nominee. you've seen this play out. >> you mentioned dianne feinstein, she sat on this for weeks and weeks. the story could be falling apart, another supposed witness, long time friend of christine blasey ford said she doesn't know him or a party that he would have been at. i mentioned shannon bream sent out an e-mail say, with the committee has been talking to the other people at the party. the committee says they talked to four people alleged to have been at the party by dr. ford, including judge kavanaugh. all four deny any knowledge of dr. ford's allegations. so the other people allegedly at the party by dr. ford's account say this didn't happen. >> they also aren't saying she's a liar. they're saying i don't have any information, i don't have the knowledge that it did happen. kavanaugh is one of those four saying i didn't do it and i need to clear my good name.

rosenstein should be fired. in fact he should have been fired months ago. we really didn't need a bombshell "the new york times" report outlining memos from 2017 to tell us that this guy probably didn't have the best intentions when he took his post. there was a reason that congress have put together articles of impeachment. we knew that something was up when the inspector general reports came out from the doj. so of course the president is well within his right to fire rod rosenstein but i don't think that's the question, ed. the question is what is jeff sessions going to do about this? this is his number two, this is his guy. it occurred under his watch. this is his department. so what is jeff sessions going to do? >> well, boyd, that's a good question which is that it seems to a lot of republicans, starting with the president himself, that jeff sessions has been asleep at the switch. >> yeah. and i think for both secretary sessions and for rosenstein, i think this is much more a question about when to do something as opposed to what to

do with those folks. so i think this is much more a political question in terms of does it create more chaos rather than clarity if he takes rosenstein and jeff sessions out right now as opposed to after the midterm elections. the thing the president should focus on is the economy and everything that's going well for him. recognizing that this really is a distraction to what the president the trying to do. and i think that rosenstein, if these reports are true, and i agree with katrina, there's mounting evidence there that does not require the "the new york times" to certify, he should step down. he would be duty bound to step down just as whoever is anonymous source is in the op-ed in the "the new york times." he really should step down. >> the timing of the meeting seems important to your point. this was in may of 2017. shortly after this meeting, whether he was joking or not, rosenstein raising the possibility of invoking the 25th amendment and then after

the meeting with the fbi and doj officials, what does rosenstein do, he appoints the special counsel robert mule tore investigate the president and the campaign. >> that's exactly why this is not a political decision if rosenstein is fired or impeached for that matter. the people elected donald trump to make the right decision. not the political decision. and by the way, he campaigned on draining the swamp. and i think a lot of people continue to forget that. there's a lot of evidence here on why rosenstein should be fired by jeff sessions, at the very least recuse himself. think for one second, ed, if eric holder knew that members of his own department were trying to secretly get rid of barack obama as president of the united states, even jokingly about the 25th amendment, would we be having this discussion in no. eric holder would not stand for that. the question isn't whether or not donald trump should fire rosenstein, this is solely on jeff sessions.

he'll have the serve the remainder of his sentence on top of any new charges. the high stakes show down between spact nominee brett kavanaugh and his accuser culminated yesterday in a tentative agreement. ford's attorneys saying she accepts the requests to tell her story but the terms are up in the air. here to weigh in is our panel of legal experts, legal affairs reporter at the washington tiemstimes. brad, i presume a republican, a right ward leaning, in this process do you think it's been done properly. >> anytime's har it's hard to s. it's still playing out. there have been a lot of delays and people becoming suspect of what's causing the delays. a moment ago there was a spot that there's an agreement to testify but there's not an agreement to testify because the

terms are unclear. so nobody knows where it's going to go from this point. >> eric, you're an attorney. at this point, you know, dr. ford wants to tell her story but there's been all of these delays and all of these terms. did you feel like she's been given a fair opportunity to tell her story? >> how much of a delay has there real preally been from r. >> there have been five. >> what was the deadline ultimately set. this is set by the senate committee because they want to get things done at a certain time. and so this woman has now come forward and she's asked for an opportunity at this point now to tell her story. and we know that a bunch of terms were hoisted upon her to impact how she could tell her story and when she could tell her story. >> i have to cut you off. her attorneys have foisted a bunch of terms. and chuck grassley said we'll come to california, you can come to d.c., we'll do it publicly, privately.

they wanted it thursday and that's tentative. a lot of opportunity and grace have given here. you have people firmly in their camp one way or the other and there are those people who are saying this isn't fair may not want to see judge ka na kavanaun the supreme court. but she said in the washington post last weekend that she was ready to testify. she was given the opportunity to do it a week from then on monday, that passed up, then wundz anwednesday and now thurs. it easit's interesting what chad last weekend when she was talking to the press, two days later is the democrats coming out saying no, we need an fbi investigation first. that was another layer on top of that. it didn't seem like there was enough sticking with the documents that they wanted so now this story has come out. i think it's fair to say why do we hear about this in september when the letter was reportedly given to senator feinstein, the ranking member of the committee

happened here. so nancy cordes of cbs is saying the committee has heard from all four people who were allegedly at the party. they deny they were there or say they don't remember it at all. is this story starting to fall apart. >> absolutely this story is falling apart. everyone is entitled to have their day to tell their story after an accusation like this is made. but what we have seen is the besmirchment of judge kavanaugh she wants to have this discussion, it needs to be done immediately, needs to be done in public and we have to give judge kavanaugh an opportunity to respond to this and let the committee members vote accordingly. and i think they'll vote to make him the next supreme court justice 0 our great country. >> the details of this hearing have not really come out. they haven't been agreed upon. do you think this will actually happen on thursday or sit going to keep getting pushed back?

