here it goes. what is roseanne's death and sexuality of muppets and jack black have in common? we'll find out. plus nancy pelosi and adam schiff employee a last-ditch effort to stall the president's order about the documents and texts regarding the russia investigation. what are they afraid is going to come out? we begin tonight with the latest on the fast developing brett kavanaugh fight. the calls began early this morning. the message for the kavanaugh resistance was clear. it began with an appearance by the ghost of's confirmation past. >> they wanted an fbi investigation before she testifies. is that the right move? should the senate honor her request? >> absolutely. it's the right move. the hearing questions need to have a frame. and the investigation is the best frame for that. >> the fbi is good at this. they do cold cases all the time.

they can, probably in a matter of days, figure out if there is corroboration for dr. ford's account. >> it would be helpful it judge kavanaugh would say i prefer an investigation by the fbi. >> laura: i think one of them is less intelligent than the rest. god bless them but we're going to get to that. amazing, though, how none of them want to examine the facts. we will do that. last night we are a former high level fbi agent tell us the fbi is trying to use kavanaugh has their political animal. and the fbi doesn't like that that much. if testimonials like that aren't enough, our john roberts reported today that a high placed law enforcement official said that there won't be an investigation into allegations against judge kavanaugh and here is why. there are no allegations of a

federal crime and the only investigation the fbi does is the background investigation. they find the info and pass on -- it on. that's already been done in this case. they don't investigate the information. the law enforcement source went on to tell fox news, quote, this is a political issue, not a law enforcement one. boy, is that true. it isn't just the politically inclined advancing this narrative, their media cheerleaders are piling on. one tweet this afternoon. a number of former prosecutors and fbi agents hate said today people who make up allegations tend not to demand that the fbi investigate them. he's of course not the only one advancing this narrative. but there is one problem with this contention. ford hasn't actually stated that she's willing to talk to the fbi.

she just wants kavanaugh investigated. think that might be an important fact or detail? late this afternoon, senator grassley at wits end over this charade submitted a letter which was scathing to the judiciary committee democrats slamming their persistent, quote, abuse of this confirmation process through delay and obstruction with every argument available. here to shred more -- not shred more, shed more light on this is the former assistant director of the fbi, bill gavin. you were called out which we will play in a moment. your reaction to where we stand with this drum beat, this incessant drum beat for fbi involvement? bill? >> laura, i am amazed at this whole thing. number 1, everybody is calling

for an investigation. an investigation of what? there is no predicate offense. an investigation if there was a rape or a sexual assault should have been done by local authorities and everybody knows that the statute of limitations has run on that now. that's number one. number two, background investigations. it's over. it's done. could the white house say open it up again? they could, but it's not going to happen. in this particular case, what could come from opening the background investigation again? we go out and interview who? number one, the alleged victim has been offered by senator feinstein where she produced a heavily redacted letter that hints at somebody that nobody knows what happened. number two, judge kavanaugh gave his point of view.

his friend alleged i have no knowledge of this and nor would i think judge kavanaugh would do anything like that. what they're trying to do is put the fbi in a no-win jackpot. it's a no-win situation for the bureau. they will say you didn't do your job. >> laura: but, someone from nbc took you to task on that analysis. i want to play it for you. and bill, get you to react on the other side. let's watch. >> my sources are presenting another view that the one that you just heard from bill gavin. the fbi could investigate this. not as a criminal matter but as part of their role background checking federal nominees. they can only do that if the white house asks them to look into this allegation. and if the white house did ask them to do that, they would be perfectly capable of shedding some light on this. >> laura: this is the rub. it's the president. it always goes back to president trump.

if president trump really cared about women and to protectwomen and cared about sexual assault allegations, he would demand that the fbi -- i guess, go back and, again, find every house with a pool in chevy chase, maryland or something and get these old georgetown prep kids to wrack their brains about a keg party 30 years ago. is there any validity to that point? >> no there is no validity at all. he said, you could dig up. who you are going to dig up? there is nobody who it tell you anything at this point in time. he said you could put them under oath. you don't put anybody under oath in a situation like this. you attain the facts and feed them to the white house and the congress and let them do what they want. you know, it just seems to me -- >> laura: this is political. >> it is. that's all it is. >> that's all they're trying to do is delay the vote and do it

any way they possibly can. i probably should not say that but that's the way i feel. >> laura: bill, it's the way a lot of americans feel tonight. thank you very much for being here. and in the american justice system, the burden of proof should be on the person leveling the accusation. in the case of brett kavanaugh his political opponents want it the other way. take this, for instance. late last night a second corroborating witness came forward with a letter to senator grassley's office. patrick j. smythe who attended georgetown prep with judge kavanaugh, he denied that the party she described ever happened. he further vouched for kavanaugh's character. this huge development received very little pick up in the more dominant mainstream press even by cnn who broke the story.

so, the question here is why? here with answers are greg -- a former chief nominations counsel to the senate judiciary committee along with gail trotter, an attorney and spokesman for the crisis network. greg, let's start with you. your reaction to the latest development. i'm sick of the word weaponize, but it's kind of weaponizing the fbi in a political calculation for the democrats. >> that appears to be what is happening here. it's painful for me to watch. there is a process there. it's confidential and keeps politics out and keeps the cameras away. and it gets to the bottom of allegations like this. it's designed to avoid politics and to get to the truth. the senate democrats chose to go another way to make it about politics that is unlikely to yield any truth.

