confirmed 3 of the 5 adults charged in connection with running that alleged extremist compound in new mexico had been released and they are out of jail. they are free, district judge emilio chavez dismissing charges because of failures on the part of the prosecutors to follow a procedural requiring them to hold an evidentiary hearing within 10 days of the suspect being charged and jails, he called a very difficult decision to make but the 10 day rule left him with no options. prosecutors could seek charges by asking the grand jury to indict them but no indication how they will proceed. in a separate case two of the five adults arrested in that raid on the compound remain in jail on child abuse charges result in the death of a 3-year-old. the dead boy's father pleaded

guilty that is not guilty. the defense attorney urged caution over the religious and ethnic implications at play here. >> inflammatory issues about their religion or race or whether they are jihadists has no bearing on the primary issue. >> the judge in that case, jeff mcelroy had a message for the public. >> i urge everyone to not react. the information in the warrants that were filed, but rather react to the evidence as it is developed in this case. >> the deputy district attorney was asked to comment on both judge's criticisms. we respectfully disagree but this is a story that is going to grow as three of the five are out this morning. we will find out what happens. shannon: we will find out more later in the show.

for the child abuse charges. the other charges would remain but these child abuse charges, the hope was that would be enough to keep them locked up but because the prosecutors did not schedule a preliminary hearing within 10 days of taking them into custody which is the deadline they had to work with and they got off on a technicality and so there is a lot of blame going around, people justifiably disappointed in this but it does not appear to be the judge's fault but of the state in this case. shannon: now what? does it but the public at risk? safety at risk? these are three people facing serious charges and now they are mixed in with the public. >> now we go back to the initial ruling by the other judge that said they could get on a signature bond, you can sign a piece of paper promising to show up for trial and if you don't show up there is a $20,000

penalty but you can be on house arrest with an ankle bracelet and check in once a week with the guy supervising you and that is back to where we are now and it is frightening, these three individuals, three of the five in the compound are very dangerous and at this moment they have maximum incentive to try to flee even if they are under house arrest or to try to carry out an attack and die because they don't want to go to jail. if your jihadist you want to die as a martyr and they know if they go to trial they will get convicted and be locked up. for them the choice is try to flee or try to carry out an attack. rob: all charges against these three are off the table or just the child abuse charges? >> reporter: just the child abuse charges. there is always the chance of additional charges. identity fraud or things like

that. rob: do you expect more charges to be brought? there is a lot more here than child abuse, the planning of a terrorist attack, the kid that died, do you expect new charges to be brought? >> reporter: they are looking at any possible way to do that. we do know the district attorney's office says they are going to appeal the initial insane ruling where the defendants were given the signature bond so they could essentially go free and be on house arrest, so secure measure. you can rebuff an ankle bracelet and people have escaped from house arrest before, missing for years. even though i understand why officials say please don't panic, people are upset and worried about this and have every reason to be. the big question for me is who is housing them?

rob: a mystery solved. woman going door-to-door in the dead of night with broken shackles on their wrists has been found safe. police responding to a shooting at a houston home found that the mother's boyfriend was dead inside. some questions here, turns out he killed himself. the 32-year-old woman was his victim. they lived together. the chilling video you side the beginning set off a frantic search after this woman dressed in a t-shirt rang multiple doorbells at 3:00 in the morning, had those shackles on her wrist, she is expected to talk to police in coming days, hopefully more details to come.
