rob: democrats to find a way to stop confirmation, more likely to rely on courts to push a liberal agenda for them. joining me now to discus is republican national lawyer's association board of governor's member, thank you so much for coming on this morning, we appreciate it. i want to start off -- >> happy to be here. rob: great. i want to start off, most of the damage that's been done to the president's agenda has been done in lower circuit courts. i think the ninth circuit is one of the favorites of the left. they love to go there. they get a favorable ruling, how does the supreme court change ability to affect the trump administration? >> well, one of the key factors that we have a trend in the courts is lower courts issuing nationwide injunctions, you see that in district court levels and court of appeals and ninth circuit will affirm that that's been particularly important in travel ban cases, in other cases where the courts and some vim

cases are resisting the president's agenda and so with another justice coming on to the court who is likely to find that that type of decision is overreaching and single court cannot set policy and overrule the president's agenda, that will deal a devastating blow by attempts by the lower courts to try to individually one by one stand in the way of the president's agenda and particularly inform shopping, that's why you see the cases being filed in san francisco where i'm sitting right now and not in places in the midwest. rob: less inclined to pull moves in the ninth circuit and might be losing bat until the end? >> correct. rob: let's start with immigration, that's a big one, a lot of damage has been done by the left to trump's policies. talk about the impact there? >> well, so you're seeing these issues blow up through the courts, the daca case situation and what happens to the 800,000,

now about 700,000 dreamers and relatives, that's a critical one, the deportation cases and separation of families at the border, that's a very hot issue right now even just yesterday there were rule negotiation that and so that's likely to come before the high court. other cases involving citizenship questions, involving the right of the government to impose questions about citizenship on the census, these are all major issues that are bubbling their way through the court that may end in supreme court. rob: next one is obamacare, tell us how this might impact that. >> well, obamacare is a critical battleground in the high court because what we have seen so far is last year in october the trump administration announced that it was going to be no longer enforcing a critical part of the obamacare ruling which is sort of refunding insurance companies for providing subsidies to lower-income americans to purchase these

plans and what's bad about this for the insurance companies is they are required under obamacare to continue to give the subsidies but they aren't going to get reimbursement which is causing them to raise rates around the country. the initial to try to challenge in courts here in san francisco actually failed, judge here in san francisco appointed by obama said no, the president does have the right to do this. that's going up way through courts and likely to end up in supreme court and justice kavanaugh already commented on the issue of various portions of obamacare and so it's going to be interesting to see how as a justice he then interprets again whether the president can sort of pick and choose and have certain parts of it apply and certain parts not which may cause the whole system to collapse. rob: sure, how about epa regulations? >> okay, this is not critical area that's begin to go see dismantling under the existing court with justice gorsuch said.

the epa over the years particularly over liberal administrations and even conservative gradually made a lot of law without congress passing laws, for example, declaring, you know, certain farmland as waters of the united states because there's a little furrow there where the tractor goes, you know, overregulation with respect to endangered species, drilling for coal on public lands, things like these, with the impending chevron, high court and lower court deference, determination of certain laws, that's going to be critical. that's really the biggest battleground that the left is most freaked out because predictable vote that he would be no on chevron deference. rob: wealth of information this morning and thank you so much and now we understand why the democrats are about to go nuts to stop the confirmation, it all makes a lot more sense.

really think senator warren who has been a college professor before serving the united states senate and not passing any substantive legislation will appeal to places like wisconsin, minnesota, ohio, pennsylvania, i mean, i don't see it happening. i don't see someone with her values appeal to go that part of the population. she's really a democratic socialist and she's not like the populist like bernie sanders where he sort of has the union appeal, and i just don't see how they will run over the trump voters and by the way in the state that is we are talking rust belt states, we have seen 300,000 new manufacturing jobs in the country and most in the state that is we are talking about. i have a really hard time senator warren will be able to go in the state and say we need to get rid of president trump and what experience she has in the economy to get it back going when it is in fact, getting back going in some of the states. >> i totally disagree. jillian: let's pull up the map here, we want to break down the numbers and i will let you respond in a second. some of the states to watch in 2020 that did tip the scale for president trump, then candidate

in 2016, you look at michigan, president trump had 47.3 points compared to hillary clinton's, 47% in wisconsin, trump 47.2 and then pennsylvania trump had 48.2 compared to clinton 47.5, you are looking at small numbers, you look at point, the economy and how well things are going right now u dr. johnson cook, do you really believe that some of those states would tip in favor of democrats? >> well, totally, like you said it's a small margin so it can tip either way. it's not just the economy, people are looking at the separation of families, people are looking at all of the things that are not going right with this nation and i think senator warren is going to be front and center for this. i disagree with ron in terms of whether she can do it or not, she certainly can and that's what strategy is about, that's what political strategy is about she has been strong and out