>> i think chairman grassley has gone out of his way to try to accommodate her, offering again to go to california to have this done, to do this in washington, to do it in public, in private. she's given her every opportunity to have her story told. and if she chooses not to do this, the committee should move forward with their vote on thursday and bring tight the full senate for a vote. >> why are they being accused of bullying, this idea that she's being hemmed in or pushed. and bullying is the word being used by at love of folks on the left. why are they doing that? >> this is partisan politics, washington, d.c. at its worst. it wasn't that long ago when supreme court justices would be confirmed on a bipartisan basis. 60, 70, sometimes 80 votes. they've made this into a partisan issue. we're trying to see if it's going to be a 51, 52 vote majority on this.

but the "the new york times" ran an article two days ago where they say she joked or made the suggestion that he might want to secretly record the president and has discussed the 25th amendment. now the president has responded to this and other things. this is what the president had to say about it. listen. >> these are people -- i really believe you take a poll, i got to be at 95%. but you got some real bad ones. there's a lingering sphench and we'rstench andwe're going to get too. >> his point is 95% of the folks who work there likely support his policies but at the top there's a stench. >> he's absolutely right. the rank and file men and women who work at the fbi and the department of justice are great americans and they go to work every day to make sure our country is safer and better. but we have seen from jim comey to andy mccabe to peter strzok to lisa page at the fbi, some of the highest ranking members, what they have done to this country, the narrative they've

put in place. bruce ohr at the department of justice. and now rod rosenstein to potentially kid -- i don't think he was kidding. he is saying to other individuals, why don't where i wear a wire as you walk into the oval office to have a conversation with the president and then to say that he potentially had a conversation with the attorney general and the former secretary of homeland security about invoking the 25th amendment? look. i'll tell you what. if it were me, there's only one way to classify this person and that's an enemy of donald trump and an enemy of the people. >> if he's an enemy why does rod rosenstein have a job this morning? >> it's a great question. you have to remember rod rosenstein before he became the deputy attorney general was the u.s. attorney under barack obama for baltimore, for maryland. he's a partisan person. he claims he's not. we've seen what he's said in front of congress. he's a person with a messiah complex. he wants to decide what the law is. he's the individual who has a

quite intense particularly for judge kavanaugh. it becomes a little more every difficulty for the republicans and pressing too hard on dr. ford. you know, these are two accomplished professionals. i think they are unlikely to make a serious mistake. we don't know. but at the end, we have to decide what happens with a tie in a court of law, the presumption goes to the defendant. but this is not a court of law. in these sure are not judges. so, you know. -- >> before we get there we have to make sure that the terms, details of both of them speaking are fair. her attorneys have said that they wanted to go first. would that be fair? >> no, it would not. it falls in the category of use when first and i pitch. the point of this entire hearing is for him to get the allegations under oath for both parties. he has to respond to what she says. at the end it may end up just a

matter of credibility. who you simply believe. but it makes little sense for him to go first before she has put all of her statement on the record. >> and also, professor, relevant is how we got here. judge kavanaugh, he wasn't perfect but he was smooth for getting closer to confirmation, in the 11th hour we found out that dianne feinstein has been sitting on this anonymous letter. there we find out that dr. ford is being represented by someone that was with joe biden. then there was a strategy to take down kavanaugh and by the way, the lawyer, deborah katz, someone on tape in 2017. >> listen. >> there will be a strategy that will emerge and i think it is possible that it might ultimately defeat the nominee. >> this is america, it's a free

country you can have political views. maybe democrats and ray be republican but when it is this highly charged is it appropriate? is it troublesome to that she is now being represented by advisors and lawyers that were basically part of the resistance? >> i cannot remember when i was in trouble in this town. we are living in troubling times. at the end of the process, i think few people will be satisfied. the problem with counsel in high-profile cases, is not to become part of the story, not to be part of the controversy. and so, the options are not great for the attorneys and their involvement in opposition to the trump administration. but, when the hearing occurs, there will be two people they will be before us. the american people are themselves going to have to make a decision. as to what is fair and ultimately, who they think is telling the truth. >> because it may not be a court but is the court of

public opinion. which is what we are all watching producers it comes out to two people.others have said to have been at that party.where the alleged incident occurred. the committee will try to talk to them. they've talked to many and the attorney from one of the people, she is one of dr. ford 's longtime friend and was alleged to have been at the party. we will see what she says. the lawyer says simply put, a friend of dr. ford does not know mr. kavanaugh. she has no recollection of ever being at a party or gathering where he was present with or without dr. ford. does the fact of others being there not remembering it or that it happened does it matter and will have an impact on the outcome? >> is a long-standing problem in these cases. there are many women, particularly, high school girls that do not come forward when they are sexually assaulted. and so, having dr. ford not say

something to someone of the time is not necessarily out of the norm. the problem is we now have four witnesses that say they certainly do not member the party or any incident of this kind. and that is something that is likely to be pressed at the committee. did she confide with anyone at the time? a friend? even in the days that followed. now dr. ford saying, i did not. i did not talk to anybody. this really was a huge burden for me. it was very dramatic and i kept it to myself. does it set a pattern of people sexually assaulted and victims? yes, it does. but it does not mean she cannot be questioned about that. what you will end up having our on both sides doubts. now how we resolve the doubts i'm not entirely sure. it is not a court of law but if two people involved, two people that deserve fairness. and if we do not have any clear
