could be a blessing in disguise. amid reports of limits on the scope of that check the white house saying it is up to the senate to set the terms. here is white house press secretary commissar sanders on fox news sunday. >> this can't become a fishing expedition like the democrats would like to see it be. we cannot allow the people that have acted in bad faith to determine and allow us to become a total fishing expedition by the fbi. the senate is going to layout, senate republicans will layout and dictate the terms. mike: white house correspondent joining us with development! how confident is the white house of the fbi will wrap up the investigation by the end of the week? reporter: let me say at the way sarah sanders said, they are convinced that this will not turn into a so-called fishing expedition. that said, i think the president is already pushing back at the notion that he believes democrats will be throwing out there this weekend that is no matter what happens

in the report there was simply not be satisfied. let me take you to twitter. the latest tweet, he's been fairly active on social media today. he said while, just our dear the democrats only thinking obstruct and delay are starting to put out the word that the time and scope of fbi looking to judge kavanaugh and witnesses, is not enough. hello! for them, it will never be enough. stay tuned and watch! that said, there is a standard operating procedure and there is also a specific protocol to be adhered to during the investigation. but this, i think they can barely see it's as much a political story as it is a legal one to be sure with the democrats already questioning again, the depth of the investigation given the brevity of the time allotted. >> these are serious allegations and we have been calling for an fbi investigation for what seems like months. these are not normal times. reporter: of course the investigation is a wrap up by

weekend. and a lot of us here will believe that when we see it. mike: also today we learned that a senior member of the white house team has suffered through her own me too moment. we can tell? crisis was pretty powerful to listen to. we're talking about senior counsel into the counselor, kelly on conway. remarking on the interesting and powerful testimony that we saw during the senate hearing at the end of last week. involving doctor ford. then kelly herself shared a personal story that came straight from the heart. listen here. >> is not the me too movement, i feel very empathetic, frankly, for victims of sexual assault and sexual harassment. and rape. i'm a victim of sexual assault. i do not expect judge kavanaugh or jeff flake or anybody, to be held responsible for that.

thereof, it is entirely conceivable the fbi can conclude the investigation in a week.but if you want a more extensive operation to find out if there's carpeting evidence either way so the stent has a better ability to decide to tell the truth, then you could imagine that investigation taking longer than a week. i would imagine that you know, a couple of weeks ought to be able to complete this. given the breadth of resources that the fbi has to throw at this and the importance of it. mike: meanwhile lindsey graham has of the questions you want answered? let's play the clip and then we will discuss. >> i am going to find out who in the feinstein staff recommended katz to be the lawyer for doctor ford. i will try to find out who betrayed doctor ford trust, to remain anonymous. there are three people and

groups at the p the person who sent this anonymous destroyed her trust, betrayed her trust to be anonymous they had a political agenda. i will get to the bottom of it. >> senator graham must know who is the leaker and what about recommending a law firm? your thoughts. >> well, after this whole confirmation issue is resolved one way or another, perhaps it would be worthwhile to get the answers to those questions for political purposes to decide whether the voters need to punish any of the senate democrats involved in the voting booth. but for the question of deciding the truth or falsity of the people that have testified before the senate in the kavanaugh confirmation i'm not sure these questions are that central. i don't think they are strictly legal but it may be a bit of a distraction in the short term. mike: let's listen to hawaii

democrat maisie hirono and discussed. >> he brings us to the crux of whether or not this fbi investigation is going to be thorough. i would think that that is what senator flake had in mind. every senate vote matters and there is time to get to the bottom of it. even if it is seven days, that is bad enough. for them to limit the fbi as to the scope and who they will question, that really -- i want to use the word farce but it is not the kind of investigation that all of us are expecting. mike: is a surprise to the democrats like hirono want the fbi to have no limit in terms of time or scope? >> with respect to scope, certainly, it is not a surprise. typically, the white house would not limit the scope of an investigation. they would give the fbi

discretion to you know, follow-up whatever leads they saw fit, interviewed whatever witnesses they saw fit, seek a corporation that they saw fit. in terms of the timing, i think it is debatable. i can certainly understand that the democrats think we should take as much time as possible. and that the republicans are going to be running out the clock and being -- making sure we don't get the information we need and rush to a vote. on the other hand i can see the republicans saying that the democrats no matter what, will say we need more time and it is never enough. i think some sort of balance has to be struck and probably the best party to strike that balance would be the fbi itself, free from any interference from either side. >> sources i've spoken with close to the confirmation process and they want to be about current and credible allegations. not a fishing expedition. does that make sense in your view?>> this except that the devil is in the details be what they mean by current and credible allegations, there are reports saying that the allegations of swetnick are off the table. that because he made unilateral

