what gillibrand and kamala harris were saying, how it will play in terms of not just the mentor was but 2020 and 2024 and beyond. i think a lot of it is scare tactics. that's why a lot of people use. chuck schumer is an interesting situation. he has a base that wants them to fight it he says he's going to fight with all he has. but even with all he has, because they do not have the power, it will not be enough. at some point, he's going to let those red state democrats go and decide on their own if they want to vote with the president and if they want to win reelection, they probably want to do that. i knew brett kavanaugh before he was a judge. i worked in the white house with him. one thing i didn't know until he said last night and i know his wife as well. i didn't know that their first date was on september 10, 2001. it was the next morning when they were walking into the white house that the secret service started pulling people out because of the impending danger. they are a wonderful couple. i loved his interaction with his daughters, but i will say his

perhaps kavanaugh, barrett. >> juan: you predicted kavanaugh. i was on the air. i thought hardiman was the guy. some people in the white house put pressure on the president because i think kavanaugh is much more connected than hardiman ever is going to be. a woman who served with hardiman on the third circuit. i think it came down to donald mcgahn, white house counsel. i think he and others really are tapped into kavanaugh and he is the republican establishment pick. he is a kennedy clerk, just like gorsuch. the problem for senator mcconnell was there is such an extensive paper trail. it's not just that we don't know much about him, as greg said, but there is so much to be found out because i think somebody said he is a little bit like forrest gump. wherever you look, a big issue, there he was. he was in the camstar

investigation into president clinton. he was in the bush white house and midst so many controversies. there he is on the d.c. circuit for many years. when he was nominated for the d.c. circuit, i think in '03, there is a 3-year delay in terms of confirmation because people wanted to know more about them. some people said he was a political guy who became a judge. i don't know. i don't want to be unfair to him. you have liberals making the case for him as thoroughly qualified and deserving of the appointment. the difference is, and i think this is something i want to say to dana and greg and the way they postured it, it is anybody that the left was going to oppose. remember that this election, the lift came from the federalist society and heritage. it's not universal. give me some qualified conservative judges to consider. no, these are people who the far right has put a stamp on in terms of abortion. >> jesse: kavanaugh is not qualified, are you saying?

>> juan: i didn't say that. >> jesse: because he was part of the list. >> juan: when i am saying is these are people who have been prescreened their conservative credentials by far right conservatives. >> kimberly: what far right conservatives? he worked for justice kennedy. he was applauded by george w. bush is an excellent choice. i don't understand what the problem is. you have legal scholars on the liberal side and democrats i think this is someone who is eminently qualified and was a good choice. i don't find him to be far right or fringe whatsoever and i don't see any evidence to substantiate that statement. >> juan: i don't think there is much doubt he is qualified. that's not the point in the politically polarized country where, as everybody here said, basically what you're going to have his five heart rate votes that will control america for generations to come. of course the people say wait a second. i don't want the court to be rubber-stamped. i want a fair hearing.

i want to know that i'm get a fair hearing. >> jesse: democratic presidents also nominated liberal justices to the supreme court. not just republicans that nominate their side. it happens on both sides, and that's fine, and that's how the game is played. it's interesting to say that the biggest criticism against kavanaugh is that he worked for ken starr. i thought special counsels were beyond reproach and partisanship. you know what i mean. independent prosecutors. they have been calling this guy a reactionary ideologue. he's going to end civilizations as we know it. he lives in the maryland suburbs with his wife ashley. he coaches his daughter's basketball league. >> greg: >> greg: maybe it's a . >> jesse: he served hot meals in his catholic charity. the guy is not a monster. he's a polished gentleman who went to harvard.

the guy has impeccable credentials and pretty much everybody thinks he's going to be a very, very strong judge. he's got a very long history of decisions and scholarship. i think that's a good thing because then you can really see how he's a solid pick. he's got a great sense of humor. as greg knows anybody with a good sense of humor is brilliant. he's hilarious. you saw that last night. people saying robie wade. he is on record as saying roe v. wade is settled law. and he's going to follow gorsuch on that issue. politically if you think about it, i think schumer can't do anything about it unless some surprise comes up in his paperwork and we don't know if that's going to happen. you are saying the other day mansion, heitkamp, joe donnelly all senate democrats up for reelection. they all voted for gorsuch. i don't see why they are not going to vote for kavanaugh as well. they are spending a lot of money on this pick in a national ad campaign. bottom line, schumer comes up

small in these moments. he botched the shutdown. i think is going to botch this battle. >> juan: i think manchin has said those pre-existing conditions, something that really concerns him. he says 44% of his state west virginia would be impacted. he wants to know how he deals with that. i think you're going to see a lot of people say let's get the paperwork. let's take the time, noting to russia mitch mcconnell say no, let's get this done before the midterms. >> jesse: 59% of west virginia's want this to happen. >> dana: i want to say juan, you mention this court will rule over america for generation. i think that actually is a fundamental issue here with the court. the court is actually not meant to rule over anybody. the people of america are supposed to rule over themselves. the court has been used by the left is a place to establish long desired policy goals they couldn't get done through the people and the legislatures, congress and the supreme court, all it's supposed to do is say constitutional, not constitutional. that's it. the idea that the court has as

it looks like the chinese are targeting states that are red states to send a message. >> dana: this will be with nato. >> juan: i'm talking about the trade fight in the idea of trade wars because it extends also to the european countries. it impacts even here at home a company like harley-davidson which the president has celebrated previously. what's interesting to me is, you combine these meanings come with along with the nato allies norms with putin. there is so much concern i think among the allies. you had the president of the e.u. saying america, don't treat your allies badly. you don't have to many of them. you stop and say well, what would putin's agenda be? the agenda would be let's divide or split up the nato alliance and then let's have trade wars because again, it's all to his benefit. you stop and think why are we treating our allies this badly? post world war ii, the globe has

