the show. in the meantime a lot of news and some breaking in the past couple of minutes. i'm leland vittert. >> and kristin fisher. stay for the puppies but we will start with really just was going to be a huge week in washington. because christine blasey ford 's legal team has been working with senate republicans over the last week or so really, but really negotiations have very much intensified over the last 24 to 48 hours. right now we are hearing that her legal team has reached a tentative agreement to testify on thursday. garrett tenney has been following this all day. we're getting breaking news in the last few minutes. reporter: yes, her attorney had a fan call with the senate judiciary committee staff this morning. they agreed on thursday at 10 am. notably, it will be an open hearing. we will get to see this as it plays out. there are still details are trying to work out. who will ask the questions and

who will testify first? the senate judiciary committee has offered to have a female outside attorney do questioning but the team of doctor ford wants a senator to do it. as for the order of testimony, her lorries want judge kavanaugh to go first. but the committee has been pushing back on the request. they argue kavanaugh cannot properly defend himself if ford has not little allegation. "fox news sunday", lindsey graham said that he expects the hearing will play out and he wants it to be fair. >> chairman grassley has been bending over backwards to make it happen for the offer is thursday at 10:00 she made conditions to the lawyer and accepted six. we will not turn over to the other side how many witnesses. there will be two witnesses, doctor ford then judge kavanaugh and their counsel. they contest those two things. if they continue to contest those two things, there will not be a hearing. christ foretold the "washington

post" at least four other people attended a party where the alleged sexual assault occurred. last night one of the individuals, leland kaiser, a close friend of doctor ford became the fourth person to deny any knowledge of the incident. her attorney wrote the committee saying, sibley park, ms. kaiser does not know mr. kavanaugh and has no recollection of ever being at a party or gathering where he was present with or without doctor ford. the attorneys responded writing apart, it is not surprising ms. kaiser has no recollection of the evening as they did not discuss it. it's also not remarkable she doesn't attend them or bring a specific gathering 30 years ago in which nothing of consequence happened to her. they say they plan to defend her when hearings take place later this week thursday at 10 am. >> some huge hearings on capitol hill over the last two years but this one really could be the biggest. garrett tenney, thank you. be with that we bring in the michigan congressman, the senator from hawaii, senator hirono saying this on state of the union a couple minutes go.

we will give you a reaction. >> doesn't kavanaugh have the same perception of innocence as anyone else in america? >> i put his denial in the context of everything that i know about him in terms of how he approaches his cases. as he said, his credibility is already very questionable. leland: is still doesn't feel like a yes, he does deserve the presumption of innocence. are you willing to give it to him? >> is keep in mind this is not a criminal trial with a presumption of innocence determines the outcome. the senators are going to have two weigh credibility of his comments versus the credibility of doctor ford comments. i sort of reject the notion that there is a criminal standard that is to be applied. leland: is the american standard though a presumption of innocence, sir? >> he does have a constitutional right to sit on the supreme court. so his right is not been denied if the judgment of the senate, he is not a credible candidate for the court. and this testimony, this

hearing will determine that. but it is not a case where he has to be proven guilty by or beyond a reasonable doubt. leland: what should be the standard then? is it, someone makes an accusation? you have four people allegedly at the incident. saying they have no memory of it. so when accusation is enough to sink someone's career? >> standard is what the judgment of the senators might be when considering a lifetime appointment. i guess i would ask senators to do is withhold any judgment on the question until the testimony occurs. and if they in their judgment, determine that her argument is more credible than his -- leland: there's already been a lot of democratic senators essay i believe her. i believe her. it doesn't sound like withholding judgment to me. >> i think for the most part those i've decided they believe her, already had determined they were not going to vote for judge kavanaugh.

leland: fair to say, maybe i want to believe her rather than, the facts. >> let's be fair about this beer for the most part this kind of assaults go unreported. and for the most part, women are not believe even when the assault is true. so i completely understand -- leland: hold on, to say not believe, this person is being given by far, the benefit of the doubt here. >> by whom?>> by anyone willing to have a hearing. for someone to sent a letter from 36 years of antennas happen, i cannot remember when, i cannot member the time, i cannot remember what house. then the united states and is says we're going to hold votes and have a hearing where this person is able to make the accusations known on national television and call somebody on the carpet and have them have to testify under oath about a set of accusations that no one has heard about for 36 years.

