>> great. ed: i thought i had a long commute. a lot of people wondering whether somebody else will be packing their bags rod rosenstein the deputy attorney general explosive story in the "new york times." is he going to get fired and pushed out? this story suggested that rosenstein in may of 2017, there was a big meeting right after james comey had been fired by the president. rosenstein allegedly talked about secretly recording president trump to document chaos inside the west wing and then potentially rallying cabinet members to invoke the 25th amendment. he is denying this story. anna: straight away this is what he is saying i never any suggestion i have ever advocated for the removal of the president is absolutely false. pete: pete see you later, rod rosenstein. my guess is, if we live in a

that we haven't had a full year of where tax have come down for american businesses. what we have had, we have seen american optimism go up on small business side. they are starting to hire a lot more. that's why you are seeing jobless claims down. that's why you are starting to see new order indexes go up. so you are seeing that companies are reinvesting in themselves as well as their people. pete: to me, that's the most important. here are all-time highs hit in the market, right? so from the dow, i think the s&p 500 we are hitting new marks. >> yeah. pete: which is an indicator. what i care about more than anything else is opportunity, wages, confidence, you are saying those things are moving -- it's not just your 401(k) it's your prospects as an employee. >> indicators are forward looking indicators. the stock market is actually forward-looking. someone is not going to buy a stock if they don't think it's going to group compared to the alternatives. we know interest rates are going up.

they think there is better opportunities. why is that? because of the policies when you have deregulation and when you stimulate the economy where you let companies decide how they want to spend their money, which is better than the government. you are seeing it go to higher and better uses. so, when you look at the leading economic indicators like i said new orders index, when you look at the jobs numbers, they're leading, right? because you are only going to invest in your property, your plant, your people if you think it's going to grow. we are seeing it take effect in the g.d.p. numbers. pete: another set of numbers, the household and nonprofit net worth rose by -- that's a big number, 2.19 trillion in the second quarter. what does that number mean? >> that means that basically what's happened is that the wealth effect has taken hold, that americans are doing exceptionally well in their retirement accounts and their investment accounts. the stock market has gone up. it means that the economy is growing, right? we are no longer in that sluggish below 2% g.d.p. growth.

when the economy grows, household wealth goes up. one of the biggest issues we had in june of 2015 is that the american middle class was actually at its lowest in 30 years. it's conception nallally growing month over month. pete: it's not president trump that gets credit it's the other guy. listen. >> the actions we took during the crisis turned the economy around. started the longest streak of job creation on record. >> yes. >> which continues to this day. so when you hear right now folks taking credit for this economic miracle, it's like hold um. >> can he take credit. >> he can't. the numbers speak for himself. if he wanted to have this type of growth he would have enacted the policies. he didn't enact the policies they took a stranglehold. we know obamacare actually hurt small businesses that's

written, these memos, by senior officials at the fbi. mccabe and lisa page allegedly was in the room, who is a lawyer. so the denials are quite weak. listen, rod rosenstein at this point has got to go. he has to be fired. there is a rumor throughout this is some set up by the media. i don't care about any of that. pete: what happens if he gets fired? the palace intrigue is what everyone wants to talk about. you fire the guy in charge of the special counsel. is there a cascading effect the media will run with forever? anna: first he got rid of comey and where is this going to end that's what they will say. >> i get the point there is always going to be political ramifications. sometimes, pete, you have to do the right thing. if this was the first strike against rosenstein i would say okay, maybe the politics aren't worth it. it's not. there are multiple strikes. rod rosenstein signed the fourth fisa warrant. why does that matter the third renewal, the fourth fisa. it matters because by the time in june by the time the

fourth fisa warrant was sworn to the facts developed in the spygate case indicating that one donald trump was spied on. two information one at the operation at the department of justice and three there may very well have been a set up of members of his team and yet he still signed off on it it's time for him to go at this point. pete: he knew better by then. ed: confirmation battle for judge brett kavanaugh. you have dr. ford, supposed to be testifying next week. there are still hangups about whether she will come forward. interesting side note perhaps, perhaps not a side note. a lot of people in the media not talking about it one of her advisors used to work for joe biden all kinds of democrats the clintons and whatnot her lawyer debra katz, one of the lawyers somebody on camera. pete: before you toss to this imagine if a republican was caught doing this and the same thing was on camera. ed: the advisor and the attorney and what they said on tape.

