justice anthony kennedy. joining me now to analyze a presidents pick is the senior fox news political analyst, brit hume, ken starr who washe judge kavanaugh's boss, justin walker, who clerked for both judge kavanaugh and justice kennedy and leonard at leo, the president's top outside advisor on judicial picks. leonard, let's go to your first. congratulations, you are also kind of the man of the moment because you've been working this process behind the scene. we were both in that room together when brett kavanaugh walked out, as father comes out first, as mother, mrs. scalia was there. two of the sons of mrs. scalia, and of course general edwin meese from the reagan administration, former attorney general. what did you feel? i know what i felt when that was all going down.

the idea of transforming that federal judiciary to respect the constitution and the law and then seeing brett and his beautiful family, it wasn't electric magical evening. >> 12 years on the circuit court of appeals, for people who aren't really into the legal organization of the courts. the d.c. court is the second-highest ports. there's a lot of administrative law cases, and a lot of cases, judge kavanaugh dealt with a lot of those cases, he doesn't have a lot of those. >> he has a couple of cases on religious freedom which is really important. he does have one really important finance case and he has all these cases involving

the administrative state where he gets intont the whole issue f how the government needs to be accountable and transparent in the separation of powers needs to becr respected. that's almost 300 opinions. >> now i know it sounds kind of trite, but i revere the constitution. anyone says they revere the constitution but, full disclosure, i've known brett for 27 years, he does revere the constitution. people were criticizing him over the last 72 hours because of the staff secretary, which runs the paper flow for bush 43. lots of conservatives said, well, he comes out of the bush administration, how can we trust him to be scalia or thomas or gorsuch. what do you say those that are still doubting brett kavanaugh? >> you've known him for a long time and as you know he's dedicated his entire life to

defending the constitution and the rule of law. he understands that what makes that judge the most fair is the idea that you interpret the laws thatat are written and enforcedn respect the constitution. and you have to go to you. you've been standing where i'm standing, so many years during so many of these pitched battles for the supreme court nominations, what is your sense after hearing judge cavanaugh h speak tonight, and yet the resistance out there from so many senators who on the left side, we are not going to support anyone whom this president nominates? >> i think judge kavanaugh gave an impressive account of himself. he has a nice family and seems to be a nice young man. he seems young to me, anyway. t but i'm bound to tell you that after the announcement i went and watched some of the reaction

on our competing channels and i must tell you that it is already starting. he has rendered a number of decisions, for example reining in theon administrative state he in washington. and he will be portrayed, a laura, as an enemy of the environment, as a defender of big interest against the little guy and it's a litany that you've heard before. you will hear it again. it will get very loud and it will be almost 100% humbug but it will be out there and all i can say about it is he needs to be well prepared to defend himself in the hearings and the white house and thosean supportg this nomination better be prepared to rebut the allegations because they will be thick andd fast. >> judge star, you've been in the thick of it yourself with the left opposing any sense that you might ultimately rise to the court at one point during your career. they painted you as a guy -- like you couldn't be trusted

with the sacrosanct rights to abortion in the constitution, and all these other social issues. you have seen it close up, what the city is like, to dedicated professionals who are dedicated to the rule of law, the constitution, and textualism. as a jurist potential outlook. your reaction to brett whom you know very well, who worked for you and the independent counsel >> brett kavanaugh is the real thing. i predict that he will be confirmed and it's going to be i guess easy for some people to vote against him. but he will wear it well. he's the real thing and he is the goodness of kindness andss spirit that we have sought tonight in the statement. what we heard tonight reallyy came from his heart and i have known him since he was coming off of the justice kennedy clerk shop. what you see with him is where you get -- what you get.

