williams. leland: bipartisanship reigns in washington. i'm leland vittert. president trump and republicans spending the weekend trying to rally support for brett kavanaugh while we await the findings from the fbi investigation that is ongoing this weekend as well. kevin cork north lawn of the white house, president got back there last night after talking about this in west virginia. hi, kevin. >> reporter: great to be with you. depending on how you frame this, this is actually a winner for both ends of the political spectrum. on the one hand, if you are on the right and you support the nomination of judge brett kavanaugh, you might feel righteous indig nation on the way he's been treated throughout the process. if you're on the left, you may feel like this nomination is an afront to all women and those who respect the rule of law. that's how both sides are framing it following the fallout from last week's explosive confirmation hearing in washington and the subsequent supplemental fbi background

check on judge kavanaugh. president trump was in the state of west virginia at a make america great rally and again he said this, i back my guy, there's no way i'm going to waiver on judge kavanaugh. he also said an additional look could end up helping him in the end. >> actually, this could be a blessing in disguise because having the fbi go out, do a thorough investigation, whether it's three days or seven days, i think it's going to be less than a week, but having them do a thorough investigation i actually think will be a blessing in disguise. it will be a good thing. >> reporter: on capitol hill obviously there are divergent viewpoints about not just the scope of the fbi supplemental background investigation but also whether or not this process ultimately should be delayed outright or go forward. listen to what lindsey graham had to say about it. >> senator flake, collins and

murkowski wanted a limited review. they wanted to talk -- the fbi to talk to the witnesses that dr. ford named. they want to talk to mr. ramirez -- mrs. ramirez. she refused to talk to the committee. they're going to ask mark judge did you ever see judge kavanaugh drug women or engage in gang rape. i think that will be the focus of it. >> these are serious allegations. we've been calling for an fbi investigation for what seems like months. these are not normal times. under normal times in a situation like this there would be an fbi report. >> reporter: here's the question, how long does this probe ultimately run? the white house is telling us based on what the senate laid out, the probe should be over by week's end. i'll believe that at the end of the week. back to you. leland: so much as changed so quickly on this one. kevin cork at the white house, thank you. eboni's got more. eboni: the white house said it's not micro managing the fbi

investigation into judge kavanaugh. doug mche'l mcelway has the lat. >> reporter: president trump dispaged an fbi report claiming the fbi was called only to investigate the allegations of dr. ford and deborah ramirez, not those represented by michael often netty. her name is julie swetnick. she claims judge kavanaugh engaged in sexual misconduct at parties when he was at georgetown prep and she was at college. >> they cannot say oh, hey, only interview the people in their neighborhood on one side of the street or only interview people from a certain period of their life. you let the men and women of the fbi, the professionals do their job. >> if there's some shocking new bit of -- not accusation, but evidence and proof, of course i'm open to evaluating that evidence. but i strongly suspect that every statement that was made to

the judiciary committee under penalty of jur perjury is the et statement that will be made to the fbi. >> reporter: the president indicated he believes the fbi investigation will affirm kavanaugh's high moral character. also the senate has said the fbi investigation be limited to current credible allegations against the nominee and must be completed no later than one week from today. and in a side that the judiciary committee is serious about false accusations, it has submitted a criminal referral to the fbi regarding false statements made to the committee by an individual who accused kavanaugh of assault on a boat in new port, rhode island harbor, an accusations which was later recanted. eboni. eboni: thank you so much, doug. leland? leland: we bring in california congressman john garmandi for his thoughts on this. dianne feinstein is at the center of the beginning of the

allegations from dr. ford. the president last night had some thoughts about that in his rally. take a listen. we'll get your thoughts. >> remember di dianne feinstein, did you leak? remember her answer? did you leak the document? uh, uh, what, no, uh, no, i didn't -- uh, well, wait one minute. no, no, we didn't leak them. leland: dianne feinstein at the center of the question of exactly how dr. ford's name came out publicly within days, if not hours before the vote was scheduled. she's your senator, congressman. are you okay with how this was handled? >> this entire thing has been a very, very difficult process from the very, very beginning. kavanaugh was controversial long before feinstein's letter ever came to light. as i understand it, dr. ford did not want to go public.