obstacles. in other words this isn't a negotiation intent on actually getting dr. ford to tell her story, which according to her words, they wanted out there. they will wanted this story out there. well, that doesn't appear to be the case. i mean, think about the one request, right? for mr. kavanaugh, judge kavanaugh to go first. how? how would he go first? to rebut a charge that hasn't been made? these are the kind of things people say when they're not serious about actually getting -- ed: undermine what might be a real claim from dr. ford. we want to hear from her. her advisors and attorneys are out there saying resist. pete: political vultures on top of someone that may be. anna: a real victim that is hurting inside. >> and i don't think that's going to play very well at this point. i think it's obvious that -- senator grassley has been more than fair. we will fly out to you. we will fly you. in we will do it private. we will do it publicly. we just need to hear your story. it now appears, i think a lot of people are starting

ed: after a rather chaotic week for the supreme court process. christine blasey ford granted another extension. how will this all play out. tom bevan real clear politics. how are you. >> good, how are you? ed: let's start with the idea dr. ford finally combings to some sort of agreement with chairman grassley in the next day or so and testifies early next week. what do you think could happen? >> it depends on her testimony if she comes forward and credible and sympathetic and kavanaugh's response is not, that's the only scenario in which can you see votes, i think, move on this. because, you know, we are talking about an audience really otherwise of about five or six people, right in the red state democrats who are up for re-election. ed: right. >> couple of republicans collins and murkowski on the republican side. ed: let's brake those down.

let's say it breaks down and she refuses to testify. what do you think happens? >> they are going to hold a vote. i think republicans vote him out of committee and he gets -- kavanaugh gets confirmed. ed: and then what if she does testify but is not credible? it turns out that maybe this story doesn't add up. maybe there is some holes? >> yeah. if her story does not hold up under questioning and testimony, and, again, if kavanaugh's rebuttal is strong and solid and republicans feel you know, is he convincing, i think same thing will happen. democrats obviously will vote against him anyway. but i think, you know, collins and murkowski will likely stick whim and he will get confirmed. ed: many democrats have come out before the hearings, the previous hearings, so, regardless of what happens, they have already been no votes. what if kavanaugh, who has been very direct in the last few days in saying this never happened, what if she comes forward, she is credible. and kavanaugh under the hot lights turns out, maybe is he a little weaker than we thought? >> right. so that's the scenario where you could see votes move.

right? obviously the red state democrats would vote probably, they would flip their votes and vote against him. and then you would look at collins and murkowski and perhaps even a couple of other republican senators. if kavanaugh, if his denials do not hold up, and she is credible and sympathetic, you could see that's a scenario where you could see his nomination not go through the senate. that's probably the only scenario. ed: real quick on that point before we go to the last scenario. you are saying the red state democrats joe donnelly, joe manchin up for re-election in a state president trump carried by double digits. they are on the fence right now. if she is credible. they may say i just can't vote for this nominee. >> exactly. i mean, right now the polling shows that, you know, if they vote against kavanaugh. they would pay a price for that among, you know, republicans in that state and independents in their states. but, if they have a credible excuse for voting against him, i think politically it won't hurt him and heidi heitcamp is another one in that situation as well.

normal high school type of guy. just figured i would try it as i think most kids do. next thing you know i was hooked. ainsley: what happened to the other guy? >> he was at my wedding. he was just at my wedding in july. ainsley: didn't get addicted. you just don't know. >> you don't know who has the gene and who it is going to effect, you know. pete: jill, his mother, obviouslyvel versed now in these issues. what's it like to go through this process and what's your advice tout folks. >> it's really difficult. and i think if you can stay supportive, unconditional love and be there, it's very helpful, you know, as a parent and most parents across the nation have that fear that they are going to get that dreaded phone call their kid is going to be dead. you get that call. thankfully i wasn't that and i am so grateful. for parents, they can really get support with an al anone

