>> sean: all right, so will president trump -- should president trump sit down for an interview with the special counsel robert muller? joining us is a president's attorneyt jay sekulow. i've asked of the very same question of gregg jarrett and judge pirro, and every other o attorney i talked to come almost every attorney is universal and saying absolutely not. can you give us an update? >> sure, the first thing is look, you have to start with

this. the depth of corruption that led to this investigation and frankly continues to permeate thisn investigation is unprecedented. you have to start with that. you mentioned in the earlier segment, the irregularity -- that is being kind -- of what took place here. you have to start with the question of whether the president was fit for an interview with the proposition, is there a constitutional basis on which that interview can take place? frankly, it is the position of the legal team and we have been clear on this in the last couple weeks that our position is that there is not a constitutional basis to move an interview forward. what i mean by that is the article to power of the president is very clear. at the idea that you have a series of questions involving the president's motives for particular actions as it relates to article two powers would frankly be inappropriate. unconstitutional. and you ask yourself, does that answer the question? the president stated that he wants to do an interview. i will t tell you, the positionf the legal team is that we do not

advise that. however, there continues to be ongoing discussions and dialogue with the office of special counsel to see if there something that can be worked out that we would be comfortable with. short of vans, the answer of course is no. the one who makes the determination -- the lawyers can advise -- as the president of the united states. he will make that decision in consultation with his legal team. >> sean: you have been my counsel -- my question -- if you told me "absolutely not," i don't think you would appreciate or accept me saying i'm going to do itab anyway. i've known you for 20 years. >> i understand that, sean, but you are not the president of the united states. it is a different calculus. look at, clearly our inclination -- clearly inclination is "no." i could put 100 lawyers in the room and 100 are going to say that. i make a the joke when i'm talkg

to reporters that if we put the president up for an interview, you have 12 lawyers and saying i can't believe they did that. if you don't put him up for an interview, they will say "what are they hiding?" if you look at what is implicated by an interview, it is very serious. it raises very serious constitutional issues that go to the heart -- as you mentioned earlier, separation of powers, article two authority how i've been saying that for a year. the decision is up to the president. we will give advice, but there are ongoing discussions to see if there can be something worked out here. >> sean: i look at the team that mueller has put together. the president has tweeted about the team he has looked dumb i put together. wooding innocent people in jail, overturn of the fifth circuit, tens of thousands of people lose their job. withholding exculpatory evidence. i'm not trying to drag you into that battle, but i have to ask you, is it appropriate -- the

you know what the problem is? those are the facts. and really no one is disputing any of those facts. the problem here is a foundational problem. that is why the irregularitiesy in the corruption involved in the process from the beginning is really unprecedented. all of that factors into the decision that is ultimately i made, whether they will be an interview or not. or whether it will be written questions or not. that decision -- we are close to making that decision, i don't ever give dates. >> sean: how is this going to end, when is this going to end? >> i think it ends soon. i cannotot give you the date because here's what happened, let me give you the process. robert muller, under his authority, will issue a report. that report does not go to congress. if that is not an independent call so. it would go to the acting attorney general. he wouldn't determine what goes forward. at the same time, quite frankly, we are developing a report that is going to lay out all of these issues that we talked about.

this is not a trial. i think people understand that. this is not a trial in the traditional sense of everything. this is a political process that is going forward. i want to be clear here. the constitutional issue, which is t the reason i got involved n this case in the first place, in fact are the major issues that this investigation turns on. there are serious constitutional implications of this, not just for this president, but for the presidency. that is what history will remember, so that is why we have to be very careful and very direct on how we move forward. we would let me ask one last question, if i may. the president has the power to declassify all of the subpoenaed documents that congress has been withholding. they have not been living up to the subpoenas. i don'tg think i would get away with that, even with you as my attorney appeared at president has the power to demand they be unreacted and released. why doesn't he do that?

>> he is a process that is in place that his white house team -- that is not a decision we make as his private lawyers as counsel to the president, wes are not the white house counsel. that is a decision that is made within the context of the white house and their purview. that decision, i'm sure, is being discussed, and if you are being discussed. i'm not going to defend what has or has not happened because that is outside of our jurisdiction. needless to say, i think this is fair to say and the american people are asking for this, transparency is important here. one of the aspects of transparency is water in these documents? if it doesn't put our national security at risk, i think it should be released and declassified. but you're not the president, i'm not the president, i don't get to make these decisions. >> sean: how about bruce ohr and the relationship between nelly and christopher steele?
