jillian: thanks for starting your day with us. we begin with a fox news alert, 300 people are arrested as anti-brett kavanaugh protests rage on outside capitol hill. [chanting] rob: it is quite a spectacle in dc, thousands of people changing and screaming despite an fbi investigation that found no corroborating evidence for sexual assault claims against the supreme court justice nominee. a majority of those 300 arrests, 293 of them took place inside the hart senate office building. donald trump defending brett kavanaugh at a rally in minnesota. >> it was announced for one simple reason. he is an incredible intellect, an incredible person.

rob: supreme court nominee standing up for himself in a brand-new op-ed with his fate hanging in the balance. shannon: griff jenkins live with reaction on this one. an interesting morning. >> reporter: unlike any nomination i have ever seen. on the heels of that report brett kavanaugh took the opportunity to make the argument for his nomination himself writing in the wall street journal i was subjected to wrongful and sometimes vicious allegations. my time in high school and college 30 years ago has been ridiculously distorted. my wife and daughters have faced file and violent threats. against that backdrop i testify before the judiciary committee to defend my family, my good name and my lifetime of public service. he admits he may have been too emotional at times but he is an independent impartial judge. that wasn't enough. ranking member diane feinstein blasted him saying the fbi

investigation was insufficient. >> it looks to be a product of an incomplete investigation that was limited, perhaps by the white house. democrats agreed that the investigation's scope should be limited. we did not agree that the white house should tie the fbi's hands. it is simply not credible to say public testimony last week's hearing is a substitute for interviews by fbi agents. >> reporter: a republican in montana look like he miss the vote for his daughter's wedding saturday. >> when you look at the evidence presented today, there is absolutely 0 corroborating evidence. to support these allegations. i am going to be there to vote for you as needed.

rob: instead of caving as molly hemingway, senior editor at the federalist points out the gop is coming together. >> reporter: they were hoping to delay the vote, hoping to delay the vote in order to kill the nomination. they thought if they had enough pressure the republicans would cave as they frequently do when you have a juggernaut of the media against them. what happened with amazing, republicans bonded together and then we have a backbone this time. we are not going to fall for this trick anymore. instead of being a situation where republicans are demoralized, do what they usually do, you have this enthusiasm and energy and the realization these dirty tricks and last-minute allegations are not going to work in the future like they have in the past. jillian: it has been 89 days since brett kavanaugh was nominated. donald trump slamming democrat for trying to block brett kavanaugh's nomination telling a

other officers, posted on social media about his gun skills. police say he opened fire as they tried to serve a warrant to his son. jillian: taking down terrorists, the trump administration releasing the first counterterrorism strategy focusing on radical islamic terrorism including fighting extremists worldwide and on us soil and combating their ability to recruit militants online. the administration hopes to isolate militants from supporters like iran, the first strategy on counterterrorism since obama's approach in 2011. rob: chinese ship nearly collided with a navy destroyer. military planning a huge show of force against beijing. according to cnn the pacific fleet will demonstrate its capability over a week in november. it comes amid rising trade tensions between the us and china as the vice president warns china is looking to meddle

from cancer at 63 years old. that is something. jillian: we had a couple days of storms over there but it will be calm in the northeast. rob: we will have an epic weekend in the northeast. >> a nice weekend in the northeast but do not adjust your set. we have snow in the forecast. not here in the northeast would take a look. you can see that cold air across the west, 63 in new york city, still going to remain warm over the south. the snow across the northern rockies and northern planes coming. we could see several inches especially across the rockies, northern planes will get their fair share in the next 12 to 24 hours and then a frontal boundary will bring the potential for heavy rain. that is the concern heading into the weekend. anywhere from four to six inches from texas to the great lakes. that is where we will watch the frontal boundary.

