2:15 am
states, the crimes in these cases were kind of shocking, one of them is homicide, gang-related homicide and all three of them in this case are cambodian and it's a complicated part of the law, it's not clear that the pardons that the governor gave them will be able to stop their deportation, it's also not clear if the government would even be able to deport them to begin with because the government of cambodia is not always cooperative in accepting its citizens back to that country. they originally came here as refugees at young age, never became citizens, they probably won't qualify for citizenship because of their crimes, so it's a very complex area. it may be a political statement on his part to the immigrant community in california, you know, it's hard to really know what -- what he's trying to
2:16 am
accomplish here, but it is troubling that these serious crimes are just going to be wiped off the record at least for purposes of the state of california. they are serious crimes. >> let's look at the pardons by the california governors, jerry brown being the most, next arnold schwarzenegger and davis zero, look at the numbers, they are incredible. these men that they are pardoning, i want to give a sense of why he may be pardoning them when you're saying reform, rob, one former gang member, became yourself minister, started for other folks as well and another works for criminal justice reform, they are doing something in giving back to the community at least. >> yeah, it does seem that way. it would be interesting to see if the governor is applying the

same standards for these kinds of pardons for american citizens as he is for noncitizens or the fact that they are not citizens play intoed the politics of this in any way, there's usually political element to the pardons. rob: that's certainly true, you are seeing 11 pardons by jerry brown and that's a huge number and made big statement, they love being that in the face of donald trump, let's talk a little bit about immigration and customs enforcement, a critical part of this country and they're being honored today at the white house and a lot of people very angry about this, what do you think? >> i'm glad to see that the president is honoring the men an women of ice who have a very, very difficult job to do now and have been very unfairly maligned and vilified by people who are opposed to immigration rules in our country. they have a dangerous job to do now but the work that they do helps keep our communities safe,
2:18 am
protects job opportunities for americans and protects taxpayers, it's even harder now because of the sanctuary policies they have to go out to the streets to arrest criminals rather than in safe areas and it's a dangerous job. just recently in massachusetts there was kind of a resistance type who was offering money to somebody who would attack an ice agent. it's a tough job out for them now and i hope the president is not only supporting the people of this agency and the work that they do but sending message to congress that congress has some work to do too here to appropriate money and to fix the law so that they can do their job and stop influx of people from southern border. rob: story went viral that talked about a guy arrested while taking pregnant wife to the hospital, left out detail that the guy was wanted for murder in méxico, these are the types of things that ice has to

2:33 am
morning and, you know, for us it's just another promise that donald trump made on the campaign trail to try and help our industry and for us when you go through 8 years of an administration like the obama administration where someone vowed to bankrupt your industry basically, for president trump for whatever he is doing to do to help industry, you know, it's great for us to be able to say we have someone who care about the people in the state and cares about the people in our industry that he's got our back and so people wonder why we supported him the way that we do or why we do support him the way that we do, this is one of the reasons why. rob: is there any indication of what you're expect to go see from this? do you have any clues of what exactly policy wise this would look like? >> as worker in the industry, i don't have any idea exactly
2:34 am
what's coming but like i said, anything that can be done to roll back the kind of restrictions on the power plants that hinders our products from being used is going to be a step in the right direction for us and, you know, the fact that the president is willing to go back for us regardless of what anyone else says, strengthen the support of people from the state. >> about 35,000 coal-mining jobs were lost under the obama administration and i know that president trump is holding a rally in charleston, south carolina on tuesday and you were helping to get coal-mining people in the industry to go, if you had a chance to see president trump, what would you say? >> actually here in charleston, west virginia, if given the opportunity, i would like to be able to say that i was the person who met hillary on the

campaign trail and was the coal worker and hopefully it's something that stuck out to him, something that he remembers or something that he's familiar with, i would like to opportunity to tell him thank you, you know, i don't -- i'm not necessarily a voice for this industry but i would like to be able to say thank you from the bottom of my heart as i reached out to a lot of people this weekend, i had a lot of people to say they had opportunity to thank him for industry and thank you them for people who want to get up and go to work and provide for families. >> 35,000 jobs lost is a ton. rob: there's indication that cheaper solar power and gas power as well could be real competition for revival of your industry, the president has been big on natural gas, he wants to push it more and wants to explore it to other countries, so do you think that coal can revive? i mean, it's going to get an
2:36 am
opportunity here but is it possible? >> well, that's all we ask for, is the opportunity, one of the reasons why the coal is not as cheap as natural gas in our opinion was the restrictions that were put on all the way across the board for using our product, so we think that this is going to help level the playing field and probably never rebound to what it once was but all we are asking for is a chance. >> all right, we appreciate it, thanks so much. >> thank you. >> the time now is 36 after the hour, a would-be robber picks the wrong story owner to mess with. >> i know that you have more money than that because it's a business. he wants to get me to back room and that was a mistake. >> wait until you see what happens, all next. >> momentum across the country shifting in november midterms, break down for republicans trying to keep control of the

