mitch mcconnell 89:30 the judiciary committee will vote on kavanaugh. tomorrow procedural vote to launch debate on kavanaugh. then on monday, after that ripens as they say here in this town, they will vote to end debate on kavanaugh and then on tuesday, we're likely going to get the fate of judge kavanaugh's nomination. it's coming down to three key republicans. here they are, collins murkowski and flake all hanging in the balance. 47 other republicans are a yes. good sign for kavanaugh, previously undecided senator bob corker threw his support behind the nominee only after hearing the entire hearings yesterday. and one democrat, joe manchin of west virginia appears to be leaning toward a yes and that could be a huge factor. in fact, we're learning that collins, murkowski and manchin and flake may have huddled together and could vote as a block. then you see here the president calling for a vote and standing behind his nominee saying judge

kavanaugh showed america exactly why i nominated him. his testimony was powerful, honest and riveting. democrats' search and destroy strategy is disgraceful and this process has been a total sham and an effort to delay, obstruct, and resist. the senate must vote. you will hear more from democrats probably about delaying the vote. this morning the american bar association is urging the senate to postpone the vote until the fbi can investigate. that's not likely to happen because chairman grassley made it clear the issue is settled citing the former committee chairman joe biden's own words on fbi investigations. guys? steve: came back to hawngt joe biden. brian: he tried to qualify it last night stop using me. bottom line it totally applies and said we are just talking instead of 191. we are talking about 2018. quick thing on the vote. jeff flake said this. this is a tough one. lisa murkowski says i'm going to go home, have some dinner and have a chance to think about all that's gone on today. steve: they snow exactly what they are going to do. we know better later this

morning. brian: do you think so, steve? steve: we will know because they are going to have the meeting and take a vote. i think it's going to be close. but it looks like i heard a number of commentators last night it looks like he goes through. if you were basing it on what you saw on television yesterday, it was so compelling, dr. christine ford very compelling and heart-felt. she really looks like it believes like kavanaugh assaulted her. then had you judge kavanaugh he came out and his guns were blazing this process has not only tried to destroy me but my entire family. if you missed some of his statements. here is 1:31 of it. and it was something. >> this confirmation process has become a national disgrace. the constitution gives the senate an important role in the confirmation process. but you have replaced advice and consent with search and

destroy. this has destroyed my family and my good name. this whole two week effort has been a calculated and/or committees straighted political hit fueled with a apparent pent up anger about president trump and the 2016 election, fear that has been unfairly stoked about my judicial record, revenge on behalf of the clintons, and millions of dollars in money from outside left wing opposition groups. this is a circus. the consequences will extend long past my nomination. i'm here today to tell the truth. i have never sexually assaulted anyone. not in high school, not in college, not ever. but i have never done this to her or to anyone. that's not who i am, it is

not who i was. i am innocent of this charge. i will not be intimidated. you may defeat me in the final vote, but you will never get me to quit, never. ainsley: when dr. ford spoke, you could tell she was fragile. you could tell she was very nervous and not used to being in front of the camera. she was surrounded by her attorneys. they helped her write her opening statement and prepare for this. she asked for coffee she needed caffeine after she spoke and continued to drink while she was taking the questions from the senators. when he spoke i was impressed when he said i have only showed this opening statement to one person. i have written all of this. he was very impassioned when he spoke. he has a lot of experience and he knows exactly how though do this not only is he an attorney he is a judge there were a lot of moments that really stuck out with me the very end when snearnght kennedy asked him had if he believed in god he said as god as my witness i have never done this to her or anyone else. senator graham, of course,

look as if you are dismissing her or being thuggish but once it started little things like how did you get to the party? how do you know brett kavanaugh? when did you first meet? how did you get home? why would you go to a party with people you barely knew in such a small setting? why is it that nobody can corroborate your story? and sadly, there is road kill. the road kill is mr. judge and the road kill is her best friend or formerly best friend lee land where he comes out and goes she has mental problems and they come out and say mark judge has been an addict and bouts with depression. that's why he doesn't want to come forward. they never mghted that to come public now everybody knows. steve: we have a sound bite with judge kavanaugh where he refers to his daughter -- you were talking about your daughter. here's the thing, because somebody essentially asked the question well how do you feel about the accuser? and then judge kavanaugh had this sound bite. >> i'm not questioning that

