welcome to america's news headquarters from washington. i'm leland vittert. >> welcome back from the swamp, i'm kristin fisher. the chairman of the judiciary committee says he's done with granting extensions. he says today is the final deadline for christine blasey ford to make a decision while her legal team is accusing republicans of bullying her into testifying before ready. our gillian turner is here. and everybody here is holding their breath waiting to see what next week will hold. >> officially, the ball is back in dr. ford's court. fox news learned discussions about getting dr. ford to testify went deep into the night with multiple senator prevailing on senator grassley. >> i've extended another extension to dr. ford to see if

she makes to testify to the senate. she should decide in she wants to move on. it's not my normal approach to be indecisive. with the extensions that we give to dr. ford if she wants to testify to the senate. i feel like i'm playing second trombone and schumer is the conductor. other supporters of the president are doubling down on their insistence that kavanaugh will take the bench despite the allegations of sexual abuse he's now facing. >> you've watched the fight. you've watched the tactics, but here is what i want to tell you, in the very near future judge kavanaugh will be on the united states supreme court. >> senate judiciary democrats though insisting all the extensions in the world won't matter. when republicans are blatantly ignoring dr. ford's original position, that a hearing prior to thursday isn't doable. senator feinstein writing in

part. dr. ford is receiving death threats. had her identity stolen and e-mail hacked. she fled her home with her family. republicans want to rush her into a hearing and it shows no sime sympathy or empathy. >> and. >> and that it's arbitrary and to bully. >> and it will be decided if two, three hours from now, leland. leland: the president has certainly not been silent on this and while we await an answer about what comes next in the confirmation hearings, president trump is spending the weekend in bedminster, new jersey with reporters ellison barber travelling with the president. >> hi, the president is defending his decision for the supreme court and attacked the supreme court nominee's accuser.

he was at a rally and he tweeted about dr. christine blasey ford asking why somebody didn't call the fbi 36 years ago. i have no doubt, the president writes, if the attack on dr. ford was as bad as she says, charges would have been immediately filed by local law enforcement by either her or her loving parents. i ask that she bring those filings forward so we can learn date, time and place. and in another, he accused senator dianne feinstein of keeping the letter from dr. ford under wraps to release it with a bang after the hearings were over. the president says it was done to obstruct and resist and delay, arding let her testify or not and take the vote. some observers say the white house is shifting gears when it comes to strategy here. on monday center counsellor to the president kellyanne conway said that dr. ford should not be insulted and she deserves to be heard. and someone closes says that the

president's comments are a shift in tone to put the administration back on offense. >> i began the week saying she should be heard, and i'll end the week saying the same thing. obviously, some folks are trying to delay this as much as they can and trying to politicize this, well past october and well past the midterms if they can do it. >> sources tell fox news, the white house confirmation she did a murder board with kavanaugh on tuesday to help him prepare for the monday's scheduled hearing. leland: all right, ellison barber in new jersey. back to ellison if we hear from the president today. and kristin has more on the confirmation fight. >> we do, and we have analysts, and andrew and gretchen, thank you so much for being with us. >> anytime. >> gretchen, i'd like to start with you, you know, democrats are accusing senate republicans of essentially bullying dr. ford. they have said that they believe

that this is an arbitrary deadline, but, yet, the g.o.p. has been granting several extensions here. so, i'm curious, gretchen, what more would you like to see senate republicans do to accommodate dr. ford? >> well, dr. ford should have a full and fair hearing. she has made an accusation, this is about sexual abuse. this is attempted rape. if these allegations are credible, this person should not be sitting as one of the very few, there's only nine, justices that decide the laws of the entire united states. for example, if someone accuses someone like let's say a catholic priest is accused of molesting a semarian or that kind of thing, that person has some civil ramifications. they're presumed innocent, but it's only probable cause to arrest them-- >> if i could just get back to my. >> remove them from their job. >> back to my original question, what more would you like to see