it took some time for her to actually release that feinstein -- the letter -- leland: the reason it went public is because somebody leaked her name. the question would be -- >> well, i don't know. i just don't know the answer to that. leland: let me ask you this. do you agree with lindsey graham who said part of the investigation should be looking at how dr. ford's name was leaked, how a woman who alleged asexual assault and wanted to remain private was thrust into the public spotlight, should that be investigated as well? >> that doesn't seem to be relevant going forward. leland: really? >> just hang on a second. the fbi's been given a very specific task, looking at the accusations that have been made. how those accusations came to pass, how they became part of the controversy is an issue that the senate can take up. what we're focused on now is the

fbi investigation. i'm not going to opine one way or another about the outcome of that but it's extremely important that it goes through, that it take place and as the president said last night, that it be a thorough investigation. leland: i guess -- >> that will inform us about what is the most important issue here, and that is kavanaugh's nomination, his job interview, if you will, to be on the supreme court. we'll see what happens. let the senate work out how information became available or not. there's been plenty of other controversy within the senate process and the judiciary committee. leland: i'm not going to get a yes or no in terms of whether you think the fbi as lindsey graham said should look into how dr. ford's name became public. you called it a job interview. >> it seems to me that's not relevant to the case at this moment going forward. leland: how in a time when democrats are talking all the time about metoo and all the time about the rights of women and women should be believed,

they should be listened to, respected. >> and they should. leland: how is it not relevant that a woman who said i want to remain a anonymous suddenly had her identity put in front of every person in america who watches television or reads a newspaper, how is that not relevant and it was a democratic senator who was the one that had the name? >> have you two different things here. let's just take them one at a time. one issue is the allegations that have been made by dr. ford and the fbi is going to be looking at that and all of the relevant matters to that. that's the critical path. that's what's really important ahead of us. now, the way in which the judiciary committee came to that information about dr. ford is another issue. it is an issue of importance, certainly to the senate, to the judiciary committee. there are many other issues -- leland: i guess i -- i'm not hearing any outrage on behalf of this alleged victim that her

anonymity was destroyed by at least conceiveabley someone who had access to that letter. the person that had access was dianne feinstein's office. >> that's a question of the senate judiciary committee's processors. the question before the american public and, frankly, before the senate now is the fbi investigation about the allegations that have been made by ford and by others. leland: if that's the issue and the fbi comes back, as most experts have said that they suspect they will, which is a report that says this is what she says, this is what he says, so far mark judge and others have said publicly conceiveabley what they're going to tell the fbi, leland kaiser saying i have no memory of this event multiple times, if the fbi comes back and says this is he said, she said, there's no corroborating evidence and there's four people

who say this didn't happen, would you then say okay, time to support judge kavanaugh to be on the supreme court? >> well, let's see what the details are in that report. it may very well be that it is inconclusive, in which case that issue will be relevant. there are many other issues with regard to kavanaugh's position on very, very important matters that are as you said at the top of the show, the new session for the supreme court is now underway and they're going to be some extremely important issues, for example having to do with corruption, that is corruption in the electoral process. those are extremely important issues and kavanaugh has a position on those. leland: fair to say, just because an fbi investigation clears him conceiveabley, that's not enough to support him. >> that's correct. leland: thank you, sir. fox news sunday right after our show, chris wallace has an exclusive interview with white

house press secretary sarah sanders, she addresses a lot of the issues we talked about with the congressman, 2:00 p.m. eastern. eboni: the supreme court starts a brand-new term tomorrow with eight justices on the bench, pending the outcome of brett kavanaugh's nomination. today they took natter the 66th annual red mass in washington, d.c. lauren blanchard is live with much more. >> reporter: red mass is an annual service that is held the sunday before the first monday in october which is typically the start of the supreme court's term. today, chief justice roberts and justices thomas and briar plus former justice kennedy, whose seat is now open, all attending the red mass this morning. the clergy wear red. they say the purpose is to bless those who are part of the judicial system and government officials. we saw jeff sessions, lawmakers, deans and professors from law schools around d.c.