dr. ford may have been sexually assaulted by some person in some place at some time, but i have never done this. to her, or to anyone. the other night ashley and my daughter liza said their prayers and little liza all 10 years old said to ashley we should pray for are the woman. that's a lot of wisdom from a 10-year-old. ainsley: you heard her first and it was very compelling. it was very believable. then you heard from him and it was very compelling and very believable. he looked at each of the democratic senators. steve: you could tell. ainsley: you pointed out. steve: you called me evil, you called me this. ainsley: you would oppose me with everything you have got he said. you called me evil. those who support me are complicit and evil. worst nightmare you called me. then he said the former head of the dnc judge kavanaugh will threaten the lives of millions of americans for years to come. he says i have worked so hard for my reputation and

it is tainted forever. brian: my hope is it never gets worse than. this we went to the edge and walk it back on every level because this is out of control. how many people can pick up yearbook in the 50's and have to stand by every comment editor 16 or 17 years old. that's what we're discussing. ainsley: it was all over social media what he wrote in his yearbook and some of them are showing to me and explanations what some of these things mental i was just, what? this is awful. and then when they asked him. brian: you thought it was awful, right? ainsley: when some of my friends were telling me what the triangle, "the devil's triangle" means, what the rumor is that that means, i was like that is disgusting. they asked him to explain it, he said it's a drinking game, a quarters game we played. steve: when the senator of rhode island was asking him about one line. he said that was from my high school days and that's a joke about gas.

voices downstairs laughing at her by the way the music was on and chairs were situated. i don't want to see her treated harshly. i don't want to see her story being cross-examined. but, you can't have it both ways because there is so much at stake for the reputation, the lives and the career of the person. ainsley: senator grassley was so nice didn't you think the way he was handling her. steve: he was trying to keep the train on the rails. brian: but he licensed out the questioning to her and finally lindsey graham and company and said i'm taking my minutes back. cornyn says i'm taking my minutes back. cruz says i'm taking my minutes back. what i mean by that is everyone gets five minutes. when it came to questioning ms. ford, they gave it to ms. mitchell to do from arizona. but when it came to asking brett kavanaugh, it was time to get to his defense. and lindsey graham let everybody know he had had enough. listen. >> if you wanted an fbi

investigation, you could have come to us. what you want to do is destroy this guy's life, hold this seat open, and hope you win in 2020. you've said that, not me. you've got nothing to apologize for. when you see sotomayor and kagan tell them lindsey said hello because i voted for them. i would never do to them what you have done to this guy. this is the most unethical sham since i have been in politics. and if you really wanted to know the truth, you sure as hell wouldn't have done what you done to this guy. i cannot imagine what you and your family have gone through. boy, y'all want power, i hope you never get it i hope the american people can see through this sham that you knew about it and you held it. you had no intention of protecting dr. ford. none. she is as much as a victim as you are. god, i hate to say that

because these have been my friends. but, let me tell you when it comes to this, you are looking for a fair process, you came to the wrong town at the wrong time, my friend. to my republican colleagues, if you vote no, you're legitimizing the most despicable thing i have seen in my time in politics. you want this seat? i hope you never get it. i hope you are on the supreme court. that's exactly where you should be. and i hope that the american people will see through this charade. and i wish you well. and i intend to vote for you and i hope everybody who is fair-minded will. steve: and the vote will probably be in about three hours. that was one of the most impactful, passionate speeches ever in that committee. tom fitton was in the room at the time. he was the president of judicial watch. tom, we didn't hear any new

details, really. no new evidence. so where are we this morning? >> well, you know, despite this big circus of a hearing, it didn't advance the ball in terms of providing oh my gosh, he certainly did it or anything that would suggest that you can't trust anything this woman said, you know, other than the fact she had no corroborating evidence and no one supported her. of course we knew that the day before the hearing and we didn't need a hearing to now know what we know today which is why his case or his confirmation is going to go to a vote later today because nothing new happened yesterday other than the circus. and i'm glad the republicans are shutting the circus down. i don't think they have moved to the committee vote if they didn't think they had the votes to move him out of committee and ultimately to confirmation. so, despite the torture and it was torture and it was really unethical what the senate democrats put him through in league with heir