>> laura: gail, senator christen gillibrand spoke out today with a lot of passion. let's watch. >> they are creating a false choice and trying to bully her into testifying on monday before a full fbi background check is completed. without the benefit of the fbi investigation and without corroborating witnesses to be able to testify, it's a sham hearing. i don't think she should participate in it. >> laura: shouldn't participate. sham hearing. a couple of days ago they asked for her to testify. she uses the phrase background check. which, again, is ms. ford applying for a federal job? you don't do a background check as part of this process. i can't believe she is a sitting u.s. senator. i can't believe she uses those phrases. a lack of knowledge about the process. >> it's legal illiteracy. i mean, when you talk about this, judge kavanaugh has

already passed six of these fbi investigations. there were hearings about this. and you look at what's happened with the accuser this week. her lawyers went to the "washington post" to tell the story. then they said they would let her testify. then less than 36 hours passed and they said she wasn't going to. senator grassley should be commended. and said we will fly to california and do something public. we'll do something private. we'll do whatever she wants to do because we want her to get her story out there. they want to take her seriously. i think the fact is this is a partisan smear and attempt to delay. it's falling apart. >> laura: a senator who was vocal on this spoke out as well. let's watch. >> the latest being a letter from the chairman to the democrats saying we have done everything we can to contact her. that is such [ bleep ], i can't hardly stand it. >> laura: according to senator's grassley office they made several attempts to contact her

lawyer and phone calls. i think a total of nine different attempts of communication, 11, total, now. they have been trying. they can't even agree on whether grassley's people were trying to get in touch with her. i mean, they know grassley's number too, if she wanted to testify. >> the democrats and staff refused to participate in the investigative efforts that are going on right now. they are not taking part in the interviews of judge kavanaugh about these allegations. they're boycotting everything. to take the position that the republicans are not taking the allegations seriously, it's the democrats that sat on the allegations for weeks and now the democrats are obstructing any effort for them to look into it. >> laura: and gail made this point. senator grassley and president trump said we want to hear from her today. i thought that was good. i would like to get this done. he said take as much time as you need.

he seemed to be going even farther than grassley did. like a dr. seuss thing, we'll interview on the phone or in person or private, a conference call, whatever. i don't know what else they can do at this point. >> chairman grassley has been incredibly accommodating and patient in the face of histrionics and antics from the other side. he's one of the senators who is most well known for his commitment to investigations and oversight. he has a team on the committee that is experienced in doing these things. he is trying to do his job which i can't say to be true for everybody else. >> laura: the other so-called witness, this patrick smythe, he says as far as he knows he has never seen any behavior like this on brett kavanaugh's part. every person she cites they are opposing her view. this case is falling apart.

question whether this will be significant 10 days from now. because it does look like she isn't going to testify. the american people believe in fairness and believe everyone deserves their day in court. they want to hear what she has to say. she levelled some very strong allegations. but i'll tell you that one of the big questions among the men i talked to is how far back are you going to hold someone accountable for the behavior that they did. is what someone did when they were 17, is that applicable to someone's life in their 50s? for women, the question is, is she going to get her day in court? is she going to respond to those that support her and oppose her. >> laura: on my radio -- i kind of do an informal poll on the radio in the morning. it's interesting to hear from men and women. this is from across the country, every state. they don't like the whole high

this. former secretary of state, barack obama met four times with iranian leadership. you criticized saying that's not appropriate. you can't have two-track foreign policy here. he responded by saying there is nothing unusual our unseemly about former diplomats meeting with former counter parts. secretary of state kissinger did it for decades with russia and china. what is unseemingly is for the podium to be hijacked for political means. >> secretary kerry can't get off the stage. when i am the former secretary i will get off. it's one thing to meet with the counter parts, it's another thing to do what secretary john kerry, wendy sherman, frankly, the whole gang, has done, which is to actively seek to undermine what president trump is trying to achieve. it's okay to talk with them, but you have to be working for america, working for american foreign policy. they are not. they are working for the foreign

policy that is theirs and not the one that belongs to the united states. >> laura: dana perino had kerry on and he did not deny that he basically wanted to tell the iranians to wait it out for the next administration. >> i think everybody in the world is sitting around talking about waiting out president trump. >> laura: at what point does the administration pursue some type of legal action against former secretary kerry and others from the former administration? >> i'll leave the legal action to others. i am trying to execute american's foreign policy. they are not only unhelpful but acting in ways that are harmful. to achieving what's best for the american people. that's my criticism. stop it and let it go. you had your day. we think you got it wrong with iran and we are trying to make it right for america. >> laura: reducing the refugee number, that's caused great consternation. it's another issue that president trump campaigned on.

