>> trace: we begin with breaking news though. judge brett kavanaugh's accuser says he would be prepared -- or she would be prepared to testify next week but only if the senate judiciary committee offers terms that are fair and which ensure her safety. that's what the is now reporting. good evening, -- good day, everyone, i'm trace gallagher in for shepard smith. this comes after the senate committee chairman republican chuck grassley of iowa gave christine blasey ford until 10:00 a.m. tomorrow to decide whether to testify at monday's hearing. remember, democrats say they want the fbi to investigate her claims first. chairman grassley says the committee is looking into the accusation and no outside investigation is needed. professor ford claims kavanaugh sexually assaulted her more than three decades ago while they were both in high school. judge kavanaugh calls the accusation completely false. we have team fox coverage. chief congressional correspondent mike emanuel is live for us on capitol hill. but, first, to the chief

white house correspondent john roberts. is he live at the white house. john? >> trace: trace. >> trace, good afternoon to you. i just received that letter in my inbox it says dear miswillie and duck staffers with the judiciary committee. i would like to set up a call with you later today to discuss the conditions under which dr. christine blasey ford would be prepared to testify next week. as you are aware, she has been receiving death threats which have been reported to the fra bureau of investigation and she and her family have been forced out of their homes. she wishes to testify provided that we can agree on terms that are fair and ensure her safety. a hearing on monday is not possible. and the committee's insistence that it occur then is arbitrary in any event. dr. ford has asked me to let you know that she appreciates the various options have you suggested. her strong preference continues to be for the senate judiciary committee to allow for a full investigation prior to her testimony, best regards, debra katz.

hearing. and you pepper him with every uncomfortable question he could possibly ask. like preparation for a do bait. i'm told by sources that that kavanaugh did well in that session. that he was very solid. not wavering at all in answering his questions. whether kavanaugh's accuser, christine blasey ford appears open question, her attorneys continue to insist as we just read in that letter there, that the fbi open an investigation but it does seem like, through the contents of that letter that i just read, that they may be willing, under the right circumstances, provided for her safety and ensuring that the hearing is fair, to have her testify without an fbi investigation. federal law enforcement sources tell fox news there was no grounds under which you could open a criminal investigation into her allegations. you could certainly ask the fbi to develop some more information for judge kavanaugh's background

information -- background investigation. that request would have to come from the white house either from the president or the white house counsel's office. at this point, trace, it does not look like the white house is prepared. it does not look like the white house is prepared to ask the fbi for that investigation. i got another call i need to take, trace. i will get back to you. >> trace: john robert on the white house front lawn. mike emanuel is live for us on capitol hill. mike? >> trace, good afternoon. things are tense here on capitol hill ahead of chairman chuck grassley's deadline tomorrow morning and clearly investigations are ongoing about whether professor ford will testify here on capitol hill. you heard john roberts read the letter. we have seen protesters coming up here to capitol hill. some protesting in front of judiciary chairman chuck grassley's office. basically saying that they think that professor ford is not being treated fairly and that's something we are hearing from senate democrats as well. >> they are giving her an

option. the option is show up monday or don't show up at all. i consider that to be bullying. i consider that to be describing. disregarding. that is set up for failure. they would like a he said, she said scenario. do you know what happens in those scenarios? the men are typically believed. >> trace: other democrats here on capitol hill say they are working with their staff with the possibility of there being a hearing next week. at this point they are not really sure. trace? >> trace: and, mike, what's the latest from republicans? >> well, we have staff members on the judiciary committee who have been very active on twitter, basically saying what they have been doing to follow up on leads. take a look at this. staff contacted mark judge, a classmate of brett kavanaugh's and obtained a statement under penalty of family. staff contacted third person allegedly at party described by dr. ford and obtained a statement under penalty of felony. staff contacted fourth person allegedly a party. and a second tweet staff have contacted a school mate

circumstances will be and she will go first and he will go second. will she say something, have a chance to come back. there are all kinds of permutations of this that you may recall in the thomas hill hearings some of it hadn't really been worked out. i would imagine that any -- even reasonably good lawyer would say i need to know what i'm sending my client into. and that goes for kavanaugh and it goes for ford. >> trace: yeah. it looks like the fbi investigation is not going to happen and really the clock is ticking here. the truth is if she does not come forward and testify, he is going to be confirmed. i want to just bring up, because you talked to a woman named christina king miranda. she is the one that came out on facebook yesterday saying that she believes this incident did happen and then today had a big walk back saying well, i'm not really sure if it happened at all. and then she said well, look, i wasn't assuming i was going to get 50 cable