been a peaceful place. >> dana: the american-led global order this been in place has been good. one thing that is happening right now is russia is building up its military capabilities and the border with poland. they are anxious. the president was sort of receptive to the idea of possibly placing permanent troops there in poland. >> jesse: that would be a big step. we are trying to reorient our grand strategy towards the pacific after defeating the russians of russia keeps knocking on the doorstep, we might have to pony some bases there. i think he's trying to modernize nato. we have these lavish trade deals with our allies in europe during the cold war. they helped contain the russians and we protect them and we get fair access to our markets. the cold war is over. we won. he is trying to recalibrate those deals because we are spending $706 billion in our defense budget. our navy protects all of the shipping lanes of the world. our air force keeps the peace. we have bases in germany.

paying all this money to protect you and you are throwing up these trade barriers, let's even it out. we are competing against the e.u. we are trying to crack open that trade block because they are very powerful. we have all these industries that are competing for market share in jobs and talents. we are just trying to put america first, like francis trying to put france first. >> dana: we have food coming up at the end of the show. we need to keep on time. >> kimberly: [laughs] >> greg: i would hate to cut into the food segment. here's the thing. allies are always our allies. if someone let's say bickering with canada or france, if someone invades canada or france, what are we going to do? we are going to kill the people who invade france or canada because that's what allies do. this other stuff is just bickering amongst the family. we are bickering over trade which is essentially like

bickering over trade or response about these or commitment in a family. we are fine. you don't argue over commitments unless you already have commitments with people. don't worry, canada. if somebody invades, we will kill them all. conversely, russia and north korea, we don't have that relationship. so when trump says the relationship is somehow clear with russia, what he is saying it's it's easier to understand because it's adversarial, us versus them. also requires more attention sometimes in order to modernize this antiquated adversarial situation. everybody wants to save face, right? that's all it is. >> dana: if he wants to have a good meeting, he will have a good meeting. i am thinking about turkey. i am a little worried about turkey. >> kimberly: they are the wild card. this is president trump with his philosophy that was really quite celebrated and encouraged during the campaign which was america

the thing i think you are missing is that kavanaugh is a guy who was bent on record with tremendous deference for executive power. if president trump gets indicted or president trump is somehow question about whether he has to testify and ends up before the supreme court, may be donald mcgahn, the white house counsel is counting on the idea come up with this guy up there and he's always going to be on our side when the hard questions, about the president and the mueller investigation. >> kimberly: that is not the standard. he is supposed to apply the law without any kind of influence. >> juan: but we know how he thinks. >> kimberly: you are referring to one esoteric law review article that was written years and years ago. perhaps the law needs to be changed... with respect to any kind of indictment of a sitting united states president in times of crisis that might affect national security or the economy

>> juan: an incredible ending to a story that's captivated the world. all 12 members of a boys soccer team and their coach have been rescued from a flooded cave in thailand after being trapped there for more than two weeks. the daring, treacherous three day mission to save the group pulled off by tying navy seals in an international team of divers. president trump is braving the effort and the bravery of the rescue crews on twitter. meanwhile, the children and their coach or not being treated at a hospital nearby. i will tell you what strikes me. they had to give the boys anxiety medication to get them out of there. they had to calm them down in order to rescue them.

i can't imagine that you give somebody something to lower their temperature and their heart rate as they're being rescued. >> kimberly: i think it was smart for them to do that because the level of anxiety that the children felt, especially in the physical and emotional strain of being held captive for that time, you don't want anything to impede a rescue effort where someone panics and then a child panics and could drag somebody under. two people. that's the type of thing that happens in a rescue operation. you want to get somebody as calm as possible. they are children. they have been sleep deprived, malnourished, haven't had a lot of oxygen. god bless the thai navy seal who sacrificed his life to try to make this possible. there was u.s. special operations involved in this mission as well. everybody came together incredibly and stayed focused on what seemed to be impossible. >> juan: jesse, a happy ending to this story, both the boys are

still not back with their families. being held in quarantine. some have lung infections from breathing the air in the cave. it will be seven days until they see their parents. >> jesse: i'm sure they are going to need a lot of medical attention. i can't believe this happen. it was generous of greg to lend these kids anxiety medication. we know it works on him. glad it works on the kids. i will say, and i am never wrong. i haven't been wrong in a long time but i was wrong about this. i do not think these kids were going to be rescued. we were doing a segment last week and we were saying that the odds of the rescue were so high and we were almost just praying and getting tearful about it a little bit in the commercial break and the fact that they were able to do this. kimberly said miracles can happen. this was an absolute miracle. they compared this to hiking mount everest with no guide underwater. look what happened. >> kimberly: i believe. you never give up.

>> dana: we have little time but i would say the will to survive is amazing but also human ingenuity, that humans have been able to figure out the technology and we have the will to survive like that is amazing. >> juan: they can't even feed them. they can't give them solid food. i'm amazed they survived. >> greg: i could not last -- you know when the elevator at fox news gets stuck for a minute, i freaked out. i have stuff with me at all times. the fact that these kids lasted that entire time in an enclosed space is amazing. it's probably the resiliency of being a kid. you don't think about stuff as much and maybe they can be seen as an adventure but i wouldn't have lasted 12 minutes. i would have resorted to cannibalism. >> juan: what do you carry with you at all times? >> greg: none of your business. it is prescription.