leftist allies it, looks like judge kavanaugh will be the next supreme court justice by the middle of next week. ainsley: tom, you were in the room, we can sit here on the couch and talk about this, but we weren't actually in the room. what was it like to be in the room when lindsey graham made those statements? >> oh, it was high drama. i could see senator graham even before that was reacting quite strongly. you are sitting there and can you see him almost popping out of his chair in response to some of what was going on. and going back to the beginning of the hearing before dr. ford testified, guys that tension in that room was incredible. and you could cut it with a knife. and everyone was paying very close attention to what she said. and then later in the day judge kavanaugh came in, and defended himself quite ably and went at the hearing, the senators there from the democratic side quite directly. you don't necessarily get that from the cameras, they were held to account.

i have to say, i thought the democrats had the advantage, even through judge kavanaugh's opening testimony. it was dramatic but the democrats lost when they began opening their mouths questioning him because the vale was lifted. you could see they were dishonest. steve: fbi, fbi, fbi. >> one of the worst things is having him i forget who was questioning him about the yearbook. giants posters of the yearbook and you saw the absurdity. brian: senator whitehouse. >> all the credibility they thought they had just went out the door when you have this poor man's yearbook being raised as if it was a piece of evidence against him. it was absurd. brian: tom, the whole idea is this do you believe to believe ford or kavanaugh's authenticity. if ford wanted to keep anonymity that was thrown in the street against her will if we are to believe what we hear. dianne feinstein had it, held it and suddenly out there. why was it out there and why was her name released?

she could have been honest and gotten to the bottom of this. one on one they could have gotten allegations out and they didn't do it. here is senator dianne feinstein denying that she leaked the letter. >> mr. chairman, let me be clear, did i not hide dr. ford's allegations. i did not leak her story, she asked me to hold it confidential, and i kept it confidential as she asked. she apparently was stalked by the press, felt that what happened, she was forced to come forward, and her greatest fear were realized -- was realized. she has been harassed. she has had death threats and she has had to flee her home. brian: why was she stalked by the press? because her name leaked out. >> through the democratic side of the aisle there. you know what i think came out yesterday was senator feinstein's corrupt operation where they withheld the fact that they knew about these allegations

while they were questioning judge kavanaugh, so they knew they had this here. they could have asked the fbi to do a quick interview weeks ago. and, on top of that feinstein's staff is recommending her lawyers further undermining her credibility to the detriment of the accuser. since the corruption of the democratic side here was expose you had, and, you know, we have to remember they are also pushing out false allegations that came out subsequently against judge kavanaugh that were absurd on their face and i'm not going to repeat them because they don't deserve repetition. this man has had his reputation dragged through the mud enough. again, the democrats lost yesterday, thankfully, not because anyone opposes them in a partisan way, it's because this process would have ruined the senate if it was allowed to go through the way they wanted to go through, which is to raise

allegations without evidence. this woman they believe what she says they believe. you can believe her and have sympathy for her. it isn't enough to derail this man's nomination, destroy his reputation. this is why it should have been held privately. you could have evaluated her and said you know what? we appreciate you think that happened 35 years ago. there is not enough evidence to derail this nomination. we are not going to torture you by going through public recitation and him. both were abused. the senate owes judge kavanaugh an apology. the best apology would be to confirm him as quickly as possible though. brian: see what jeff flake and susan collins. steve: see what the vote is this morning. tom, thank you very much from judicial watch. ainsley: the media lashing out at brett kavanaugh for defending himself on capitol hill. watch. >> i thought it was a temper tantrum. >> most support san i have ever heard a judicial nominee. >> he looked unhinged.