substantively i think we will have a different conversation. i think we will have the political conversation that's unfolding as brett just said. but i think it will be a deeper conversation, i hope there will be. it began tonight, what do we want the supreme court to be and what do we want supreme court justice to be. we can use shorthand terms and they are helpful, regionalism and textualism. i would also say that we -- do we want to's restore the traditions of the homes as and apprentices and, byron white, appointed by president kennedy, who believed fervently in that we the people, and the ability of we the people to govern ourselves as opposed to governing five platonic guardians including a 5-4 majority. it's the right of we the people to govern ourselves. brett kavanaugh has the advantage in addition to being just soo steep in those first principles to also understanding

what we have been talking about and that is the administrative state. and of the need for accountability. he's been a very powerful voice with the fundamental principle. >> justin, you clicked both for kennedy and kavanaugh. justice kennedy has hired seven of judge kavanaugh's clerks over the years meaning justice kennedy puts judge kavanaugh in high regard. you are one of the clerks i guess but going back to the conservatives that are going nuts over the past few hours, what can you tell my viewers, our viewers at fox tonight about their relationship, anthony kennedy and judge kavanaugh's relationship and does not expand into their jurist potential outlook on some of these hot button cases? >> they both absolutely revere

the constitution. i just can't imagine how proud justice kennedy must be that his successor will be not only one of his former clerks but a former clerk -- justice kennedy talked about him in chambers all the time. he would point to the chair where judge kavanaugh sat and said, brett, he was always there in the morning when i came in and he was always there at night when i left. i would say, brett, go home, you work too hard. but he would never go home. he's probably bursting with pride right now. i guess i also think america --g i think they will fall in love with judge kavanaugh and i think there will be some senators who find it very difficult to vote against such a family man, such a patriot and someone who has just spent the last 12 years on the second highest port writing 300 opinions, 300 times out of 300 times. and adhere to the constitution and approach ofer the matter not

fair and impartial way. >> you alluded to the causticau nature of this nomination process early on. i want to play for all of you part of what mitch mcconnell said today on the senate floor about how the sky is always falling when a republican nominates someone to the court. let's watch. >> we are looking at the destruction of the constitution of the united states, as far as i can tell. it's hard to keep a straight face when you hear stuff like thatat. please, give the american people some credit. decade after decade, nominee after nominee, the far left script hardly changes at all. anyone and everyone a republican president nominates to the supreme court of some kind of threat to the republic. >> laura: while that was about

as animated as you and i have ever seen, senator mcconnell. i mean as great of a speech as judge cavanaugh gave tonight, coaching cyo basketball and the story about his parents being incredible people. the left doesn't care about any of that. this is about abortion and gay marriage, and that's it. >> is about those kinds of issues, and it gives you a sense of what is this issue and its seizure by the american court back in 1983 has done to our judicial system. this is an issue that should have been settled by the legislative processes and let the people decide with the law ought to be. and the supreme court divides a right but no one had previously detected in the constitution for that and we have been fighting this battle ever since. far from settling the issue, it has animated and some might say poisoned our politics to the

greatest sense ever since. once again that issue comes to the fore. it is the end during political and moral issue of our time and one which the courts have had more to do with and they probably should have. that's the approach that judges like brett kavanaugh and others on this list would have stood against and that is why the democrats and their allies are so opposed to such nominee is. they are accustomed now to winning these victories on social policy and other issues by judicial fiat. they are not able to win them in the legislative process and that is why they are so much steak at nomination like this which tips the balance of the supreme cour supreme court. this may be as judge starr suggested an edifying process in which that will be able to occur. i hope so. but i'm a political reporter and i'm telling you what i see out there and it looks rough to me. >> chuck schumer was there

today, he basically was up there -- he was right. it was like hitting the gong about how this is an alarm bell for the left and for the democrats. this is do-or-die, you have to stop this. but my question is, if brett kavanaugh is solidly conservative but, maybe not answer and then skinned scalia. but if he is solidly conservative, replacing someone who is usually conservative, or traditionally conservative, is it that big of a swing on the court, is it really given especially the last years of opinions by this court where anthony kennedy was with a 5-4 majority on every opinion of great consequence? >> that's a good point laura, you will see a lot of scare tactics. kennedy was not a moderate or liberal, he was for the most part a conservative justice especially in issues like

separation of powers, federalism, areas of religious freedom, free exercise in particular. weaw saw the last term and he voted with the conservative majority of the court, 75% of the time. so this is hyped up. and we know why, because the left wants to have a court that. is outcome based. they want to make sure that they get results from the court that they know they can't get through the political process. >> that hits the nail on the head, does it not? we now have a federal court system that is doing the difficult and ugly jobs of legislating them. you know this as well, barack obama had a profound effect on our judiciary. the nominations he got through even with some of the delays in the last few years, he transformed the fourth circuit court of appeals.