group. love their child and be with them without the process and without overdoing it and being overbearing. it makes a difference. it allows the child to get sober themselves if they choose to do that. when they want to make the change, they make the change. and it's possible. so it's possible for anybody. anna: again, one of the things that just paused in this vote 99-1 is more treatment clernt centers. is there anything you like in this bill or don't like about it. >> i'm a big fan of the bill. i think it's a start in the right direction. the only thing i will say i don't like -- not don't like but think could have been done better or as sooner, i think this has been going on for a long time. pete jay, you run a treatment center. you are there. now you are helping people who are there. on the ground. what's the crisis like right now? >> we see it every day.

the bill fights to stop fentanyl from crossing the border. whether it's u.s. postal system from china or from mexico but we deal with this on a regular basis. kids overdosing because they think they are doing heroin when really they are doing fentanyl which is 50 times as strong as heroin. they do the same amount and next thing you know they are dead. i'm making that phone call to a parent like my mother just said she waited for that call. i'm making that call to parents and expressing that this is what happened to their kid. pete: how do you address that crisis, someone comes to you? >> in what way? pete: a son or daughter comes to you. they are addicted? >> in florida, we would put them into our treatment center. we would start that process. the first step obviously is the detoxification. get them off the drugs. they will go through withdrawal period. they have to get off the drugs. and then bring them into treatment.

they do counseling. psychotherapy. anna: it doesn't work for some people because they are not ready to go. how do you get your kid or loved one ready? >> you have to be ready the parent can never get the loved one, the k450eu8d, the husband, the brother. you can't get them to be ready. it's a personal choice you have to get through yourself. hit that bottom. and we all create that bottom? pete: were you there at that bottom? >> i was just going to say jay had many bottoms, you always think that's the bottom. and so a court incidents which we have had many back in the day, jay had a particular court incident when he was in his early 20's, and our lawyer, who we love, he suggested send him to florida, jill, please, dear god, send him to florida. so we did. it was the hardest thing i could do but i did. he got actually sober for nine months and i was thinking yes, that's what we want. and then he used again and that was for several years. and then finally.

report "new york times" suggested he wear a wire in an effort to remove president trump. a source telling fox news the comment was a case of sarcasm. was it just a joke or more. here to weigh in the host of judicial watch tom fitton. thanks for being here. joke or not joke. does it add to the sense that the those within the president's own justice department are working against him? >> oh, it certainly does. it helps explain why they appointed mr. rosenstein specifically as special counsel to target him, despite having no good reason to make the appointment. and the story really isn't about the justice department and the fbi and meetings about donald trump. it's about the basis of the mueller investigation. and it shows you the mueller investigation was based on little more than personal animosity by top fbi leadership and rod rosenstein, evidently angry that he was being held accountable for his

involvement in key decision-making related to comey's removal. pete: sure. >> they target the trump with an harassing special counsel as a result. pete: he, of course, wrote the memo that in some part was a justification for comey's firing. but, just when you think those inside, who are resisting this president are gone or being fired, you get a reminder that they are still there. so when folks criticize this president for being critical of his doj or the fbi. not the ronk and file but the high level leadership. it's hard to not understanding where he is coming from. >> exactly. and he probably feels hand cuffed as a result of the mueller special counsel in the sense that anything he does with respect to the justice department and fbi in terms of cleaning house, is going to be met with charges of obstruction of justice. you can't fire -- well, just now, rosenstein quite credibly, frankly, is accused of talking about trying to record the president, joke or no joke, and talking about using the 25th amendment. and his statements really haven't shot much of that

cross-examining him on that statement, wow. ed: you are licking your chops. anna: he goes on to say he doesn't feel like in his experience with the president that he ought to be impeached. >> he said he shouldn't be subject to the 25th amendment. the 25th amendment obviously is inapplicable here. the 25th amendment was designed to what happened with woodrow wilson he had a stroke and couldn't govern or temporarily what happened to ronald reagan he was shot and had to turn over to the vice president. it wasn't intended to remove a president who you disagree with his policies or you think the white house is in disarray. anna: right. >> that's unconstitutional use. pete: professor, so if you are the president of the united states, you have a attorney general who has recused himself. >> right. pete: you have a deputy attorney general in charge of the probe who allegedly saying these things, how do you have faith that you are getting justice from your justice department. >> you don't. you don't have faith. and if he were not being investigated at this point,