the message centered around the idea of truth and truth in america, quote, today we thus call upon the spirit of truth to enlighten us more deeply in the truth and those self-evident truths upon which our nation has been formed and is based. and while four members of the supreme court were there, the man who nominated to join them, judge brett kavanaugh, was not. protesters were chanting we believe christine ford outside on the street and there were some seated in the church. thhomily called for renewal, enlightenment and healing, something that might be what everybody there needs a little bit of. eboni. eboni: thank you for that, lauren. we're going to bring in our supreme court panel, carrie servino and we have the director for the american civil liberties union. thank you for joining. for lack of a better word, an

intense week this week. i want to start with you, carrie. judge kavanaugh's approval rating, so-to-speak, has gone down since august among some expected groups, talking about suburban women, he's down 11 points, amongst independents he's down 12 points, amongst democrats he's down 5 points. his support is down across the board, including with republicans, down 4 points on this poll and then among men, he's down 5 points. so my question to you is why not at this point just nominate another conservative justice if indeed the goal is for president trump and i think it's a reasonable one by most people's standards to put someone in place on the bench to to replace justice kennedy that will move the court further to the right under conservative viewpoints, why does it have to be specifically brett kavanaugh. >> a couple things. i'm not sure when the poll was taken. looking at our polling, for example in west virginia, we saw that after the polling -- the day of the hearings, after the hearings that evening, we polled

and found in west virginia 58% of respondents said kavanaugh should be confirmed. that has increased since before the hearings. a lot of people after seeing his very passionate defense of his reputation in that hearing will have moved in that direction and women as well had nearly a 20 point spread saying we actually think kavanaugh should be confirmed. eboni: i think we know all polls can tell us something different. we learned last election cycle not to put too much in any of those polls. under the premise that some have kind of soured on judge kavanaugh, in your estimation, is there reason to consider putting another conservative forward? >> again, i also -- i want to say, i think there's a lot of people who are very concerned about this process. i see and we heard for example kellyanne conway reveal- eboni: we're going to get to

kelley ann in a second -- >> we get a lot of e-mails saying -- eboni: can i ask, does it have to be brett kavanaugh in the seat? >> he's been a person that's been nominated. to rescind the nomination because of unfounded, uncorroborated allegations at this point would be a huge travesty to -- eboni: is that a yes? >> i think yes, the president said he's supportive of kavanaugh. i would say we need to follow this process through and not withdraw his nomination simply because of unfounded allegations. that would be a horrible thing to the process. it would say simply that it's guilty until proven innocent instead of innocent until proven guilty. >> sadly, you can hear in the conversation here there's doubt about the integrity of this individual and sitting on the supreme court. the option that was always available to brett kavanaugh was to say listen, we were all young at one point in time. we all do things we regret. i show remorse and contrition

for things i did and i'm sorry. he didn't take that path. he constructed an alternate reality in which he's a choir boy and did nothing wrong. the present day-care tear is at -- the present day character is at issue. some of us have doubt about it. i agree that there's other options available to donald trump and i'm sure president trump at the end of the day wants a conservative jurist on the court. eboni: i'm not going to take a position here. we all listened to the testimony. i think people found compellingness on both sides to be fair to both people that testified but not a lot of probative value. again i'll ask you, absent probative issues, does it have to be brett kavanaugh specifically. >> yes, if the president nominated anyone else, i say we would have seen a line of attack against anyone. >> sexual assault? >> i think so.