senate republicans do? they've offered her a public or private hearing. >> just to delay until thursday i believe is what she's asking. >> okay. >> i guess she's had a home bunch of issues at home, break-ins and whatnot. >> fair pointments she needs to collect her thoughts. >> and andrew, why not wait? what is the rush when you're dealing with a lifetime appointment on the supreme court? >> well, you know, look, nobody has a problem waiting until wednesday or thursday, but let's just be crystal clear. the democrats motives are crystal clear in this case. they are using her as a pawn to try to make certain that he doesn't get approved until after october 1st, after the term starts or number two, and this is the real goal, that they can delay this thing until after the midterm elections and hopefully for the democrats' sake, the democrats win the senate. they're not so concerned about everybody taking a deep breath and getting the bottom of this. these allegations have been out

there for 30 years. and in fact, feinstein had these allegations for long time before she released them. so i have no problem with her testifying it's just we have to do it this week. >> to be fair, senate republicans said they want her to testify on wednesday, she said she cannot do that, she wants to wait until thursday. my problem is what's the one day difference. bottom line the chairman of the senate judiciary committee chuck grassley says he's granted multiple extensions and granted one last night and put out the tweet. he says with all the extensions we give dr. ford to decide if she wants to testify to the senate i feel like i'm playing second trombone in the judiciary orchestra and schumer is the conductor. so, politically, is it smart for senator grassley, chairman grassley to keep granting these extensions? >> yes, it is. >> i would. >> i think it's smart for him do. i think that people want to hear

what she has to say and this needs to be said and then people will-- this isn't a criminal court of law, he is enjoying the presumption of innocence as he should, but we -- after allegations are made there has to be a hearing about the allegations and it should be done on terms that are comfortable for the victim witness and that's how we do it in court. we make it as comfortable as possible for them to testify and we have support and therapy dogs and that needs to be done here. and she needs to have a safe forum in which to articulate what occurred. >> andrew, quickly to you. what is the likely that kavanaugh does not get confirmed, any chance in your mind? >> yeah, there's chance. let's see what happens when she testifies and his response. him not being confirmed aren't as great, a what people think. this is clarence thomas part two all over again, that was an extraordinarily close vote. this thing is up in the air i

have a problem with the lack of evidence, with the lack of proof in this case, and these are allegations from 30 years ago. you still have to have proof, you still have to have evidence, you can't just make baseless allegations and sink somebody's supreme court nomination. >> do you agree with that, gretchen. do you think there's a chance of derailing his confirmation? >> i do, it can. there is one evident, one witness rule in court. one witness, if found to be credible, that is the proof. her testimony about what occurred on that evening is the proof. there doesn't need to necessarily be corroborating evidence when you have the one witness rule and she's that one witness between the two of them. >> i've got to leave it there. thank you very much. >> thank you. >> be sure to watch media buzz tomorrow at 11 a.m. eastern, howard kurtz and his panel talk about this. and chris wallace, senator

lindsey graham, check local listings for time and channel. leland: you may have heard the kavanaugh debate took up most of the objection j en-- oxygen in the news cycle, but president trump was in the great city of missouri. >> here are some achievements. 4.2 growth. and jobs claims fell to a nearly 50 year low. we've created over four million new jobs since our election, we've added nearly 400,000 new manufacturing jobs. leland: with that we bring in gary, fox news contributor from orlando. gary, are things as good as the president says they are? >> yes, and one thing they forgot to mention and one thing

i love the most is welfare rolls, as well as food stamps dove in the last few years and less people on welfare and work fare and you can't get a better situation than that. look it, every number that i look at has had an economy above par, doing really well. when i spoke to ceo's of big business, as well as medium sized, they're all very happy and it's amazing what you can do when you get out of the way as a big government. i think with the lowering of regulation, the corporate taxes dropping, by the way, just to get in line with the rest of the worrell, have been a huge help and hopefully continues. leland: you say hopefully it continues. how does this derail? >> debt and deficits. i talk about it all the time. the one thing that the president and mcconnell and ryan did not do is anything about the debt and deficit. they raised spending $300 billion a year ensuring we'll have debt going forward.

