jon: 7:00 p.m. on the east coast, 4:00 p.m. on the west. welcome back to the special edition of the "fox report". any moment now president trump will take the state at the arena in west virginia. he looks to drum up support head of the midterm elections. the president likely to address the uncertainties surrounding the supreme court pit brett kavanaugh with west virginia being home to senator joe manchin one of the key swindles. ellison barber is live in the arena where the rally will take place. what is the mood like right now? reporter: it's interesting. there's a amount of people here

for various reasons and some are voters that live here in west virginia and say they're here because they want to the president trump and they like the attorney general is the republican running hopefully the that seat may help by democratic senator joe manchin. other people from west virginia who told me they like senator joe manchin may have respected him and like how he reaches across the aisle. they came here because without like it was a once-in-a-lifetime opportunity to see the present. i asked them what they hope to hear and expect it to here in the main feeling in the room as they want to hear president trump. we've covered a lot of these and you hear people talk about how they want to see president trump. they like him. they feel like it's an environment where he thrives and see the man that they voted for.

you can hear from the music that people are excited and waiting for president trump to arrive. the general attorney told me earlier he expects president trump to not only campaign and advocate but address the situation with cavanaugh and attorney general said he hoped he will talk about it the 80's hoping he will use that as an attack on joe manchin but we don't know how senator manchin or bo. you considered a key swing vote when it comes to judge kavanaugh. he said he supports the delay and an fbi investigation but whether or not president trump addresses that tonight, that is the big question. a lot of people here thank you might. john. jon: the president is due to start any minute. any indication, allison as to whether he's running on time? reporter: we know that paul just walked in and that's a good sign

he is also in the building and exactly what he will walk out we don't have that time just yet. he's expect to start at seven and often times he does start fairly close to on time. a lot of the people here have been waiting since early this morning. there was a line of a couple hundred people by the time we got here at ten, 10:30 so a lot of people have been waiting and most people they will be the president soon. whatever he does these things, the schedule always seems fluid. president trump really sticks to his and we about the economy that is about tax cuts and often he points out a democrat in the state that did not vote in favor of the tax cut and usually pokes fun at the media. that is something the crowd enjoys. people are ready the president to come out. when he comes out we don't have the time just yet but he's not

congressional district, west virginia secretary of state was there with his wife. selena state senator and people from basically all three of the states and the public in harmony for west virginia third congressional district is there as well. it's a 34 for the president. >> yes, a lot of the running for office are tied himself closely to president trump when where he did strongly like west virginia. others are at more of an arms length because are not sure whether it's a positive for the campaign or not. it'll be fascinating to watch night how he dreads the needle on the politics in west virginia. on one hand, do you want to come out heavily against joe manchin where the possibility that he could be a swing vote? he could be a democrat who votes for cavanaugh because he knows his constituents, perhaps, want him to do so.

that means if jeff flake or lisa murkowski or susan collins republicans don't vote for cavanaugh that makes up for it. do you want to come out swinging on mansion or do you want to cut out supportive and vile of the voters in west virginia in support of kavanaugh so that manchin sees the political liability of not voting for kavanaugh. jon: in the race seem to be getting tighter between those two. >> yes, some of the polls had manchin way ahead a few weeks ago but one of the latest polls has them that in neck. have seen this happen before were president trump either endorses or comes to town to endorse and it changes the complexion of a race. jon: republicans, there are three senators who are? 's when it comes to the kavanaugh nomination. susan collins of maine, lisa murkowski of alaska and jeff flake. flake did vote to send the

recordation to the floor from the judiciary committee and indicated that absent any unflattering details in the fbi report he's willing to vote for judge kavanaugh. then you have the two female senators that doesn't help can't afford to lose one of them and get the nomination through. that's where the vote of someone like a joe manchin or joe donnelly could be a little. >> if 51-49. two independents and tend to caucus with the democrats. you lose one republican a down to 50-50 and the vice president would then pass the tie-breaking vote. he is on a narrow hedge here. i'm not sure that because flake said that his vote in moving the nomination from the committee to the floor was contingent on an fbi investigation meant he would

virginia. the president hopes he can unseat joe manchin, long time democratic senator. question is will joe manchin vote for or against the confirmation of judge kavanaugh. that is the issue of the moment. the fbi has contacted the second woman to come forward with sexual assault allegations against supreme court nominee, brett kavanaugh. this after senate republicans agreed to delay a confirmation vote for one week while the fbi looks into her claims. leland vittert has more on all that. reporter: the fbi and resources are unmatched and almost unlimited. there are serious questions as to what they can uncover here beyond anything that is already in the public record. >> no physical evidence and no forensic evidence and no electronic evidence. they will be limited to about half a dozen people, largely

duplicative of what's been done by the senate. reporter: christine ford stands by her allegations and her lawyer says a thorough fbi investigation is critical to develop the relevant facts. judge kavanaugh continues to deny any and all charges and says he will speak to the fbi. one of the people likely to be interviewed is for the friend who said ford was at the party where the alleged assault took place. her lawyer that she, too, will cooperate with the fbi but in a letter says my client has already made clear she does not know judge kavanaugh and has no recollection of ever being at a party or gathering where he was present with or without doctor ford. notably, mr. kaiser does not refute doctor for the count and told the press she believes doctor for the count. however, the untreatable truth is that she is unable to