>> i don't think thomas hardiman engaged in sexual assault. >> we've seen a campaign mounted to slurs against judge kavanaugh that i think there would have beebeen drudging up stuff on anyone. no one said she was there but we also have dozens of people who knew him at the time including some she put at the party who say this sounds nothing at all like the kavanaugh we knew. so at the end of the day, is it guilty until proven innocent or do we have to say these are old allegations -- eboni: i don' i don't think as saying that. >> the standard of proof is not a criminal trial. you're talking about the supreme court. you're saying should this man get a promotion to the highest court in the land and sit in judgment of everyone. i think on that question, you choose people who you have very little doubt about their integrity and character. when this comes up in a way that i don't believe its unfounded, i think it is corroborated by

people who know and stand what happened then. we'll find out more from the fbi. >> there was no one at the time who could corroborate it. eboni: to your points, this is why the fbi investigation could possibly be the best thing for the process. >> donald trump is right. i don't say that often. he should make sure it's a fair and independent investigation. eboni: thank you both. leland: the u.s. navy continuing to keep up pressure on the chinese who claim much of the south cha china sea for themselves. defense officials say the guided missile destroyer u.s.s. decatur carried out a freedom of navigation operation in an area where beijing continues to build up military fortifications despite telling the world they're not doing it. american war ships have been shadowed during similar operations in the past. not immediately clear how the high cheese responded to this

>> reporter: about 50 people have been rescued from the rub bell of the hotel. indonesia's disaster management agency is warning the number could rise as rescuers reach areas of the coast that have been inaccessible because of damage. thousands ma may have perished. the tsunami waves reached 20 feet high. a 7.5 magnitude earthquake rocked the area on friday, triggers aftershocks and waves that put the coast under water. the disaster affected 2.4 million people. rescue earths have been hampered by damaged roads and lack of heavy equipment, lack of fuel supply. thvictims have been found aliven collapsed buildings. many of the dead are buried under the collapsed rubble. hospitals are overwhelmed.

they're working with without electricity. many people are being treated outside. the government is conducting a mass burial for health reasons. >> the deceased will be buried privately as soon as possible. later today, a mass burial will be conducted for health reasons. all the deceased victims will be buried after being identified. >> reporter: a spokesperson for the country's disaster management agency says there was no early warning, no emergency siren and limited shelter and space prevented evacuations. many people were on the beach when the tsunami hit. early estimates predict that 17,000 people are now left homeless, making this the most devastating earthquake for that country since 2004. back to you. leland: jackie, thanks. eboni: dozens of -- dozens of people injured and millions are urged to evacuate as a typhoon soaks japan. the storm is packing heavy winds and rains with officials urging residents in several areas to

watch out for landslides and flooding. travel has been affected with hundreds of flights and trains canceled. this is the eighth typhoon to affect japan since july. meteorologist adam is keeping an eye on the typhoon at the fox extreme weather center. >> this is a big one. it's certainly a concern. really some of the heaviest, strongest winds hit the southern islands early this morning. you're looking at it running up the island, from the south, moving to the north and east, going to continue to make that move, bringing heavy rain with it, winds up to 90 miles an hour. this is something that's going to be a problem throughout the rest of the day, into the early morning hours, through tomorrow. this is going to be a large system. it's not the only system in the pacific. we have one of our own in the states. this hurricane rosa running to the south, off the mention cay baja pens -- mexican b a aja peninsula, lifting to the north.

it will impact places across the desert southwest here's the projected model, from a category 1, you notice it falls, so it becomes a rain maker, not a big hurricane as it works its way into the united states. it will bring moisture to areas where you typically don't see this much rain. we'll be talking about at least widespread, a couple of inches of rain across southeastern california, stretching into portions of arizona and isolated areas, this won't be widespread buisolated areas get up to 3, 4g within the next couple days. it will be a soggy start to the week in that portion of the country. otherwise, temperatures across the country in some places feeling a little bit like summer as you look at spots in the 80s. there is cooler air, a little bit of a taste of fall across the upper portions of the country. spots there hovering in the 50s for daytime highs, 67 degrees in chicago.

