mueller team, one of which was the hillary clinton non-victory party as well. we saw on full display peter strzok who got kicked off of that because of his bias. i'm just saying. but, the elite media may think the american people are dumb. in fact, didn't peter strzok point out multiple times that he thought he could smell trump supporters in walmart. the condescension drips from the elites even if they work in our government. you are not dumb though and have you realized that the mueller investigation may not be as above board as you think. a new fox news poll out just yesterday shows that the approval rating for bob mueller, just in one month has dropped 7% from being above water at 55% to now under 50% of americans approve of bob mueller's investigation. most significantly, the number of democrats who approve has dropped over 10%. i think they realize the smoking gun they hoped -- it's so sad that they are

but could there -- you know, could it still tie the agency up in a legal process? >> yes. and that's what's going to happen. there is going to be so many laws against some officers. and some agents that it's going to affect the performance of their official duties. and it's going to affect the system. pete: now, doctor, we reached out to cornell law. we have not received a statement. now, part of the other -- you know, way they have been gone at this is it's not just ice agents but contractors working with ice. as we know, in the military the same thing. there are contracts out with individuals who aren't government employees. is there more of a basis to go after contractors in their support of ice? >> well, look what happens if you go after a contractor. all -- whoever owns that contract is going to raise the price of that contract in order to offset legal fees, hence, it's going to effect the taxpayer. going to come right around to the taxpayer and to the person that's working for the government. pete: jason, where does this end?

in a new 29-page indictment the doj released yesterday the russia special counsel draws a direct link between vladimir putin's government and election meddling. the indictment charges 12 russian military intel officers with conspiring to interfere with the 2016 presidential election. specifically, they are accused of hacking and releasing emails from the clinton campaign, the dnc, and dccc. both the deputy attorney general and the white house taking care yesterday to point out one particular element of the indictment. >> there was no allegation in this indictment that any american citizen committed a crime. there is no allegation that the conspiracy changed the vote count or affected any election result. the special counsel's investigation is ongoing. >> while these charges send a clear or strong message, experts say the reality is that the russians are highly unlikely to extradite any of their officials to the u.s. for prosecution. the president himself tweeting just an hour ago,

paycheck from the american taxpayer? he should not be there anymore. he doesn't have credibility. and he needs to move on. and, obviously, he may have to face additional justice beyond that. but it's just amazing that he is still there. pete: it sure is we will get to that in a second. lisa page on monday testifying publicly if not should she? >> no, it's going to be continuation of the deposition and, look,. pete: something so much more powerful -- peter strzok being out in the open, exposing himself for who he is. it's powerful and cleansing for the american public is there any way to get the candor of lisa page before cameras? >> well, i have been a big supporter of releasing the transcripts if you are going to do a deposition. the difference between the deposition, pete is as you saw at the hearing, it can kind of become a circus like atmosphere. have you five minutes to question. in a deposition, you actually let people develop a line of questions. it's just a different

format. sometimes that format is better, but i think at a minimum the transcript needs to be released to the american people, absolutely. rachel: congressman, you mentioned that peter strzok is still on the fbi payroll. he also still has a security clearance. who is to blame for that? is that the trump administration? pete: the fbi? rachel: who is to blame for that? >> i think we need to know, he had the security clearance at least for the purpose of reviewing documents to prepare for the hearing. and so i think what we just need to figure out was it a limited clearance just so he could prepare himself? that's one thing. if he still has his security clearance after all of this, that's obviously a huge problem. because there are people who have their security clearances yanked for doing far less than peter strzok has done. and it just kind of find into thifeedsinto this thing. he still has a job. why isn't he being held accountable. the fbi needs to answer the question. pete: how could he be held