and i don't know when, eventually there will be repercussions because debt and deficits always come back to haunt markets and the economy. leland: it's something the president is not interested in doing. he says he's not going to touch entitlements, and doesn't seem to be concerned about signing the massive spending bills. >> you're right, all evidence in. they're not doing anything about it and now we go to the midterm. if they lose the house, then they definitely can't do anything about it and again, that's the big gigantic worry and i'm surprised interest rates aren't a lot more higher to accommodate for this fact, but so far, so good. markets and interest rates have done real well to help things out. remember, $7 trillion was added to our wealth effect over the last two years and that also helps the economy. leland: and certainly how people feel matters. this is the latest polling we have, a total of 70% of american voters say the nation's economy is excellent or good. that matches the all-time high

rating for the economy another 28% say the economy is not so good, or poor. shouldn't come as a surprise that among democrats that number is much, much higher, about 35% of democrats saying the economy is not so good. do you people vote with their pocket books this midterm elections or are democrats able to turn this into a referendum on president trump? typically they do vote with the pocket books, but i call it the trump stuff that keeps getting in the way on a daily basis, whether it's kavanaugh, rosenstein, mueller and any number of things that we read about and hear about from the media on a daily basis, most definitely gets in the way. and i'm surprised the poll numbers are much, much better and that the republicans don't do a clean sweep based on the economy, but it doesn't look like it's happening yet. leland: it brings up a good question. are republicans losing the messaging war because they're

not a good message about the record or the media is leading them in the wrong direction? >> i think a combination of both. i follow the media closely. they don't want to report any good news, that's a definitive fact. when i look at the new york times i see articles how bad the economy is, believe it or not, which flies in the face, but i also think the messaging. i think the republicans are afraid to even talk about tax cuts right now because there's this whole message out there, they're only for the wealthy and the rich when in fact it's flowed down to everybody, especially in the job market. engo, i think they're afraid of their own shadow and that's not helping the situation for them either. leland: we've certainly seen confidence in the middle class. thank you, gary. >> take care. >> at least 24 people are dead after a gunman disguised as soldiers attacked a military parade in iran and iran is pointing the finger at the u.s.

brian joins us from the london bureau. hi, ryan. >> this was an audacious attack, gunmen opening fire on the parade commemorating the war with iraq. as that was broadcast live on television causing as you can see mayhem, children hit in that attack, as well as the people that were participating. people were just simply watching. it's a big question, of course, what is a very sensitive part of the world, who did it. islamic states raised their hand almost immediately through a tweet saying they were responsible, but there are a lot of commentators telling it's probably just islamic state trying to piggyback through the attack and on the attack and trying to gain attention through it. the government in tehran is claiming separatists from this region. now, this is the mostly arab region in what is mostly a persian country, and there has

long been a separatist movement there. that said, most of the attacks generally are on unguarded oil pipelines, for example, under the cover of night. this are rarely things that are quite brazen as this. the iranian foreign menster tweeted and he forget who the perpetrators may be, he holds actors outside of the country responsibility, hinting that perhaps saudi arabia was behind it. and saying that that just won't stand. heerp here is what he tweeted, terrorists recruited trained and armed by a foreign regime have attacked, children and journal irses among casualties, iran holds regional terrorist sponsors and u.s. masters accountable for such attack. iran with respond swiftly and decisively in defense of iranian lives. what response might we get from iran? iran is perhaps unlikely to go

is a disgrace and a disservice to the senate and the american people. that being said, the president and i are confident that senate republicans will manage this confirmation properly with the utmost respect for all concerned and i believe that judge brett kavanaugh will soon be justice brett kavanaugh. kristin: the kavanaugh allegations made their way into the midterm discussions during a high profile texas senate debate friday night. republican candidate ted cruz and democrat fred o'rourke made their positions clear about accuser dr. christine blasey ford. >> doctor ford's allegations should be investigated by the fbi, full stuff. there's precedent for that, that's the right thing to do given the gravity of the allegations. >> the allegations she's raised are serious and they deserve to be treated with respect and i hope she comes and has a full