determination that they are not credible? i'm not sure p would allegations that judge kavanaugh perjured himself regarding secondary details about how heavy drinker he was and other matters not directly related to the sexual assault allegations. are they included in the current allegations? i think there's a little room for argument there and i think that is probably what's going on here in terms of the debate between the democrats and republicans. mike: take listen to two key senate republicans appearing this evening on 60 minutes. and we will talk about it. >> could either of you change your minds depending on what the fbi report comes up with? >> of course! i mean, of course. >> my mind is made up about brett kavanaugh. it would take a dynamite accusation because here's the deal, doctor ford, i don't know what happened but i know this, brett kavanaugh denied it vigorously. in her but she named could not

verify it. 36 years old, i do not see anything changing. mike: what are your expectations in terms of what the fbi will tell us on or around next friday? >> that is an excellent question, mike. i really don't even know. i mean certainly, we will hear this much of the same, people make the allegations will stick to their story and people that deny them will stick with their story. i think the real question here is will there be any corroborating evidence in one direction or another that the fbi can uncover that can shed light on this? that's what i'm going to be looking to see. as to the comments made by the senators, in your tape, thing is very revealing. those that think the truth or falsity of judge kavanaugh 's testimony regarding at least a sexual assault allegations or other things, they're going to say yes, my mind is open and i will be waiting to hear the results of the fbi investigation.

which is probably a regional tactic. >> your expectation about how relevant centers will react once they have the information should key moderates icons, flake, murkowski and democratic joe manchin iii from west virginia, heidi heitkamp, be more likely to vote yes? >> i think all of those votes are in play as you all have been reporting and a lot will depend on the details of the fbi investigation. unless the fbi uncovers either new allegations like the dynamite charge we heard referred to in a moment ago, or some fairly critical corroborating evidence for some of the accusers. unless the fbi finds out, then i suspect that the confirmation will go forward. i do not claim any expertise as a soothsayer. mike: i will put you on the spot. you expect judge kavanaugh will

anticipated meeting between president trump and deputy attorney general rod rosenstein. white house press secretary sarah sanders saying the meeting could be delayed again after the two men were supposed to speak this past week. trey gowdy saying that there are a lot of questions that the doj number two must address. included from fbi director, andrew mccabe memos and reports that rosenstein proposed secretly recording the president. >> i need to see the memos. i need to ask rod what he said and i will get to what he meant. those may or may not be the same thing. i appreciate the president talking to him this week and we will talk to him. i want to know what he said and i want to know what he meant. mike: we are live in washington

with more. what has the president said about the deputy attorney general and what are democrats saying about all of this? >> well, there was speculate the president was going to fire rod rosenstein last week. but the united nations, the president said it was his preference not to. democrats are standing by the deputy attorney general, who has denied a new york times article that said he considered wearing a wire to record the president and that he brought up the topic of the 25th amendment with cabinet members. democrats say rosenstein removal now would tarnish the mueller investigation into russian collusion. >> rosenstein must stay there to defend the integrity of the investigation until it is finished, it is very important for the integrity of american democracy. >> there has been speculation that fired fbi deputy director, andrew mccabe, who is now the subject of a grand jury probe, may have been the source of the new york times story. two house committees have

averted the deputy attorney general to speak with them. something the chairman of the house oversight committee, trey gowdy, talked about on "sunday morning futures" earlier. >> rod deserves to be heard out. and i appreciate the president talking to him this weekend we are going to talk to him. i want to know what he said, then i want to know what he meant, i want to know whether anyone else was present for the meetings. if your case hinges on the credibility of andrew mccabe, good luck. >> mccabe's memos have now been subpoenaed by two committees with a deadline for the justice department of later this week. mike? >> the present and rosenstein were expected to meet last thursday when all eyes were on the kavanaugh hearing. when we did not meet. any word on when the meeting could take place? >> yeah, the white house has said because of the supreme court nomination hearings last week, the meeting was postponed and will continue to be postponed at the fbi has opened an investigation into judge brett kavanaugh. white house press secretary single "fox news sunday" that lately, the new york times article will not be the only

topic that the two men discussed. but that will have to wait. >> a date for that has not been set. it could be this week. i could see it pushing back another week given all of the other things that are going on. with the supreme court. >> likely, the meeting will be put off until kavanaugh is investigation is over and there is the possibility we could see rosenstein job stay right where it is through the midterms. mike? mike: lauren blanchard, thank you. molly: for more this is bringing in the senior writer at the weekly standard, eric, thank you for being here today to weigh in on this. i'm sure you can hear lauren there just reported, we don't exactly when the meeting will be if it will be this week or next week. but does the president essentially have a right to some of the answers he may be seeking and want to know if someone were wanting to wear wire or secretly record him or if there's any plot to somehow remove him from office.

