said, he wants to get another nominee in the same mold. i testified in favor of neil gorsuch i considered him an intellect of the first order. i thought that president trump found someone that could legitimately go to that court and contribute in a major way. it will be hard to follow that home run, quite frankly. that is what really prompted justice kennedy to retire. there was a certain comfort factor with the selection. i think that kennedy wanted to spend a year with him. it's now time to leave. i think he's comfortable doing that.

>> jason: with this pick that is coming up, the democrats had signaled, no matter who it is they will go off the rails. is there anything that the democrats can actually do to derail a nominee? n >> jason, as you know, what we are about to see is a time-honored performance. this will occur on capitol hillr with every confirmation of hearing. roe v. wade will once again loom greatly over the hearings. nominees are likely to refuse to answer questions about roe v. wade. they will cite ironically a rule by the democrats called the the ginsberg rule. that was by joe biden when he was chairman. the nominee, in that case, ginsberg, would not be required to give her answer to how she would rule on an issue that h might come before her. since this is a discretionary court, anything could become before her. it has been used since then, it will be used again. we will see what will happen. the worst argument that i have seen put forward was by a couple

of senators, a couple of academics. they said because of the mueller investigation, it is simply improper for the president to nominate anyone. that argument is unfounded. historically and constitutionally. there is no support for that. president trump has every right to make this nomination. >> jason: when amy barrett came up before the senate judiciary committee company started to touch upon the religious aspects. is there a litmus test that they will try to put in front of this nominee? >> that was a particularly raw moment. when senator feinstein made a comment about her catholic dogma, as she referred to it. barrett could make for the most interesting hearing. the fact is that she has not been shy about tackling tough issues.

i often criticize nominees who are blank slates. people who spend their lives avoiding any interesting thoughs or any interesting article. she is not one of those. she has been very much in the debate. she has not held back. that would make her confirmation quite exciting to watch. >> jason: senator mike lee has also been mentioned. he is on the list from the president. being a sitting senator, is there a special pathway? does that hinder his ability? >> jason, in this environment. it is not necessarily a big advantage. the positions in both sides are pretty much baked in. the democrats are looking at a very tough political environment for them to support any nominee, with the exception of a few of these senators in purple states. people like claire mccaskill, joe manchin and west virginia. they'll be in a tough position for this nomination.

but it is a razor-thin margin, there are a couple of republicans that could easily vote. that is what makes his nomination so fascinating. amy coney barrett is the most reliable pro-life nominee. that could end up costing those senators. >> jason: who would you nominate? >> [laughs] it's sort of funny. i think he has some very good people on this list.nk i wouldn't pick a favorite. i think it would be very hard to find another neil gorsuch. i think often times he puts people on short list because of the ease of their confirmation. we need to focus on intellect. that is what will make gorsuch a legacy nominee. objects don't do that. intellect does that. >> jason: it does. i think the democrats do a great

donald trump becoming the president. how do you see this playing out for the president? >> it is a huge issue.th it will be in the midterms also for two reasons. one, depending on the contentiousness of the hearing. i know the president very much wants to have the nominee confirmed before the midterm. even if he or she is, it will still be a big issue. voters think it is quite likely that the president will get a third pick. the short list is all three areh very bright, very capable people. i am sorry to see diane off of that list. she was on it before, also very capable. it will be a contentious hearing. it is a huge, huge issue. we could certainly break down these three nominees if we have time on the show. they have plenty to offer. >> jason: tom fitton, i want to get to you as it relates to peter strzok. you have done -- as a former chairman of the oversight committee, nobody was rooting

more for judicial watch than me. you are amazing being able to extract documents at the department of justice. but they are still stonewalling. as we go into this peter strzok hearing, what would you like too see and what documents do you still need to see at judicial watch? >> it is hard to question someone when you don't have all the documents. congress still doesn't have all the text messages, the emails. the government told us they want to take up to two years to turn over the communicationsov betwen strzok and page. in fact, they just gave us a batch of emails. as best as i can tell, those are the first publicly available emails we have between page and stzrok. they don't talk about russiagate yet. at least the process has begun. that is better than what congress is facing with the justice department. they haven't committed in providing anything. mr. strzok hasn't committed to testifying on the hill. his lawyer is arguing on whether he will testify or not. so congress has to decide to

fish or cut bait on this, continually threaten the administration or members with impeachment or contempt and not follow through doesn't seem to be getting them anywhere. they need to escalate it. either by bringing the president directly or coming up with other ways to force the justice's hand in producing these records that congress has a right to see under the constitution and the law. the justice department is thumbing its nose at congress. it's thumbing its nose at the presidency. there's a real crisis here. the document fight is just one symptom of it.oc it's all designed to protect this terrible corruption that took place within the obama administration and continued into the trump administration through the compromised mueller investigation. >> jason: people talk about the deep state. when i went there, i didn't know much about it. now i found that it is very real. i wrote a book about it.t. it's coming out in september. david, what should congress do to extract those documents and

on the russia probe. 39. in july of 2016, we just got through jim comey with the unprecedented press conference, and three weeks later, he is working on donald trump's campaign and the russia probe. i think that group was then transposed over onto the russia probe and then, many of them, were transposed onto the mueller probe. i will give mueller credit for this, the moment he found out about the texts, he got rid of peter strzok. here's what you want to be asking yourself. if it was bad enough or bob mueller to get rid of him that moment he found out about them, they weren't written in march of 2017. they were written in march of 2016. so he never should have been on any of these three probes. if the animus enough was enough to kick them off when you found out, the animus should have been enough to kick them off when you said it, which was early in 2016. completely the wrong person. the fbi's reputation -- look. there are lots and lots of fantastic fbi agents.