didn't pull the trigger because there were children in the area he said. rob: all right, antifa at it again, taking over seattle streets clashing with police and gun right's activists despite multiple violent, some democrats still refuse to denounce this group antifa so where is the outrage from the left on their behavior, here to debate that executive director of the america rising pack alex smith and former obama campaign staffer robin byro, thank you so much for coming on this morning? robin, feels moderate and pragmatic democrats would walk away from antifa and don't try to support them at least publicly but a lot of people on the left are kind of sticking with them, we will show you a picture here that shows keith ellison holding one of their
2:42 am
books and also wearing controversial t-shirts, when you see this kind of -- picture like that, what do you think, robin? >> well, you know, this is really upsetting to me. nancy pelosi herself more than a year ago actually condemned antifa by name and said that they deserved unequivocal condemnation people calling themselves antifa, i was hoping that more democrats would take her lead and, you know, gosh, they've been deemed domestic terrorist organization by the department of homeland security, you would think that more of us would be denouncing them by name, now, i understand if you think that they are just promoting antifascism, great, but they are a violent group that's literally a domestic terrorist organization so i want more democrats to fall in line with nancy pelosi, i'm a frequent critic of hers but that's one thing she got right so i wish that more people would -- would fall on board. rob: yeah, alex, a lot of people
2:43 am
on far left see group of voting block and they are afraid to tick them off, they are afraid to let them go and to stray from them, what do you this? >> this should be no-brainer for democrats, group that uses outrageous tactics that are beyond the mainstream, just recently in washington, d.c. they threw eggs at the secret service, they ruined the counterprotests by peaceful protestors in the wake of the 1-year anniversary of the charlottesville tragedy so they are disruptive, i think, to the discourse that democrats and progressives are hoping to have, you know, that being said, though, i think that what's unnerving about a group like antifa it's not just antifa that's using tactics, look at maxin waters who is encouraging people to attack, you know,
2:44 am
members of the administration, republicans where they are, at the grocery store, at the gas station, so these tactics are becoming more mainstream and they are becoming aspoused by democratic leaders. rob: robin, comments like maxine waters, does that kind of lend credibility to antifa, does that give them a way to continue to do what they do where they feel they are justified? >> good point, rob, i could see where the case could be made for that. you know i've always heard that as crazy as this sounds that the turnout for the unit the right white supremacist rally in dc was due to antifa but i have condemned them, nancy pelosi has, i just want more people. what might really help if more people, celebrities in hollywood
2:45 am
condemn them because i don't hear any of them doing that maybe that would help because we've had our speaker condemn them but it just hasn't taken lift. rob: okay, rob, last word -- alex, last word. >> this is the cultural debate that democrats should hope to avoid, a group like america rising which uses tracking as one of primary tactics to monitor democratic candidates, this would be the question that we ask democrats as we follow them and their responses would be telling to voters. rob: yeah, i've been with some of the rallies with antifa, antitrump rallies and a lot of kids don't know why they are mad and they want to destroy something and scream and yell and a lot of it is nonsense, we appreciate it. >> thank you. rob: 45 minutes after the hour, let's check in with brian kilmeade and see what's coming up on the big, long 3-hour show.

2:52 am
republican-held seats, republicans are on defensive. the only question is how many seats they will lose, good night for republicans mean they will barely hang onto control in the house. now, there are 4 races, as you can see generally in the northeast that are tilting to the democrats right now. these are race where is the democrat is favored but very close, perhaps the most interesting is new hampshire 1. a few races where the democrats might lose. nobody has won the race by 4 points. early warning sign, if the republicans pick up new hampshire 1 on election night, what we will be thinking not a big blue wave and may be able to hang control, if they lose all four races, then republicans begin to worry about 21 toss-up races. again, they are all over the country, heavy concentration right here in the middle, i
2:53 am
think the thing to watch more than anything else on these districts is minnesota. four of minnesota's eighth congressional districts are in this toss-up category. two are open seats currently held by democrats, two by republicans, again, that's going to be later on election night, we will learn about what's happening because of minnesota. if the democrats -- if they win all tilting seats and the seats we expect them to win, they would need to win 11 of these 21 races to win control. >> so what are the big issues that will sway voters one way or another? >> three big issues, the economy, health care and immigration. those are the top issues now, democrats are much more focused on health care, republicans much more on the economy, very conservative voters are focused on immigration, key to turnout but all of these issues combined are going to be perceived or going to be viewed not just on a question of what are the candidates saying but do voters

believe they can make a difference and that's something they're very skeptical about right now. >> which party has uphill climb from here? >> republicans without a doubt. again, the question is going to be how many seats do they lose in the house, in fact, for the democrats, this might be considered a bonus round. if they have a good night, again, if the generic ballot is where it is today where democrats have 7-point edge nationally i would expect them to have a good night, they would win most toss-ups and have a chance to win 15 districts. these districts don't have a lot in common but i think the theme is you might see in new jersey and pennsylvania, suburban affluent districts that are uncomfortable with president trump. we had a special election in ohio recently, that story all over, the district the president won by dozen points and it's a 1-point race. >> thank you for educating us this morning, we appreciate it.
