tv Justice With Judge Jeanine FOX News September 16, 2018 12:00am-1:00am PDT
12:00 am
america. "justice with judge jeanine" is next, and remember, i'm watters * and this is my world. judge jeanine: welcome to "justice," i'm jeanine pirro. thanks for being with us tonight. i want to take a moment to say our thoughts and prayers are with everyone in the path of and affected by tropical storm florence. including my sister and her husband who live outside of wilmington. we'll have an update on the storm at the bottom of the hour. as always, a thanks to all of you for making "justice" number one, and for making "liars, leakers and liberals" to stay on
12:01 am
the "new york times" best sellers list. tonight is more than an open. it's who i am. it's what i know and what i did for over three decade. as a prosecutor, superior court judge as well as elected district attorney. the way it works is you are innocent until you are proven guilty. unambiguous word etched in stone. why would anyone ignore this truth, especially the ranking democrat on senate judiciary, senator diane fine tine, is stunning. but you shouldn't be surprised. the left is committed to the removal of a duly elected president. and now an all-out assault on our system of justice. to them you are guilty, guilty
12:02 am
until proven innocent. but no one * in all the years i spent in courtrooms has ever been able to prove a negative. so forget the time-honored notion like due process, probable cause, beyond a reasonable doubt or a jury of your -- your peers. today word and unsubstantiated facts are enough to convict in the esteemed hallowed halls of the united states senate. the ability to defend yourself or confront and cross-examine your accuser. truth in this scheme is nothing more than collateral damage if a republican is on the receiving end of an anonymous allegation. so diane, let me see if i get this.
12:03 am
another democrat, a congresswoman from california, no less, forwards a july letter to you containing a completely unsubstantiated claim that supreme court nominee brett kavanaugh while in high school tried to force himself on another high school student almost 40, i said 40 years ago. kavanaugh for anyone who even cares has categorically and unequivocally denied the allegation. so why are we just hear being this now? diane, when you get the letter, what do you do to make sure it's real? that the person is even real? given the penchant to buy fake dossiers and make up facts and collude with the media to sabotage even the president of the united states, forgive me if i think it's all hogwash. okay. you say quote the individual
12:04 am
strongly requested confidentialality, declined to come forward or press the matter further. and i honored that decision. diane, you honored that decision. did you even speak to this alleged person? did you meet with her, talk with her, interview her. did you ask her to meet with others? did you ask why she said nothing for almost 40 years. and diane, why would you wait to even send it to the fbi. is it because nothing in you and your pack of demon rats, that's what i said, demon rats, aka, democrats bag of tricks was working against kavanaugh. nothing was working what you were doing, including cory booker and every unhinged lunatic you could find. >> bre brett kavanaugh to serves
12:05 am
associate justice of the supreme court of the united states. >> we cannot possibly move forward, mr. chairman with this hearing. we have not been given an opportunity to have a meaningful hearing on this nominee. >> mr. chairman, i agree with my colleague senator harris. >> everyone else joining us today. i know this is the american people. >> mr. chairman, i move to adjourn. mr. chairman, i move to adjourn. judge jeanine: diane, you have been sitting on this letter for two months. you let brett kavanaugh foe through days of hearings and
12:06 am
issued 1,300 follow-up questions, now, you want to character assassinate this man who has undergone six fbi full field investigations where no such allegation reaccept belg this anonymous man sense has ever surfaced? diane, as a ranging member of the committee interviewing kavanaugh how could you let a moment pass without addressing the issue when kavanaugh was in front of you and had the opportunity to respond. why would you let it go? let me tell you why you let it go. even you didn't believe it. what other reason could there be. i know about women who have been sexually assaulted and the kind of pain they go from. it's different from other crimes. it lingers and rears its head throughout their lives. i prosecuted on their behalf for
12:07 am
decades. one of the ways we establish their credibility is with how recent their complaint is. a recent outcry is enormously powerful. an anonymous one 40 years later, not so much, diane. but silence? you bozos in congress had taxpayers money to pay staffers who were victims of sexual misconduct from senators. whose side are you on? does it depend on the politics of the accused. your audacity to try to destroy a man with impeccable credentials, harm his family and shift the burden of proof to the accused by alleging one of the most of heinous allegations
12:08 am
imaginable shows your complete disregard for truth, justice and the american way. that's my open. do you think dianne feinstein is a liar, leaker or liberal? or all three? there is only one way to find out. my new book, "new york times" number one best seller, the case against the anti-trump conspiracy. joining me now to discuss the vital issue of conservative censorship. house majority leader kevin mccarthy. after all these months, after brett kavanaugh has been in the public eye and under scrutiny, and diane feinstein at the
12:09 am
