heather: the headline says rod rosenstein suggested he discussed the 25th amendment but then you have rod rosenstein saying based on my personal dealings with the president there is no basis to invoke the 25th amendment. his job in question right now. you think it is do or die. >> absolutely is. he will try to defend himself against this new york times article and probably call fake news. he will say there's misleading facts but interestingly he probably won't or hasn't explained what is misleading about the article or whether it is the just of the article he finds untrue so he will try to stay on as long as possible. the president is calling him and to give him a chance to say did you say this? do you think i should be impeached? what is your evidence to prove that? the president and white house is trying to walk a fine line.

democrats would love to have the president remove him from office and use that as a bargaining chip or even galvanizing call to action against republicans in the midterms. there are political ramifications. heather: do you think democrats and some republicans that are not pro-donald trump are trying to get them to make movement on rod rosenstein? >> they would love to set that trap. the white house at this point is a little smarter than that. we did see some articles of impeachment introduced against rod rosenstein because he refused to come up with documents behind the fisa warrant about the russia investigation.

my guess is he will survive thursday but i don't see him surviving long after that. heather: that is another question. in terms of whether or not rosenstein was being sarcastic which he claims he was being sarcastic in terms of the wire donald trump himself cracked jokes that perhaps he shouldn't have in the past, the left is accused constantly of having no sense if you were when it comes to donald trump so perhaps rod rosenstein was being sarcastic but you talk about the fisa warrant been declassified and made public donald trump seems prepared to do that and rod rosenstein said don't do that. >> maybe there is a reason why, it would make him look very bad or the evidence he used for that warrant is based on a suspect dossier paid for by the clinton

foundation and has a sinister background. washington is the swamp. rod rosenstein will try his best, he came out swinging and supportive the president and when he realizes he lost a lot of allies on the other side of the aisle swung way to the other side trying to score democratic points and this is where we are. heather: where we are in terms of brett cavanagh categorically denying sexual misconduct allegations. are the left as resistance tactics to destroy the supreme court nominee's career setting a dangerous precedent? >> they are. whether you are talking about last-minute allegations particularly the one in the new yorker with less substantiation than the previous allocation by doctor ford.

no substantiation, we are seeing democrats are being true to their word. if you are number one brett cavanagh's name was flooded he was nominated they said they would stop at nothing to keep them off the bench. we have seen the tactics coming out. i think everyone wants to hear doctor ford testify thursday. they went to hear brett kavanaugh testify that there is fear about giving into these delay tactics opening the door for very incredulous allegations to come forward. heather: think the league needs to be investigated, senator feinstein did a huge disservice to doctor ford and brett kavanaugh in the way it was presented when she had ample opportunity beginning in july to take this to an investigation. behind-the-scenes and bring it forward. there is a lot to discuss and we will see what happens thursday. thank you for joining us. appreciate it. the time is 20 minutes after the top of the hour. teaching kids about whiteness

actually lose? this is a race giving democrats a lot of hope and beto o'rourke has raised a lot of money. take cruises up by 9 but this is a race you have to acknowledge the possibility of a stunning upset. odds are it is still texas. >> why is he in this position? >> partly because of republicans not being enthusiastic or his response to donald trump's nomination two years ago or possibly when he isn't as well-liked as other republicans might be in the state. we have to give credit to o'rourke. he has been a great campaigner. having said that, look at the political gravity, where do they go? what you will see is closer to election day a lot of republicans will say not sure what i think about the two candidates but i know which team i went in charge of washington.

>> what about arizona? >> this is one democrats of thought from the beginning they would flip this year. arizona is a tough state, republicans got martha mc sally who they wanted to run against kristen cinema. there is a solid race on each side. arizona is interested almost everywhere in the country, if you ask what is going on people say healthcare in the economy. in arizona it is healthcare and immigration. heather: mix alioth tough on immigration. >> this race is a pure tossup. if democrats want to win the senate they have to win here. heather: what about nevada? >> dean heller is the only republican senator running for state won by hillary clinton. because of that he is vulnerable. he is an underdog at this point but it is a competitive race. this is a place republicans hope to surprise experts.

heather: what makes it competitive? i could republicans take it? >> republicans could possibly take it because a democratic leaning state, it is not new york or california. a leading democratic state, and incumbent senator, a powerful force and a very competitive campaign but you have those forces, incumbency coming 5 to head. heather: tennessee is up for grabs, the president announced he will be headed to tennessee. >> the president is going back to tennessee, something about this election cycle, they are worried about the prospect of the senate. tennessee is a huge donald trump state that they never thought they would be concerned about. bob corker having difficulties with the president, he is not running for reelection. all of a sudden democrats are saying, former governor, very

is this overreach or is it necessary? >> i think it is necessary but we haven't gotten to the point that we can tackle this problem at the level it needs to happen. the fact that law enforcement entities, the faa, don't have the ability to mitigate these drone threats is pretty absurd. they should already have the authority to protect our national interest and citizens and to be able to shoot down any rogue drones that may prove a danger to our country. heather: how real is the threat? this is what secretary nielsen said to congressman mccall, the threat is real, commercially available drones can be employed by terrorists and criminals to deliver harmful substances, disrupt communications and conduct illicit surveillance, our hands are tied when it comes to regarding americans against these threats. >> it is not a matter of if but

when an attack will take place. remember recently there was an attempted assassination on the venezuelan president and he almost died from a drone attack and that is the type of situation we will see more and more and that attack alone helped trigger these, looking at mitigating these threats because it is so imminent. when you think about it for years isis has proven this is an effective mechanism to attack others on the battlefield. we need to get ahead of the problem and for congress to look at this as a real imminent threat like it is. heather: you said at the beginning of the conversation you don't think this is enough. what else do we need to do? >> we need to allow law enforcement to do its job but at the same time we need to help look at implementing more technology and innovating this. right now as it relates to drone technology there are a number of