it certainly sound like the benefit of the doubt to me. doesn't it to you? >> it doesn't solve the benefit of the doubt when we have united states senators saying before hearing what she has to say, that she is mistaken and that she is -- is not the benefit of the doubt. >> congressman, you cannot have it both ways. what about the senator saying i do believe her despite four other people saying i have no memory of this. what about those senators? >> to my point, you cannot have it both ways. just as you said. a people that run the judiciary committee, the senators who are in the majority, are deciding already that no matter what she says, it is not true. i have an idea. when we wait and see what she has to say? i agree that anyone who is already determining the outcome of this may be prejudging. but i do not think it is unreasonable for people -- leland: only a 15 seconds let me see.by definition republicans are willing to have the hearing.

the codirector of the brennan center for justice. i want to start with something that senator lindsey graham who is one of the republicans on the judiciary committee, something he said to chris wallace on "fox news sunday". he was asked the question, is there anything that ford could say that would make you change your mind? listen to what he said. >> what am i supposed to do? go ahead and ruin this guys life based on an accusation i do not know when it happened, i do not know where it happened and everybody named in regard to being there said it did not happen. i am just being honest. unless there's something more. kristin: jennifer, i will start and put the questions to you. is anything that ford can say to change republicans mines on the committee? >> i think it is less about what she says and how she presents herself. credibility is often it has more to do with presentation and how someone withstands questioning and how somebody answers the small details.

about the event. it is not necessarily what she says but how she says it. he certainly is right about this. there are four people named by doctor ford. all of them have said that it does not happen or they have no recollection of it happening. and the weight of the evidence is with judge kavanaugh. >> what do you think? >> i think before she comes forward and testifies, for sinners to say we don't believe her we do believe her. i think that is necessary for this to really go through the process. it is after all, an appointment to the highest court of the land. life tenure, stakes are really high. i'm really uncomfortable with the amount of prejudging going on in this context. kristin: >> the only people prejudging are democrats. they're saying 100 percent, i believe her. i stand with doctor ford. and the republicans are bending over backwards to give this woman every opportunity. kristin: senator graham --

senator graham did say he was probably going to continue to vote for kavanaugh unless there was some new lackluster allegation that comes up. >> right, they were all going -- kristin: let me ask you all, is anything judge kavanaugh can do or say that could really impact how republicans on the committee vote? jennifer? >> we have not had a chance to hear from judge kavanaugh at all. and i think as you will recall back in the clarence thomas hearings, when justice thomas came in and defended himself before the senate and before the people of the united states of america, people saw a man who they believed felt had been wrongly accused. and that turned things for him when people had a chance to see his emotional reaction. and so that may be the case here. kristin: and faiza patel, to you, anything that kavanaugh can say? >> i think was interesting is how hard he and his allies are

trying to come up with an alternative story here. which we saw over the weekend with the twitter storm suggesting it was a case of mistaken identity. i think there's a difference between the clarence thomas moment and what strikes me is that in that case it really was a question of just putting the individual including clarence thomas, from the committee and having him testify. where is here, you really see an effort to reach for an alternative explanation for what might have happened. so i do think that there is a difference there and i am interested to see how it plays out.i'm adjusted to see whether judge kavanaugh also goes forward with this mistaken identity with this other theory being floated on twitter over the weekend. i think there's a lot of interesting things that we might learn from this hearing on thursday. kristin: before we go i want this new fox news poll to come up. it says who do you believe? 46 percent of the people say they believe ford. 30 percent say that they

believe candidate kavanaugh. and others say on shore. jennifer, i will leave it to you. the poll was taken before the four other people alleged to be at the party, before they came out to say they have no recollection of the party. but still, those kinds of numbers have to make senate republicans nervous. >> i think they are making senate republicans nervous. i do not think they should. the supreme court justices, it is not a popularity contest and has nothing to do with what the public thinks. it is every thing to do with what the senate thanks. these republicans should not allow themselves to be -- they should bring her in, all hard to testify, listen with an open mind. then they should vote. kristin: and testify she will on thursday. what a hearing it will be. jennifer braceras and faiza patel, thank you so much. please stay around after our show for "fox news sunday". lindsey graham interview will be featured with chris wallace and what he has to say about the kavanaugh hearing. right here at tpm eastern.