average 401(k) has just about 1,000 bucks in it but that may not be enough. >> if you are not saving enough, what can do you and can the soaring economy impact your savings. pete: this is a segment i need. here to weigh in is heather, thanks for being here this morning. if the economy is benefiting you and your family or you are in an opportunity where can you finally stash some away, how do we do better on 401(k) and on savings? >> well, pete, that's a good question. you can first talk to fox and see if you get an employer match on your 401(k) that's very important personal contributions, 18,500 a year. if you are under 50 and if you are over 50, can you actually contribute up to 24,500. this can add up very quickly, if you can't max that out right now, pete, then you want to set a minimum contribution away from paycheck every pay period of 3% to at least start that 401(k) and get it going. rachel: thanks to trump and

the g.o.p. we are now living in record breaking good economic times. so, how can living in this period of time economically with wages rising and so forth, how can that help us get a jump start on saving and how much should would he be saving given that incomes are rising? >> so, president trump's tax cuts are really fueling this economy, the stock market is doing very well. home prices are up. if you check out your home price on zillow or your 401(k) you notice that the price of your assets is going up. those are unrealized gains though. so you want to be careful. there is this thing called the wealth effect. meaning the better you feel psychologically about your money, even though you haven't sold your house and you are not going to tap into your 401(k) until you are 59 and a half, the more you spend. i think it's very important. have you got to be careful. use this money from things like tax cuts and the stock market going up to put towards your 401(k) and retirement savings. that's what you want to do. it's very important. pete: heather, is there such a thing as too late to save?

american. and the fact that there isn't a peep from a single democrat in congress, that has concerns about any of this is pretty terrifying. pete: is rosenstein absolutely completely tone deaf to the timing of it. do you think this is bob mueller and rosenstein and others saying hey the more president trump you try to discredit this investigation and call it a witch-hunt here you go friday before you meet with putin dropping it. >> you would think at some point he would sort of wise up. to me the most astonishing thing about that whole press conference was when at the end of it, after he described the indictments, he then launched into this 10-minute lecture about politics and the fbi being above politics and how we need to -- we need to mensd the differences in this country. i'm like why are you giving a political speech at the end of this -- just stick to the indictments. that's all i care about from you. rachel: i don't know if it's really working. i will tell you what. i live in middle america, i don't think people are focused on this. >> a agree. rachel: people are focused on what he did in the nato

counsel's investigation is ongoing. pete: next guest says this proves we never needed a special counsel in the first place. alan dershowitz the author of "the case against impeaching trump." yesterday you saw rosenstein and the charges brought. did the case for impeaching trump get stronger or weaker? >> oh, it got much, much weaker. first, as i prove in my book the case against impeaching trump, you need to have a crime, an actual crime, of course, this indictment doesn't charge any crimes against any americans. this indictment proves any counsel's office in the country could have conducted. this there is no need for a special counsel to do the kind of investigation that led to this indictment. second, this indictment is going nowhere. we're never going to see contested proof. a real trial of these charges because these russians are not going to be

extradited. they are not coming to disney land for vacation where they can be served and arrested this is the end, not the beginning of the accusation. and indictments are merely accusations. they are not proof. no reasonable person can dispute the fact that russia tried to interfere with our election, but that's not the issue. the issue is whether or not the president, the president's campaign or anybody else had anything to do with it we should have had an independent nonpartisan commission looking into the role of russia in the election. so we can prevent in the future. these indictments aren't going to prevent anything. so, i don't think it does us very much good to see these indictments come down. pete: professor, how about the timing of it. it comes the friday before the sunday summit with vladimir putin. is this something that would happen intentionally from the special counsel, from rob rosenstein to get this to sort of muddy the waters of this meeting with vladimir putin? >> >> i don't know what the

purpose was. but justice department regulations preclude using indictments to affect political outcomes. and you would think that since there is no rush on, this since we already know most of the facts from previous indictments, that they could have waited until after the trip was over. it's not the purpose of the justice department to get the president to ask vladimir putin about this. the president said he was going to do it. i think that's a good idea. i'm sure vladimir putin is just going to say no, i had nothing to do with it and russia had nothing to do with it and we are not going to get any more information from this. but, again, it gives rise to the possibility that politics, the thumb of politics is on the scale of justice. this is not the perception we ought to have. pete: still on the scale of politics after everything we saw with peter strzok as well. democratic leadership and a lot of democrats running for president. democrats rank and file said then well, president trump, needs to cancel his summit with vladimir putin. he has got to come back here. what do you make of their

