hurt in a military helicopter crash in the country of iraq. according to "newsweek" 10 u.s. service members were on board when the black hawk went down. ainsley: u.s. army pilots from the special operations regiment reportedly flying the aircraft back to base after a raid. a military official says that the crash is likely the result of a mechanical malfunction. brian: this marks the third military aircraft crash in iraq. it happened this year. the last one march killing all seven service members on board. the other happened back in february. no one died in that one. so wool find out the latest there. a lot going on in iraq in syria on a daily basis let alone what's going on the chaos in afghanistan. steve: this was not during the raid. it was on the way back. we will keep you posted on other details u in other news. john brennan who once upon ran the cia and insists he is not political. he is so steamed that the man picture left right there, the president of the united states, donald trump.

in the intelligence community. you don't need to mix politics with that. steve: right. he also did say, mr. bolton in israel, he said that going forward he is okay with looking at the policy of whether or not when somebody leaves the intelligence community whether or not the security clearance follows them. brian: which to me makes more sense to have a policy. hey, listen, i want bob gates, he served a bunch of presidents, 11 different presidents, what it is. i want him informed whatever is he doing over at william and mary. i like what condoleezza rice is doing at the hoover institute. i want her informed. you should be making that choice as a president. i want them up to date so they can call and say listen, i'm seeing some of this intelligence. i know the guy over in turkey let me make the call. i think going through that list of sally yates and others right now would diminish the president going at john brennan who is way over here. michael hayden and others come out. their criticism seems measured and thoughtful where john brennan is off the hook and uses terms like

kind of mentioned that on the us what lawn on friday. why we want this fight? >> well, in a lot of ways john brennan san idea foil for someone like president trump who believes that the law enforcement intelligence community had their thumb on the scale when in the last year of obama in 2016 during the campaign and here you have the former cia director who has, you know, very shrill tones and using in my view a lot of hyperbole described the traders reactions as traitor, treasonous, et cetera. in that way it's an ideal kind of conflict and foil for trump to elevate brennan in many ways as this sort of face of his resistance. brian: interesting to see clapper go out of his way in one sound by the to say he says things that got limbself into trouble and mullen said too this is not the way somebody in intelligence should be acting even though they are out of office.

do you sense some distancing in that respect? >> i think there is -- first of all, there has been, i think, some concern for a while now. i have written about brennan in his sort of new media personality role now for some time. and, you know, my view is that it's, you know, i think that when he is interviewed, and he makes allegations and says things that, you know, the russians must have something on him. he has an obligation at this point to his viewers now that he is pundit to provide that evidence or he shouldn't make those kinds of accusations on air and should be, you know, providing that to mueller, the fbi, the justice department because those are very grave concerns. and if it's indeed true and not just speculation, not just sort of the regular kind of partisan blather, that's something that every american would have to take seriously. so it kind of begs the question. i would say this. this strategy from trump, i think, could back fire if you see more people like bill mccraven who is, you know, the special operations

commanders who oversaw the bin laden raid, is he far less partisan and political. the fact that he got into the fray this week to defend brennan, that could be, if you see more of that, that could be a problem in a lot of ways, at least for the officer suedable parpersuadable. >> what was he promised from hillary as much as people respect him and has the best commencement speech ever and over at the university of texas now. he might have a political horse in this race. we'll see. we have navy seal coming on later saying the navy seal community very upset he got involved in this. i want to ask you this. people on the left don't love brennan, correct? he is not a democratic lover boy. >> no. in fact, you know, in 2014-2015, because of a scandal that we have largely forgotten at this point, brennan nearly had to resign after dianne feinstein accused him of lying about the surveillance of

democratic staff during the, you know, that committee's report on the black sites of the cia during the bush era and also brennan at one point recommended that the staff members at the cia had sort of monitored in their research, you know, be prosecuted for violating their own, you know, rules in terms of handling classified information. so, brennan has a checkered past in this as well. i think is he a divisive figure also among progressives. brian: final thought, eli he was cia director when the russians were meddling in the election what the heck did he do about it act concern and give president obama to give a stern talkings to vladimir putin. that's not really a strategy. >> on this point, in 2016 a lot of reporting on this. brennan did try to sound the alarm. he was also senior national security official in all of the obama years. and, you know, the obama administration -- brian: he got very concerned when president obama was no longer president. eli, great column as usual.

time. ainsley: the article says dan was interviewed with mueller investigators for over 30 hours over the past nine months. what do you make of this? >> this case has gone from embarrassing to really like an intergalactic disgrace at this point. when are we going to get to the collusion? guys, the entire country, the emergency brake on the entire country has been pulled for the last year and a half because we have been told that donald trump's team, right? colluded with the russians to win an election. are we ever going to get to the actual collusion? do you know what this reminds me of, this case? ever get a really big box from amazon or something and could tell they were out of cardboard. this has to be like, what, a dog kennel or something like that? and did you go through the box and you throwing the air popcorn out and like a bottle of vitamin fills? what happened were they running out of boxes? this is like the mueller case a box of air popcorn. there is no there there.