he transformed the backcourt with his nomination. >> this was not in fact what the founding generation intended. when we go back to alexander hamilton, the alexander hamilton, and we read his federalist 78, and what he said so eloquently, he said in about four pages and every school child should read it and every grown-up shed. this judiciary is the least dangerous branch. why is it the least dangerous branch? it's not going to be imposing its will on the american people. it will simply be exercising judgment. so that's what i call a grand tradition. the john marshall's come up the great chief justice, all the way through so many justices who are revered given to a great extent by the left. they would not in fact countenanced the kind of scare tactics for one thing.

this is beyond the pale. but we also care about results. we are here to make what we believed to be the most humane and compassionate that is not what we were here to do -- when i say we i mean the courts and the land. i would much rather be stewards of the law and take the text, meditate on that text but don't just make it up. and that is the great divide that is going to divide the united statesin senate. >> justice kennedy and judge cavanaugh, and let's watch. >> tomorrow i begin meeting with members of the senate, which plays an essential role in this process. i will tell each senator that i

revere the constitution i believe that an independent judiciary is the crown jewel of our constitutional republic. if confirmed by the senate i will keep an open mind in every case and i will always strive to preserve the constitution of the united states and the american rule of law. the one for all the suspicious conservatives out there who remember david hackett souter who trotted around the senate and that all these senators baca in the day and he turned out to be a judge, very nice man but we ultimately evolved toward a much more needed point of reference. it's judge cavanaugh the type of judge who will it evolve? for all those critics on the

right,ga those who would evolve from the more liberal block on this, what would you say to them? >> i would point out that when i took judge kavanaugh's class as a first-year law student, the first thing he assigned me was to read the constitution. this could be an exciting and fun minutes, because she read case after case and sometimes you have to take a whole constitutional walk. anybody who comes at this question with an open mind is going g to find a judge who has spent 12 years at hearings to the structure, the history, the meaning, the text of the constitution and doing so in such a fair-minded way, he mentioned in his speech that the person who hired him as not justice kagan. three left of center justices, they have off hired a former

it's exactly the opposite. and hardiman's people said it's hardiman. he called the vice president, and he had told three other people that they were on the list. because the decision was so late, the white house had to prepare for background packages, even asking each one of the nominees who they would put on their guest list if they were chosen. so -- >> if you are one of the other people and you have your guest list, it's like that kind of sad. >> they people supporting the individual candidate said we've been asked for a guest list. i guess he is the one who he believes can get nominated, or confirmed through the process by the first of october. they think that's really important job.

that's going to allow the nomination to come to the floor. >> john, i heard in recent daysp there have been some resistance to cavanaugh building up and set up inside of the white house. people have saidm it seems like there is some criticism of kavanaugh's record. others were concerned because he had worked with judge star as part of the independent counsel in whitewater but that was going to be difficult also because he was staff secretary to bush, 43, who didn't even support president trump. i think i'm going to say that it is to president trump's credit that that did not dissuade him. he sat right outside the oval office for five years. >> and here's the tough thing about doing television, she knows far more than i do. but i do know that there was some resistance among -- not necessarily in the white house

but some people, particularly the 2011 obamacare decision where he rolled in his opinion at that the individual mandate was a tax as opposed to a penalty. they said we don't have the jurisdictionhe to hear this case because text doesn't kick in until 2015. >> the problem is then you have to deal with the supreme court precedent. >> he is a form believer -- she may be the next supreme court think. and then there was this idea that he was very tight with theh bushes. he met his wife ashley in 2001 and talked about that day because i was here the white house when we were all told to evacuate the white house because they thought there was a plane coming here. it was flight 93 that went into the ground in pennsylvania. everyone thought he was a little too tight with the bush administration for his liking. the fact that he put them out there with such conviction tonight -- >> this is going to

immensely proud that his law clerk has been nominated to the court. it will be a second law clerk because now justice speed 18 also clerked for justice kennedy. but in's terms of concerns, there is a 12 year record of 300 decisions by judge cavanaugh that show that he is a principled conservative who believes in judicial restraint and believes hee' is not the 10t senator of some super legislator horror, but instead, he is there to interpret the law. president trump had four great candidates, and people had their favorites but now i think people will rally around paul and conservatives will rally along, because j he really is the principled conservative that we can count on. >> laura: except the protesters. and chris, that's your party there on the court. they had all of their preprinted signs up, you have the male rail

