them plans to defend kavanaugh. and now this wrinkle. now these allegations, and a leading democrats calling these new claims powerful, compelling and highly credible. they are all but daring republicans to question new accusers and the victims they say must be believed. here's a selection selection of the charges. >> i saw bridget bishop with the devils. >> i saw somebody else with the devil. >> >> tucker: that's a scene from "the crucible" which as you may remember it was arthur miller play about the witch trials.

miller wrote it as an allegory about the mccarthy hearings. mccarthy hearings were a period that the left deeply hated when they took power and re-created it themselves. now you wonder if progressives still read miller's play and if so, are they outraged by it? it might seem completely reasonable to them. bob accuses villager of witchcraft and they deny it, because i always deny it. the witch can't prove without a doubt that she is in fact a witch so to the stake she goes. chris would understand this reasoning. he has been making the same case about brett kavanaugh and public recently. watch and explain it. >> it is judge kavanaugh who is seeking a lifetime appointment to the supreme court and i think bears the burden of disproving these allegations rather than dr. ford and mr. ramirez. >> tucker: so even those of

you that are absolutely dead certain that brett kavanaugh is guilty, because you saw it on cnn, would have to admit this does put him in a tough spot. brett kavanaugh no longer has that protection so it's up to him to clear his own name. he has to figure out how he can prove that christine ford's foggy 36-year-old memories are wrong or his daughters cannot grow up learning about how their data as a sex offender, that's his choice. and, democrats are demanding that kavanaugh called down yet another but democrats want another. the only way he can show he's innocent of these charges, various and dumb people on television agree with this and nod their heads in unison.

but what that really work? is that the purpose of fbi investigations? joe biden doesn't think so. keep in mind that biden is both an attorney and former chairman of the senate judiciary committee. watch this. >> the next person that refers to an fbi report as being worth anything doesn't understand anything obviously. fbi explicitly does not, in this or any other case, reach a conclusion. period. >> tucker: okay we fooled you again, that's joe biden from the 1991 joel clarence hearings. he was on the other side of the debate then so he obviously had completely different views than the ones he holds today. democrats know that of course but, so what, proving or disproving a recovered memory is

not the point. the point is destroying brett kavanaugh. most democrats don't hate him personally, there's nothing personal about any of this. kavanaugh stands behind the democratic party and the power it seeks. he's in the way and he must be crushed in the case of his wife into little girls. sorry, that's a cost of winning. no omelettes without some broken eggs. the problem is that outside parties in d.c., people out there don't understand that. why wouldn't they believe it? that's the only other thing that never changes ever, human nature. there is a mob instinct in people. the every population, wise leaders know that, why is leaders feel that.

you can tell the mob is building by the way people to start talking, like this. i think there's a compromise here come and hear me out on this. so kavanaugh gets confirmed to the supreme court. okay, in return we get to cut that pesky of his off in front of everyone. >> tucker: so that's what we are, castration. medieval moments call for medieval remedies and this is definitely a meeting of. so ethan, are you comfortable with this and are you comfortable that once you are accused of something, you should be the one to disprove the accusation and it's up to you to prove what you are saying about you isn't true.

>> i think what we have to have is a hearing of both sides, and i think we will have that from dr. ford. and that's the suppose it witnesses that have occurred. it's not up to process, this is like a job application. >> hold on, let me back up. you are arguing something parallel to what i ask you. i'm in favor of all of that, the question is what do we make of your party leaders, members of the judiciary party saying, we have at least three democratic members of the judiciary committee saying that in plain intro, english. prove you are not guilty, are you comfortable with that

standard that's an un-american standard? we've never seen it before and it's happening now. i want to know what you think of it. >> i'm not comfortable with the scenario, when they say, prove you are not guilty. and i've been consistent about this throughout the entire me too movement. when there is single accuser it's hard for to call for somebody's job to be lost. when we have multiple accusers coming forward, plus michael avenatti is teasing another one, then we have a pattern and we need to look very deeply into this. >> tucker: does it occur to you that we have a pattern of people making charges that they can't substantiate to achieve political ends? is that a possible explanation for that or am i a sexist for suggesting that? >> we have two really big issues. one, i don't like that politics is the blood sport that it is today. the democrats had on the letter, but politics is politics.