do you think he deserves answers to all of those questions? >> absolutely. but i think he is wise to wait on it. you know, it is a measure of how much the kavanaugh confirmation firestorm has consumed all of the political oxygen in washington. that here we had the number two person at the department of justice that is alleged in a new york times article to have been talking about wearing a wire on the president. to be invoking the 25th amendment, which removes from incapacity, a president.yet, the story that was a bombshell when it came out, has kind of all but disappeared from sight as all things kavanaugh have taken over. >> it has been remarkable to see how quickly the news cycle has been changing in general. you know, the democrats and republicans are pretty far apart when it comes to rosenstein but here is a tweet this is from maxine water, democrat in california. she says rosenstein, don't quit, retire or resign. let donald trump fire you. if he does he will face the wrath of the american people.

democrats and republicans. now that is a lot to unpack and that one tweet. but when it comes to democrats and republicans, do you think they are deeply invested in whether rod rosenstein keeps his job? is there a difference between the average democrat and average republican might be thinking on the issue? >> of course, rod rosenstein his job cannot be removed from the question of robert mueller 's special counsel investigation which was begun by road rosenstein at about the same time he was talking about wearing the wire and invoking the 25th amendment as the new york times reported. if that is correct. i think this is something we republicans and democrats may have come a little bit closer on this which is your hearing from people like trey gowdy, that he wants to hear from rod rosenstein, he is not coming out and calling for rod rosenstein to be fired. i think there is a recognition that if he fires at this point, rod rosenstein, whatever his replacement is chosen, has to be confirmed at the senate judiciary committee. i do not think that the

president of the president's allies want to go back through another confirmation of the senate judiciary committee anytime soon. so it is a real disincentive there. >> the plate is rather full as you might say. democrats have also argued that rosenstein is essentially, you know, integrity when it comes to the mueller investigation. and that he is somehow, the preservation for that. the thing he has that kind of importance? >> you know, he certainly is an important figure in everything that's been going on in washington. but what's really interesting about for example, the number of times reporting on road rosenstein, was just how much rosenstein was kind of blowing with the wind, just how much he was driven by public opinion and kind of a weak opinion washington after james comey, the fbi director, was fired. in part because of a memo

written by rod rosenstein, arguing it would be a good thing to fire james comey. the backlash on that, rod rosenstein was caught by surprise. and his reaction was one that really suggested that he values elite opinion in washington tremendously. and may make his decisions based on what makes him look good. >> the president said last week, my preference would be to keep him, speaking of rosenstein. and let him finish up, that is his preference right now. how much weight does this conversation hold? the expected conversation, potentially happening this week and potentially at some point in the future? >> i think before things got riled with the kavanaugh hearings, that might have carried a lot of weight. i think at this point, the president is going to have rod rosenstein and he will have to find a reason not to fire him. he will find a reason not to suspend him and i think that is

800 after two natural disasters strike an island in indonesia. rescue crews working feverishly to locate survivors from friday's magnitude 7.5 earthquake and subsequent tsunami. they feared the death toll could reach into the thousands. we are going to now with more on the aftermath. jackie? molly: the vice president of indonesia says they expect to find more victims. just today, 50 people were rescued from the rubble of a hotel. rescue efforts have been hampered by block and destroyed roadways, lack of equipment and the air force bringing supplies for survivors. 7.5 magnitude earthquake rocked the island on friday. triggering aftershocks and also 20 foot waves that put the coast underwater. the disaster affecting 2.4 million people. victims have been found alive in collapsed buildings and many dead are still buried under the

rubble. they say survivors left without food, clean water or shelter, hospitals are overwhelmed and working with electricity. many people are being treated outside. after the dead identify the government is conducting a mass burial citing health concerns. still, the president to urge people to stay where they are. >> there are several villages due to lack of heavy equipment that we cannot evacuate just yet. hopefully, the equipment will arrive tonight. will start evacuating victims that are still in the secluded locations. >> a spokesperson for the countries disaster management agency says there was no early warning, no emergency sirens and limited shelter and space preventing evacuations. many people were actually on the beach when the tsunami hit. now many cannot get off the island. the airport is closed and the nearest open airport is more than 10 hours away by heavily damaged roads. molly: thank you.