it stands for the resilience within us all. ♪ >> judge kavanaugh has not asked to have the fbi review these claims, is that the reaction of an innocent person? it is not. >> i don't know how a fbi investigation would help unless they're able to locate witnesses that can either corroborate or contradict. there is no crime scene to analyze. there are no forensics to analyze and the fbi can't interview her and judge kavanaugh and then repeat back what they say. that-- you can't determine credibility that way. so, i hope that she comes, i hope that she will testify. i think she'll be treated fairly. leland: democrat and republican

lawmakers no doubt picking sides on whether or not the fbi should many about involved in accusations against supreme court nominee brett kavanaugh. getting involved in a decades old state level case is more easier said than done. is trey gowdy right on that one. >> whether or not the fbi should be involved is one issue, but what congressman is pointing out, this is a 35-year-old event and unless you're going to find eyewitnesses, there's certainly no physical evidence, merely having the principals recite, being the judge and the accuser, recite their stories is not getting you anywhere. unless you can find eyewitnesses, i don't see a whole lot that's going to come out of an investigation like that. setting aside the issue whether there should be one or not. leland: how would it work for the fbi to become involved?

does there have to be a formal request? >> the fbi does not investigate these kind of crimes. if a crime occurred that would be a local offense. the only way it's pertinent to the bureau, it's part of a background investigation that they've been requested to do. the fbi does a limited number of background investigateses. leland: they've done a number of investigations. >> as a federal judge, correct. essentially they have a client, either the white house requests them to do this investigation, when he was nominated or the senate. and if either of them. either of those two request that they round out this investigation in the face of new allegations, they could do that as part of the mandate and they could do it. leland: noteworthy, as you mentioned, this would be a local crime, if there was a crime that happened, in which case, the governor of maryland could ask the maryland state police to investigate that. he has declined to do so, so far.

democrats talking why they think a fbi investigation is necessary. take a listen. >> the way i portray it and describe is, you have the entire force of the presidency and all of the supporters of judge kavanaugh in the senate arrayed on one side and on the other side you have dr. ford who doesn't even have the benefit of a fbi investigation as we all have called for. you know, how unfair is that? >> is anyone entitled to a fbi investigation is this who does the privilege rest with? >> the privilege rests with someone who makes a credible allegation of a crime within the investigative jurisdiction of the fbi. it's really that simple. is the allegation credible? and is the subject matter within the proper investigative jury of the fbi. leland: based on what we know of dr. ford's claims, is an

investigation possible? if she recites her sorry to the fbi and the judge recites his story, what do you investigate? >> that's the road i went down early. if she can tell you when, where and who else is presents. and some, there was an event 35 years ago, i can't tell you where, i can't tell you when, i can't tell you how, i can't tell you who was there. not much to investigate. in fact, nothing to investigate. so far. now, i don't know that she doesn't-- she won't furnish some of that information and if she does there are questions to be asked. just a prediction, an educated guess, it'd be hard to believe that a fbi investigation 36 years after an event like this would turn up very much, and frankly, given the politicalization of these, i'm not sure it would change anybody's mind no matter what they found. leland: and the fbi getting

billion worth of merchandise tariffs coming in. and then they said, well, we're going to do the same thing. i said, that's okay. we're far more bullets. we have a lot more to come back with. kristin: well, let's bring in dr. michael pillsbury, he was laughing there, director of strategy at the institute. why are you laughing? >> i like the president and frankly, kristin, he seems to enjoy this. kristin: oh, yes. >> he could have been negative, oh, the chinese have cancelled the talks and they're not coming, i'm so sad. no, he seems to enjoy the process of negotiations. kristin: he is the author of "the art of the deal". so you agree with him that the united states can afford to wait and we can afford to allow china to walk away from the table? >> yes, this is going to be a long game in my opinion. the chinese are tough.

