"the five" now. >> jason: i am jesse watters with jedediah, juan williams, dana perino, and greg gutfeld. it's 5:00 and eric see, this is "the five" ." fox news alert. a major clash on capitol hill. secretary of state mike pompeo squaring off with senators about president trump's meeting with vladimir putin and much more. the latest on the heated hearing which is underway, but first to another major story we are following. who is lying and who is not and where is the rest of the tape? those questions are front and center in a new controversy

surrounding a leaked audio recording of president trump and his former lawyer, michael cohen. it happened in 2016, they were discussing discussing the payment to a former "playboy" model. >> i need to open up a company for the transfer of all that info regarding our friend david. when it comes time for financing -- >> what financing? >> no, no, no. >> jesse: a payment was never made. the lawyers from both sides battling it out about what was actually said. the transcript states president trump says don't pay with cash. >> giuliani can't make up the words "don't pay." listen to the tape. the words "don't pay" are not heard of. >> there is no way the president is going to be talking about setting up a corporation using cash unless you are a complete

if the southern district of new york is looking into michael cohen's activities, this is not going to get the southern district of new york author back. what is the goal? is it tried to embarrass the president? to say there are other tapes means there better be better tapes than that one. if you put out another tape, it's worth in -- worse than soggy cigarette? it's a sparkler you can't use again. here's the other thing. this is the second time the administration is put out information that turns out to befall slater on. so reporters, for example, that went out and said in november of last year we hear there is a payment that was made to karen mcdougal. no, never heard of it. no, no, no. and then it turns out it's true. >> jesse: does that go back to the everybody lies about sex mantra in the '90s? >> dana: i don't know.

i don't know anything about any of this. >> greg: the golden rule is you deny, deny until it really happened. >> jesse: why the strategy? why leak the tape? to show you have independence, make the president nervous? >> juan: according to lanny davis, rudy giuliani was demeaning his client and badmouthing him. they wanted to push back. it was interesting to me that dana said michael cohen is no longer seeking any pardon. the question becomes maybe michael cohen is now cooperating with prosecutors looking into president trump. what strikes me about this is you guys are so dismissive, the wet cigarette butt. and so many levels. i guess it plays into what trump was saying yesterday about don't believe anything you here. don't believe anything you read. just listen to me. talk about an autocrat. yeah, yeah, yeah this is the way it is now.

people -- people from the north national organization for women standing behind them. and you couldn't talk about it when hillary clinton was lying outright. she had signed documents saying she knew that the c stood for confidential. i think lanny davis was a good choice because he is very media savvy. i have done a lot of tv with him. i think it's an issue he knew there may not be something in the bowl going on. but we want to sway public opinion on donald trump. we want to try to get those people who care about honesty and integrity and who voted for him, yes. >> jesse: and humiliate him a little bit and make him nervous. >> jedediah: and someone who will get on television. he is going with that. >> dana: when was the last time you had to go dynamic lawyers battling it out in the press? it's been a really long time. mostly it's on dramas, on television. or in the movies.

clearly this is about avoiding this embarrassing story breaking. >> jesse: a campaign finance violation punished by $15,000 fine? >> greg: i love the fact that cohen, just months ago, and on trust she -- untrustworthy slimeball. now they are in bed with him. i think it's important. what is the end game? i think cnn, i don't blame them for doing this story. it's interesting. but where do you want this to go? impeachment? >> dana: i don't think the media has an agenda. i think they want to the story to keep going. i want to know, what is lanny davis' end game? what's that strategy? >> greg: i think there are people in the media want trump out. the problem is, they haven't thought about 66 million people

who think you just got rid of a popular president. >> dana: 65% of democrats do not want to push for impeachment. it's like they've gotten the memo. if it looks like you take away the presidency from somebody for a campaign finance violation, i'm not saying that's going to happen. but if that is the perception, you won't recover. >> jedediah: they are thinking about reelection, and they are saying if we don't have something substantive here to impeach him on, you have to think about his potential for reelection and the character issues come into play when it so ridiculous. no one voted for donald trump, saying this is a wholesome guy, a guy with outstanding character. no, they say good businessman. they wanted their taxes lower. he hated obamacare. they wanted more jobs. all those things that were important to them, he is delivering. >> dana: delivering on them means the economy is roaring. what happens in a midterm and the economy is roaring?

