ed: at the top of the so we promised to give you a look at a new harris poll conducted this week on where the public stands on the brett cavanagh nomination. the director of the paul posted his analysis@thehill.com and showed it to fox first, after the testimony the poll found today only 37% say confirm him. 44% say reject him, 23% undecided. the news got better for brett kavanaugh when respondents were told there was no evidence of sexual assault. 60% said if the fbi finds no corroboration the assault allegations, they would favor his confirmation. a majority of the public expects the fbi will come up with little that is new, meaning 63% say they believe brett cavanagh will be confirmed, 37% say they want their senators to vote in favor of confirmation. interesting because we have one of those senators now, bill

chad herbert, senior -- talk a little bit about the process. let's stay out of the weeds and get into politics. there are a couple tracks here. mitch mcconnell is trying to get this going but then there's a reality of the fbi investigation. >> reporter: the realities it might take up to a week to get this reporting which means they don't start to run the clocks in the senate until next friday or saturday. it takes four days to do this. mitch mcconnell would move to end debate on day one, day 2 would be the meeting day when they wait for the motion, day 3 you moved to vote to break the filibuster these 51 votes, and once you voted to break a filibuster, opponent of the nomination are given 30 hours. on day four day five you have a confirmation vote. mitch mcconnell can't do this until next wednesday at the earliest. that might drift into the weekend.

ed: they have a friday deadline. what do you expect in that 30 hours of debate or not? probably not start until next weekend, potentially with a final vote on brett kavanaugh assuming they don't find anything new early the following week or can it be done next weekend? >> reporter: it depends when they start the clock and democratic and republican senators think mitch mcconnell is jumping the gun they will say this up our agreement. mitch mcconnell needs those phones. he didn't have jeff wake until they broke his agreement, they are at 49 yeahs but you could go as high as 53 if they get susan collins on board, lisa murkowski, don't have the votes, the math is paramount. ed: democrats might come aboard, claire mccaskill in a tough senate battle in missouri before dramatic testimony on both sides, she said i'm going to vote no. now a polls suggest she is no in neck with josh all, people wondering whether the brett cavanagh nomination will have an

impact, joe donnelly late on friday doesn't interview with the local paper in indiana, he had already said i'm voting no on brett kavanaugh but let's see what happens with the fbi, maybe opening the door to yes. >> and heidi heitkamp of north dakota, keep in mind, look at the 3 democratic senators in swing states voted for neil gorsuch, manchin, donnelly and heitkamp. i would start with those. chris: a lot of people asking about this video sheila jackson lee from texas at this hearing, doctor ford testified she gives an envelope to one of the lawyers, a lot of conspiracy theories on the internet, we want to separate fact from fiction, you did some digging. >> i have seen those envelopes, they were envelopes written in longhand, we support you, we believe you, not seeing what they said inside but sheila jackson lee and other house

clearances, confidential, they are supposed to be private so to suggest we are going to put out something that is supposed to be very confidential, the way senator feinstein has handled this entire process you just alluded to has undermined severely the confidentiality that is in struggle. chris: we were talking, washington post posted the story, we can't verify it but on the record a yale classmate not making sexual allegations that saying he saw violent, belligerent drunk in brett kavanaugh. this is unverified, uncorroborated. it has to be frustrating for you and brett kavanaugh. didn't the agreement friday open the door to a bunch of new allegations? >> we were clear over the weekend the white house is not going to micromanage this investigation and it is not a fishing expedition.

the investigation is limited to as dictated by the senate, senator flake, collins, murkowski, these senators asked for this investigation in the white house is accommodating them. it is limited to current credible allegations. ed: how do you define that? >> it is not about relitigating brett kavanaugh's behavior in high school and college the current credible allegations as dictated by the senate, they set the parameters. ed: i got an email from of you are saying why we going through brett kavanaugh's alleged drinking escapades but nothing about doctor ford? does the white house believe her yearbook in high school, her social media was scrubbed, all these things on the internet, what does the white house believe about what is fair game with doctor ford? >> we will leave the investigation to the expert and trust the fbi to do their job.

>> brett cavanagh is attacked every day with these allegations and doctor ford, no one wants to attack the victim the questions are not being raised about what happened to her. >> we are leaving this to the fbi to do their job, accommodating the senate and talk about what we do now. the allegations as alleged by doctor ford completely uncorroborated. the people she describes have no recollection of such a party and her lifelong best friend since she doesn't know brett kavanaugh. ed: doesn't know how she got home. when does this end? do you expect to vote next weekend or the following week? what is the white house gameplaying? >> we are accommodating the senate, accommodating what senators flake, collins and rakowski asked for in the parameters they set, this would be done within a week. ed: friday it should be done and you hope there is a final four vote after that.

coaching young girls. they clarified it, their family has been through this not quite like this. what goes through your mind when you see that? >> nothing close to this. my dad was confirmed 98-0 but that was stressful. can't imagine what his family is going through. that particular story was tasteless i thought because last week he was a gang rapist and now the insinuation is he is a pedophile. it is ridiculous. it is just gross. it is also assuming all the allegations are true. somewhere in the article it said when you're credibly accused of sexual assault, that is debatable. has he been credibly accused? earlier guests talked about how this has been corroborated.

a former fbi assistant director joins us now. let's start with what joe biden said. his words are being twisted. we played a long clip. he is making it clear at the end of the day the fbi will get he said she said. was he right then? was it possible the fbi is going to get a corroboration for sexual assault allegations. >> the fbi does not render opinions or conclusions, something reports facts and to get straight what is going on. these are called special inquiries. they are not investigations in the traditional sense of the word. they are called special inquiries or spins to draw the distinction. they are interviews and background checks, wiretaps, grand jury, no subpoena, no compelled testimony, not full on

investigations. ed: when the senate said this is about current credible allegations, publishing a story on uncorroborated, not current last friday. and he specifically says there is drunken violent behavior in college by brett kavanaugh allegedly but he wants to talk to the fbi about it. will that be part of this? >> it will be part of this and that is why this supplemental spin is necessary so we don't have these spurious reports from all directions, we get it from fbi interviews, documented interview summaries, not some washington post reporter or new york times reporter or any reporter at all. these are straight on factual interviews looking for corroboration or anything that contradicts what they are saying.

ed: there is irony here all around, if donald trump is criticizing not the rank and file fbi agents but the leadership, he is counting on fbi to give him a seal of approval for his nominee. there is irony there but also in the new york times op-ed from james comey saying here is how you should do it, the guy who was criticized by democrats for how he handled the clinton email investigation and the republicans for how he handled the trump fbi idea. why is he weighing in? >> no idea. he has been thoroughly discredited. or leon, i travel in circles where i talk to current agents and former agents, there's a huge community of retired agents and we hear from the ones that are still on board and he completely lost their support. the general consensus from this entire communities he is off the rails.

that gives us a glimpse of his internal biases when he was fbi director. ed: one of my friends, i went to give you the pedestrian view, people watching us are hearing the allegations, there have been 6 background checks, how in the world if these allegations are true, gang rape, all these heinous things, how could it not have been found six times, would that be a massive failure by the fbi to not uncover it or are these in terms of the investigation they didn't find them? >> they can't find things that were never recorded by anybody any time in the last 36 years. they interview friends and associates and colleagues. any logical person going all the way back to college days, not necessarily high school days, don't know if they carry them in the yearbook but none of it did come up. ed: a needle in a haystack, can't find anything.
