you can't turn the channel. they did get to some substance. what were your main take aways? >> history happening in front of us. my main take away, this is more political circus. this is not a constitutional inquiry. the fact that they keep asking general policy-based hypotheticals proves they are not interested in whether we have a candidate that is constitutionally fit to be a justice. heather: you were saying your opinion shows they don't understand the role of the supreme court. >> what we have our members of the senate asking policy questions. it is not the role of brett kavanaugh or any supreme court justice to consider policy issues. you have diane feinstein asking questions about gun violence and the impact on society. it is the role of a supreme court justice to review the law and compare it to the constitution.

heather: in terms of what senators are doing, with griff jenkins who is covering for us hours on end, they would go through this whole dialogue in five minutes and say to brett kavanaugh that is not what i said at all and ignore that is not what i said at all. >> this is political theater with members of the senate simply setting up soundbites for their future campaign, posing statement and raising the intonation of their voice and saying don't you agree or phrasing it in some type of question because they are not inquiring on brett cavanagh but trying to make the statements. heather: a great opportunity to educate everyone if you would ask these questions and listen to what he has to say, fascinating how the entire

process works. >> this is a great teaching moment for the american people especially considering recent polls have told us the average american knows absolutely nothing about the supreme court, they know more about dancing with the stars. heather: true. something we don't know about is who wrote this op-ed in the new york times, a big topic today. in terms of that when does the right to free speech cross the line? >> it depends. we are free to offer our opinions, free to offer our thoughts. it is when we make accusations of a criminal nature that are false and when you are a public official the standard is higher. do you have to prove that somebody made that statement with malice knowing the statement was false when they made it?