11th hour says i got this anonymous letter 40 years ago and he sexually abused somebody, and we didn't bring it up until just now. what took them so long? >> you make a great point. she waited until after the hearing. but this wasn't the only hearing this judge has gone through. he has gone through all the background checks. he has been appointed a judge so he had to go through there as well. it never came up. remember senator feinstein, her own body person, her driver, we found out worked for the chinese government, and we didn't find that out until a couple years later. this is politics. this is how far this country has split apart. the "new york times" would print an anonymous letter without a name. now they are going forward with this. this is the wrong thing to do by the wrong person. if you watch that entire
12:10 am
hearing. we have one senator who thinks he's spartacus because he's releasing information that's already released. they embarrass themselves. this is not where we are going. we have three separate branches of government. judge kavanaugh has been through every scrutiny there possibly has been. the way he handled himself with all the uprising. all the people that would try to break it up and get arrested. he had a mind, i think i want somebody like that. he kept his head and answered the questions. judge jeanine: i want to move on to something that is incredibly important and i want to continue to talk about going forward after tonight. and that is the google twitter, facebook and what is going on. you are at the tip of the spear in congress as it relates to
12:11 am
getting going toll come before you and answer some questions. why and how far are you getting? >> understand this, judge. i'm fired with another congressman, patrick mchenry on the innovation initiative. i believe in technology and i come from california. but i don't like bias toward conservatives. this is something we have been working on, we have the ceo of twitter who came before us. he admitted he shadow-banned conservatives. judge jeanine: explain to my viewers what you mean by shadow-ban. >> they went through a conservative on twitter, puts some information out. long before they went even know it's not going to all the followers. people don't see it. people aren't seeing it on the twitter feed.
12:12 am
what they did to prager university. they banned when they talk about baseball or israel. but the real concern i have today was google. your viewers have to understand, 90% of all searches go through google. when you go through that second page of the information, 95% drop off. they control the information we are seeing on the internet. when you see the video that came forward -- >> i want to show it right now. it's a -- go ahead, guys. can we put the sound on what was going on at google? >> most of people here are pretty upset and pretty sad for -- because of the election. >> in the first moment i really felt like we were going to lose, there was a massive kick in the gut that we were going to lose. and it was really painful. >> we'll be strong and vocal.
12:13 am
and not just from a press standpoint or p.r. standing point. but actually working hard behind the sanes. judge jeanine: that's the day after donald trump was elected. there is prove positive they hate conservatives and hate donald trump. can conservatives feel safe on facebook and twitter and should they get information from google? >> that's what we are working forward on stopping the bias. they have a silent donation where they work to get certain people to the polls to vote for hillary. but what is disturbing as an american. google stopped working with the u.s. military. but they work with russia and china. in china they created a search engine so the chinese government can spy on people searching.
12:14 am
the words they are searching for are human rights. remember when google started? their motto, do no evil. don't do evil. judge jeanine: congressman kevin mccarthy, i want to have you back on this. this an important issue. thanks so much. joining us to discuss the latest in the never ending mueller witch hunt. tom fi -- tom fitton. i'm tired of always giving you kudos. >> i'm not tired of it. judge jeanine: we have the strzok and page emails. clearly they are in a situation where they are intentionally trying to leak. they are saying don't believe your lying eyes. we are trying to stop the leaks
12:15 am
and they pat each other on the back when they get negative stories about the president or carter page. tell us what the latest is. >> they talk about the media leak strategy. and there is news reports out this weekend saying that the leak of the dossier which they are talking about over unclassified systems, the disasterrier was classified according to the fbi and doj. they say the leak of the dossier at the beginning of the trump administration to cnn and buzzfeed, they said maybe we can use this as a pretext to interview people. this leak strategy that they know was happening. it was coming out of their sister agencies, the fbi is acknowledged to be involved in stories. they knew christopher steele and fusion gps was leaking information. they didn't tell the fisa courts
12:16 am
that. they were spying on trump, they were taking up the information from the trump campaign phone records. they were targeting carter page with an illegal fisa warrant. , through this page warrant. and all part of that strategy was the leak of all that classified activity to make trump look bad. i was laughing because this google video, you could have had the same video videotaped of the fbi. that was the reaction of the fbi to the trump victory. judge jeanine: the whole thing is sick. we have carter page coming up as the next guest. but way find so incredible is that when this stuff is leaked, they actually come out, peter strzok, just like he did at the hearings. his lawyer says they were investigating leaks and they wanted to stop them.
