tell special counsel he was aware of a trump care meeting that campaign officials had with a russian lawyer. the president think what the attorney does not know if they knew about the meeting. i did which came nothing. the answer is that i did not know about the meeting. just another phony story by the fake news media. molly: garrett tenney is live at the white house with the latest. molly: the president has said all along he has no advanced knowledge of the infamous trump tower meeting. but last month a number of media outlets reported michael cohen was prepared to testify the opposite and same mr. trump did know that the meeting had of time.those reports cited anonymous sources and this week, michael cummins attorney, davis admitted he was one of those sources who confirmed the story even though he did not know whether or not it was true. in a statement to the new york post this week, davis said, i

regret i was not clear enough to the post. i should have been more clear. i could not independently confirm the information and the cnn story. i'm sorry i left that impression. i was not at the meeting. the only person that can confirm the information is my client. today, the president again publicly attacked his attorney general. you will remember that later, back and forth between the two started when the president told fox and friends jeff sessions never took control of the justice department when he became ag. that part of jeff sessions to release a statement saying in part, i took control of the department of justice the day i was sworn in. while i'm the attorney general the actions of the department of justice will not be improperly influenced by political consideration. the president has repeatedly tweeted jeff sessions over the statement and did so again this morning saying jeff sessions said he will not allow politics to influence him only because he doesn't understand what is happening underneath his command position. how the conflicted robert mueller and his gang of 17

angry democrats are having a field day as real corruption goes untouched. no collusion. president trump followed up the tweet tweeting a quote - from lindsey graham saying every president deserves to have an attorney general that he is confident in and what makes that more notable is that lindsey graham is one of the handful of lawmakers on capitol hill this week for suggesting that president trump could replace jeff sessions after the midterms. molly: will be something people will be watching. thank you very much. reporter: you got it. mike: for more on this the spring andrew mccarthy, former united states attorney and fox news contributor. good to have you, sir. >> hi mike, how are you? mike: great! if this was the cleanup guy and michael cohen pleads guilty does it mean candidate trump did anything illegal, sir? >> i do not think so. and it is mainly because the campaign finance laws work differently depending on what your status is good for example, as a candidate,

president trump did not have any dollar limit on what he was able to spend on the campaign. they are very technical laws the campaign finance laws and the president is not a lawyer. michael cohen is a lawyer. it can be very difficult for prosecutors to establish criminal state of mind for the president. mike: how big is the burden of proof for government prosecutors? >> well, this particular statute, all of the criminal provisions of the campaign finance laws require the government to prove beyond a reasonable doubt that the defendant acted willfully. willfulness is the highest mental standard of proof in the criminal law. it really almost defies the old adage that it is no excuse. i think it would be very difficult when you're dealing with somebody again, who is not a lawyer, who did not need to be thinking about dollar limits

on contributions and who had other reasons to enter into a hush money arrangement that did not have anything to do with the campaign. mike: you bring up an interesting point. what's the difference between the role of candidate versus contributor in these cases? >> well, one big difference is the dollar limit. when you're dealing with a $2700 limit which is not a huge amount of money, versus somebody does not have to think about a limit at all because it is a candidate, i think is a pretty big redline difference between the status of one and the other. mike: i want to play a comment free from alan dershowitz from today. the owner will ask more reaction. >> the real issues could be that are being investigated, the office giving immunity to the executives of the corporations and other people. and so, i think any vulnerabilities that the trump organization or the campaign has willed to be the southern

district of new york and not in the robert mueller investigation. mike: your thoughts on that, andrew? >> i think if alan is talking about criminal liability, he is right about that. i think the president's first concern is not criminal liability. the justice department guidance for the sitting president is never going to be indicted. with respect to the president, the concern is impeachment, not indictment. but with respect to others including the organization, the trump organization, if there's any criminal liability, i think alan dershowitz is correct. that is the center of gravity right now not this molar investigation. mike: you expect the president some point to face criminal campaign finance charges? >> i don't. i do not think it will be -- if we just assume everything we know now is everything that we will know and it doesn't get any worse than this, that i don't think a prosecutor could prove intent beyond a reasonable doubt. these are very hard cases.