we've probably made some mistake, i used to think that china is weak, they're going to collapse, it's a state-run economy, what's good about that? that apparently is not true. they've got something like $3 trillion, t trillion in reserves. they have a lot of slack in their economy, they're able to subsidize. they don't have to just collapse and fold because the threats of trump. kristin: and president xi isn't tied down by-- >> he doesn't have a senate and a house, right. kristin: the term limits that president trump has, obviously. mike, i want to talk about, so many people hear about the tariffs and trade wars and they don't feel the personal impact yet, but major retailers like walmart, they are coming out and they're saying that because of these tariffs, they may have to spike prices, raise prices on several key items. i want to pop up a graphic of some things that walmart, in particular, is saying that they're going to have to raise prices on potentially.

christmas lights, shampoo, dog food, luggage, mattresses. a whole bunch of things. are people really going to start to feel the pinch because of these tariffs? >> on some products, yes. i think what you also see though, is some very clever chinese lobbying inside the united states. the chinese know who is with them and who is against them. so, they've formed some coalitions and provided a lot of threats, and they're frankly hoping that after the midterms president trump will politically be unable to sustain his tariffs campaign. they're hoping that the american side will blink first and will fold. so-- >> and of course, china is threatening to go after u.s. farmers. >> absolutely. now, this is in violation of their agreements, but they're still doing it. they're good politicians inside the u.s. we don't have that kind of capability inside china to influence president xi's advisors, i wish we did. kristin: even imposing the latest tariffs,president trump

this week hinted that he may be considering imposing even more tariffs on china. listen to this. >> if there's a retaliation against our farmers and our industrial workers, our ranchers, if any of that goes on, we're going to kick in another $257 billion and that will be also at 25%. we don't want to do, but we probably will have no choice. >> i think he's exactly right. kristin: say that again? >> i think he's exactly right. we're going to have to go to full-- >> 257 billion of chinas tariffs. >> and maybe apple and iphones and may be an exception already. kristin: and leland wants to know-- >> not about the country as a whole, but the chinese have been remarkably tough. this cancellation of the delegation is another example they're just not going to fold and they doubt our credibility.

lumberton, north carolina. hi, jonathan. >> hi, leland. right no we're overlooking a culvert. as you can see, there's water and debris and trash swirling around the drain across mlk. as far as mlk, the thoroughfare going through downtown lumberton, the waters receded enough so that the traffic is allowed to move through slowly in both directions. the other side of the culvert, water is bubbling through here and threatening homes downstream and a very swift current. local officials say that these conditions are expected to remain through the weekend. now, this flooding comes just two years after hurricane matthew left much of this town and surrounding robeson county jumped water what many thought was a flood so big it would only happen once in 500 years. well, just two years later, residents are looking at something even bigger. we sent our drone up to give you an aerial perspective of this

flooding that lumberton is about 60 miles from the coast, but prolonged rains from hurricane florence have created flood companies not only in this town, but throughout many parts of the southeastern north carolina. statewide flooding is affecting 750 roads including sections of interstates i-95 and i-40. we followed a caravan of relief supplies into the state, even with police escorts, the supply trucks had to stop and reroute several times to avoid flooded roads. meanwhile, flooding along the cape fear river forced duke energy to shut down its lv sutton natural gas plant in wilmington. flood waters preached a dam surrounding a cooling lake. north carolina's department of environmental quality is monitoring because river flooding has spilled into a basin of coal ash, a byproduct from a retired power plant at the site. meanwhile, we've learned that the coast guard set up a

reconfirms that congress needs to protect the mueller investigation because there's so much back-stabbing in doj right now and across the administration that we need to and 60% of americans support the investigation going forward and congress needs to make sure that happens. kristin: one to have big questions throughout washington who leaked this and, kevin, you believe that the former acting director of the fbi andrew mccabe who we know was in the room during the meeting you believe that he leaked it from his memos. >> yeah, well, most likely source of this and he knows thousand play the media game, he has been proven to be a leaker, i think charges could be brought against him, he has a book deal coming up. he has a gofundme page, i think he's the worst of the swamp and -- and i think the doj, current doj is going to be ticked about this and they may actually go after him on it. kristin: he's already under investigation, josh, you agree? do you think it's coming from mccabe? >> he's under investigation for