12:17 am
but we now know that there are text messages to each other about congratulating each other. they are getting articles written and the strategy is work is consistent with the articles coming out. what is coming next? how much worse is it going to get, tom? >> these are text messages they found that supposedly had been deleted. so there are emails no one has seen. they are slow walking the release of emails to judicial watch separately. there is the rest of the fisa application that the president by all accounts is prepare topped declassify. it's a matter of when, not if. my view is the president needs to stop it through executive authority on his own or seek court action to stop this mueller investigation. if all the comes in an investigation before you were doing this corruption, what
12:18 am
would you tell the prosecutors. you would tell them to investigate the prosecutors. judge jeanine: the word is the declassification may happen soon. governor mike huckabee is next. is president trump ready to disclose documents that could shed light on the russia investigation? i talk live next with one of the key figures in the investigation next. carter page.
12:21 am
12:22 am
comcast has connected more than six-million low-income people to low-cost, high-speed internet at home. i'm trying to do some homework here. so they're ready for anything. judge jeanine: president trump looks poised to declassify fisa applications against carter page. joining me, carter page himself. your first visit on "justice." we are delighted to have you on. i want to start and november quickly through this. you have been through so much. we now know the liars and leaks and liberals in the doj as well as the fbi want to frame donald
12:23 am
trump to impeach him. do you wake up at night and say this is a huge thing that's going on, how am i in the middle of this? >> it's like i often say, judge jeanine. it's not about me, it's about fixing the disaster it created for this country. judge jeanine: how are you so tough? >> i have incredible support from people who have been doing a lot of work, including tom fitton and judicial watch. people in congress like chairman nunes and chairman grassley who have been doing so much to try to get the truth throughout, and you and your team at fox. it's been incredible. judge jeanine: do you ever wonder why it was so easy for them to accuse you? this has been going on for years. you are still walking around. but do you ever worry? if they were going to frame the president, maybe they will frame
12:24 am
me too? >> certainly they would definitely try. congressman nunes -- congressman schiff is constantly throwing out words about me, testifying incorrectly in front of congress, et cetera. it's so preposterous. judge jeanine: now, you know, paul manafort is put in solitary confinement 23 hours a day in an effort to break him. and right now, we realize that, you know, they will do anything to break someone in order to get at this president. but the strong and page texts now make it very clear that they were leaking information about a fisa warrant involving you that no one in this country has ever seen in a newspaper before. should these guys go to jail?