cooperate it because she has no recollection of the incident in question. market judge, who ford says was there, has no recollection of the event but will cooperate. same thing for alleged party attendee patrick smith. republicans who keep pointing to this soundbite from then judiciary committee member joe biden and anita hill hearing. >> fbi explicitly does not, in this or any other case, reach a conclusion. >> kavanaugh supporters are spinning this as a good thing saying the mere fact that an fbi report will take away a key democratic talking point making a week delay well worth it. jon. jon: leland, thank you. lawmakers are reacting to senator jeff flake's call to delay the vote. arizona senators last-minute decision pushed the vote back by a week. rich is on capitol hill. reporter: what you have on capitol hill is most begins say they will vote for just cap not

in most democrats saying they will vote against judge kavanaugh and a handful of undecided who are waiting for the investigation to conclude. republican leadership so they don't want this to go on but keep it in the scope of this week to make sure it does not go on indefinitely and think that nomination of judge kavanaugh. senator hatch wrote a letter to the fbi director in which he says quote, the president noted this request should be limited in scope and completed one week from yesterday. with your leadership and professional career staff handling the matter i have no doubt the fbi is capable of conducting the necessary interviews well within that timeframe. he says he wants to be alerted if there are witnesses seeking delay or who are uncooperative trying to push this into a timeframe beyond this week. there are outstanding senators who will decide this and waiting on the investigation. >> how do you feel about what's been agreed to? >> it was a good step to take. thank you. jon: a.

reporter: there are democrats who are agreeing. senator of north dakota says quote -- senator jeff flake is the one who pushed this investigation and he says he would not vote to move forward on the nomination if it were not for a week long investigation to look into the allegations of sexual misconduct and sexual assaults by judge kavanaugh. that is something that he says later on because of his conversations with democratic senator chris coons he was persuaded to push that investigation because he says he trust senator coons and they have a good relationship. if it were anyone else, he would not have taken that step. they are speaking together in an event in new york where they said the good friendship and relationship help create the bipartisan amateur that led to

the investigation but there are a handful of democrats and republicans in the middle looking to this investigation to see if they are going to support judge kavanaugh's nomination. that right now is where it will be decided. jon: which on capitol hill, thank you. for more on this, let's bring in former federal prosecutor doug burns, also associate editor and fox news for jupiter. i want to play for you both something that the former assistant director of the fbi told me earlier today about the timing of this investigation. he's not convinced it can be done in one week. listen. >> any student of recent history is to understand once the investigations are launched they have a way of taking on a life of their own. fbi will pursue diligently and thoroughly but they have to pursue. i would say there is no guarantee that they can do that in one week to protect the way the course of an fbi invitation

and how it will go and how long it will take is like playing roulette. jon: is that the charge to the fbi to get this done in a week? >> it is. very explicitly. the fbi would have to be convincing in his arguments to continue the investigation. probably they would have had to bounce something that they want to chase down. to convince the white house and republicans in the senate. already, they been given a fairly good parameters within to work. it's not just doctor ford that they are allowed to talk to but ramirez, the classmate who has her own allegations against kavanaugh, a classmate from yale. it struck according to our reporters not to talk to julie the third allegation that came up but they got two of them pursue and they will have to

work within that one week unless there is some finding that is very convincing. jon: six, doug, say that the democrats are supporters of doctor ford want to drag this out and want to slow walk this until -- and make it so that kavanaugh cannot be there cannot be a confirmation vote until after the midterm election. is it possible for them to drag this out? can witness say i can't talk to you today but i have to go grocery shopping. >> that is interesting but working off john's point, you have to work backwards. they made it clear this would be limited to one week and it's almost like you have to work backwards. your point is amazing which is wait, what if there is a concerted effort that people say i'm away on vacation or i'm this or that. it will be fascinating and i don't think we can predict with the crystal ball will happen

after one week. honestly. >> so far, the principles about that i'm available. they are already talking to the fbi were making cases to do so. again, what is it beyond talking to the principles. they will chase down classmates and put a timeframe together and determine whether these events have happened across the calendar. that takes time, effort and possible propagation that could lead to a desire to extend the investigation but politically it would be difficult to do so. jon: we all know clearly that line to the fbi can get you time in a federal prison. these people are going to be compelled to tell what they know and the. >> will question about it. if they refused to be interviewed, that type of thing, jon -. jon: there is the president appearing, as you might expect,

[cheering and applause] a vote to confirm judge kavanaugh is a vote to confirm one of the most accomplished, legal mines of our time and a jurist with the sterling record of public service. you know, for ten years, he is a young guy, but for ten years they were talking about him. i do not know them but heard about him a lot because they were all saying he should be on the united states supreme court. that's why i put him up. [cheering and applause] i will tell you. i will tell you. he has suffered -- the meanness and the anger -- in west virginia they did a poll, total support for judge kavanaugh 50%.