♪ >> dana: you are looking live at capitol hill, secretary of state mike pompeo testifying before senators about what took place at the trump-putin summit and the president's plans for north korea and iran. here are some of the more contentious moments from this afternoon. >> has the president told you what he and president putin discussed in their to our closed-door meeting. >> the president has the prerogative to choose who is in the meeting. >> did he tell you whether or not what happened, those two hours question! it implies a notion there was something improper about having a one-on-one meeting. >> i heard you talk and brag about the number of sanctions. >> these were facts. >> the statute required sanctions to be imposed. >> my best recollection of the constitution is the president signed val off. i thank you for presenting that

law. b. one of the things our founders thought of, jedediah, and a system like ours, you should have the executive branch accountable to the legislative branch. i think he did quite well today. >> jedediah: i love the way he delivers things. he is so measured. his delivery alone inspires confidence i think he did what he needed to do. he talked about no easing of the sanctions with russia and gave a good defensive nato and talked about how we are not recognizing russia's annexation of crimea. i thought marco rubio did a great job when he listed out all the policy reasons the united states has been strong on russia, kind of reminding people that what you see in the media about, the media doesn't like the way trump responds to putin in a press conference. look beyond that and look at what the administration has actually done, and if you look at that, you see had they have been stronger than the prior administration. i felt it was an empowering moment for people to see and get their head on straight as to the fact that this administration has been quite strong. based on what pompeo said today,

they will be strong. it was confidence inspiring and i'm glad he's in there. >> dana: right before the hearing, ambassador john bolton. do we call him mr. secretary? no. he is the national security advisor. he came out with a statement saying the president has decided to lay the putin invitation until after the russian investigation is over, so probably won't take place until early 2019. >> jesse: republicans on public or are -- republicans on capitol hill are breathing a sigh of relief. i thought pompeo did a good job. probably the most effective person that cabinet for delivering president trump's message. he talked about how tough the administration is been on russia and how ready nato is to counteract any russian aggression. rand paul made a really good point. he said president reagan, when he met with his russian counterpart, he never went up there and shook his fist and

number two, how many hearings does this make? this is why i keep saying trump is the most educational presidency ever. when trump burps, they have a hearing on what he eight. did he have chipotle or wendy's chili? every time he does something, there's a hearing. because of that, we are forced to learn more about governing. it's the most transparent agency. i have a theory. i think there is shifting going on with russia and iran in terms of syria. i think russia is looking at iran as their high school girlfriend. or the high school boyfriend. america is the college quarterback. they just dumped iran for america. do you think that's a good theory? you're going to see iran on its own with syria and you're going to see they're going to be having to back away because russia is no longer going to support them. >> dana: part of it is because netanyahu has gone to russia

three or four times and talked to putin because iran has fighters on their border, and russia should do something about it. will he? i don't know. >> greg: i think we are going to end up seeing a positive result in syria pertaining to iran and also with north korea with russia's help. >> juan: most transparent? we still don't know what happened in the meeting with putin. >> jesse: he wants some flexibility. >> juan: because the russians are out there and they are saying in fact that president trump agreed to some kind of reconstruction with syria, some kind of deal question where we know. >> greg: we will find out. >> dana: pompeo said he feels like he's got all the information he needs. >> jedediah: during the obama years we were saying, what is going on behind the scenes? i remember folks on the left saying give him some space. >> greg: boasting about lying to america? >> juan: if you want to talk about sex scandals, imagine if obama had been involved --

homelessness, drug use, human waste. here's what matters to their leaders? straws. plastic drinking straws. santa barbara passed a bill punishing restaurant owners with jail time and fines if they give out straws. each straw counts as a crime. meaning if you hand out straws at her children's birthday party which i often do, you can do more time than your average felon. i can understand this law if you didn't have any other stuff to worry about. if you didn't have a dramatic rise in disease, crime, homelessness. maybe go after their straws but your state is teetering on the edge of armageddon. it may be why politicians are focusing on evil straws. the concern is really a denial of farmers problems. straws makeup only 0.02% of the plastic that ends up in the ocean. you would find more plastic in the faces of certain coastal politicians who i won't mention. what also hurts this narrative,

cory booker is not helping the democrats keep the seats they have in the senate right now. he is certainly not trying to increase their majority. the ten senate democrats running, many of them in states where trump won by double digits, 65% of the people say we want kavanaugh confirmed by the midterms. it makes it so much harder on them. thinking through the game and this strategy is difficult. if his goal is to get some headlines out there so he can be a front runner in 2020, that's one thing. but there are consequences and fallout. >> juan: jedediah, quinnipiac has a pullout since 41% of americans say no to kavanaugh. 40% say yes to kavanaugh. this is a big split in the american mind. 50% were okay with neil gorsuch. just a year ago. it seems to me there is something different about the kavanaugh nomination, even among republicans. the level of support is not what i thought it would be. >> jedediah: kavanaugh is not radical to me at all. i think some conservatives on

delta ceo is 6'3". the american ceo is 6'3". the united ceo refused to do this, refused to do the interview. they say the people were able to fit back there. no one in front of them was reclining. i think the recliner is the problem. somebody in front of you reclines, and then if you are 6 feet tall, maybe for you and i, greg, it will be okay. if you are 6 feet tall, your knees. >> greg: the big problem is not about the seating. a lot of people don't mind flying like that because i don't fly that often. "wall street journal" readers fly a lot, so they get this. i think the bigger problem is they've got to figure out as soon as possible, they've got to change the seating and unloading of passengers. we have a big problem right now with status inequality. you go on instagram. you see how much better people's lives are. the idea of having people in coach walk-through first class i think is such a disillusion