reaction? >> the president of the united states is in charge of conducting foreign policy, whether you agree with him or disagree with him. it's his decision to make. i personally don't see any problem with the president meeting with putin. i hope he raises the question. i hope he raises other important questions about bilateral, multilaurel relationships, that's the job of the president. the minority party doesn't get to make foreign policy or tell the president who to meet with and when to meet. they maybe should have been telling the justice department to delay this release until after the meeting rather than telling the president who to meet with and when. pete: absolutely. last thing, peter strzok in his testimony admitted he was removed from the mueller probe because he says it was the perception of bias. a lot of us think it's the reality of bias. how then can -- president calls them 13 angry democrats. known democrats, known partisans for hillary clinton. one that was at hillary clinton's victory defeat party. is there not a perception of

bias problem in the mueller probe as you juxtapose it to why peter strzok was kicked off? >> well, peter strzok, i go beyond the perception. look, i have been practicing criminal law 53 years. if i ever had somebody like that on a jury, i would strike him meeltd. people don't know how their bias influences their decisions. it's often deeply unconscious. every criminal lawyer knows that. that's why you want a judge, you wants a jury, you want a prosecutor. if i had a client who was being prosecuted by peter strzok, we came up with these messages about my client. i would immediately move for a dismissal of the indictment and i think i would prevail. because it's not only the perception of bias, it's when bias exists and strzok admitted the bias, you can't be sure that it doesn't influence actions and inactions by the person with the bias. pete: all on a work phone but nothing to do with work. alan dershowitz, appreciate your time. >> sure. pete: nancy pelosi wants to be house speaker again.

could be disappearing. pete: the u.s. birth rate now a 30 year low. and millennials are having fewer children. so is the middle child, because we're only having basically two instead of three in danger of becoming extijted. rachel: laura van der kamp is a middle child the mother of four and the author of "off the clock, feel less busy while getting more done." i need that book and she joins us now. so, tell us, laura, why are people having fewer kids? >> yeah, well the number of children per woman has gone down precipitously since the 1950s, used to be almost four per woman. the average family had about four kids, now it's under two. the average family no longer has a middle child. it's really amazing if you think about it. used to be the case. but the most common reason there has been recent surveys coming out people think it's all about economics. the economy is pretty good right now. there are certainly issues with student loan debt and things like that. the most common reason is people say they enjoy their

leisure time and the assumption is that more children will take away from that life experience, i guess. pete: a lot of people say item nothingography is destiny. cultures not replacing themselves and don't birth rate are heading for decline. is this a symbol of culture not willing to invest in the next generation. >> it certainly could be. if you think about what we're talking about leisure time. people watch on average, well, great to be on tv talking about this but four or five hours of t. have a day if you want to preserve that instead of having children is an interesting argument. rachel: if you are watching a lot of tv you don't produce as many children. [laughter] >> the honest truth is that the difference leisure time between parents and non-parents is s. not as big as you might think. i study how people's schedules go and time diaries. non-parents only have about an hour more of leisure time per day when you look over the all demographic as all of people who have children under age 18.

kids take a lot of energy in the first you years. parents of young kids have a lot less leisure time but they do grow up. todd: what does this mean now for the next 30 years. >> certainly if you do have young kids like i do, i guess they have less competition, that's kind of exciting, so my middle children will be doing well with that but, over the long run, things do play out. as you look at the demographics of things like social security. if there is fewer workers supporting retirees. and also just in terms of a vibrant culture. kids are good. rachel: mother teresa saying too many kids is like too many flowers. i have eight i think siblings is one of the best things can you give your child. >> certainly as they grow up, the people we feel most supported by as we get older tend to be the people we have had the longest relationships with is going to be your siblings. pete: thank you very much, laura. rachel: great stuff, laura. pete: right now president trump playing golf in scotland getting ready for big meeting with vladimir putin. the media is already setting