and i think the case against president trump would be weaker than the case against john edwards and remember, about five or six years ago when he was charged with the campaign finance offenses, governments case did not go very well. they had an acquittal on one count and ultimately, the jury hung and the justice department decided to hang up the white flag. mike: how big of a factor do you think embarrassment played into the actions here for the president and his family? >> i had to think it would be a huge factor. i know if it was me it would be a huge factor. your common sense says that it's a big deal. mike: andrew mccarthy, fascinating times. thank you for your time and expertise, sir. >> thank you. molly: a fox news alert. hurricane lane now downgraded to a tropical storm and it has really slowed down. let's look at where it is right now. there still lots of heavy showers, that is one of the chief threats here as far as

massive flooding potentially be concerned. we have fox team coverage. we have adam klotz and extreme weather sent to tracking the storms path. but first escort to steve harrigan on the ground in honolulu. reporter: molly, they were real fears here in honolulu that this could be a major storm that might make a direct hit. instead it does not seem that way at all. we've seen remarkable degradation of the storm over the past 48 hours or from a category five, major hurricane not just a tropical storm. it is really a rain event at this point. but some of the state getting hit hard by that rain. the big island more than 40 inches falling in some places. more than 30 over parts of the island as well. it has caused some flash flooding, landslides, major roads blocked off and some home rescues as well. the governor says the state is still not out of the woods yet. >> i would just like to emphasize that there still is the potential for flash flooding and rain damage due to

lane, there still is a lot of moisture in the air. the partnership, and emergency responders will still remain on the job monitoring the status of the storm and keeping everyone safe. reporter: in addition to problems from the storm, the island of maui is battling several brushfires as well. one, more than 3000 acres causing hundreds of people to evacuate their homes. very difficult conditions for firefighters trying to battle the flames and those hurricane conditions. some tough times there. some people in a shelter from the hurricane actually had to be moved from the shelter because of the fires. really battling to natural disasters at once. here in the capital, everything was shut down yesterday. including many of the airports. most things now including all of the stores are back up and running. people were told her to pack supplies. food and water for 14 days but all they got was a drizzle here

in honolulu. back to you. molly: steve harrigan, hopefully the storm was little faster. another slow-moving storms can really cause problems when it comes to rain and flooding. thank you. from the track of land let's get to meteorologist, adam klotz and the fox extreme weather center. adam: you talk about this being a slow-moving storm and it certainly is the case. moving northwest currently at three miles an hour. very slow moving wind now down to 60 miles an hour. at one point we were up to 150 mile an hour wind. it has really weakened in the last 48 hours or so. it will continue to fall apart as we track very slowly moving but it will not help with the rain. i think the heaviest rain has moved up there still plenty of scattered showers from the big island moving down the island chain. often on showers likely the rest of this salad as we continue to see moisture move across the island. we will see this moving again. again, moving slowly but this is moving back out to sea. in the next day, this will be totally out of the woods. you're talking about continuing

the weekend and it's eventually going back to a low pressure system as it tracks well away from the island the next couple of days. rainfall, 30 to 40 inches. we we have reports of the 45 inches there in the big island of hawaii. that is the big story there. back on the mainland, i do want to leave you this. we've almost been ignoring this but there are plenty of spots where wildfire continues to be a danger here across and out to the west. please they really need the rain, this is the next seven days. you can see total rainfall in the entire area, completely bone dry. there is a lot going on. molly: certainly concern for the folks on the west. when the fires take hold. adam, thank you very much. mike: summer news from the family of arizona senator john mccain. the vietnam war hero and longtime republican lawmaker is no longer seeking medical treatment for an aggressive

>> we hear about a blue wave. i say where is her blue wave? doing better with jobs are there more people working than in any time ever in the history of our country. i do not think there will be a blue wave. i hope there is a red wave. they keep saying whoever is president, they do not when the midterms. but no president has ever had this economy. mike: the present speaking of the ohio gop state dinner in columbus ohio. summing up the state of play in the midterms and predicting a strong showing by the republicans with the help of a strong economy. we have more from washington. reporter: what are the prospects for a red wave in congress, november? it is the president's help for the midterm elections.

[applause] i don't think there will be a blue wave hope there's a red way. >> the conventional wisdom says the party that controls the white house moves in and the election. democrats will have to flip through 23 seats but there within striking distance of doing that. and there may be an enthusiast -- recent poll shows voters at back to the clinton are more likely than donald trumps voters to be extremely interested in the 2018 races. >> will call the democrats soft favorites. which means that if you have a blue wave, we don't think at the current time it will be one of these tsunamis that will win 40, 50 or 60 seats.

