[♪] judge jeanine: breaking tonight. 48 hours from the pick that could define the future of the supreme court. hello and welcome to "justice." i'm jeanine pirro. thanks for being with us and thanks for making justice number one last week. what a show on deck. matt schlapp is here. so is tomi lahren and a powerful political panel. we'll be discussing the president's big decision on the supreme court monday night and more. but first how badly were the feds out to get donald trump and where does the house intelligence investigation stand now. joining me to discuss that and more is the chair of the house intelligence committee,

republican congressman devin nunes. good evening. '. >> great to be with you. judge jeanine: yesterday you sent yet another letter to congressman gowdy and goodlatte asking that they question individuals openly in this continuing trump russia -- alleged trump-russia collusion investigation. now it appears your letter includes up to 42 names. some of them from the executive tostles of -- office of president obama as well as the state department, doj and fbi. what is different about your third letter? >> the third letter is about fusion gps and all the people in that realm of fusion gps that could have been involved handling the dossier, digging up the dirt and feeding it into the fbi.

judge jeanine: in terms of this information going to the fbi. it seems that you went from the initial who paid for this dossier, what was it all about, and you seem to have gotten answers to that with the dnc and hillary clinton. the hillary clinton campaign. but now the issue seems to be more fine tuned. that is how did this dossier get from the clinton campaign and steele to the fbi? do you know what the answer to that is? >> we don't know the answer to that. we think it could have come from many directions. one of john mccain's former staffers did it. we think many people in the press had this and gave it to the fbi. at the same time christopher steele was supposedly working with the fbi. what we are asking for, though, is for these 42 people to be interviewed in public.

i would suggest -- i i can't control lou they do the interviews, but i think they would want to do more deposition types. let the republicans "an hour of questions at a time. then give the democrats an hour. these 42 people help us get to the bottom of was trump really colluding with russia or was this an orchestrated effort by the left working with the fbi and doj to frame the president and many people involved to dig up dirt to start this investigation. that's why i think it would be helpful to have all this done in public. judge jeanine: when you talk about a deposition, that's different than the run-of-the-mill hearing where the right gets up and says i'm the greatest guy that ever lived and you are awful. and the left gets up and says i am the greatest guy that ever

lived and you are awful. it's like a circus. you would think the deposition would get into more in depth information? will it allow for the basis of a criminal predicate prosecution in the event they lied? >> i believe there is a task force that the oversight committee and judiciary committee set up made up of five republicans and five democrats. let each one have an hour at a time so you don't get the grandstanding and political speeches. that would be worth a lot more for the congress and the american people to understand what information each witness has that's relevant to this matter. >> congressman, one of the things i find so fascinating is the house, i believe it was last week, gave the department of justice until yesterday to give them information, this house resolution for deadline for doj

and the fbi to come clean on the beginning of the trump investigation or as the fbi called it operation hurricane. do you know, number one, did congress get any information from the fbi and doj, and number two, if they didn't, where are we with this? >> as always, we have to pound and pound and pound to get information from doj and fbi. they did give us a lot more information last week or expecting more information monday. but let me -- you mention something about crossfire hurricanes that was opened july 31. one of the key outstanding question us is what happened before july 31. they seem to be playing word games. judge jeanine: what i want to know now is if they don't give you that information and maybe we can pull the congressman back

up. if they don't give you that information, what can you do to the fbi and doj? you have given them more deadlines. now we have yesterday they were supposed to give us stuff. this investigation has been going on for a year. at some point don't you feel impotent? >> there is a couple things here. before july 31, for a coup months we have been zeroing in on that. they had plenty of opportunity to tell was happened. they have not. now, ultimately here, the president of the united states, it's his doj and his fbi. at some point here he need to get involved. judge jeanine: i don't want to go there yet. here is the thing. you guys have oversight over the department of justice. i know you are intel. i get that. the mayor cap people have been

watching this circus play out where you tell the doj and fbi, we want these record. you then go through the charade. not you in particular, of sending a letter and saying we want this by friday. you don't get it friday, maybe you will get it monday or tuesday. what my viewers want to know, what the american people want to know with all due respect to you. and i don't think anyone has had more pushback than you. and for that i give you tremendous kudos. i really do. but it's almost as if congress shouldn't even bother at this point. what do you have in terms of a sanction? otherwise you should be work on legislation. >> well, look, ultimately we have the job of oversight. they have to comply with us. they slowly complied. part of what we uncovered here, it's congress that's help uncover the dossier, the dirt,

who paid for it. when people are trying to hide this like the democratic party and the clinton campaign are trying to hide in conjunction with the fbi, the fbi and doj didn't want the american public to know any of this. we have a few outstanding documents. it's very, very important. what steps do we have? we can hold them in contempt. but at the end of the day we need to know what happened before july 31. that's what we are trying to get to. if you look at phase three of the investigation like we talked about a moment ago, having the 42 people come and testify will be powerful for the congress and the american people to have transparency and sunlight. judge jeanine: what we are looking at is the beginning of what the fbi and the doj says is the investigation into president trump. july 31, 2016, candidate trump. if fbi and doj say that's when