12:25 am
>> judge jeanine. it's funny. devlin barrett in the "washington post" had a report about me having interviews with the fbi. the following month they kept having the various leaks you are referring to. i told them similar to what in manafort's attorney said yesterday. he had security threats. he's concerned about his safety. that's exactly what i told the fbi that month as well. it's a terrible shame instead of thinking about safety of americans, they are concerned about political agendas. judge jeanine: i see your tweet from today. you say with you, too, have suffered death threats, carter. >> absolutely. i alerted to the fbi to this in march. and sure enough, you know, as
12:26 am
you correctly allude to, liars, leakers and liberals. the following month after i spent 10 hours as was illegally disclosed to the post later in the year. sure enough i actually had additional death threats after that came out. judge jeanine: i'm so sorry, carter page. thanks so much for being with us. keep the faith. the truth comes out. the war of nasty words between the president and the former secretary of state over iran. we'll hash it out next with the panel. dan bongino and chris hahn ready to go at it is going to fall ovr
12:31 am
12:32 am
girl. judge jeanine: that's president obama's former secretary of state responding to the president tweeting this earlier. john kerry had an illegal meeting with the leader of a hostile regime. he told them to wait out the trump administration. was he registered under the foreign agents registration act? bad. my panel is ready to battle it out. and dan bongino and chris hahn join me. you have got john kerry having meetings with the foreign minister of iran about the iranian deal because he knows the president is going to can it. three times they meet. why isn't this a violation of the logan act which prohibits an
12:33 am
unauthorized american citizen with negotiating with a foreign government? , chris hahn? >> he wasn't negotiating. did the president get together with john kerry to sell more books? he has done more for john kerry's book sales than if he had gone on every show around the country. judge jeanine: the logan act prohibits an unauthorized american citizen from negotiating with a foreign government. what's he doing with the prime minister of iran? >> the logan act is crap. no one has been successfully prosecuted using the logan act in the history of the united states. the logan act was the predicate for going after lieutenant general mike flynn when sally yates was the deputy attorney general. so chris cannot have it both ways.
12:34 am
opinion him down on an answer right now. either the logan act is crap like you said or he'll fully renounce and apologize to general mike flynn for this nonsense. >> mike flynn was negotiating policy. john kerry met with a former colleague about a world event. and he said wait him out. judge jeanine: in addition to munich he met him in norway and at the u.n. he admits he's talking to him aboutal damaging the iran deal. that's negotiating with a foreign power. >> he was not negotiating. they are chatting. it's like you and i. we want to talk politics. judge jeanine: i'm not the secretary of state and you are not a prime minister. danaminister.dan, hit
12:35 am
it. >> this is why people cannot extend liberals. i don't mind democrats. it's liberals like chris. did you see how he snakes his way out of that? john kerry was involved in a dispute with the united states over the iran deal. he was unauthorized. he went over seas and told the iranians, an enemy of the united states, what to do to battle back against the trump administration. >> i told him to wait it out. judge jeanine: why would kerry be so invested in this iran deal? is he invested? >> of course he's invested. he's the one who got it together. judge jeanine: i guess it doesn't apply to democrats, only
12:36 am
republicans. >> i think the president would do a good service by not making this a big deal. judge jeanine: go ahead, dan. >> get john kerry's advice. chris, did you miss the election? your whole crew got their butts booted out of office. time out. chris, shut it. this is the same guy we are supposed to take advice from tax policy from john kerry who parks his vote in rhode island to avoid paying taxes. judge jeanine: you want to talk about swift boat with john kerry. >> that's a low blow, judge. judge jeanine: it's not a low blow, it's appropriate. i read the foreign minister is the best man at the wedding of john kerry's daughter. what is the connection here. why are they so desperate to make this deal with a country
12:37 am
determined to destroy us. >> i think they wanted to stop them from getting a nuclear bomb. judge jeanine: really, did that work? dan, go ahead. >> judge, they put them on a pathway to a nuclear bomb. did you miss the press conference by netanyahu when the israeli spy took out a treasure trove of documents, literally showing how the iranians are still building the bomb. do you watch this channel? do you watch the news ever? judge jeanine: and they were spinning the centrifuge while they were negotiate was and not even tells us. they lie. they want to kill us. >> i think the iranians have to be watched closely. judge jeanine: we don't have the ability. we can't monitor their nuclear development, we are not in the
12:38 am
pac. >> we pulled out of the pac. >> when we expect the iranian -- when we inspect the iranian iranian facility we have to ask their permission first and they provide a guide for us. i'm sure they will bring us right to the nuclear bomb. judge jeanine: why does it always end this way. michael moore's dire prediction for the 2020 election. get ready to have a good laugh on the most of outrageous things said this week.

