to do a better job. they have got to do a better job communicating. >> jessica: i don't think they are serving him well when is implement mated the same way that it was. separating from the parents of the border. we talk about trade, the same problem. >> harris: wow. there is nothing like here. who came to play? [laughs] everybody. secretary of state mike pompeo set to head to north korea this week to meet with kim jong un. as reports suggest, north korea might be making good on the threat to denuclearize. talks with opera. will talk about it. and, the attorneys for anti-trump fbi agencies claim house republicans are trying to trap his client by demanding trump testify in public.

u.s. intelligence officials on north korea's willingness to abandon its nuclear weapons program. despite his signing an agreement with president trump during this assignment last month, general jack keane weighing in. >> more of that could have been in the works before the agreement that he had with the president. i know that mike pompeo really understands what needs to be done. what he wants from them is simply this, he wants them to tell him where all of their nuclear sites are located. if they do not give him that, then we don't really have a dea deal. >> jessica: president trump tweeting earlier, "many conversations with north korea going well." in the meantime, no rocket testing in eight months. only the opposition party, which includes the fake news, is

complaining. if not for me, we would not be at war with north korea!" david, this is part of the negotiation and secretary mike pompeo's job to get all of the nuclear sites and put together a timeline of the denuclearization activities. he hopes to achieve major disarmament of the activities in the next two years. it could be a year. >> david: all promising and very positive steps. kudos to secretary pompeo for all of the steps. it is a very fair favorable de. and before we jump in -- all, but they are not abiding by the deal, they are moving things around, we have let everybody know, we know what they are doing. north korea thinks they are going to get away with something, we know what is going on. let's make sure that we keep

honest and factual discussions with north korea and we are going to get a favorable deal. >> harris: i interviewed the former deputy assistant to secretary of state colin powell yesterday, and he told me this. you can talk about all of the movement and things that we have satellite images up on the ground, but those are nonnuclear devices that we know of. don't get your sites off of what we are trying to negotiate right now. some of that -- the politics at home for kim jong un may drive some of that. but the nuclear deal is the end game here. >> david: what we ultimately want out of this is a denuclearize to north korea. then we can start moving to the next big issue we have with them is making sure that we are not packing into the system. they want us hope we get into human rights, too. >> you have to believe that the president's tweets that he is

sending off, he knows that president kim jong un results. >> is in an interesting the world we live in? >> abby: they are comparing north korea to libya. that whole thing happened, they pulled back. he knows that they are paying very close attention. i think the frustration that the american people have, though. you get up in the morning and read his tweet and say everything is going great, and you read the reports from sources that want to be unnamed saying that they are doing the complete opposite north korea. there is a real confusion out there and the frustration of what is actually going on. are we making a progress and north korea is going there on thursday of this weekend has been dealing with this from the very beginning. you help that he is having this consistent dialogue, and we ultimately get to make this. >> jessica: one of the most important things to watch as the sanctions relief and not taking the press with maximum sections

relief. there has actually even been china loosening its enforcement of those sanctions after the summit, slightly. smugglers being allowed to move goods around the board agreed that is struggling troubling. that is one thing amongst all others that have brought north korea to the table. we cannot allow sanctions relief approach. we give them economic care. north korea ultimately, as kim jong un's father and grandfather did not denucleariz denuclearize. >> he has to eat, too. he eats pretty well. >> jessica: economic stations are obviously the way forward. playing down the fact that there would be a third nuclear facility that we did not know about and intelligence officials are releasing these satellite images appeared it flies in the face of the narrative that things are going well. >> harris: nuclear facility, yet.

>> jessica: it is a major deal and i cannot imagine what would be going on at this was president obama negotiating with kim jong un and, lo and behold a nuclear facility pops up. >> harris: a short range, nonnuclear -- the pictures don't match the words. but it is different. >> jessica: you are going to have to negotiate with people like this man who will do anything in his power to continue to needle us and threaten us. >> harris: aren't all dictators that way? >> jessica: the same thing in dealing with iran. now, we are learning how that deal is done. >> jessica: they went around congress' back. a billion dollars trying to get out of the u.s. bank. i got so bad that the u.s. banks had you're not willing. whatever deal we incorporated with north korea better not looe one with iran.

>> jessica: let's talk about that attorney. he said anti-trump messages. those text messages, remember? now eric using house republicans for leaking private testimony last week. the allegations in the letter in the house oversight and judiciary committee. saying "heaven sharpen their knives behind closed doors, the committee would now like to drag back special agent strzok and have him testify in a public request that we originally made and the committee denied."

asked to appear in person. he lied -- we have not heard from or seen michael flynn in about seven months. this is a chance for us to hear what he has been doing, how he has been working with investigators, having been giving them all of this important information that they have been asking for. >> david: we don't know that. what we do know is that this investigation needs to wrap up. if they don't have anything conclusive in this investigatio investigation, as it relates to the president, and did his campaign collude with the russians, which is what this campaign started out as? is this just about folks trying to pad their pension? the longer this investigation goes on, the longer people stay on the government payroll, the bigger their pension is going to get. at some point, wrap this up and come out with your conclusion. >> dagen: if you look how long

the flynn sentencing means that he is cooperating. if there is no way to read into it from the outside looking in, not knowing what is being said. >> dagen: what do you think the judge is trying to get from him? >> jessica: this is one not worth noting. they stated that the former fbi director, jim comey testified to the committee, remember this? fbi agents did not believe that flynn intentionally lied about talks with the russian ambassador. that is what he has pleaded guilty to. lying to fbi investigators. so if comey told the house intelligence committee one thing, he said some things altogether different on this book to her. so, again, before a judge accepts a plea deal, for something, you have to get to the bottom of did he really do it or not? >> maybe get some different flavors of popcorn next week. fruit baskets, popcorn.

"just out that the obama administration granted citizenship, during the terrible iran deal negotiation, to 2,500 iranians - including to government officials. how big and bad is that?" david, this is more evidence of why the president pulled out of the deal. >> david: we must not forget that iran does not want to be our partner. they want to take everything they can from us. every time we learn something new about this iran deal, there is more outrage of this country of the president getting out of this deal. come on, you tell me, you go to that deal and tell me that it is a good deal for america. you will advocate that there are iranians? >> dagen: a number of people in those roles. >> jessica: the sleaziness of this deal.

$7 billion and set in the middle of the night. that relates to a state-sponsored terrorism. and by the way -- >> dagen: this is not about the citizenship. >> jessica: a deal for iran to convert $6 billion in a bank by funneling money through u.s. banks that was so bad and smelled so awful that u.s. banks would not get on board with it. >> abby: u.s. banks would not be involved. how much more are we going to learn about this deal? about what they gave iran that we did not know about? we can wait for the confirmatio confirmation -- >> dagen: what about the billions of dollars? >> harris: u.s. courts had held up iranian money that was in u.s. banks because it was owd to the families and the victims of iranian terror.
