very hypothetical? is not very hypothetical brett kavanaugh and his wife and their daughters. imagine you are accused of a sex crime and informed by a lawmaker that there really was really no way you could beat the charge, no matter what evidence you presented. you could never be declared innocent except in some "very hypothetical way." how would you respond to that? you probably wonder what country you are living in. definitely not america. these are the democratic party's' new standards and it goes without saying that theyca are highly subjective and not applied to everyone. it depends entirely on how useful you are. senator ted kennedy drove his oldsmobile off of a bridge with a young woman inside. he fled the scene and left her but never summoned helped. he didn't want the dui arrest. the young woman that he abandoned slowly asphyxiated over a number of hours.t. ten years after doing that, he ran for democrat and he died a hero.

the democratic party needed ted kennedy, so they excused virtually everything he did. you are watching something similar unfold with the deputy chair of the national committee, keith ellison. last month he was crediblytt accused of physically abusing an ex-girlfriend, karen monahan. apparently she never heard about it because nobody in the party seems to believe monahan despite the fact that she is a woman. as she put it "i have been smeared, threatened and isolated for my own party all for the sake of the allegation she made for daring to speak in public. we asked the dnc today about the ellison case and they did not have much of a response." we take allegations ofof sexual abuse seriously and we are working with the state party to review the allegations. right, we are confident it will be a thorough investigation. on the other hand, why would it be? none of us ought to be in the investigations business in the first place. political parties, college administrators, rappers, all ofs us. we are not people we want

determining anybody's guilt or innocence. when not qualify for that. we have a legal mechanism for doing that. it's not flawless but for almost 250 years our justice system han function pretty well. o better it's pretty straightforward. than any other country in the world. if you believe a crime has been committed against you, you report it. that would include theft, embezzlement and sexual assault. go to police. it's not easy but it's still your obligation as a citizen, if not at least to protect the rest of us from whomever you believe did it. the police investigate and a judge or jury rendered aea verdict. that's due process. it's the cornerstone of our system and one of the main reason people moved to thisre country from other places, because it works. it's more fair they are then cnn. or a summary of judgment from self-appointed gender judge mazie hirono let's not give up on it. it's one of the best things we have. former obama regional campaign

director and he joins us today. thanks robin for coming on tonight. i want to hit you with some fairly recent news off of capitol hill. dianne feinstein, senator from california who was the person to whom we owe this story and is the one who brought it to public attention. she said today, and i'm quoting, i can't say everything is truthful about what christine ford has said. i can't say everything is truthful. how do you respond to that? >> we know back in august she took a polygraph test and determined what she said was truthful according to that test. now those are subjective and are not admissible in court for example but, there is that. >> tucker: you don'tor understand, i'm not doubting that she's saying what she believes. last night on the shelf i said i think it seems like she believes whatever she's saying. i'm quoting dianne feinstein, the person who brought us the story saying, i can't say everything is truthful. in other words, she may be lying. this is the person who brought us the story, who suspended the nomination process because of the story, now saying she could

be lying.ry i don't know what to make of that. >> what i make of that is she wants us to be investigated. they are calling for the fbi to investigate it and president trump said today he does not want the fbi to investigate that, that brett kavanaugh has been through enough already and that is just his personal opinion. but i think the american people deserve to know exactly the character of who the next nominee is for the supreme court. >> tucker: i'm sorry to pause, i'm getting news in my ear that is breaking right now that and the new demand is that she will not testify. she's been invited to testify as we have set in the open and now she think she will not until the fbi completes its investigation. it's hard to even process that how could you investigate an event that he apparently took place between three people, 36 years ago.

"the new york times" editorial page and schumer and blumenthal, we need a major fbi investigation. as you pointed out, there's nothing to investigate.

aj they want to appoint a blue ribbon commission and maybe they will wrap up their work sometime next february. it's purely for delay. >> tucker: so can i ask you, why not an independent counsel? he can take maybe four or five years to get to the bottom of it. i am giving everybody every benefit of every doubt. i'm not attacking ford who again, i said he was a nice person. this is a political tactic designed to prevent the president from putting his nominee on the court. why are the republicans in a congress playing along with this? >> i think some of them, and this is the only thing that i think makes it dangerous for s republicans and for kavanaugh and for the republic because there are certain republicans in the senate who so hate trump that they would put their egos above the good of the country, and what so many republican said about voting every four years, they would have to do it for the supreme court nominee is.. maybe for ben sasse. maybe not for senator bob corker.

"the new york times" -- i wanted to mention on here, teddy kennedy. one of the great things in "the new york times" editorial on this case was to say that things were so totally different in the 1980s. that's why this woman, dr. ford committed and reported at the time. you remember the 1980s. there were sexual assault like mad, every place. the proof of this that people aren't taken seriously in the 1980s was to link to an article in "the washington post" citing "the new york times" treatment of the accuser of william kennedy smith.

the authors didn'tm, know. apparently the previous ceo, sergei brin took a stand on this in 2010 and wouldn't let it happen, wouldn't let the censorship in china happen. got credit in "the wall street journal" for doing it. and now fast forward eight years and google has reversed itself,, but done so secretly and that seems to be the problem. i think they didn't show up at senate hearing that they were invited to, inviting growing problem for google. >> tucker: but since the rest of us are so wholly dependent, to get our information about everything in the world, how should we feel about this company helping the authoritarian government of our main rival keep its subjects under its thumb? >> i think the congress needs to invite them back and make sure that they come. obviously a subpoena power was required. the trick here is the technology of doing this being able to track somebody searches for awards like human rights are dictatorship back to their phone