stuff happening? >> last ditch effort by doctor ford's attorney and senator feinstein. there plan did not go as they would have liked by exploiting doctor ford from the get-go and now we are seeing anything they can do to cause decisiveness, discord and anger among their followers to throw this off they are going to do so that is what we are seeing, the fbi went above and beyond even on the supplemental investigation to try to determine if any individual with firsthand knowledge that can corroborate doctor ford's allegation and miss ramirez and not one of them could as summarized in executive summary by the senate judiciary committee released late last night. rob: some information that will blow away our viewers, written questions answered by supreme court nominees throughout history, 1278 questions answered

by brett cavanagh, put the rest of them together and they only get 1247. brett kavanaugh beats everybody else combined, neil gorsuch had quite a few too, 324. i read an op-ed from the editorial board of the washington post, they think they should go no one this but brett cavanagh was not properly vetted for the job. >> he has been vetted more than any other justice in history combined. >> not only for the supreme court seat but look what he went through on the previous opponent a background investigations. that is the last ditch effort, how many degrees to brett kavanaugh. that is not what the scope of the supplemental investigation

called for. it is nonsense at this point. rob: democrats say we have more witnesses we want to interview, don't you at some point as someone investigating this have to draw a line? you could have a man on the street saying i drank with brett cavanagh one time, where do you draw the line? >> that is my point. the line was drawn at who can have firsthand knowledge of this? if it is not firsthand information then it is hearsay and not applicable and has no value to determine facts to corroborate or discredit her allegation. that is where the slippery slope could not happen. democrats signed up for this and they agreed to the limited scope for the supplemental investigation. they don't like the results and we are seeing the mud slung and the last-ditch effort. jillian: they called it for be a

week initially. rob: they agreed to that. is the white house -- are they in any way in control or guiding this investigation? the allegations telling the fbi not to talk to brett kavanaugh. >> it is more of a chain of command. the senate requested it. it has to go through the white house and executive branch so the fbi is tasked with doing this. the whole idea that because brett kavanaugh and doctor ford were not interviewed by fbi agents is a smokescreen. they don't need to have their testimony because they know where they stand. it is not to review or agree with their claim but to find others to corroborate it or deny it and that is why they were interviewed in this process. heather: we will continue to break it down.

in this fbi investigation, anyone who thought the fbi could do a weeklong investigation and have some tangible evidence out of that is woefully ignorant, that is not going to happen but what republicans are doing is try to say to their base, i went out and tried to get the investigation done, now you can vote for me. >> last word to you. >> scott rasmussen has been tracking this daily, 80% of republicans want brett kavanaugh confirmed, 81% of democratic women do not want him confirmed. it is more of a tribal split than anything else. the important thing for all of us is to recognize this is so political, it is punting its job to create laws to the executive branch. that is why all the battles are in the courts.

rob: the fate of brett cavanagh hanging in the balance as lawmakers prepare for a cloture vote this morning. jillian: three of four key swing vote senators are trying to get to yes. who is in, who is out, what republicans need to get brett kavanaugh across the finish line. rob: loretta, thanks for coming on this morning. a simple question. there seems to be a lot of confidence from leaders on the right. is it justified? >> they certainly need to project confidence. they are coming into a critical vote this morning and four senators who still haven't declared which way they are going to go on this nomination, and jeff flake, all four have yet to confirm which way they are going to go. leadership is working on that and we are seeing a lot behind-the-scenes to get those

folks on board. jillian: who will it come down to? just one person? >> reporter: there's a tremendous amount of pressure. we see some hints. susan collins and joe manchin thought the supplemental fbi review was sufficient and barroso folks are thinking those two senators will vote yes. lisa murkowski has a lot of pressure in alaska and some supporters, the indigenous community which had her in tight elections in the past, she's concerned about that and we are hearing about her office, with people who met with her in her office, indicating she is struggling to get to yes. jeff flake, we have seen he was very determinant in the judiciary committee in allowing this nomination to move forward and has consideration how he wants to vote. he's not up for reelection. he decided to leave the senate

but who his successor will be a tight race between two members of congress. rob: let's see the information. we have 48 confirmed yeses on the republican side and as you said, indications from collins and manchin, he needs to vote yes to maintain the lead in west virginia. if you get those two you are at 50 and they are in. what do you think the odds are that they get this through? looks like the odds are pretty good. >> reporter: it is looking okay. anything could happen. late last night we learned the judge himself put a piece in the wall street journal. there's question among the senators about his temperament and he addressed that head on in that opinion piece and hopefully that will do some good towards weighing it and letting them