they sat on it to try to delay it. but what's happened now is, we have women who are being slammed and slandered, attacked in disbelief and in the middle of them me too movement, it's time to get them their due. >> tucker: hold on, it's not about all men and all women. it's about brett kavanaugh and christine florida. the case is specific. we are not putting men on trial or trying to exonerate women for the crimes committed by our ancestors, we are talking about those in the senate judiciary committee. you are suggesting that you are not allowed to just believe somebody but i retain my right of reason and, she's claiming that this man sexually assaulted her and alter the close of her life. she can't fly in airplanes, she can't have a relationship with

men. she didn't tell anyone his name for 36 years during which time he got married and a career. doesn't she have an obligation to tell someone to stop him from doing that if he is in fact a criminal? where is her obligation here? >> every psychologist will tell you there are eight primary reasons why a sexual assault victim, a trauma not come forward. >> tucker: i'm not asking about her reasons. the odds are 120 million in the first place. if he's actually a criminal then we have a right to know that and she has an obligation to tell us. i know it's hard, but why doesn't she have the right to know? if bernie made off rips you off and you don't tell his other investors, you are part of the problem, are you not? >> dr. ford did communicate with her therapist. >> but she didn't name him for a

36 years. i'm saying if it is true, what's going on here? don't the rest of the us have a right to protect ourselves from this dangerous man, brett kavanaugh? >> hang on. you have a very powerful person here, a judge on the ninth circuit. >> tucker, you were just talking about the privileged elite and the wealthy and those in power. that was brett kavanaugh from day one. he went from an elite school, that's calling for something is to change. >> tucker: it you are intentionally dodging my question. which is about the responsibility to protect the rest of us. i think it's not just about her, and her feelings, your responsibility to others around

but the press is now starting to fall for its own joke. taking creepy born lawyer seriously, and, it's not about one specific allegation, it's a series of allegations. this is a pattern of behavior, rachel, that took place across many months and many years. i believe that when these allegations are surfaced within the next 48 hours, there will be no question that brett kavanaugh does not fit to sit on the u.s. supreme court. >> he hasn't provided the allegations needless to say. this guy is a buffoon. the consequences are serious, why let this charlatan intrude on the process? why are they allowing him to take center stage? >> michael avenatti is taking a page out of trump's own playbook. but here's the difference, michael avenatti has brought the

weinstein's personal friend of senator christian kirsten gilln new york. seth, when you see senator gillibrand position herself as a defender of all women everywhere, what's your response to that? >> i don't know how it is that she has heard the two accusers and agrees with them because as she said anything yet? i don't think so. but senator gillibrand has a very long history of embracing whatever is expedient and dispensing with whatever is no longer expedient. she was elected in 2006 as a conservative democrat. now the motto was basically her mentor and arrange for her to become senator after hillary clinton became secretary of state in 2009. she was a conservative, she had an a rating from the nra. she had been a philip morris attorney.

and when she became senator, she quickly attacked left. one thing she said this year that i thought was very revealing, i asked why when she used to support deportation of illegal immigrants and now she was on board with the dreamers, she said, welcome i came from a district that was 98% white and she said this is something she's embarrassed and ashamed about. >> tucker: so she's embarrassed and ashamed of her former constituents who lost her political career, after she was a cigarette lawyer. and i think she worked for harvey weinstein's law firm as well as being good friends there. so when you see this former friend of harvey weinstein's and bill clinton's, who knew all about their reputations of women abusers and said nothing, do you think it's a credible posture for her? >> i mean it's consistent for her. this is exactly what she has done throughout her entire career. remember a few years ago she

we do believe that a person is innocent until proven guilty in this case and, we have judge kavanaugh in a possible position, people have noted this. i want to believe that women are always morally superior to men, but the duke lacrosse case and lena denham's book, and even going back to classic literature like, to kill a mockingbird, we know that's not always true because we are a broken people. >> so not every woman always tells the truth in every incident? >> sadly that's the case. we know that you don't immediately become more moral because you are a woman. that's why justice must be blind. justice has to be blind to everything. gender and race, socioeconomic sand age, and we are counting on that. if we get away from that notion, it's dangerous for our nation

and dangerous to everyone in our country. >> so it's dangerous of people are judged on their race. >> absolutely. now listen, i believe women. and i think we have a right to use our voice and speak up, and as a victim we have to have the opportunity to come forward and share our perspective. we also need to understand that we deserve to give justice to everyone in this nation and if someone from america is therefore judge kavanaugh, we still support him. if something changes and is actually proven that he is a predator or anyone sitting on the supreme court today, we would be the first people calling for impeachment, we would be leading the charge. but that's not where we are. in fact we are doing a women for cavanaugh kavanaugh rally at 8:30 a.m. until 9:30 a.m. and any of the reviewers who want to come would be welcome. this is an important moment for conservative women to speak up

principles, i think everyone would get more if they had gone up to ted cruz to lay out their case or lay out their points to him but i don't think it's a good idea to encourage people -- i don't think you accomplished much by doing that. but i think for public officials to be whining or complaining that they are being harassed in public, that takes out of the notion of public service the public piece of it. >> tucker: so let's get back to his showing up at your parents house. i disagree with what you're saying, i think it's bad for the country. >> my parents are not in public service. >> oh come on. >> tucker: let me be totally clear, i hate this stuff and as it totally wrong. i would never bother you or your