we began the investigation, and you now find out that a counter-intelligence investigation was started against a presidential campaign a week after the guy gets the nomination, the republican candidate for president. and in fact it's before that, we have got a counter-intelligence at the level of a third world country. >> that is correct. i think any involvement, even in crossfire hurricane of an informant being paid to go into the trump campaign is a red line we never crossed before. but what could be even worse is if there were informants run into a trump campaign and their associates before july 31 which would be even worse. at the end of the day we have to hold the hearings, ask the questions, and ultimately we'll have to declassify the

information so the american public knows what the counter-intelligence resources were used for. judge jeanine: why do you think the president is not declassifying? >> i don't know. the fisa is frustrating to me. i think pieces of the fisa on carter page, we have had an ongoing feud about this for many many months. i think the fisa is 100% fraudulent. you have james comey and others defending the fisa which is unbelievable to me. so the president just ought to solve this once and for all. declassify. but most of of that fisa, the pertinent parts of it could be declassified. he could help answer for all of us who was telling the truth. were they justified to get a fisa warrant on carter page or not? i don't think they were. and i think the american people have the right to know and the

president should declassify. judge jeanine: i suspect he's waiting for you guys to use all of your powers. but it would put an end to this ongoing investigation. i want to thank you for all your efforts on behalf of getting out the truth and putting sunlight into our government. thank you so much. by this time monday when should know for sure who president trump picked to nominate the supreme court. and decision that could have a major impact on this country for decades to come. joining me to discuss, cpac chairman, matt schlapp. i will ask you a quol up question to my questioning of chairman nunes. he believes the president should intervene and declassify information because the fbi and the department of justice are simply playing games with congress. and, you know, congress has been

pretty impotent up to this point. what do you think? >> i like the idea. this whole question about russia collusion, the mueller investigation and what happened with the fisa courts, i think the american people deserve to see the straight facts. i'm not sure congress can get it. i think it's fair charge back to the executive branch. the taxpayers should know. >> they should know. it's been an ongoing battle where you have someone like tom fitton and people who have to go to court to get more than congress has. let's talk about 48 hours from now when the president gets on national television and announces who his pick should be for the united states supreme court. let me preface this with a number of thoughts. ronald reagan was able to put three judges on the supreme court. and there are republicans

presidents like bush senior who put suiter on who he thought -- souter on who thought was a conservative and he turned out to be a liberal. then bush putting on john roberts and he was the deciding vote in obamacare. who do you want? >> the first question is, is it a good strategy to pick somebody without a track record and hope they will be a conservative? terrible strategy. 50% of the picks from republican presidents have turned out not to be solid. judge brett kavanaugh has 300 decisions on every topic under the sun. more of his opinions have become the basis for supreme court decisions almost 12 times more than any other candidate. he's got the track record.

john roberts didn't have a track record and it was a mistaken pick. judge jeanine: amy coney barrett who on a number of levels would be great. she is very young. but the most of important point is she was just confirmed by every republican in the senate and three democrats. donnelly, manchin and i forget who the third one is. tim kaine. if this just two years ago. how do they come back and say we didn't like her or we were delusional two years ago. plus i want to play some found for you on her hearing. >> do you consider yourself an orthodoxed catholic. >> i am a cath thick. if you are asking if i'm a faithful catholic, i am. but i would express my personal

church afail yaition or religious beliefs would not bear on my duties as a judge. judge jeanine: i play that because it seems there was at that hear twoog years ago, not just by dick durbin. but also dianne feinstein. staying she is living the dogma of her religion. i think that tees it up for people on her side saying enough of this anti-christianity stuff. let's put her on. >> she had such grace to be able to sit there when the bigoted senators make it sounds like it's . she has only been on the court

for a short time. less than a year. she we know where she is on a lot of issues. judge jeanine: she is on the circuit court of appeal. alaina kay begaaelena kagan was. >> 50% of the picks from republican presidents have been off the mark. neil gorsuch, a fantastic pick. judge jeanine: too much information as in bourke also creates a problem. >> the big difference with bourke, it took a super majority vote. because of what harry reid did, it just takes 50 votes. as you pointed out, we have democrats running for reelection from red states.

judge jeanine: welcome back to "justice." last week i spoke with michelle malkin and pam bondi with their experiences with left-wing protesters who confronted and sometimes threatened them in public. why does this keep happening? here to discuss, tomi lahren. you experienced your own situation with i have had situations like this as well. and right now, i still have not heard from anyone on the left who said, it happens on both sides, it does, it does. able to identify someone from the right going after someone on the left saying they don't like

their politics, signature at them. threatening them. telling them resign. >> the left believe if you challenge their way of thinking and world view in an articulate manner, they believe that's harassment. but they can go out in public in a restaurant or bar or mall and say nasty things and throw things at me. since maxine waters came out and encouraged her followers and supporters to continue the attacks on the right, it has gotten worse. i have seen it in my personal life get worse in the last couple weeks. judge jeanine: maxine waters is as crazy and batty as she sounds. she is creating a movement where people think it's justified. first it was impeach 45. but then it many you got to stop him. you have got to push back, and she never apologized.