networks coming at me. what did she expect and how big is that walk-back of the corroborating evidence? >> well, i talked to her for almost an hour last night. and what she says is not corroborative. what she remembers is there had been something that happened very bad at a party that was, as she put it, not cool. but she doesn't really remember when this was. she doesn't -- didn't doesn't have any people that she talked about it that she can remember, as she actually said to me, i can't be confirmation for this. i believe it because i remember hearing something about a party that went -- where something bad happened. and she says, you know, there was a lot of drinking in the private school, prep school -- in that era of time. and she said a lot of drinking by everybody. and she said by chrissy,

that is who she knew her pretty well, by bret who she knew pretty well and she said by me. and it was entirely plausible to her and she believes chrissy but believing is not confirmation. >> trace: it's interesting you brought up the anita hill and clarence thomas hearings in 1991. you broke the story. you know more than anybody. at the end i remember you saying at the end of the hearings the country was divided along he said, she said lines. and it seems to me that if these hearings go forward we are going to get some very similar results to what you captured back in 1991. >> well, it's a very different country now. and, you know, shample sexual harassment was almost an unknown term at the time.

the number of complaint that were filed the following year were doubled. it's just a different world that we live in today. and i don't know how it would play out it would certainly play out between those who believed him and believed her. i'm sure that's true. but whether it's so much along gender lines. whether it's -- this is not a good way to go about it. it's why her lawyers would love to have the -- some effort to interview people by the fbi. it's also why republicans are upset that they don't have the full letter. so they don't have. >> trace: right. >> they don't have a date when they think this is supposed to have happened. so, if you don't -- when you are in a negotiation, if each side has something the other side wants, there is some give in the joints is all i'm saying. >> trace: it looks like negotiation is still going

shipping center this morning in aberdeen. that's about 70 miles northeast of washington, d.c. officials say the shooter died at the hospital. she arrived there in critical condition. peter doocy is live for us at the scene in maryland. peter. >> trace, the press conference with law enforcement officials is going on right now. they started taking questions. we do know for the first time that the shooter was a 26-year-old woman, they have not revealed her identity yet. but they said that she shot herself in the head and died at the hospital. they also reveal that she was a temporary employee at this rite aid distribution facility and showed up to work today as normal but was not there very long until things started because the first 9/11 call came in at 9:06 a.m. after that, frawnders got

there within about five minutes. that's when we understand that police convict quickly met up with some fire and e.m.s. they got there quickly as well. they then went into try to render first aid where it was possible and locate the shooter. they did locate the shooter and in terms of victims, were told that there were some people who sustained gunshot wounds. three of them have passed away now. three of the victims, two died at the scene. one died at the hospital. that is in in addition to to the shooter. there are four people dead in total. we are told that two others who were shot or three others who were shot are expected to survive. did i get a quick question in to the sheriff. i asked him if they have been able to rule out terror as a possible motive they have not ruled anything out but terrorism is not high on the list of likely motives for this 26-year-old female

shooter here in aberdeen. trace. >> trace: peter, you mentioned the victims. are we learning anything more about them. who they were? >> we don't know anything except where they were shot. we understand that the shooting incident happened outside of this rite aid distribution facility and moved inside. they are being treated right now, the survivors at johns hopkins bay view center in baltimore which is a half an hour away from here. at the time when these victims all got there, the doctors said that they didn't even know whether or not one of the people that they were treating for a gunshot wound, priority one patient was the shooter. listen to this. all right. well, they said essentially that a patient is a patient and they were notating between people who were shot versus the shooter. again, it looks like the authorities are still

dr. grant once appeared on reality show about online dating and local magazine once named him a bachelor of the year. cerissa reilly was at one point pursuing a teaching career. their clients say their clients deny any accusations of nonconsensual sex. thcouple out on bail. if convicted they face the possibility of decades in prison. let's bring in the lawyer who works in both the state and federal court systems. these two women turned themselves in or didn't turn themselves in but went to police wicking that tends to be damning for the suspects. >> it bolsters the prosecution case and not looking good for this couple. when have you these crimes allegedly on tape, i would venture to say that that's pretty good evidence of guilt. the fact that both of these women immediately went to the police after they allege they were raped the police found drugs in the system of at least one of these women. i think that's a good argument that the priewlings is going to make that these two defendants drugged and raped these women.