mike: meanwhile, the battle over the supreme court nominee, judge brett kavanaugh raising new questions over the future of the high court. democrats arguing kavanaugh is so partisan -- >> considering that he has totally shown himself to be the politically -- a political and partisan operative that he has been which as i said, is one of the reasons that his earlier confirmation was held up for three years. he revealed himself as partisan and i would think if i were a democrat, for him i would ask him to recuse himself. mike: meanwhile the son of antonin scalia telling fox news how his father might have reacted to this process. >> on a general level, it would be terribly surprised about the intensity surrounding the supreme court nomination. because so much of it comes down to roe versus wade. my father often said that with

roe versus wade in particular, but other cases as well, the court was really trying to come in and settle a cultural issue that should have been resolved in elections. mike: germany we have a constitutional attorney and educator. good to have you. >> thank you so much, i am glad to be here. mike: two of the moderate senators that teamed up for this fbi program 60 minutes i talked about how judge kavanaugh handled the testimony this week. check this out and i will have you weigh in. >> the statement at the beginning i thought was pretty raw. but in keeping with someone who has been unjustly accused. >> there were some lines that he delivered that were sharper, more partisan, more, this is the clintons, paying me back. this is democratic smear campaign. that i was surprised, struck to hear from a judicial nominee.

mike: judge kavanaugh was clearly fighting for his name and his integrity. your thoughts on how he handled himself the other day? >> you know, i think that what we are seeing here is the direct result of the fact that our nomination, our confirmation hearings have deviated from being constitutional confirmations to being political confirmations. we have senators asking politically driven questions rather than constitutional qualifications. and so now, we get to this point where you can have partisan politics directing questions at this man. that are completely and totally outrageous. and then expect him to respond in defense of his own character. i think that it is absolutely ridiculous. i think that is where we have come in society. the idea that kavanaugh should have to recuse himself before any democrat that comes before the supreme court is just ridiculous.

i mean seriously, does that mean that ginsberg needs to recuse herself when it comes to any gay marriage case or homosexual case given her direct and public opinions that she has based on the subject or that kagan must recuse herself from all healthcare issues? these are the kind of things that have driven our supreme court to becoming political rather than just the constitutional body that it was created to be. mike: you made reference to jerrold nadler who'd already suggested there will be investigations if judge kavanaugh is confirmed. and democrats win back the house. they are floating the idea of recusal spirit is at -- >> the whole hearing was about an assumption of guilt. the idea that we have senators telling kavanaugh that he needed to call for an fbi investigation, is absolutely ridiculous.

in america, we are innocent until proven guilty. kavanaugh doesn't need to call for his own investigation. those who are making the accusations, they are the ones with something to prove. not kavanaugh. and the idea that there should be investigations on kavanaugh, he is actually confirmed is also ridiculous. the entire constitution is set up so if a justice, and activist justice if they are partisan, if the act immoral, if the act contrary to the constitution, they are supposed to be removed. their term is not lifetime. there is nothing in the constitution that gives the justice lifetime appointment. their appointment is based on as the constitution says, good behavior. and to assume that a justice is going to act in bad behavior, is not a constitutional measure. it is a public opinion measure, which our justices were supposed to be shielded from in

the first place. mike: there is a question whether the judge kavanaugh treatment becomes a standard operating procedure for supreme court nominees going forward. take a listen to senator lindsey graham from friday and i will give you a chance to respond.>> if i am chairman next year, if we keep the majority as senator grassley moves over and i hope he does because i think he's done a great job. and we will remember this. there is the process before kavanaugh. in the process after kavanaugh. mike: your thoughts? >> you know, this is really what happens when we deviate from the constitutional standards. we get this kind of emotional and political chaos. our government is not supposed to be driven by vindictive tit-for-tat. our government is supposed to be driven by standard. we deviated from the standard a long time ago in confirmation

>> we are actively having guards coming onto the beach and into the want to let people know we had a nonfatal shark attack and advising them to stay out of the water. molly: jeff paul joins us from our los angeles bureau. what is the latest on this young man's condition? >> molly, we are learning the boy that was attacked had surgery and right now is in critical condition. authorities of the victim was diving with others from his church youth group when at some point, a shark estimated to be around 11 feet long, attacked impaired first responder state of the victim is fighting for his life but alive. thanks to some good samaritans there were also diving for lobsters. those men rushed over to rescue the boy, all while the shark was still swimming dangerously close to them. >> so we are not in the water for over 30 minutes. and i hear screaming. i thought it was someone who had caught some big bugs and was enthusiastic. good for you! and then it kept going. and then i realized he was

yelling, i got bit, help! help! >> luckily got him out of the water because once he was on the kayak and started heading in, that is when i looked back and the shark was behind the kayak. he didn't want to give up yet. >> does know were able to get the boy out of the water and to the shore. a helicopter then transported the boy to the hospital. the coastline and one at the beach where the attack happened right now, it is shut down pure lifeguards and police are worried the shock that attacked could still be out there swimming around. also working to identify what kind of shark was of all. they say shark in the area is not that rare and there are many species of sharks that are not threatening. >> this is the first time in my career of 30 years that i have seen an attack or anything with a shark that has come in and made contact with one of our swimmers or divers or surfers here. this is a first.