justice. liars, leakers and liberals like michael moore trying to ramp up fake fear. >> who do you think will beat trump? >> the honest answer is i don't know if we are going to get to 2020 as a democracy. judge jeanine: what's he talking about? he don't know if we are going to get there. what does that mean? >> he may be right. democrats refuse to accept election results. if you think about it, back in 2000, the previous republican president, they didn't accept the election results. they have done the same thing with donald trump. the one thing we can't survive as a country is when either side refuses to accept the will of the voters. and democrats don't accept
12:44 am
election results until necessity win it and they use the result as a bulldozer to run over everybody. judge jeanine: do you remember when hillary clinton said we have got to make sure that donald trump accepts the results. you know, when they thought she was going to win. they were so worried he wouldn't accept it. let's go to right now we have got what is it, obama at an ohio rally. take a listen to this. >> when you hear these folks brag being this economic miracle. just remember when it started. just remember when the ball got rolling. we, we spent 8 years pushing that boulder up to the top. we get to the top and it start
12:45 am
rolling down the hill and he says look at how we are doing. they are standing there and didn't break a sweat. judge jeanine: go ahead, governor. >> i never knew how humble president obama was because he never bragged about his economic miracle when he was in office. he never talked about the record you be employment for minorities, and when president trump delivers on the things he said he would do, it's because president obama laid all the ground work. but the one thing i will remind you. do you remember when president trump then candidate was talking about what the economy was going to look like under him? president obama said that's not going to happen, it would take a miracle. well, the president, president trump promised it, delivered it,
12:46 am
and now suddenly barack obama grabs the baton and jumps in front of the parade and says i was leading it all the time. judge jeanine: i remember when carrier said these jobs are never coming back. i want to go to another outrageous comment, that is i think we have it here, kavanaugh, interesting that kavanaugh went to an all boys school and had 65 women vouching for him. debra messing said brett kavanaugh went to an all boys school, it's like you knew about the sexual assault and tried to hide it. they say because he went to an all boys school he most of probably assaulted a woman as dianne feinstein came out and delivered this anonymous hour
12:47 am
that i did my open on tonight. >> the big difference, judge, 65 woman signed their names to it. they are willing to be accountable for it. the one person who is unknown and completely anonymous with some coachy accusations, we don't know who it is. we have no idea. but i'll tell you what we have learned from all of this. if judge kavanaugh teaches and coaches girls' basketball and gives women jobs, he's a sexual predator. if he doesn't web's a sexist. but the left would love him if he would wear a dress and hang out in women's restrooms. they would applaud and say he's fit for the court. judge jeanine: conservatives silenced by social media were talking
12:50 am
12:51 am
hm. i'm thinking... will i have enough? should i change something? well, you're asking the right questions. i just want to know, am i gonna be okay? i know people who specialize in "am i going to be okay." i like that. you may need glasses though. yeah. schedule a complimentary goal planning session today with td ameritrade. judge jeanine: the attempt to silence conservatives on social media. it's a critical issue we are going to ex please on "justice." my next guest had a
12:52 am
controversial experience with twitter. executive director mark mccrory. tell us what happened. >> we tried to promote some tweets. this is a paid ad. some were accepted some did not. the ones that were rejected had the word criminal alien and illegal immigrant in them. they told us they were rejected for hateful content. only when we started to make a fuss and fox news and others called up twitter, then they backed off and said it was a mistake. we didn't mean to do any of it. i don't believe it. judge jeanine: so many people are having content banned or not included or things -- i talked to someone today who said she had something up on google two years ago and now it's down.
12:53 am
they are changing our lexicon, the dictionary. if hate speech, the word illegal alien is hate speech, why does title 8 of the u.s.c. include criminal alien and illegal alien in our statute. i'm telling you, mark, this is the beginning of their attempt to not only control our first amendment free speech, but to stop us from speaking. this is where europe is. what can we do about this, mark? >> all we can do is push back all the time. this happened to us a few months ago with a couple of these tweets. we kind of let it slide. that was a mistake. everybody needs to push back every time it happens and make a fuss by the. when you turn the lights on, the cockroaches scatter.
12:54 am
when you focus attention on their attempt to manipulate language. judge jeanine: this week the dalai lama, something he said caught my attention. i was blown away. he talked about europe being for the europeans and refugees should go home and rebuild. ways your reaction as many perceive as a controversial statement and a statement but for the dalai lama i guarantee would have been expunged as hate content. >> the whole point to refugees is you protect them while a war is going on so they can go home and rebuild. of course, that's what they should be doing. a lot of the syrians want to go home. lebanon wants to accepted them home. judge jeanine: the refugees are