people, planned parenthood people, center for american progress. i didn'too find that display tonight. i'm trying to put myself as an outside observer which is hard given my background clerking on the court. but none of that seemed attractive to me. they probably have a garland out there. what are your reactions? >> i -- if i have that i wouldn't be here talking about this tonight. but merrick garland, that all comes back to it, that's what set this up. the left wing of the democratic party and the democratic party as a whole has no choice but to resist this nominee, regardless of the qualification and regardless of his background. they feel that like their nominee was stolen by mitch mcconnell two years ago and as a result we are in for probably the super bowl of artists all

madear it clear what the road mp is for confirmation. she said she wanted a judge that would adhere to constitution and the laws and she wanted someone who is going to respect major precedents in the court. if you look at kavanaugh's record, that's what you get.ce you get someone who's grapples with precedent, she has certainly given herself and other moderates in the senate some space. >> and they confirmed this nominee is best rushed, and held to after the midterm elections. if frank lost his mind, what is he talking about? but explain this because i got more interesting is the day went on. >> i think chuck schumer is right. i in fact hope the republicans follow his advice. two reasons, we need a conversation about the

constitution. right now in 2018. the longer we have this conversation the better the conservatives are going to do. the press, religion, talk about the bill of rights and the ten amendments, the longer that conversation goes the better the conservatives do. t and why that document is so important. second, conservatives are much more focused on supreme court. and, it will elect at least two more republican senators. it may even save the republicans in the house because every conservative will vote to make sure that this man, a strict supporter of the constitution becomes the next supreme court justice.

it is that's significant in the americanra political process. >> laura: interesting. mark penn, i thought that wase interesting about whether that controversy should take place at that should occur before the november elections which i think will freak out chuck schumer and company. >> what about your pal frank's idea here? obviously that's from the republican perspective. i think it's interesting that i'm someone like, a bird in thes hand, get this guy done i always say that about endorsements, get them it done as quickly as possible because you never know what tomorrow brings. i think frank's strategy would be huge gift to the democrat.

i think the democratic base would be energized and the more it could turn out because then you could effectively affect the choice through the nomination. right now we will protest but there's nothing we can really do, which has not happened with neil gorsuch. so i think the longer this plays out, the more it plays to the democratic advantage, two-thirds of the people in this country would not overturn roe vs. wade even though abortion itself is a closely split issue. second trimester and third trimesteres abortions, most peoe want only under limited circumstances. they do not want to overturn and reopen social ones in this country and they think that all any nominee that would do that would probably take the country in the wrong direction and, it makes for a more divisive society. >> here's the problem with that. the problem with that is, you have someone like brett

kavanaugh who -- listen to his speech tonight. how he spoke, how he spoke with not only reverence about the constitution but the process. looking forward to meeting with the senators and being an independent jurists. i think most fair-minded people but most americans you can out to be --he you don't revive the constitution and put women in jail. that doesn't strike most people. i think that image tonight of the court hurts the democratstt morning, noon and night. i don't think it's attractive and i don't think the women out there tonight help the democrats at all.we frank, your thoughts about what we heard tonight? and apparently on another network tonight, cnn, rick santorum was criticizing brett kavanaugh. what is that all about?

>> well this country needs civics. it's not taught in high schools, it's not taught in colleges. and the longer that we have this discussion, it may not be about politics but it that the bill of rights matters and we shouldn't be politicizing everything. it's driving people insane. i love the fact that this president made this very calm, very conscientious choice and chose someone who is committed to theut constitution. i think the longer we have this conversation, the better it will be for america in the long run.k >> that's a risky idea, i get why frank is saying, and a lot of people wanted donald trump for immigration antitrade.

diligence. he was calling people, he was cross-referencing claims about certain nominees. he liked all of the nominations. it is that accurate? >> he did. it's true. he was as transparent and engaged and intense as any president in modern history. he met at length with these prospective nominees, he asked questions and he was on the golf course over the weekend on the phone half the time talking to people about this process. i mean, i've never seen anything like it. the democrats are complaining that it's a corrupt, secret game. >> this president has been out here working hard on this for a long time. >> laura: i have to bring this up, people who say, democrats should take over in november because this is not a true republican poet president.