essentially running again he plans to win again. during the course of his campaign, he had all of that confidence and was exuding it and constantly beating the competition. so when not believe him now? that this potentially could go a republicans favor? >> well, i think that the one thing that is a big concern and you may see him confident in some respect if you read the tweets every morning, he seems very shaky. about the whole robert mueller probe which i think is energizing a lot of people on the left. i think he has a lot of troubles, we know that they are showing strong signs in tennessee and the senate race. we've all work within striking distance in texas. we see that republicans who have tried to go to measures of voter suppression in georgia have been challenged by the courts. and so, that shows good sign for stacy abrams. we really have a lot of things to be very confident about. i think there would definitely

be a blue wave but i do not like to talk about waves because waves begin and demand. you want something that will carry through the 2020. molly: christopher, it seems it really both sides are cautiously optimistic. and the republicans seem to be, feeling a little better. at first it was a lot of talk it could be bad. now this seems to be more talk about how potentially it may not be as bad. and the president say why not? maybe there is potential for a red wave. >> me to say republicans, we are not cautiously optimistic. we are optimistic! so a couple of things. first of all, the whole conversation about this blue wave is really fascinating to me. it is fascinating because the blue wave has simply ãit will simply crash up against the redwall and it will be the end of that. from the perspective of americans, americans do not care. i keep hearing this and i just heard a moment ago. about the concern about the mueller investigation.

block,blah blah blah . americans want to know if we can feed our families come over to the economy look like? >> some can't feed their families retina. from my perspective really, we're looking at if we are better off than we have been under the failed policies of the last, the answer is yes. thus, there really is nothing to be cautious about. we are optimistic. republicans retain both the house and the senate. molly: jason, as we look across the map they were seats held by republicans. they held eight out of none of the seats in the special election this forces 2016. however, democrats, these were very close races in places that the president had these wide margins. we just saw republicans managed to hold on in ohio.

in that special election but by a tiny margin, the democrats came very close. is that some of where the help from democrats is coming in? even the republicans have managed to hold the seats for the most part and have their win. a win is a win. it seems that there is some enthusiasm. >> absolute peace with the balderson situation he should've won the race far and away but we see that it was razor thin. i think he won by about 1600 votes.it's a very thin margin. it is something that has been held for 35 years by republicans. and complete republican dominance. the fact that we are even in play in places like that should be very scary for a lot of republicans. this talk of a redwall, the redwall will get demolished by this blue wave coming up.

i like it confidence, i hope he stays confident. i think that kind of confidence is what keeps republican voters at home. i think you should think twice about that. and try to motivate his people and tell them about a blue wave rather than saying no, leave nothing to worry about. molly: christopher, bring you back in, only talk about what we seen on the map. 8/9, greater republicans for the one seat they got the democratic victory, the upset was in their corner, southwest pennsylvania where conner lamb, were actually during the course of his campaign agree with some of the donald trump policy, especially on tariffs. is that will be looking at here?if you can find the candidates that really match their district, be it democrat or republican. especially in the areas where the fight is so hardware the president was making statements about the economy. is that part of what we are watching? that economy? >> it is in fact part of what we are watching with the issues. but to the extent of the kind of conversation and the kind of confidence that we have as

republicans is what's going to keep our voters at home. nonsense. in fact, it is what is going to motivate our voters. and, the left, although they are very shaky to talk about it, is secretly talking about impeachment behind closed doors. that is the kind of stuff that gets us motivated. so good luck with that. >> i don't know if it is so much of a secret but we shall see! about a lot of these things. he could be giving orders to his attorney general, it could be declassify information related to the investigation. but if you take the tweets at face value, he seems to be implying that he would like the hillary clinton email investigation to be reopened by the fbi and justice department. and there was that inspector general report that was highly critical of the fbi and conduct during the investigation. he stopped short of alleging bias. that report made a little bit difficult i think to argue for reopening the probe. but maybe this report if true, that they missed a lot of emails, did not really directly examined very many of them, maybe that could be reopening the investigation. molly: the article is interesting it essentially talks about, at mann time you wonder how they managed to read that many emails. and the sex crimes investigation of anthony weiner. it was attributed to as james

comey told congress, they said the wizardry of our technology. a lot of folks thought that this was a lot of ground to cover in a short period of time and talked a lot about that. could that potentially to the reopening of the investigation? >> certainly, it is unlikely all of these emails were about yoga lessons.if it is a case it seems it would be a need for more answers as to why they were able to reach conclusions that they reached if they did in fact, only examine a small percentage of emails. i know there are some on capitol hill i would like to see a special counsel, maybe robert mueller, expand his orbit a little bit. or maybe a separate special counsel that would investigate what went on in this investigation. maybe that senator lindsey graham and others called for that. maybe this report will make that a little bit more work because this to be more support. the president clearly has used this as part of his feud with