we are beginning to see the change of seasons here across the country, a cooling off as we wrap up september. back to you. eboni: fall is certainly here, thank you so much, adam. leland: tesla's ceo, elon musk, is out as chairman of the electric car company's board and he must fork over millions in fines to the securities and exchange commission. with the settlement, the s.e.c. will keep musk in charge of the company. he must step down as board chairman for three years. musk and the p company will pay $20 million each in fines, stemming from musk's tweet saying that he was going to take tesla private back in august. missing from all of this is justice for the shareholders who lost hundreds of millions of dollars because of that tweet. eboni: that was a big oops moment. you've got to wonder what he thought was going to come of misleading his shareholders like that. leland: you have to wonder what in the world elon musk is thinking a lot of times. eboni: fair point.

trump likes going to west virginia. it's a party for him. tennessee will be a big tell on this. i don't think president trump has coat tails -- i think president trump has coat tails in certain states. that's why you'll see him campaigning in those states. leland: you watched the president's crowds in west virginia, a state he won by multiple double digits. yet, you've got a democratic senator in joe mansion who really does still have a chance to hang on there. how do democrats capitalize on that and try to turn out trump voters turned democratic senate supporters? >> i think all the democrats really have to do is push for turnout. if you look at the history of west virginia, joe mansion is replacing robert byrd. there's a history of supporting the democratic party. so i think the democrats have they focus on turnout, they really should win west virginia. i would be willing to way jeer t a lot of people in that event cheering for president trump would still be willing to vote

for joe mansion because that's the history of west virginia. there's not really any coat tails there for the presidential republican candidate. >> we haven't had the kavanaugh vote out yet. up to 60% of voter 60% women ina support kavanaugh. leland: i saw some of the same polling. the subtabs talked about how not many people were going to change their mind on mansion based on how he voted on kavanaugh. >> well, look, joe mansion is in sync with west virginia. there is no doubt about it. leland, donald trump is more in sync with west virginia. i say this tightens. i don't know that trump has enough to push morrisey over the top. mansion is an outstanding candidate for west virginia. but mansion has played it right. why is joe mansion going to play hard ball with other democrats and potentially vote for kavanaugh if he's not concerned of a late rush here? leland: it's a good point.

he was in the room with flake, collins and murkowski, talking about this on thursday, trying -- conceivably trying to find a way to vote yes. he wouldn't have been in the room if he was a solid no. this brings up a solid question as to how kavanaugh plays going into the midterms. sarah sanders talking about what republicans want to focus on when it comes to kavanaugh and the fbi, take a listen. >> dianne feinstein and her staff knew about these accusations. they could have done all of this in a private way to protect dr. ford. instead, for the people that claim to champion women, democrats have exploited dr. ford, they've exploited the process and i think it's been totally disgrace f i don't think anyone has hit the nail on the head better than lindsey graham did in thursday's hearing. leland: is this really the job to sort of diversion tactic that

will work for republicans, does it race nat resonate with the b? >> there's danger for republicans, in that they see republicans giving too much ground to democrats in this process and if they can't get kavanaugh confirmed, i don't think there's going to be unbelievable righteous anger. i think they're mad at republicans. if they get him confirmed, i think you're going to see a certain amount of push that republicans can run on and say we are doing things. the ball is in the court of republicans on this one. leland: all right, garland, you get the final 20 seconds. >> i think the democrat basically as the party make out well on this. the main thing is -- leland: real quickly, strictly looking at this politically for the midterm elections, is it better for democrats for kavanaugh to get confirmed at the end of next week or is it better for it still to be an open supreme court seat going into the midterms. >> i think either way they're okay as long as they're perceived as fighting for it, as

deadline. the deadline has come and gone and come and gone and the white house keeps setting additional ones. what do you think of the latest one? >> you're right,it's self imposed. seems like we've had 10 nafta dead lines. the deadline is really self imposed. they're trying to get it done before the new mexican president goes into office, december 1s december 1st. they really want canada involved. so that's why you're seeing them make this last minute push. eboni: when the president says as he did last night in west virginia, your neighbor, that canada must be fair or we'll go without them essentially is what the president has been saying. do you think that is a negotiation tactic? >> i do. president trump often says things like that. that's part of his deal making. i think the administration is saying -- his aids tha aides the doing this, they do want canada involved. they know congress wants canada involved. democrats and republicans both