lying about leaking, stories that hurt hillary clinton during the election, so i think both sides are pretty angry at him for various reasons, honestly, we don't know, i think -- you saw within minutes the president's son using ammunition to argue for the firing of rosenstein, it's absolutely like mccabe has and some of the president's allies have incentives to do this. >> you should not fire rosenstein and let him do his job and he's in a position that he could take out avengance on andrew mccabe and i think he might. kristin: whether or not he should or not fire rosenstein. everybody is kind of guessing, is president trump going to fire him, is he not, do you think that this will lead to president trump actually taking action against him? >> you know, i think he won't, i think he likes to let people twist. we have seen that with his attorney general, jeff sessions. i think he's going to just -- i don't think he wants to take the political heat and i don't think he needs to. he leaves rosenstein and place

and let it play out. kristin: the deputy attorney general has issued two denials, i want to pop the latest one up, you can read it for yourself, i never pursued or authorized recording the president and any suggestion that i ever advocated for the removal of the president is absolutely false. he never pursued or authorized but noticeably absent from that he never says that he didn't say it. >> he said it. >> even if he said in jest, we talked to somebody who was in the room and we were told that he kind of said it very sarcastically as, you know, talking to andy mccabe, what you want me to do, wear a wire? >> we have seen this play out so many times in administration where they weponized quotes that people are saying sarcastically and are using it to hurt the other person. andrew mccabe is under a lot of heat and that's what we are seeing right now. kristin: josh, what stands out to you from the rosenstein statement? >> i'm sure it happened. kristin: we are all in agreement on this.

out there. >> yeah, this certainly hurts iranian diplomacy because the iranian state has just tried to show how strong it is and that is really been state craft for them, you know, but, of course, we have seen the protests on iranian citizens, two large terrorists attacks in two years. leland: how does the u.s. capitalize on this, how does israel capitalize on this? >> i don't know that we are going to change policies in order to do that but what we will do continue to insist to our european allies that they adhere to our sanctions and that we try to get, you know, a lot of progress on making sure the iranians stop their enrichment of uranium and other things that are not good for the international community. leland: secretary of state pompeo to that point yesterday, we will get your reaction after the sound. >> the islamic republic of iran continues to be the world largest state sponsor of terror, we are determine today stop that

you know, this is -- unlike the hearings a few weeks ago which was all staged. we knew what the questions were going to be, we knew what the nonanswers were going to be, in this round we really don't know what's going to happen and while it's not a legal trial as such, it's akin to it because we will have a chance to assess her demeanor, her response and cross-examination and the same for him and out of that we will have a better idea of who we believe. kristin: there are obviously so many parallels to the anita hill hearings but so many differences as well in this era of social media, the metoo movement, how will these hearings be different from the hill hearing so many years ago? >> well, you will will are instt response and while the republicans now saying we are going to confirm kavanaugh even

as they still say they have open mind f she's credible and persuasive and if he's not, he sounds evasive as he did a few weeks ago in the first round of hearings, i think it's possible that you'll see the tide turn. it only takes two senators on the republican side to throw his nomination into jeopardy and until you see it play out, i don't think anybody knows but i think politicians, even on the republican side are sensitive in the metoo era and will be loathe to look like they are attacking her or prosecuting her. >> just a few days confirmation seemed like a sure thing, now, do you truly believe that confirmation is in jeopardy, seriously jeopardy? >> yes, my predictions are often wrong but i think before we hear her assuming she does, the idea that you can say ahead of time that the republicans are going

to run this through is inaccurate. politics are too fluid and there are to too many republican senators who have expressed not doubt about kavanaugh but a willingness to listen to this person, to the accuser, and to decide if she's credible. you know, so far the indicators are that she may well be credible, who has more reason to lie her, you look at her position, she has thrown herself into the vortex, she's had to move, getting death threats, there's not a lot in this for her to come forward. and i was say if you look at respective positions he's in a more difficult position, he has more incentive to not remember and perhaps not to tell the truth. that's not to say that's what's going to happen, but the respective positions, she begins in the lead. kristin: fair points ands is somebody who wrote the book the most dangerous branch is certainly someone who would