thing. the fbi can't themselves agree if truth is truth. not just about the comey meeting you are referring to but what about the mike flynn case? hey, steve, if the truth is the truth, then how come the fbi agent who told the air quotes here "truth" and said they saw no evidence of deception in mike flynn's interview. how come bob mueller turned around and charged him with lying to the fbi. i'm not playing word games when i interview you when i sense no signs of deception. wouldn't that mean to a normal reasonable person i don't think you lied? apparently not to bob mueller. i know the media is having a lot of fun with this and playing their dopey silly games. the reality is what rudy said has merit to it the fbi themself can't agree what the truth is on this case. they charge mike film anyway. by the way, the trump team has every reason to be suspicious of bob mueller's intentions precisely because of things like that. brian: it's crazy, too. because at the end of that first story with don mcgahn he says he could not believe

the president, according to this story said go ahead, robert mueller, talk to don mcgahn. he thought the president was setting him up according to this story. it's been nine months. the president is not setting him up. and then he realizes now there was no -- there was no setup. so he talked for 30 hours in three separate interviews. he still trying to get court appointees out there. including brett kavanaugh. do you think it is true though that the president does not know exactly what mcgahn said? >> he may, he may not. brian, in my 10-plus years working federal cases and skilled lawyers for both the government on the other side, if donald trump is guilty, he is the worse guilty person i have ever seen in my life. you don't wave privilege and let your lawyer, white house counsel, by the way questionable about attorney-client privilege. most definitely some executive privilege here being the chief executive of the united states, you do not wave that privilege if you are getting the left

i get the sense that we have not fully looked into what brennan did and didn't do leading up to the russia part of this investigation and why trump was being investigated. why was the fbi dealing with the christopher steele? what did he know about this -- the whole dossier leading up? he acted oblivious. remember trey gody's question about when he first found out about it my sense is those people running to his defense might be pretty embarrassed, shortly. look part of what you see here is desperation. when you look at certain obama era people, they know that, in fact, they are at the heart of this. i think it's reasonable to guess and it's a guess right now because we don't have the data, that, in fact, it was brennan's cia which led the fbi to the dossier in britain and that in fact, the people who are tied closer to the cia than they

referendum on president trump, on the fact that he doesn't represent most americans, that his values don't line up with most americans. and so being heard in this election fits the stage for everything in the future. ainsley: do you agree with that that his values don't line up with most americans? >> listen, i think we could have a great debate if our choice is between gillibrand and trump. she is for open borders. brian: that's terrible. >> she is for sanctuary cities. she is against ice. she represents an absolute total turn around on gun control. she used to be pro-nra when she was upstate new york congresswoman. once she became a statewide new york senator she became antigun. did you go down the list of what she believes in and that's about 30% of the country. if i were trump, i would say willingly, let's have a debate over these two set of values. he likes lower taxes and more jobs shy likes higher taxes and more food stamps. pretty clear choice. conservative judges, she likes radical judges.

steve: mr. speaker, you know better than anybody, what it is like to run for congress. have you gone through midterm cycles as well. during a midterm cycle. do people vote for their national representatives for congress and in some cases senate based on the president or based on that actual representative? >> i think there is a tremendous impact in every election now because of the nature of the country. you guys are in 435 congressional districts every morning. so you can't talk about a purely localized election because the waves the things really matter. that's why i think, for example, that the story on sunday was so important that don mcgahn, the white house counsel had spent 30 hours giving briefings to mueller's staff with no executive privilege no. presidential client confidentiality. saying this is the end of the mueller investigation. you can't reasonably ask for more than 30 hours of the

more comprehensive. i can't believe peter strzok, would be considered to allow to keep security clearance, james comey allowed to keep security clearance, bruce ohr after he testifies closed doors should willingly give it up what we know about his texts and gates and webster and hayden and condoleeza rice and others, i think that is a bad precedent to go down. i think you can get both sides on the same page when it comes to pulling back on those who know everything. if you hire me to be a expert on your network and i have intelligence access, i say things, at home, are you saying this because you know stuff we don't know or saying you got it from the press? look at john brennan, he seems to be telling us things we don't have access too. when we ask him, i've become much more informed by watching the free press. do we buy that?