extreme vetting. security for our country. down to 30,000 next fiscal year. bob, a big fan of the administration called it cruel and shortsighted human rights first. another group, abdication of our humanity. your response? >> american is the most generous nation in the history of civilization. it always has been and continues to be under president trump. we want to get it right for the american people. we've taken in over 4 million legal permanent residents in the last almost two decades now. we continue to take in more people than most countries in the rest of the world. we have to get the security piece right and make sure we allow those who are in most trouble, most harm's way to be taken care of in the best place to take care of them near their own country. those are not heartless things. those are things that are kind and caring and decent. it's the way to treat fellow human being and what we in the trump administration are committed to do.

>> laura: many of the christian refugees feel abandoned in syria and iraq and beyond. they can't go to these camps because they're afraid of going to these camps. how do we reach them? how do we get them in the country? >> it's an important and difficult challenge. we want to bring in all those who are most in trouble and are having the most difficulty in the places in which they reside. vice-president pence made this a priority to ensure that christians are treated fairly in and equitably in our processes. we've seen some of these issues in these camps. the state department is working to make sure that christians are not mistreated or persecuted or treated in any way that is unfair trying to make their way into the united states of the america. >> laura: the u.s. commission on international religious freedom lists china and saudi arabia, one and saudi arabia number three the worst violators of

human rights. i think of president reagan. we didn't do the heavy trade with the soviet union because of not just nukes but because what they are doing on human rights. how do we justify this huge trading relationship with saudi arabia and china given how they treat people? it's a selective decision. >> it's always the case when you are trying to advocate for american interest, you have to weigh the concerns. it's the case each country presents its own situation. what i think we've been incredibly consistent on is making sure we identify, we call out these concerns. i've done it with respect to china. i've done it with respect to every place we find religious minorities being mistreated. people from nearly every religion and 80 delegations, this administration is taking religious freedom all around the

world in china and other places very seriously. >> laura: a million muslims in china detained. christian churches smashed and churches driven underground, pastors being imprisoned. and president she -- it's heart breaking to many of us who care about religious liberty. what leverage do we have with china other than just trade. >> we will talk about china in the other context. there are a myriad of opportunities but a lot of challenges. this is a non-transparent government. it is still a very centralized government. it treats our intellectual properties hourably. -- horribly. it treats its religious minorities horribly. we have an opportunity. you have seen what the president is doing with trade to make it fair and reciprocal. what we ask with china behave in a way if they want to be a power on the global stage, they have to operate way the global

leaders have for so often and frankly in the religious dimension they have not done that. >> laura: we talked about the relationship between big tech and this administration. whether it's adversary yal. but google, specifically in china, assisting google in developing an app to furtherer is censor free expression and the ability of the chinese citizens to get information. any thoughts on that. a huge u.s. company assists china? >> it's professionally and personally troubling to me. when american companies deal one way here and another way dealing with china. it's the core problem that president trump is trying to address. which is that china doesn't permit american investors to invest on the same terms that chinese companies can invest here, joint ventures. the list is long of nonreciprocal relationships.

what is going on? >> well, on sesame street brought to you by the letter s for sexualization. a writer who wrote for sesame street from 1984 to 1998 did an interview this week with queerity and said this. we will put it up on the screen: he said, i always felt that without a huge agenda when i was writing burt and ernie, they were gay. i didn't have any other way to conceptualize them. and more than one person referred to arnie and i, his lover, as burt and ernie. he claims they are gay. this has been talked about since 1969 when these 2 characters who were roommates on sesame street. >> laura: i thought they were puppets. >> well, frank oz tweeted out, he created owe da and miss piggy and fozzie bear, he tweeted out almost instantaneously.

it seems that mr. saltzman was asked if they were gay. it's fine that he feels they are. they are not of course. why that question? does it matter. why the need to define people as only gay? he said i created bert. i know what and who he is. this is a real important thing. why does this matter. why are we sexualizing the beloved children's characters. and we see this with harry potter. i've seen it with pooh and piglet. children's characters should be sacrosanct. when you try to politicize them and it tells us something about our culture where we want to be adolescents forever and take these childhood icons and impose our hangups on them. >> laura: so what is eyeore? just kidding.