jeff sessions but i think the general impression the president has is that the tribe scandals are taken much more seriously by the federal government than clinton scandals. i think this is another opening for him to make the argument. molly: seems to be one of the key complaints of the president that he made repeatedly. i want to take a listen to, this is an interview. with the president just last week to take a listen and i'm glad to get your thoughts. >> at the right time i think will have to do the documents. i did not want to. but i think i will have to. there is such corruption. before i got here, it is from before i got here. it is the obama administration. you look at what happened, they surveilled my campaign. it's very simple. the fisa report. molly: and that aired broadly over the course of this weekend. we got a chance to listen to a lot of what the president had

to say. what about those particular issues? what are those thoughts? >> i think the president, that is one of the things a lot of people have been wondering about. there has been his demand, particularly in the house for more of these documents pertaining to the trump/rush investigation to be released. the justice department in them and under the trump administration has been slowly walking to the release of these documents. except in heavily redacted form. the president does have the power to declassify these documents himself. the question has always been why doesn't he do it? is it because they don't say what he wants us to believe they say? or is he trying to maintain an image of impartiality and reluctant to get involved in that basis? if it is allowed at celtic is beginning to assist patients and he may be more inclined to get involved. >> it will be fascinating.

helped with north korea as much as they were earlier in the year. molly: gillian turner, thank you very much. mike: joining offer more in this we have jim wash, to national security expert at mit security studies program. jim, great to have you. the president says he is not satisfied with progress with north korea. now what? >> now, i think there has been reports that the secretary pompeo has had difficulties when he visited pyongyang. they've not been able to make much progress. i think we can all agree on that. the question is what is the cause? this seems to be two possibilities. one is, as north koreans have done in the past, admitting they are slow playing. maybe the president needs this deal more than they do. and they will take their time. and so, pompeo comes to pyongyang but does make progress because at the end of the day, the north koreans know it's about mr. trump. if that's the case it could be

a good tactic. he has used it before you may remember just before the summit in singapore. we pulled back and canceled it then they added it again. if that is a because i think it might be useful. but if the cause of this slow progress is that the u.s. is making proposals that are simply unacceptable to the north koreans, then this tactic is not going to change the fundamentals there. both sides have to make it where both sides act. you do something and i do something. that is the nature of negotiation. at this point we really do not know what the cause is. >> the president spoke this week in west virginia about his relationship with chairman kim. let's play the sound and i'll get you to react. >> i got along very well with kim jong-un. really. good chemistry. but i can tell you, there has been no missile launches, there has been no rocket launches, there has been no nuclear tests. and they say what is taking so long? i've been three months, i have a good relationship with chairman kim.

mike: to be fair to the present, during this time of trying to figure out what the north koreans are doing, there have been no nuclear test, no more bad behavior. is that a bonus, jim? >> absolutely! i've said all along, week after week that it is a win. if they are not testing missiles than their missiles are not getting better. i would add to that that we have our american detainees back. that was a win. mike: sure. >> was of serious negotiation to do. that was simply a declaration now we have two get down to the real hard negotiations. but i think that it has all been to the benefit. and i know it is jarring for people to hear the president say those things about kim jong-un. but you know, actually, even though it is hard to take, i think is a good thing. i think he's keeping this, he's not letting the problems in the negotiation seep into the relationship so that -- and i think keeping separate will make it easier to have

successful negotiations.but they have to negotiate. there still a lot of hard work ahead of us. mike: what about china and all of this? the u.s. is battling with china over trade issues. there is concern about china doing more to do with the north korean nuclear issue. what about china? >> this is where i was little concerned about what the president suggested. i've never liked the idea of tying the north korean issue and the trade relationship with china together. the president has done in different ways over time. it seems to me these are different issues. and it is mice and elephants. if you asked me which is more critical national security issue i would say it is north korea's nuclear program. i think it's a bad idea to tie them together. and if the proposition is that well, once we get all of this stuff solved then we will have north korea you know we will deal with north korea, that does not sound like a good plan to me. it could take a really, really long time.

anything is better to keep these things separate. it is in china's self-interest to make sure north korea behaves. let's work together cooperatively on that and then keep our fight over trade separate. that is what i would say anyway. mike: what is your take on secretary pompeo naming a new special representative for north korea? >> mike, it is great news. i have been pressing for that for a while. as talented as he is he cannot be everywhere at once. at some point he has to stop going to pyongyang and have delegated staff members have responsibilities to go continue to carry the ball forward. i like that made the appointment. word on the street is that it's a serious guy. i welcome that and so, hopefully he can get in the saddle and again to have a real hard negotiations. north koreans want some things. they want an end to the korean war, peace treaty, we want some things. we want to see a list of all of the nuclear facilities and the way to go forward is to create those. mike: jim walsh from mit, great