down with robert mueller for 30 hours to spill the beans because the legal team said spill the beans because the president said he didn't do anything wrong. >> maybe if he didn't do anything wrong, why they let him spill the beans. maybe there is no beans to spill. what really comes out of this is two things. it is extraordinary for the subject of an investigation to allow the prosecutor to speak to the lawyer. that never happens. and secondly, mueller, we hear, wants to interview the president. that is what the big debates has been about for the last number of weeks. he needs to get past a hurdle that he has a need to speak to the president. i don't see how he gets past that if he has talked to a lawyer who can tell him what the president was thinking and what he was saying when he made the decisions that mueller is looking at. brian: but the word is, andy, i know you as an american citizen says great, looks like the president is innocent to let his counsel go. you as a lawyer is that wise to

let him do that? >> i don't think i would have done it. brian: it threw mcbegan off reportedly. he thought he was being set up. >> maybe, maybe not. there is lot of speculation in the article. since mcfan spoke to mueller, looks like the investigation is winding down. we had two indictments of russians. the case against the guys who were involved in the hacking, the actual intelligence officers where in the indictment there is is not even a hint, not a whiff that the president had anything to do with or campaign had anything to do with collusion. what we're also hear something is that mueller is quietly farming these cases out after he brings them. so, a couple of cases have gone. one has gone to new york, maybe two have. one in the hearn district of virginia. one got taken over by the justice department national security division. this doesn't look like mcgahn came in and dropped a bomb all of sudden there is criminal

liability. actually looks like entirely the opposite. ainsley: will mueller, the we're waiting for this report to come down. will he write the report or finish his report before paul manafort's cases and these other cases are tried? >> i really don't think so, ainsley. obviously the reason he has gone after manafort to see what he has on collusion with russia, if anything. with all the effort he put into that, i can't see him writing the report. ainsley: even though it doesn't look like there is collusion according to paul manafort? >> the trials are not about collusion, but manafort himself has connections to kremlin-backed ukrainians and other connections. he is probably very interested in that. steve: andy, we don't know who the leak came from regarding this "new york times" blockbuster. >> right. >> but rudy giuliani was on yesterday, he thought it came from brennan, i mean rather the mueller team. watch this. >> this is a desperate special counsel who leaked this to

"the new york times" illegally. could be mcgahn. mcgahn is not doing it. he would have done it a long time ago if he was doing it. they're down to desperation time. steve: former mayor said the truth is not the truth, mr. comey and the president both have two different truths when it comes to what happened regarding michael flynn. >> what i think he was trying to respond to there to the suggestion that was made an honest person never has anything to fear from going in and speaking to a prosecutor. i can tell you having been a prosecutor, the problem with that theory is you can be as honest as you want to be or can be, but up to the prosecutor to make the decision whether you were or weren't, whether to bring charges or not. a honest person is not in control of that decision. brian: knowing in your heart that you're telling the truth doesn't get you out of jail or trouble. let's switch gears talking about john brennan coming out yesterday, i wasn't being political, i will sue the president in order to get my

clearance back. does he have a case? into i don't see how he has a case. he is a former official. there is a wealth of evidence i laid out in a column last week of politicizing the intelligence when he had access to it. i think there is an immense case to deprive him of his security clearance. i wish he hadn't been singled out in a way that makes it look like a political vendetta, but there is very good case he should have his intelligence clearance revoked. ainsley: john bolton agrees with you. there is something we were talking about on the curvy couch earlier, when it comes to attorney/client privilege there are certain things president could have told mcgahn that mcgahn is not allowed to mueller, correct? >> i read the stuff how he represents the presidency, not donald trump. that to me seems like malarkey. brian: white house counsel? >> he represents the president in his official capacity. he doesn't represent an abstraction or institution.

allegedly in defense of the first amendment but i think it is pretty clear that all of these papers have been attacking the president day in day out and the point of my column ultimately is, this is really hurting the media. there have been a number of studies now, one for example involving 4,000 american adults who said that 70% of them said, they believe the main line news organizations publish false, fake and misleading information and they know it. they know it while they're doing it. the bulk of these people think that it is because the journalists have an agenda. now that is an incredible indictment of the main line media. steve: right. because going forward, how do you ever get that back? >> that's right. part of it is the agenda is showing. that is what the opinionization of the news has done, that every story is an opinion, has taken away any neutral fact-gathering. these attacks on the president are really back firing on the

media because, if it is about protectioning first amendment and free speech rights, if the public thinks you are misusing or abusing that right, they're not going to support it. i think that is what's happening. the papers, this is a crisis of confidence in american journalism. the newspapers and the major broadcast networks don't seem to notice. they just double down on the screaming and the shouting and the attacking. steve: when they do the screaming, the shouting, and the attack, if you do it, monday, tuesday, wednesday, thursday, friday, saturday, eventually it become as dial tone. >> that's right. it doesn't register anymore. people are tuning it out. 70% think the main line media organizations do this knowingly. steve: the reason the editorials got together because when they say the president calls us the enemy of the people, that is terrible. you don't think the press is the the enemy of the people. >> no.