her best friend denied that she had even met brett kavanaugh and ms. ford had said that she was there that night. what about her testimony though? >> her testimony may have been heart-felt, there were too many holes in her story and her story was falling apart. i'm sorry, i didn't cry with her. i cried with him. i felt his pain. i didn't feel any emotion from her because she couldn't keep herself together. >> that's right. >> papers was all over the place. she had her lawyers dictating what she should say, what she shouldn't say. i look at all of that i paid attention to all of that. >> yeah. >> she didn't draw me in. he drew us all in and we believe him. steve: ladies, it seems like she believes that brett kavanaugh assaulted her back in 1982. >> okay. but, listen, i believe that she was abused and looking at her from yesterday, looking at her demeanor and disposition, i believe she was abused probably earlier than 15 years old. but i don't believe that brett kavanaugh did. this. >> right.

so, very believable but then you heard from him and you saw how upset he was. and it was very believable, too. so what do you think the truth is? what do you think was happening? >> well, the truth -- first of all, you have to have evidence. kavanaugh had things to substantiate. he kept calendars. i was just so taken aback by that she couldn't keep her story together. >> that's right. >> she has no proof. accusations, allegations without accurate information is merely speculation. >> that's right. ainsley: do you think she is lying? are you saying she lied? >> i'm not saying that she lied. i'm not saying that she lied. i believe that she was abused somewhere but it was not by brett kavanaugh. >> that's right. >> it was not by him. >> yesterday, his father, brett kavanaugh's father saved his life and it was so good to finally see republicans saying and ban and not fall and go cold. it was finally good to see republicans call out the hypocrisy that's been going on in this country. brian: we heard from diamond and we heard from silk.

blows because they didn't want to see those optics. but, you know, it was frustrating for a lot of people dividing this into five minute increments did not allow for any real substantive questioning to occur. steve: okay. so after the 8 or 9 hours of testimony that we saw yesterday later this morning they are probably going to vote. where are we after having watched that? >> i think he did a lot of good for himself. if the vote had been taken after dr. ford's testimony, i think his confirmation would have failed. she was very compelling. there were even some statements from senators saying that they were persuaded. senators that are viewed on the fence. but then he came out and he changed that i do ma'am nic. this was really the two-minute warning in the fourth. and he sparked the offense, he went in there and instead of attacking her, he a attacked the democrats that was effective for the right group of people. not going to change the mind of people who believe

dr. ford. i think it did spark the base. they are going to have their voices heard this morning. ainsley: do you think after watching all of that yesterday that he is confident to be a supreme court justice? >> i think he -- i think there is no question about his competence. and what you saw yesterday was a human being, you know, a lot of people were taken aback by the anger. but, he was not going to be the next michael decaulk kiss who just sits there and gives a rather wooden robotic response. he is accused of being a rapist. most people would be quite angry that was a change for people to see greater emotion for them. for many people they thought that was quite genuine. ainsley: competency does he deserve it? >> i don't think his qualifications are really in doubt here. i mean, the question for the mexico is what standard of proof are you going to apply? have you got to apply some standard. it's not just a job interview.

in terms of where this hearing ended, it pretty much ended where it began. this would not satisfy a preponderance of the evidence standard, which is the lowest standard. at most these accounts are echo poise, they are even. so, evidentiary standpoint, many senators would feel they have to go back to the merits of the confirmation and whether he is qualified. there is not a lot of debate about that. brian: common theme for democrats kept calling for fbi probe. the bar association says they want to take time and investigate this more. listen to this theme. >> if you're very confident of your position, and you appear to be, why aren't you also asking the fbi to investigate these claims? >> are you willing to ask the white house to authorize the fbi to investigate the claims that have been made against you? >> judge kavanaugh, will you support an fbi investigation right now? >> i will do whatever the

committee wants. >> personally, do you think that's the best thing for us to do? you won't answer? >> look, senator, i have said i wanted a hearing, and i would welcome anything. i'm innocent. brian: already had six background checks. where do you think that was going knowing that he gave out same answer five times already, jonathan turley? >> well, quite frankly, i actually thought he flubsd that part of the questioning. this was a very likely question to come out. i think he should have just said look, i'm fine with an fbi investigation. but it's ultimately up to the committee. i would certainly support it if the committee feels it's going to go forward. he seemed. brian: do you think that would have been a mistake because the whole thing would have been delayed another week. and we have already seen these crazy accusers anonymous letter in colorado