>> trace: talking about a doctor had access to drugs knew dosages to give and so forth. these videotapes and the police say there are lots of videos on iphones presumably they are pretty clear. they have audio. don't know yet. the question becomes is it hard to prove if somebody is incapacitated by just looking at videotape? >> that's a good argument. that's the defense is going to argue. you can't tell what's going on in these videotapes. were these women consenting or not? i would venture that's-to-say that's a difficult argument to make whether you have hundreds and thousands which is what we are hearing from the authorities, trace. none of those other allegations come into this criminal case. this case involved these two women and these two women are saying we didn't consent. we were drugged and raped. >> trace: what happens if -- it's a good-looking couple. he is a doctor. she is a teacher. what happens if they go through videos and find somebody no, i consented. i was willing? >> the prosecution is going to say that evidence should not come in. this has nothing to do with whether or not any of these other women consented.

these two women part of this case. you brought' a good point. this is a doctor. this is a surgeon, trace. he arguably had access to tons of medication. tons of an anesthesia sexual harassment we know, thankfully, the medical board is looking into him. i wouldn't be surprised if we see additional charges. could it be he sexually assaulted some of his patients when he assaulted them in his office? >> trace: this goes deeper. the videotapes do they play them all in court or certain ones allowed to be in court or just the victim's videotapes? >> if i'm from the state i want only these victims. you don't want any argument made by the defense that some of these women don't look like they are drugged up. they don't look like they weren't consenting to the sex. it's going to be ultimately up to the judge what is probative and what is not. the judge will only let in videotapes of these two victims. now, if more victims are added to the complaint, arguably those videos can come in as well. >> trace: orange county says they are getting a bunch of calls. >> over a dozen. the police are still investigating. far from over. the police chief says he saw

>> trace: south korea mung says he is bringing a private message from dictator kim jong un to president trump and it's about nuclear weapons. moon and kim wrapped up a three day summit. next week the south korean president is set to meet with president trump on the sidelines of the u.n. general assembly session in new york. moon also told others that the north korean dictator that wants to meet with president trump again. it would be a follow-up to their first face-to-face meeting in june which took place in singapore. the date department correspondent rich edson is live for us at the state department. rich? >> secretary of state mike pompeo wants to transform the negotiations between the united states and north korea. he has invited his counterpart for a meeting in new york next week while pompeo is up there at the united nations general assembly. in a statement pompeo says, quote: this will mark the beginning of negotiations to transform u.s. dprk negotiations through the process of rapid denuclearization of north korea to be completed by january 2021 as committed by

airport managed to get into the cockpit of a plane. that's according to investigators in orlando. police say a student pilot hopped a fence and got into an empty american airlines passenger jet. they caught the guy, but not before the incident that put the whole airport on lock down. jackie heinrich is following this story for us. what are you learning about this suspect, exactly? >> trace, we know the suspect is a part time aviation student with some flight training. is he from trinidad. he was charged with criminal theft of an aircraft. criminal trespassing and visa violation. he still may face central charges. airport spokesman says the 26-year-old parked his car coshocton side at terminal around 2:00 a.m. leaving the engine running. ran and jumped a fence before boarding the empty air bus which can hold 190 passengers. the suspect was tackled by airport personnel who then called police. they arrived within two minutes.

>> there obviously seemed to be some planning involved. if he was a student pilot from the area, he would be familiar with the airfield. >> the florida institute of technology the university has confirmed the suspect from trinidad is a part time florida tech student studying aviation management who had completed some flight training in the past. they declined to release his name but we just received i it. that suspect being questioned by the melbourne police department and the fbi joint terrorism task force. they are still working to learn his motive and any possible criminal history. coincidently this is the same hanger where president trump hosted a rally back in 2017. and last two months second incident putting airport security in the spotlight just in august a horizon airlines employee stole a regional jet and crashed it in a suicide in seattle. trace? >> trace: jackie heinrich, live for us in new york. thank you.