have said it's not a deal unless canada is involved. they might not approve it. congress has the final say. they might not approve it. the administration knows that. eboni: as you say, the mexican president that i currently agre, they have an existing deal with mexico reached back in august but as thi drags on, do you thik this gives canada gives more leverage in terms of coming to the deal? >> i read a little bit from canadian media, says that canada feels like they have the leverage. and that's because they know that the mexican president wants canada to be involved, the new president, they know congress wants canada to be involved and they feel like they're not trying to waste time and get the clock going but they know that all these other people want canada to be involved so they feel like they have some leverage. clearly, the administration does too or they wouldn't be trying once again to include canada. eboni: he did mention it last night in the midst of the kavanaugh news, it is important to note that the president did bring up the nafta deal last night. when its comes to what's holding

up the process, the negotiations, the talk of the dairy tariffs and also the auto tariffs. can you talk about that aspect? >> so the administration has this tendency, they talk about the president's threatened auto tariffs and he's threatened different tariffs. eboni: canada is a big aut aimporter. >> they're our neighbors. it would devastate canada if there were auto tariffs. let's remember, it would also hurt american auto dealers and people in the industry. eboni: trades and exchange, normally what hurts one side hurts the other. >> i'm not sure the president really wants to do that. he often threatens. this is one of his tactics. he said both things. he said they don't need to be involved but he also says he wants them involved. eboni: the politics of it all as we go into midterms, the actual effects of the trade we'll say potential war that's

going on here or holdout are one thing but the politics are another. most americans feel that the economy is strong and peoples' pocketbooks look better than they did a year or two years ago. do you think the negotiations work in the president's favor going into the midterms? >> there is some of that. i was talking with people outside of washington. when you get outside of washington they're talking about the economy and the normal kitchen table issues and not necessarily all the things going on. they are also talking about the supreme court. so that has been a factor. i think that works in his factor but some still say that this trade war with other countries isn't working very well. eboni: anita, thank you so much. leland? leland: have you ever seen this before, man's best friend taking to the ice, evidently he's going to learn to twirl or something. we'll show you that. and terrifying moments for one teen after being attacked by a shark. all right. we'll tell you where authorities are telling swimmers to watch

surfing spot in san diego. we have the latest l.a. >> reporter: the 13-year-old boy was bitten by a shark. he is fighting for his life but alive in part thanks to good samaritans who were also diving. they were nearby and after realizing what happened, they rushed by for his rescue. >> we were in the water for over 3068 minute3 of -- 30 minutes ad screaming. i thought it was someone who caught big bugs and was enthusiastic and i kept going. then i realized he was yelling, i got bit, help, help, help. >> luckily we got him out of the water. once we threw him up on the kayak and started heading in, that's when i looked back and a shark was behind the kayak. he didn't want to give up yet. >> reporter: this all happened about 25 miles north of san diego. authorities saying the victim

was diving with others from his church youth group. at some point a shark estimated at 11 feet long you attacked him. they're working to identify what type of shark was involved but seeing a shark in the area really isn't that rare. it's home to many species of sharks that are not threatening. >> first time in my career of 30 years that i've seen an attack or anything with a shark that has come in and made contact with one of our swimmers or divers or surfers here. this is the first in my career. >> reporter: authorities haven't released the name of the victim, only saying that he is 13 years old. they tell us he had surgery and is in critical condition. the coastline and water at the beach where this attack happened right now is shut down. lifeguards and police are worried that the shark involved could still be out there, swimming around. they're hoping, though, to have that part of the beach reopened tomorrow. eboni. eboni: prayers for that young man, absolutely. thank you, jeff. leland? leland: we've got dogs coming up.
