occurred we would have heard about it and the behavior is completely out of character for bret. in fairness, who knows what type of information we will see in coming days because, you know, this is all new information. >> that's right, you will see that there's more discussion of this but i think it's important to know that in the context of dr. ford's allegations the woman that she said was at the party that the -- dr. ford's allegations stem from say she didn't know judge kavanaugh and we are talking about these statements by classmates of judge kavanaugh, that seems to be the same situation in this case, so we are seeing many similarities, anybody can make the claim and outrageous claim about someone but what matters are facts and evidence and the facts in this case are going to show that judge kavanaugh is going to be able to withstand the smear attempt because of sterling character and sterling reputation.

rob: we do have in fact, have three at this point, one that says that kavanaugh pinned her down and put his hand over the mouth and she tried to scream and another exposed and the third we don't know, we don't know what, are you alleging that all three of the women have gotten together in some kind of, you know, attempt to save roe v. wade and invented all of the stories? >> i think you do need to consider the motivation of people making allegations and understand that the search for truth and justice is what really matters and i think that the senate republicans and chairman grassley have bent over backwards to try to be fair and accommodating to make sure that they hear these very serious allegations and these women need to be taken seriously, however, there are important foundations of american principles of justice and fair play and when we look at the hearing senate republicans will have to decide when enough is enough and to actually go forward and vote to

confirm judge kavanaugh. jillian: well, we will see how this plays out, see what evidence is presented, what information we get, but let's just say right now if he is to be confirmed, we are hearing over the weekend a lot of democrats floating the idea of impeaching him, your thoughts? >> right, well, certainly that is always a possibility, but they would have a very high burden to show and judge kavanaugh if he's confirmed to the supreme court would have a lifetime appointment and i think that this is of apiece with the democratic strategy to make sure that they are not more justices on the supreme court who have fidelity to the constitution who do not want to insert their political policy preferences into their judiciary opinions and it shows, i think, just where the democrats come down on this issue and it does not reflect well on senate democrats. rob: all right, gale, thank you for your time this morning. >> great to be with you. rob: 19 minutes after the hour, taking on tech, google and facebook both under fire for

jillian: health care, voters saying the legislation didn't go far enough and a majority of voters say that it is extremely important for a candidate to share their view on the issue. so is it too late for republicans to gain upperhand on health care, here to debate ant juan and laretta, i will start with you, is it too late? >> good morning, it's not too late. we still have several weeks going to november election and they have to ramp up messaging, the poll that is you're seeing at the national level are consistent with what we are seeing out in the front lines, up and down the ticket and voters in all races whether it's internal or external polling are telling candidates we want to hear more about healthcare solutions.

jillian: a lot going on antjuan, i think, you tell me is it going to be hard right now to get the message focused? >> i think we have seen since february of this year, republicans have damaged this issue of health care and they are at the point of no return. they will be convicted at the polls in november for failing the american people on health care. it's amazing how after president obama has left office his landmark -- piece of legislation has become very popular because health care unlike many issues in this country is not partisan, it's not democrat or republican, impacts us all in some way slaip or form and republicans made it political issue and they failed on the issue. jillian: they tried to make it a political issue? >> well, i think they have tried to make it a political issue and i think what we are seeing is that we are not hearing republicans talking about

retaining obamacare or affordable care act, they do like the fact that there are individual -- they are glad that the individual mandate has been let go by congress and the president and but they do want -- they do want coverage for existing and preexisting conditions, you see the mix there among republicans, democrats have made mantra and have been talking about medicaid expansion where republicans are now starting to get in the mix and talking about the potential of using medicare waivers, while democrats want to have a government solution to health care, republicans are trying to look at this issue as a -- a choice issue and affordable issue and accessible issue which was not what was promised under -- it was promised under obamacare but was not delivered under obamacare. going forward -- >> it's funny how you try to walk back the issue of health

before president trump that democrats did not deliver on promise. health care is the key issue and we are seeing that in every single race and every single poll that that's what americans are more concerned about but it was in the wake of obamacare that you saw insurance premiums skyrocket, you saw folks that had individual insurance carriers, they were left with little choice and they had to change their doctors for the most part, so -- so obamacare did not deliver a solution for our country in terms of health care but i will agree with you that republicans do need to step up and this was a bipartisan situation, both sides carry blame for not delivering quality healthcare solutions in this country. step up with free-market solutions and they need to start talk about it.

jillian: congress taking aim at shrinking seats and leg room on airplanes. rob: good. lawmakers weighing legislation to ensure that we canfully comfortably. tracee carrasco from sister network fox business with the possibility of new federal standard. jillian: music to our ears, tracee. tracee: finally protection for passengers but congress is weighing this bill that would order the faa to establish a minimum for the airline seats, the size of them which we know really have been shrinking lately. it would also adder faa to investigate the size and the number of bathrooms on airplanes and also come up with some new guidelines for allowing passengers to fly with service animals. the bill would also block the involuntary bumping of passenger who is were already on board the plane and come up with some requirements that airlines must clearly state their policies