-- at 2 pm eastern. leland: severe flooding and heavy flooding across the midwest on saturday in texas. one person dead and rushing waters, 45 homes damaged by the flooding.residents throughout the state forced to evacuate. oklahoma with record rainfall. 14 inches! the number is more than doubling the previous record there which was set just below seven inches in 1997. residents in the carolinas still face major flooding threat is the battle hi warder now more than a week after the hurricane. we are now in the southwestern part of the state, hi jonathan. reporter: hi leland. i know we'll get industrial grade pumps. what happened here is this used to be a park.

you can see this bench partially submerged. this was overlooking the river but the water level got so high that it overtopped this flood control berm and now it is keeping floodwaters on the other side and they brought in these pumps to put water back in the river. we actually googled this location looking at satellite imagery from google earth. you can see that there is a park that normally extends to the river. which under normal circumstances, the banks would be about 200 to 300 feet where i'm standing. right now the water is inches away from where i'm standing. typically flooding poses the greatest risk to life and hurricane florence was no exception. for more than make the rest coast guard has been sending shallow water response boat teams into flooded areas since the storm made landfall on september 12. they rescued a total of 258 people and 205 pets.

the division of aviation sent of a drug to survey conditions along interstate 40. about 30 miles north of wilmington. three days after the storm made landfall, this was the scene near mile marker 387 in hendrick county. looked more like a river. a week later 547 roads remained closed statewide. including sections of i-95 and i 40. state highway officials are asking people to avoid traveling in those portions if possible. as floodwaters recede from roadways they leave damage and debris behind. the fire department has been washing fish off the stretcher by 40 near wallace in pender county not far from the aerial images that we showed you from last week. firefighter said floodwaters allowed fish to travel far from the national habitats. the fish became stranded on the interstate when the waters began to recede. the u.s. house of representatives has authorized nearly 1.7 billion dollars in down payments for relief

group claiming responsibility for saturday's attack on an iranian military parade that killed 25 and wounded 53. the group called the arab struggle movement for liberation of -- was to form their own nation southwestern iran. iranians are not so happy about that. the foreign ministry initially laid blame elsewhere but they said they suspect these rebels as the attackers. kristin: president trump going to actually type for next week's general assembly.there is so much on the table from north korea to china and iran. he is expected to double down on the hard line stance he has taken on iran since withdrawing the u.s. from the nuclear deal. >> the president said he will talk with anyone. we can have a constructive conversation. we want iran to stop being the worlds largest state sponsor of terror. but make no mistake about it, there is no indication they have any intent to do this. kristin: here we have the heritage foundation, brett

connolly does or the secretary state that he would not rule out president trump meeting with iranian president ronnie and the un or the u.s. ambassador to end nikki haley. she said the same thing this morning on another sunday show. what do you think the likelihood of a trump/rouhani meeting is on the sidelines of the general assembly? >> anything is possible. your talk about a situation where you've hundred 40 heads of state coming together in one place. they pass in core doors. a lot of meetings are carefully orchestrated upfront. and structured and scheduled into the president's agenda and secretary of state agenda, investor bolton i'm sure will have a number of meetings on the site as well as ambassador haley. the schedules are busy, they will move from place to place but it is possible something could happen impromptu. depending on circumstances. kristin: at the meeting with kim jong-un. [laughter] so, there's been quite a bit of confusion about what the agenda will be when president trump

hosts the meeting of the un security council on tuesday. president trump tweeted he was just going to be about iran. some of his top aides have said that you know, this going to be about nuclear proliferation. and it is important because if it is just around then i believe present rouhani would be allowed to be in the room. so the best of your knowledge, where does that stand right now? is it just about iran or the broader issue? >> is about the broader issue of nonproliferation as you mentioned . it is strictly about iran iran has the opportunity to come in and adjust security council to present its arguments and position. the united states did not want to have a situation develop where i ran and possibly some of our allies who support the iran nuclear deal, the obama administration arranged, still, even as the u.s. has pulled out, they do not want to have any kind of space become evident between the united states and its allies. so they have broadened that to nonproliferation. but i do believe iran will be a significant part of that

discussion. kristin: let's talk about north korea. it was at the un general assembly this time last year that president trump came out and called north korea gleaner kim jong-un, little "rocket man". now we are a year later what is expected from the president on north korea? >> administration has obviously, engage in a direct bilateral meeting with north koreans. they've got some promises. the delivery on those promises has been less than what we would hope.nonetheless, the president and administration still have hopes that they're going to be making progress. i expect the tone about north korea to be much more positive obviously than last year. and mike pompeo is supposed to have a meeting on thursday on the issue north korea and meeting with his counterpart, the north korean foreign minister this week as well. hopefully progress can be made