>> trace: number of americans filing for unemployment benefits hitting lowest level in nearly 50 years according to the u.s. alici u.s. labor depar. some economists warn the comub could go up as folks in the carolinas continue to deal with the effects of hurricane florence. the fox business network's hillary vaughn is here with more on that. hey, hillary. >> hey, trace, what this means is fewer american workers are requesting the government to help them because they are unemployed. "us weekly" jobless claims, which tracks how many people apply for unemployment benefits is at 49-year low. the labor department saying 3,000 fewer people filed up employment claims last week bringing the tally down to 201,000 claims. the lowest number we have seen since 1969. now, there is a few things driving. this one, layoffs in the u.s. are steadily dropping. they have been over the last

8 years. on top of that there is a record number of jobs available. companies are ramping up hiring to record levels and incomes are also on the rise, but, let's put these numbers into context. remember, they are calculated weekly. last week hurricane florence hitting north and south carolina. as expected, there weren't as many jobless claims filed in those states. that is playing a part in the low number of claims. economists expect hurricane florence to have a temporary disruptive effect on the labor market with many shops and businesses still under water. those employees in many cases are eligible to apply for unemployment benefits. officials say some may just have not had the chance to file for those yet. trace? >> trace: and then when the construction starts down the road then maybe those numbers go back down again. that's the hope. hillary vaughn, thank you. emergency officials are warning people that the flooding in the carolinas could get a lot worse. forecasters say some water ways will continue to rise through the weekend. north carolina's governor telling people in flood

prone areas to stay alert and stay safe. rick leventhal is live in bowling spring lakes, north carolina. rick? >> trace, this was the main dam in boiling springs lake and completely gave way on saturday night despite the best efforts of town officials who tried to drain the water out patricia lake here 3 and a half feet they draped off through a spillway to try to reduce the pressure on the dam well before the storm but there was just too much rain. that lake empty along with many others in this maul town, roads washed out here, too. earlier we met a woman at another one of the washouts trying to get home for the first time. >> never -- oh my god. >> sunny daniels grew up here, she couldn't believe her eyes lake gone and is road is washed away. one cave in has a pickup truck in the middle of it.

he got out and is okay before the road collapsed. sunny did make it home today. she found a tree on her house but wasn't as badly damaged as she had feared. >> the tree fell where my bedroom is and then this girl, the first people that got killed during the storm was a girl that i graduated high school with and her baby. the tree fell on the house. so i was just grateful. the next time i think about it you just get real emotional. you know? i'm just grateful me and my son wasn't there. >> sonny has water but no power there are duke energy trucks here today, trace, trying to get the energy back on. they have a lot of work to do. >> trace: they do. you talk about sonny's story, you are hearing all these stories from people affected. what are people there doing to recover? >> well, there is a crew here now just ran a cable line, a fiber line here. you can probably see it through the rocks and over the water and over to the other side to try to get some of these folks some

internet service back here. they have repaired some of the dirt roads in the area. created some detours so that every home here is now accessible. the police chief told me about all of this that they did as much as they could he said mother nature always wins. >> we have had flooding issues before. i think we have always had contingency plans and talked about what if. and now that what if has come to life for us. >> trace: when they rebuild this dam, trace, they have got to do it right. they are saying it could take as long as two years to fix this. this is a main road through this town. so they -- they are going to be in it for a while. >> yeah. but a little bit of wifi can put a little sunshine in a very bleak situation. rick leventhal live for us. it's been a year since hurricane maria swept across puerto rico and devastated the u.s. territory. millions of people were in the dark, some for nearly a year. homes, businesses destroyed.

city and took the roof off of this house blowing to the martinez family and tossing it into the neighborhood. it's still not livable this house down below me, as of this week finally a new roof top is going in. we took a flight in a helicopter around the island were samaritan's purse a disaster release organization which handed out 7,000 blue tarps after the storm. as can you still see in the air blue tarps still remain the only protection overhead. window farm on the coast line totally destroyed by maria. it still stands there a graveyard. life remains far from easy. >> almost a year since the hurricane still every day we go to places where we find people still living under a piece of plastic in the coastal town maria ate up much of the beach leaving about a dozen homes to suddenly collapse into the sand several months later.

city leaders where most lost power for months and as of today still no electricity. according to city leaders, the city is only 50% rebuilt at this point. and the governor tells us that despite the billions of dollars that have been spent this past year, when the next hurricane hits he fears it could all happen again. >> we have some infrastructure that has been put in. we -- all we have done right now is essentially lift up the old system. in some parts it's more vulnerable than it was before maria. >> many homes in this neighborhood and in other cities and towns across the island still are littered with abandoned and vacant homes. they have been condemned. they are not livable. the owners just basically walked away and left them. there are multiple ceremonies around the island today commemorating this very somber one year anniversary of hurricane