ainsley: senate lawmakers set to vote today over judge kavanaugh. what kind of impact will all this have on our politics going forward? let's bring in constitutional law attorney jenna ellis. hey, jenna, thanks for being with us also works for dr. dobson. >> thanks for having me. ainsley: great to have you here. from a female perspective what did you think of her testimony. >> i thought she came across as very sincerely confused. when judge kavanaugh responded i thought he had such compassion for her because clearly she has been through something traumatic but ultimately she didn't provide any substantiation or corroboration for the allegations. it's not what we do in america to base our decisions on emotion or compassion but evidence and fact. ainsley: you know that going to law school and studying the constitution. as a constitutional lawyer, i wanted to get your reaction on this because judge kavanaugh said the constitution gives the senate the important role of choosing or helping to move forward the supreme court justice.

this process, scorched earth politics have affected him and dr. ford. it was hard to watch without feeling a tremendous amount of sympathy for both of them. ainsley: sarah, lindsey graham had said something to the effect if he was a rapist or he had done this in his experience people that he knows have done that go on and do it and continue to do it. did you see any signs of that when you worked for him? >> of course not. judge kavanaugh was an exemplary boss. is he a tremendous judge. he was kind and respectful to all of his law clerks, male and female. there wasn't a hint, as he alluded to his testimony there never has been a hint in his long entire professional career anything like disrespect towards women. brian: you are the legal professional. who do you believe? >> i don't really think -- i don't really think there is

any way to answer the question of who is telling the truth. and i am not a legal professional in the sense of evaluating credibility of witnesses that often. all i can say is both parties seemed sincere u and that the credibility of the allegation seems like it has to turn on more than just sincerity. and all of the evidence that there is, from something 36 years ago, supports judge kavanaugh's account. as his entire lifetime of distinguished service and respectful treatment of women. steve: that's right. because dr. ford had said there were four people who were there. she named the people the investigators went and got sworn statements from all of them and they say this never happened. in fact, her best friend, who see seed, dr. ford said was at that particular event, said i wasn't there, that never happened. and i don't think i have ever met brett kavanaugh.

steve: 9:30 this morning senate judiciary have a meeting and take a vote and move to the whole senate if it passes big question is how will these moderate republicans vote. in fact, there was a 20-minute meeting yesterday with the three moderate republicans and joe manchin a democrat. after 20 minutes joe manchin said no decision yet but apparently susan collins raised some concerns about mr. kavanaugh. ainsley: first three, they are the republicans and they are on the fence. but, we in newt gingrich sits here earlier he thinks they will vote yes. manchin is a democrat from west virginia. president trump won by more than 40% there. brian: keep in mind, he would never decide if he gets in or not he wouldn't be the deciding vote he

there are so many motives. i interviewed forensic experts for the work i have done on wrongful convictions and false allegations particularly of rape. there is an excellent textbook written by a retired nypd guy who headed the sex assault unit, and this statistic literally 2% of women lie about rape is a figment of the imagination of the feminist left. actual empirical studies published in peer-reviewed journals show that the actual rate of lying about rape or sexual assault is anywhere between 8%, and 41% and in some precincts in new york city it is 90%. it is astonishing that people lie about rape. you have hollywood and academia brainwashing generations of women to believe they should always be believed. she may be deceiving herself and others. pete: we don't know that she is lying. that is your opinion.

last couple weeks but they have drawn on their faith and close friends and each other and i was proud to see brett defend his integrity. jillian: what you think the truth is? doctor ford seemed so believable and most to talk to when they hurt her testimony it is believable, she had been through something that you heard his testimony and he seemed believable too. >> i don't know doctor ford. i have known brett for 20 years, i have seen him in every kind of social setting, i have seen them on dates, i know his ex-girlfriend, seen him at parties and weddings and never seen anything remotely approaching the kind of behavior alleged here. it is completely inconceivable to me that he did the things she is alleging. i have to say we are talking 35-year-old allegations. i don't trust my own memory after 35 years and particularly don't trust memories bottled in someone's head. she said she didn't talk about these allegations to anyone for three decades and we have a lot