in securing some of the details on next steps. >> there was so much uncertainty surrounding president trump first speech at the assembly last year. this year he is returning as a little more -- if possible. how are other world leaders going to be looking at this opportunity to spend with president trump over the next few days? >> the united states, no matter who the president is, if it is obama or bush or clinton, so forth. the president of the united states is always the star of the show. the country that everybody goes to see and go to listen to. the agenda in many ways shapes the agendas and positions of other countries. so the president's comments are going to elicit strong reactions. i'm sure the countries that will be singled out in the speech. iran is going to be a very strong part of his address. you will have north korea possibly a more positive way but the present will also bring another number of issues up as

legal team of christine blasey ford. she agrees to testify on thursday. now we are joined on the phone, chad, is it safe to say this is a done deal? the ford will indeed testify on thursday? >> well, as much back-and-forth as we've had i don't think anyone is willing to say everything is completely dumpy even in the letter from the attorney to the judiciary committee they say they are number of logistical things. this would be a hearing at 10:00 on thursday. i want to point out all the republican sources i've spoken with indicate that they thought

it was the last possible time that they could hear from ford but also the date that ford had been telling when they would be willing to come and testify. a thursday hearing really pushes things past the october 1 deadline. which is when mitch mcconnell wanted to have the confirmation for brett kavanaugh and on the court. if they do this monday it would take until the end of the week probably friday night before you could even have a floor vote to confirm. and again, the math on that is clear when you're in a 51/49 senate. kristin: there's so much back-and-forth about whether or not she would testify first or kavanaugh are testify first. or bring in an outside attorney. for the questioning. where does that stand? >> there are some of the things that remain unresolved. it is clear in the letter from

counsel that we do not know if there will be outside attorneys doing the questioning. if you go back to the previous models in 1991 with anita hill and clarence thomas, one of the things that kind of backfired on republicans politically later was the very tough cross-examination by spector. then, the republican senator from pennsylvania. the idea that they. the republicans really came off pretty harsh against hill. and while he might've gone clarence thomas confirmed it was not a good political optic to have. it is something republicans sensitive of. keep in mind republicans thought having brett kavanaugh the court and his nomination that it would be something to get the voters and it may backfire when supporters of president trump, republican woman in the suburbs, they do not really like what's going on in this confirmation process and it could blow up in their

face. kristin: chad pergram, thank you for your expertise. never a done deal. never a sure thing but it looks like we will have a huge hearing on thursday. leland: all right, the political applications obviously go way beyond the confirmation or the lack thereof. her judge kavanaugh to the supreme court. we'll talk about that we are bringing in josh from south carolina. robert from atlanta, josh on the left, robbed on -- robert is on the right. take a listen. >> i was a prosecutor, defense attorney and a judge. for every woman that comes forward regarding an allegation like this, god only knows how many never come forward. also know that sometimes people accused of things they did not do. i would advise the president to let us handle this. leland: josh, you agree with lindsey graham that it would be better for the president to stay off of twitter for the next week on this? >> i think it is better for the president to let the senate

handle it. think is been pretty restrained by the president's, he's been fairly subdued but absolutely. i believe this is the judiciary committee question. let's let the judiciary committee handle it. i believe that this entire thing has been nothing more than a political sideshow and an attempt to stop the good justice from being confirmed. i think the judiciary committee will see that and judge kavanaugh will be confirmed. i think we can move forward. but the president would be well served to try and stay on the sidelines, let the senate do its job and i think ultimately kavanaugh will be confirmed. leland: robert, you have democratic senator saying i believe somebody even before they have heard the testimony. >> well, we went through generations where women were not believed. where women were questions continuously. so to now have the pendulum swing even slightly this seems to be a shock to the nation. leland: robert, year defense attorney. you live by the idea that

people are innocent before proven guilty. here in the united states. yet when it comes to politics you do not seem to agree with that. >> no, i agree with people are innocent until proven guilty. but also people have to have their day in court peter went to the hearings until the fbi can investigate to confirm the veracity of claims? leland: robert -- let's put this back into your world. if judge kavanaugh was your client, you would be able to squash a warrant in two seconds based on this. year four people on the record saying this did not happen. given accuser saying i don't remember when it was. you probably would not let your client talk to the police and the situation. come on! >> we not being held beyond reasonable doubt standard here. the confirmation hearing not a court of law. let's have a full investigation because you do not want to taint -- leland: but it doesn't go both