if the president were not being investigated by special counsel, it would have taken 30 seconds to fire both the attorney general and the deputy attorney general. but, because is he being investigated, many republicans are telling him it would backfire. you can't do that you can't be deemed. pete: should he anyway? >> that's a political question, not a legal question. can i tell you, this he has a perfect right to do it lylely. he can do it without being guilty of obstruction of justice. look, you are entitled to have a deputy attorney general who is not snooping around the white house. trying to get people to get you removed from office. you know, the job of attorney general is very schizophrenic, on the one hand a member of the cabinet loyal to the president. on the other hand loyal to law enforcement. it's a very schizophrenic job. a deputy attorney general not trying to get rid of you under the 25th amendment. ed: normally we would love to have you on the other big

story. you are a sharp legal mind. and i wonder you told us before we started privately that you thought there was some parallels here to the rosenstein story and the kavanaugh, brett kavanaugh story. >> sure, he said, she said, he said, he said. we need to get evidence. i don't like when i hear from democratic members saying we believe her. you never met her. you don't know her or know about her. we believe him. he has testified. but, still, let's have evidence. john adams said facts are difficult things. and you can't get away from them. we need facts on both of those issues. the one thing that's clear where is the american civil liberties union protecting the rights civil liberties of both of these people. she has to go first. if you are a civil libertarian you don't want to go back to the day was of the inquisition. they would call some poor guy. in we are not telling you what you are accused of or who your accuser is we want you to testify and then we

will present your accusers. that's not the way it works in america. the accuser goes first. she gets cross-examined. then the accused has an opportunity to respond. anna: what do you make about the request of her attorneys, the request that they made of no lawyers, just the lawmakers instead, and he goes first rather than her going first? >> second, just dead wrong. every civil libertarian should want her to go first. as far as lawyers are concerned. if i were being intiergated i would much rather be intear garretted by senators. most of these guys don't know how to ask questions and follow up jess. waiting for staffers to hand cards. american public benefits if you have an experienced, hopefully woman lawyer who is sensitive to issues of sexual abuse who will not use it as an occasion to try to demean a woman who may well be a victim, we don't know that yet. what we need are a good lawyer who knows how to frame questions, follow-up questions, cross-examination. why should anyone.

your kids or guardian for your kids when you die. is he fantastic. but it doesn't answer the question. 15-year-olds, 17-year-olds do things that they are ultimately ashamed of later in life. so, it's not conclusive evidence. i wanting to hear conclusive evidence. pete: it's important but not conclusive. >> hard question is are they going to be are they going to question him about his sex life when he was 17? did you drink a lot? what did you do? when did you first? those are going to be, you know, they are relevant but maybe we are going to get a situation which we object to women doing it improperly so. going back into the sex life of a woman. when he is accused of being a predator at 17. at least i would like to know what he was like as a 17-year-old. that's relevant although i think ultimately the question that congress and the senate will have to decide is a hard question. ed: someone else gotten involved in this is hillary clinton. >> oh, god. ed: oh god might be the best reaction. here is what she said should

sick. we want to give it back to him. talk to us about that. >> it's hard to explain. it really wasn't much of an idea. it was just something that kind of just popped up and landed on our laps. i just so happened to come across and i found her, first person i called was my sister. i called jenny and she is like let's make this happen. let's bring her home. and it was crazy how it worked. and i sent the previous owner an email. i spoke to her probably 30 minutes after the email was sent. i previously met her almost two years ago when i originally found the vehicle. we couldn't agree to a price at the time. meanwhile dad had to walk away from that vehicle. once again and it was tough two. years ago when we first found it to see that car again right in front of our face so close but so far. and you know to walk away from it was tough. so to see it again, posted online i knew i'm not missing this opportunity again.