investment vice. you share an ability to deceive and manipulate others. building ponzi schemes to engrandize yourself. truth and justice ultimately caught up with bernie. you have a guy who was the head of the cia, who as far as i'm concerned, is part of the swamp that created and made up this anti-trump collusion narrative, still going after the president. they are not afraid of us but we are always under the gun from them. >> for me i see pure bitterness. it's like some of these former obama administration officials, it's almost as if they are jealous they are not part after winning administration. i hear from hollywood liberals and former administration officials how terrible this president is. but they give no example how terrible he is. terrible for whom?

for the average american this president is doing wonderful things and they fail to acknowledge it. i think it's jealousy. judge jeanine: donald trump tweeted back, thanks to republican leadership america is winning again and respected again paul over the world because we are finally putting america first. you know, i'm going to make a prediction. i believe although historically the other party wins in the mid-terms in the first presidential term. i think it will be extremely close or the president is going to win the mid-terms with his party. >> i agree. the left is showing us who they really are. it's things like what john brennan is doing and what liberals are dmoght streets to conservatives -- are doing in the streets to conservatives. i think you will see moderates

excuse for saying she is a minority. but using that to gain a financial advantage with the school is not good. >> i think the president talking about it on stage over and over again is the most of uncivilized thing i have seen. i have heard you talk about civility. that's ridiculous what he did at that rally. i don't know what her background is. we don't know what her family history is and i don't think it will be relevant. if the president keeps talking about her, he is threatened by her because she is a strong intelligent woman who understands things he can't possibly comprehend. keep on hitting her. all he's doing is raising her profile. judge jeanine: do you think chris is right when he says elizabeth warren would be far better president than president trump? >> of course she wouldn't be.

chris must have turned down his earpiece because he hasn't listened to what democrats have said about republican presidents every time one gets elected. you hear the same old tired old rhetoric about them being racist, and them being sexist and against women and against the poor. it's worth noting if you saw the survey results this week, you now have voters saying it's republicans who are more for the working class and democrats are for the wealthy and elite and the business community. people see through it. and more importantly than those comments about elizabeth warren, if the rest of the president's message that matters. we are going to have secure borders. we are going to have economic security. we are going to have personal security in this country which he started in his first term and continue on his second term.

politics and politically correct culture was getting very out of control. but in terms of me switching parties it was after the election of donald trump, i voted for hillary. i was on facebook crying wondering what had gone wrong and what happened to the good people of middle america. but a friend of mine reached out to me and showed me a youtube clip that showed all the different ways the media had taken moments out of donald trump's campaign and spun it saying he was a racist and homophobe. i was shown a video that showed black people at the rallies and cnn cut them out of the video. the media had been dishonest about who trump supporters were. judge jeanine: when trump talks about fake news, you find that

to be accurate. >> i know it's accurate. judge jeanine: you have a new #walkaway that you are wearing. >> i'm walking away from the democratic party and the divisive almost violent rhetoric coming from the left. the complete lack of civility and the lack of being able to sit down and have a civil discourse about our political beliefs. if you don't agree with what the left says, it's because you are a nazi or bigot. they have become so entitled, if you disagree with them, they cannot serve you in a restaurant. judge jeanine: we are at the point. people who are working in the government who have -- are spending 18 hours a day, most of of the ones i know, are being thrown out of places and not served.

i understand yesterday something unusual happened to you. >> i was in a camera store in new york city. i was trying to buy some technical equipment. and when i went to make my purchase the salesperson said to me, are you planning to use this equipment for alt-right purposes. i laughed and said alt-right? he said aren't you with the walkaway campaign? i said yes, i am. he said i'm sorry i don't support that and can't sell to you. judge jeanine: what did you do? >> started shake. i understand this is going to happen to me more going forward. and it took my breath away. to be honest with you, i was scared. these people have my information in their computer. now i don't know what's going to happen next. judge jeanine: now you are experiencing what republican conservatives have been experiencing across the country, whether you are walking down the street in manhattan, the more

visible you become the more people will attack. i had someone on my show last week and i said give me one example where people on the right have done this to people on the left. give me one example. because they say both sides. are you seeing now that's not the case? >> i am seeing that's not the case. the other thing i'm seeing is how forgiving people on the right are when these things happen. it's two different worlds. people on the left can be so vicious and attack so much. but people on the right, even if they disagree with you, they docket civilly. judge jeanine: you are an interesting individual. you are gay, you are a hairstylist. you are an aspiring actor. you live in manhattan. you have been have democrat. now you are in a position to see some of the lies perpetuated by the left and you are leaving. but ways your mission. >> i'm not telling people where