ways. on the one hand you say this is a confirmation not a court of law. and they continually to try to dragon the fbi investigation. they just pass the information along to the white house. it is nothing more than an attempt to delay beyond october 1 to prevent kavanaugh from being -- >> will have about 30 seconds left. i want to pop this up. at that was interesting. do you believe ford or kavanaugh? look at the split among democrats, 59 percent believe christine blasey ford. among republicans, 60 percent believe brett kavanaugh. is the truth totally lost here? >> no, if you look at the overall pole, one third of americans believe her and one third of americans believe him and another third do not know what to believe. it's the same thing we so with anita hill in 1991. in the late summer americans were against clarence thomas because i thought maybe there was some veracity to the claims. leland: you had your 15 seconds

really the first celebrity trial of the me too era. there will be women in the audience that have accused bill cosby of sexually assaulting them and you know that they want him to throw a very long sentence in prison at bill cosby. kristin: what you think he would be sentenced to? >> and want to guess back and say what legal experts have told me. there is a matrix that decides how many years, months and years a person convicted of these crimes gets. the judge has the ability to go above or below those levels. and in this instance, many of the legal experts in pennsylvania that i have spoken to have been putting in a range of 3 to 5 years potentially. but the range that the judge could go to could be as little as probation or 10 months.

or could go all the way up to more than 10 years. kristin: what are you really going to watch and for as this starts and progresses, i think it will take about two days. what are you looking for? >> this is a very ornate courtroom. it has all of the weight of the legal system. it is just like a courtroom that you would see in a television movie. and i will be keeping one eye on the woman who will be lining up very early in the morning to get seats in the courtroom. because they will not be guaranteed seats. then my other eye beyond bill cosby. bill cosby was very angry at the end of his trial. he cursed at the prosecutors after the jury left. and i will be watching to see his reaction. the other thing i will be watching, the door. i will wonder, will bill cosby his family show up? will they be at his side at

this singular moment in his life? or will they not be in the courtroom? which was the case for most of the trial. kristin: so we have a cosby sentencing, the first big celebrity trial of the me too movement just days before the accuser of judge brett kavanaugh is going to testify on capitol hill. can you put into context what type of movement this is for the movement? >> absolute pay bills cosby has been accused by more than 60 women of sexual assault. dating back to 1965. this is a day that many of these women never thought would happen. half a century in the making. when you talk to them, they will tell you that they are linking these two moments in history. the cosby about to face his fate and a supreme court justice, being put through a process in which he will be judged based on his alleged actions in the congress.

hurricane florence in north carolina, we headed out with a local volunteer fire department in the rescue boat to check homes for people that may have still been trapped. while we were doing that we heard some barking. and the fellow that was with us, found these two dogs. they were there in the rescue boat. they were in rough shape. malnourished, horribly dehydrated and clearly very thin. they had swam up to this home and climbed up on the patio to try and escape the flooding.

there were left for dead, quite literally. and boy, what a difference a week will make! with the help of lucky dog animal rescue in dc, this is the younger and a little bit more friendly one. they go. we have florence that is equally friendly, the mother. they are now in washington d.c. like so many other dogs. that were rescued from hurricane florence that had been left by their owners. we bring in colleen burkart with lucky dog animal rescue. pretty incredible journey for these guys. >> it is amazing. they are now here looking for homes. they spent a night in a foster home. leland: we thank them and so far they have $18,000 donated to help florence and other dogs. >> ran away have 100 available and we promise to bring more. these guys have a lot of that care needed. it was absolutely amazing all that was donated in the last week. leland: and they responded

pretty well to the care they look totally different than when our photographer, rick, took a liking to them as well. it is amazing how they responded. >> they were very hungry, they ate a lot, got all of the vaccinations. they had a lovely stay at the vet in north carolina and are doing very well. leland: do you have any idea how many dogs that were left essentially, for dead in the hurricane? >> right now we don't know. but we partner with shelters in north and south carolyn is out work as evacuation centers. we tried to clear out before the hurricane happens. they brought up about 80 animals last week so that shelters could be open for dogs. leland: 70 looking for dogs say if it is a rescue have no idea about the history. no idea what it will be like. what are the advantages of a rescue like these dogs? >> there so adoptable! they always need deserving homes. there are no different than any of the dog. they might just need a little bit more care and patience. we are vetting foster homes that they get nutrition and everything so they can get a great home.
